Your citizenship wouldn't be on the line in any event but I can't make heads or tails of what else you're asking. The sentence just isn't put together in a way I can follow.

When foreigners obey US immigration laws they are not penalized.


I can't make heads or tails out of the original question either, but taking the statements literally, it sounds as if you got married before the 90 days was up, then the marriage for whatever reason wasn't working out, and he/she returned to their home country. If they went back to their country after obtaining a K1, they would have to apply for a different visa to come back...K3 or visitor. Whether or not they would be approved depends on what they try to come back on. But without Advance Parole Document, he/she cannot return to the USA with the original K1 visa. The USC's citizenship is not jeapordized as a result of this. Hope this helps somewhat...

Birth certificates don't expire. They are a legal document which should be kept on file by a government entity in the jurisdiction of the place of birth, and are reproduced and usually notarized by a government official when issued to an authorized person. Unless there is an issue with your SO's name or information (missing middle names, mis-spelled names, different name altogether, wrong parent names, birth dates, etc.), I wouldn't worry too much about it. Police certificates and something similar to the proof of eligibility to marry (and/or singleness) might need to be more recent, however. Since your SO is in China, make sure someone can translate all of this into English if the documents are not already in English. But if your SO got the BC a year ago, I personally wouldn't worry. If you've been with someone else since January, one would think you had already knocked it off with the fiance of three years already. You might try to call the US Embassy, explain your situation and the need to cancel the petition from the person you are no longer with, and see how they recommend to take care of the situation. Regarding the criminal record (misdemeanor probabtion and the felony), I'd recommend just being honest with the government and with your fiancee about it, as it would come up in the government's research into your case. I don't know about a death benefit being earned income, so someone else would have to comment on that. As for income, you have to make enough money per year so that your fiancee/wife would not become a public charge (be on food stamps, wellfare, etc.). You could use another individual living in your family (child from previous marriage of working age, parent, etc.) to be a co-sponsor. So long as the total income is higher than the required amount, it won't be a problem. Or even better in your case, IF your SO has a nursing or other type of degree (or is pursuing something along those lines), you might see if a hospital or medical office would be willing to recruit nurses from the Philippines, which would allow her to come here on a work visa and marry her while she is here with that visa. Hope this is of some help.

Evidence submitted on magnetic or other similar type media will NOT be accepted.



Additionally, in some if not all US embassies or consulates, they will not even allow the interviewee/applicant to bring magnetic or optical media into the building. It would save trees and money if we could do so, but the US Government hasn't gotten that high tech in some areas yet. So the short answer to this is waste some trees making copies of anything that substantiates your continuing relationship and proof of meeting in person. Photocopies of card envelopes, letters, photos, hotel/travel receipts (engagement ring is a plus for K1), ticket stubs, etc. Same thing for all documentation you send to your SO for their interview if you won't be able to go with him/her. Burn some trees and inkjet cartridges and mail 'em.

I don't have the copies of the forms we submitted in front of me, but I know I put a combination of both N/A and none for several answers. We didn't have any problems or RFE. So long as you have submitted the required evidence, you shouldn't have a problem. The government likes pictures, so hopefully you provided color pictures to them proving evidence of travel there to the Phils and also of you and your fiance together. This can establish pretty much the fact that you know one another. Proof of continuing relationship can be established by pictures, but it is better established with items such as receipts for engagement rings, etc. Check the guides on this site for more information. I don't think age difference matters so much. I've heard of 40-year age differences between couples, particularly American men with much younger Filipina women, so me and J are actually an exception to that since we're only 3 years apart and in our 20's. All you have to prove is you have a legitimate relationship, have met in person, and that you intend on marrying her. Hope this helps.

My fiance filed for K-1 visa and gotten NOA1 on 24th June 08. I was looking at the visa timeline and saw that they're processing June 24th NOA1 recipients today! So I was just wondering if ours would be processed?? Also... another thing is that I got to know from my fiance, they still haven't cashed the cheque yet coz he said the money's still in his bank account. Well, we have gotten the NOA1 with the EAC receipt number and all that but they still haven't cashed the cheque? Is there any problems there? Anyone has any idea? When would they normally cash the cheque? Also, I checked the status of our case today and it's still written there: Case received and pending.

