K-1 Fiance(e) Visa Process & ProceduresOur K-1 isn't being worked on yet
I sent my I-129F to the Vermont Service Center two weeks ago and have not received any notification yet.

I understand that it was a holiday earlier this week but regardless I expected at least my NOA1 already.


I checked my bank account and my check hasn't even been withdrawn.

Does anyone know what could be up?

I've been arguing with my parents (who have been helping me considerably with this K-1 process) about using a senator to speed up our K-1 process.

My parents believe that if I write a real sappy letter to a specific senator, he/she would be able to push the process along.


I simply believe that theres nothing a state senator can do with this affair and furthermore, if they could do anything they wouldn't at risk of it not being a true marriage and helping someone come into the country illegally.

besides, we're far enough in the process that by the time a senator would read his/her mail we'll probably receive our NOA2. headbonk.gif


What do you guys think? am I wrong?

Gary and Alla congrats on the 4 1/2 months. We're at 4 months and still haven't gotten our NOA2, hence the eagerness to see each other again.

and as for the good reason for her to go back... well she has to for our k-1 to go through her embassy... though I suppose some people would just not bother anymore.


I'm expecting our NOA2 within the next couple days (fingers crossed) so wish us luck and good luck to everyone else thats waiting!

I recently discovered the B2 visa (I don't know how I never saw it before)

I'm curious if anybody has used it and if it's worth filing while waiting for my K1 to finish up.


I can't travel to see my fiance just because of my education, she's finished school though and is bored of just waiting to come to the U.S.

so any information you may have on the B-2 (particularly how long it takes to go through) would be very helpfull.

I tried some Long distance ones before where I had never actually met the person in real life.
2 of the 3 I tried were mistakes.

One turned out to be a guy with a girls acount. (short lived relationship of course)

The other was a girl that had made herself a profile and account all with another girls pictures (a friend of hers). I had her get on the webcam and she would actually have her friend sit in front of the camera while she was out of view typing back to me. I really liked this girl's personality but geez. If you're going to go through all that to keep up a lie then how can someone trust a word from your mouth y'know? That went on for something like 5 months untill her friend contacted me telling me everything. headbonk.gif

But I met Iryna almost 2 years before we went through the k-1 and spent about 9 months together so It was all good.

So anyone who can go through a real long distance relationship (without meeting the other person yet) is a brave soul. kudos to you. biggrin.gif

Can you please give me some insight on domestic violence and IMBRA and anyones experience in dealing with it. I have 2 convictions where I slapped my ex in the face for stealing from me. This was over 10 years ago and I have 2 simple possession of marijuana convictions, and 2 cocaine possession convictions. This also was more than 10 years ago. Several attorneys told me I would need a waiver, but 2 said I did not. I read the IMBRA law throughly and to my understanding it would not prohibit me, just make it more troublesome as my fiance would be notified of my background, as she is already aware of it, and I would have to submit the documentation that USCIS requires. One of the attorneys told me also that USCIS will possibly also want me to take biometric fingerprints, this may slow down the process also she stated. Can you give me some guidance and what if anything I can do to aid in the process. Also, how did anyone here affected by IMBRA answer question, 3 Part C of the I-129f form where it gives you 3 choices to choose from. I was not battered, did not act in self defense, nor did I violate a protection order. I thought that applied if you filed more than 2 petitions in the last 2 years and you are seeking a waiver.
My fiance is willing to sign an affidavit stating she is aware of my past convictions and is willing to move forward with me. I am travelling to meet her in 3 months and I am very excited.
I have since changed my ways and am more level headed now. Looking back I should have literally counted my loses and left, and I would not have the DV issues to deal with now. I am open for all comments as this is a complex issue and some guidance here would be gratefully appreciated.

Your son would need to have had his visa issued within a year of the date yours was issued. I take it that year has already passed. Your husband would now file an I-130 petition for his stepson in order to eventually obtain a CR2 visa.

Hi pushbrk, we did'nt make it for K2 visa so we'll take your advice to file an I-130. Do you have any idea how long the processing will it take? Is it true that it takes 8 years or more? I hope to hear from you and thanks again.

yes, this is what I have tried to explain to him.  Applying and getting approved are two different matters.  and that it will be him that has to answer all the questions about the first k1.  This is a new and unexpected venture for me.  But I am glad he found this forum, as it will be nice to have someone to ask questions to.  In general we just need guidance in this matter.  Thanks for any support...and criticism, because it all helps in understanding the process.

My Lover who is in India, started this forum.  He is concerned that his english is to bad to write here. We are a gay couple.  I am in USA, and I was concerned when he mentioned that a straight friend of his had applied for a k1 visa a few years ago.  He says he was unaware that the visa she applied for was a fiance/marriage visa until he went to interview.  He went to interview with no paperwork. The visa was denied. This is it in a nutshell. He was only trying to visit USA.  I know these kinds of actions, no matter what, do harm to those who are legit.  I to was concerned about "visa fishing" when I first met him.  And if not for my elderly parents, he would wish I come live with him in India.  He is better off than I am.  I told him I was very concerned about this and would like some opinions.  And I do appreciate ALL replies as all are constructive.   Thx

As I fill out the G-325A I am baffled at how.... or why they would leave so little room to write the answers. I have seen people who can write very small but this seems less about getting information and more about testing ones ability to squeeze names dates cities and countries in places big enough for only one of them.

I guess I could write all this stuff on an attachment sheet of paper but It would make a lot more sense to design a form big enough.

Ever notice when the Govt "wants to" it has no problem giving you ample room to fill in the blanks such as the IRS forms or and Arrest data sheet. (so I have been told :) :)

When doing the standard K-1 visa would I check b. status as permanent resident?

I have the whole form filled and and it will not "save" so I will just leave it up until I answer this last question.

I am planning to go be with my Fiance the 24th of aug. My 1-129f was received back in the middle of april, if my calculations are correct, I might get my NO2 about the time I leave for 18 days.


If it does arrive then is there any time sensitive things in there I need to worry about?

Since I am going over to see her is there anything I should do / bring that might be to my advantage?

as of yet, I have not received any RFE, in fact my case on-line has not so much as been touched.
I just wondered if; rather than wait until the do RFE me, should I jump the gun and get them this info now in an effort to save longer delay later on.

Anyway, if I were to call and bring up this issue, I doubt the person on the phone could make any changes but maybe there is another "case handler" or some such title who could do it?

I filed for K-1 may 18 and I am still waiting on NOA 2, after all this time of not hearing anything, I happened to notice (when looking at a copy) that I did not fill in the "place of birth" for my fiance's father on the documents I sent in. The city has changed names over the years and I meant to determine which name to use and somehow never filled it in. (he is deceased for some time now)

What are the odds they will let this slide?

Should I contact them now with this info as it might save time in the long run?

If so, how to contact them, via phone?

Thanks for the replies but I am a little confused, of course the I-134 is required to be notarized as proof that you really signed it.

My question has to do with "Evidence of our meeting".
When the first document is filed.. the 1-129, it states "copies" of documents are okay but ACTUAL documents will be needed at the interview. If copies were enough from start to finish you can imagine how easy it would be to claim anything.

I sent a copy of my passport with the visa page with indicates I was in her country at the time we had a meeting.
How will they verify this if I do not furnish the actual document (passport with visa stamp) or notorized copy at the interview (when other *actual*...not copies are presented)?

When applying for a K-1, I submitted a copy of my passport and the Visa which shows my dates of travel as primary evidence, apparently it worked out because it was approved and sent on to the embassy ... (well it's on it's way.)
My main question is, will they require a notarized copy, because the one I sent was not with my orig documents was not notarized.
Since copies are all that is required when filling the 325, that was all I sent but at the interview they will want to see "the real thing" on things such a birth certificates etc.
I am reluctant to send my passport so she will have the actual "item", at the interview, should I get a notarized copy?
I would hate for her to get rejected for "failing to show evidence" because we only produce a "copy" of the visa which documents my travel dates.

Other than that we also produced photos together and train tickets from a second trip.
