I would expect 4 - 6 weeks to get from there via NVC - London - you for Pkt 3. I think its an Ohio male thing with doing paper work so dont be too hard on him LOL (I'm assuming you already have you Police Cert and got your vaccinations up to date and documented for you rmedical). Apart from that enjoy these last few weeks/months soaking in memories of England to bring with you from here on in it really does begin to pick up apace. Good Luck and a soon to be Welcome to Ohio

My husband had been married three times before as has the OP (not four as someone stated) you will need to supply the three divorce decrees in full from the courts responsible in each case. We DID NOT have to provide any evidence of where the ex's were now :wacko:

I believe the OP was asking for advice ref this issue and not her her choice of life partner. None of us are in any way qualified to give advice on the latter.

The issue of my husbands previous marriages was never mentioned at any stage in the K-1 process and in no way seems to have impacted on our approval which was granted :yes:

how interesting just looked to see what we did (same 3 divorces) and the form has changed there used to be three lines not two :wacko:

Dont worry about the implications of this scenario at no stage during K1 or AOS did anyone ever ask any questions regarding previous marriages (and none were for 20yrs) just make sure you submit the complete certified divorce documents appertaining to each divorce.

My heart goes out to you, at the time of our K-1 filing we had an excessive wait (compared to others) for no apparent reason though and I remember the 'waiting and watching' I CANNOT imagine the utter heartbreak if, like you, I had finally discovered that it had never even been filed correctly I think I would have been broken - but I guess that serves no useful purpose so I guess it's fightback time!

A couple of things occur to me in no order:

(i) I would be a little worried if my lawyer had made such a fundamental error as sending it to the wrong place as to whether he had made any other major/minor mistakes in the process of completing/filing the forms, submitting evidence of relationship etc.. Is he an experienced immigration attorney or just a lawyer who 'said' he could do it.

(ii) Just a thought it would be possible if the K-1 was not in play for him to come over in April for the marriage to take place as planned and for him to return to Australia and file then for the married visa - this does have some advantages over the fiance visa in the long run as detailed by Rebecca (obviously he would need evidence of his intent to return to Aus but many tourists DO marry and return)

(iii) I am in total agreement that a 'simple' DUI should cause no problems whatsoever but one way of finding out for certain what is on his police record is to apply for the Police Certificate now.


Just some thoughts, like I said my heart goes out, I too am another oldie but goodie waiting till 47 to take the plunge but on a happy note it is definitely worth the wait :dance:

I personally do not read this situation as a denial of visa, no visa was ever denied, it would appear from the facts stated that this was merely a "timed out" that is by the time they got round to processing it it was too late and they admitted that and said try again of you want. Personally I would answer the question "No" and then on an attached sheet explain what happened - the visa was never processed therefore it could not have been denied or granted to say he was denied would in my humble opinion raise unneccesary red flags.

Dunno why but in trawling BBC website I discovered Una Stubbs is joining Eastenders and in the report it stated she is 69 . Hmmmmmm I must be getting old I remeber her from Till Death us do Part and somehow it was a shock to realise the bright bubbly young thing is 69 ................ gonna go cry as I check my grey hairs :crying:
