I arrived Sept 04 married Oct 04 and got green card Aug 05 so will be filing May 07 (I think - haven't checked as I cant face more immi paperwork)

Cannot believe it is nearly two years that I have been here and have no idea where the time has gone or what we have done with it. Living in the back of beyond :lol: finding any job was hard and at the time incredibly self confidence knocking but eventually got a job at Walmart and I actually enjoy it though it probably isn't my long term plan. Married life is full of ups downs and surprises but we bounce back and are very happy. Lifes curve balls sadly included the death of my mother-in-law and other unforseen events but on the whole I have settled and enjoy life here. I miss England much less than I would ever have imagined (so long as I can lisen to Radio 5) but do miss friends and a good old natter. Like someone else said I too will take US citizenship just to get immigration off my back once and for all but in my heart I will always be British (think its an age thing). Somehow the K-1 journey seems a long time ago but oh so well worth it to be together ......... there are bad days but the trick is always to remember there were bad days back in England too so in truth nothings changed you just pick yourself up dust yourself down and get on with life and all it throws your way.

Use me for one, we have pics and we did talk before your wedding and met at mine a few weeks later. We used our local bobby as he has known us from the beginning, purely friends ofcourse! Just put together as much rubbish as you can, I sent in letters addressed to us separately as well as together. Documents showing your the beneficiary of any 410K and/or insurance policies. Once you start collecting you will be surprised at how much you will gather.

Deportation (j/k) would be a more pleasant experience than sitting in a car with any one of our cats on the 20mile trip to the vets it's one of my phobias just can't do it lmao

Our evidence pile is not the strongest, we have joint accounts (health/tax) but no leases loans mortgages bills etc. So in attempt to come up with some evidence I am trying to think outside the box
ie I am including a newspaper article on my SIL when we collected bear for Hurricane Katrina where I am mentioned

it also occurred to me that the best evidence I have is the fact that as I dont drive my husband ferries me everywhere work shopping etc. can I list this fact on the cover letter?

I have also maintained a blog since being here hows about including samples from that ?

Any suggestions/input welcome


Do you have friendly work colleagues that could attest to seeing you with your husband every time you come to work? Or would your manager be willing to attest?

While I am not from the camp that thinks photos are much evidence, a few wouldn't go to harm if you feel you are lacking.

Another would be to join some clubs or even get a flipping credit card that has you both as account holders.

But, I don't think you need to worry too much, and I'm sure you'll come up with a good enough application.

the work colleague one is strange as the instructions specifically state that the people who write on our behalf should have known us SINCE our wedding - I didn't start work till three months after my greencard If we get an RFE I will use this evidence but not going with it to start

Already including a few photo's (Xmas family gatherings ) but not got many of us together as one of us is always holding the camera lol

Have a credit in card in my name which also has hubby as card holder and including copies of that

Hopefully I am worrying uneccesarily just had forgotten the stress of USCIS paperwork :crying:

Just curious has anyone EVER managed to complete the whole I-751 package from start to finish in the 3hrs 20 minutes they say it takes. I'd say it was nearer 3 weeks 2 days by the time I'd sweated, procrastinated, photocopied and screamed! Or am I just useless (at least by USCIS standards lol)


They don't count the time you pencil is not touching the paper......

(i) 15 mins to learn law and form (yeh right maybe if they linked to VJ but not without it lol)

(ii) 75 mins to complete form (woohooo I was actually quicker than this that was the EASY part)

(iii) 110 mins to assemble and file the petition (absolutely no comment on my performance at this stage other than :crying: )

Total 3 hours 20 mins

I suggest a reality check for USCIS

As can possibly be noted from the frivolity of last thread we have managed to get the I-751 into the post (hubby at PO NOW) and beat the deadline so add us to the NSC list I just hope they accept it so we don't have to pay the new fees. I have never felt so uninspired to git R Done as I have for this (been able to file since 05/18) somehow when we are here together the incentive isn't there. So impressed with those who have it out on first available day and was relieved to see in someones siggy yesterday I am not the only one not that ready to face the USCIS quagmire again.


Here's to us all get an easy run and no hiccups in th eprocess.

I just sent my I-751 application to NSC on July 28, 2007. NSC received it on July 30, 2007.

Check not cashed yet.

Meanwhile my 2-yr conditional GC is about to expire on Aug 23. I am about to take some new jobs and I wont be have a proof of work authorisation after Aug 23. If I dont get my extension letter before Aug 23, what are my options?

Can I make an info pass and get a stamp in my passport? To do this, is the return receipt proof of submitting my application?




I filed same time to NSC and have heard nothing/no check cashed either my greencard runs out on the 18th beginning to wonder where that leaves me but refuse to panic :wacko:

In reply to the original question (and none of the open or implied criticism of when or how you filed - totally unnecessary IMHO) Having filed WITHIN the 90 day window allowed by USCIS you have fulfilled the criteria. We too did not have my NOA extension letter by the time my 2yr card ran out, kinda scary but as I hadn't had too show it for "official" purposes in the preceding 2 years I wasn't unduly worried. There appears to be a massive backlog creating slow receipt notices/check cashing at the moment so you may just have to wait the extra week or so like us and sweat it out - but on the basis so long as you send it in in the timescale prescribed (right up to the last day!) as you did I don't see any way you can be in any trouble but I totally understand the sweating as I was there two weeks ago!

woohoo received my I797C today and have been transferred to California (assume this is good news)

with reference to the receipt number it states on the bottom of mine

" Upon receipt of you ASC appointment letter, you can find the status of your case online at www.uscis.gov." it goes on to detail the number off the biometrics letter you need so its that number we need not anything off this letter to track our cases.

No affidavits from anyone, we would have gone that route if we had run into problems but in all honesty we are private people who didn't want to turn to friends/family to start writing letters etc. The list above is the sum total no additions but if you look carefully half the things were already in place/provided at the time of AOS, we had nothing "joint" in the way of bills, leases etc (the phone bill is only in hubbys name) the credit card only in mine and in truth I never use the joint bank account. So believe me from where I sat it felt like a very thin list hence the comment about my lack of driving it seemed like the best proof that we did have a joined life as without him (bless him) I would never leave home lol.

I know how worried I was that I had little evidence of a co-mingled life (no joint bills, mortgage, leases, kids etc.) so I thought I would share a list from our covering letter of the stuff we did include - we today got email notification that our 10yr card has been ordered ................... cannot begin to explain the relief that this is over with. So if this helps or gives hope to anyone else I am only too happy to share.


Copy of Joint Federal & State Tax Returns for XXXXX & YYYYYYYYY for both 2005 & 2006
• Copy of 2005 & 2006 W2 Forms for both XXXXXXXX & YYYYYYY
• Copy of 2006 tax rebate Check payable jointly to XXXXXX & YYYYYYYY
• Copy of XXXX"s Works Life Insurance Beneficiary Form
Copy of XXXXXX's Profit Sharing Beneficiary Designation Form
Both the above show YYYYYYYY named as beneficiary on XXXXXXX's employers records..
• Copy of Letter from YYYYYYYY's emoloyer. and copies of Health Enrollment, Health policy and Retirement Beneficiary forms all showing XXXXXXXX as beneficiary on YYYYY's employer records.
• Copies of Joint Bank Statement from ????????? County Bank.
• Copy of ???????? Credit Card Statement in XXXXXXXXXX's name
• Copy of Both YYYYYYYY and XXXXXXXX"s account cards on Bank Account and ?????? Credit Card
• Cellularone Phone Invoices from 2006 & 2007 showing both XXXXXX and YYYYYYYY’s phones billed on same account

We submitted about 21 days before deadline (can see nowhere where technically you can't leave it till day 90) this caused us no problems at all. BUT there is that period where you are in a kinda limbo done the legal requirement but out of status according to the paperwork in your hand. I can vouch for the fact that it does make you kinda nervous and was convinced it would be the time I actually needed the card but it wasn't the case. As for my work even though it was recorded when I started when my greencard expired to this day I have never been asked to verify that it was ever extended.

good luck with your foray back into the depths of USCIS it's no more fun the second time around lol

seems normal looking at timelines that it takes a couple of weeks plus to cash check/issue NOA. It would also be reasonable to assume that anyone who possibly could got theirs in and beat the deadline for fee increases so I am assuming they are swamped at the moment so wont start worrying for several weeks yet at least no-one has heard a thing yet.

As I said previously the indication to me was that they did not want to see more than 180 days in a 12 month period so under that criteria you would be fine at 95 days but it is the case as everyone says on a given day you can get the pain in the B@@ officer who wants to get ahead.

whether you visit is a decision only you can make in my humble opinion the worse that happens is you get turned back and it doesn't go against you, you just waste you fare - for me at the time that was a no-brainer.

Stop sweating the things out of your control and occupy yourself with things you can :yes:

I experienced EXACTLY the same situation as the opening poster (cant remember the exact dates) but had travelled for 2 or 3 trips of 2/3 weeks and then two 90 day trips I then came back for a two week holiday and was interrogated for 45mins (Pittsburgh) by immigration officials (luggage searched, spoke to B/F on phone down in arrivals etc etc). The end result was they believed I was here only for a holiday and I was allowed in but I did learn several things.

i) Every trip you run the risk of of some a**hole officer adopting the "More than my jobsworth role" it is always at te discretion of the officer examining you as you enter whether they stamp you or not be it trip 1 or 20.

ii) the critical factor that they are looking at is if you spend more than six months in USA within a 12 month period (not calendar year) then you are technically resident in US more than UK and it aint a holiday !!!!

iii) I had no "evidence" of my ties to the UK whatsoever - I was ###### scared but I answered all questions honestly and was eventually allowed in

My advice - look at your visits within the last 12 months from your planned trip and see if you are gonna raise a flag, if your under the six months then go for it. I came back again after this incident spent the whole trip terrified that I was going to be refused entry and had the easiest entry ever with not one single question being asked about my visit!!!!!!! Never lie and only ever answer the questions asked. Only ever travel with the luggage that you need for the trip/documents you are making (much as near the end of the process it would be great to move winter clothes over as excess luggage it does raise a red flag if its August and your only visiting for a week). If you come back and they don't let you in it does not count against you at a later point in the visa process.

I would expect 4 - 6 weeks to get from there via NVC - London - you for Pkt 3. I think its an Ohio male thing with doing paper work so dont be too hard on him LOL (I'm assuming you already have you Police Cert and got your vaccinations up to date and documented for you rmedical). Apart from that enjoy these last few weeks/months soaking in memories of England to bring with you from here on in it really does begin to pick up apace. Good Luck and a soon to be Welcome to Ohio