Waiting is such an agony!!!!

pretty sure you will need a police certificate from any country where she lived more than 6 months since her 16th birthday.

Yeah, we were touched i think only twice before our NOA 2. So it doesen't mean that you'll get an RFE, they'll let you know just in time, and they will also let you know, why they gave it to you and what they need... So I would say, you guys are totally fine, and you don't have to worry about REF's...

So I've pretty much just announced to the VJ website that we've gotten our NOA2 (stated on USCIS website, not yet gotten hard copy of it). Anyways, I was wondering what do you do after this?

Questions in order:

1. Do we call the NVC after getting hardcopy of NOA2 or before? Normally call after 1-2 weeks?

2. What does it mean by NVC Received and NVC Left?

3. So when we call the NVC, we're supposed to ask for the case number? How do we do this? Also, after we get that, do we go back to the same USCIS website to check our status or NVC website??

4. Should I start gathering the police certificate now? How long would it normally take from NOA2 to the embassy sending package/checklist to my place?

Really hope someone can answer me. Thank you!!!!!

Just an update: My fiance received the NOA2 hardcopy finally on 8th Nov! Anyways, I was just wondering, what do I have to do after NOA2? Does my fiance have to send me the I-134? To state that he's able to support me? What do you actually need in I-134?

Also... are all the instructions stated in the package that will be sent from NVC to the US consulate in my country? What do I have to prepare for the package? I would love to hear from people who have been through the process. I already have gotten my case number from NVC. What can I actually do with it?

heya smile.gif i think you should wait for the packet 3... or at least call up the US embassy in Thailand and ask them whether they've gotten your package (after 1 week of getting NOA2). I'm now currently waiting for my package 3 too... and as for the medical exam, there's a list of panel doctors that you can visit and i think they have to sign some documents if i'm not wrong so you'll have to wait for package 3 for that... as for police clearance, you can do it now, depending on how long it'll take you to do it! smile.gif

Just wanted to let you guys know that it is possible to delay/extend the NOA2 validity period. It will be extended automatically for another 4 months no matter what. So no reason to write an email or a letter to the US Embassy (as in my case). I emailed them yesterday and they emailed me back saying that I don't have to write an email to them requesting the extension. However, it is only extended for another 4 months and that's it. It still gives me good timeframe to get things ready and get myself ready to go over there smile.gif Oh yeah, and the NOA2 validity period is actually talking about the whole process until getting the visa! smile.gif

I know that the K1 visa is valid for 6 months... but my NOA2 expires by 1st of March 09. So I was thinking, before the NOA2 expires, I will be getting the interview and I will receive my K1 visa... so if I get it before March, then add another 6 months... I have to be in the US before September...

So I might not be very clear on this... the 1st of March expiry date of NOA2... does it mean that I have to send in my Packet 3 before the expiry date? What do I have to do exactly before that date? Does the interview have to be scheduled within that time frame? What does the date signify actually? I know it's the validity of the Petition.. but what exactly does it mean??

I need your honest opinion and some help on this one... I have finally received Packet 3 from the US embassy in my country. Well, actually it was sent to my house and my parents have opened it. I didn't tell them earlier about the Petition because I was worried it wouldn't be approved (I was rejected for Tourist Visa the last time). So anyways, they found out about the Petition thing when I was just about to tell them... Anyways, my parents told me to think it over carefully. Not that they object me from going over there, but just that I might be too young (23) and naive maybe? Well, obviously, marriage is a very serious matter...

Anyways, I was wondering whether I would be able to extend the NOA2 validity period? It was stated as from 1st Nov 2008 to 1st March 2009. I would like to delay it for maybe 2-3 months? I read some posts here saying that it will be extended automatically? But I was wondering if I should write an email to the US embassy over here? Would they reply my email and normally how long more would they be able to extend it if possible? Anyone that has gone through this before??

The reason I would like to delay it is because I have just started working in my country (well, it's been a year now) and it's been going good. I would like to gain more experience and also I want to spend more time with my family. I want my parents to know that I'm serious about this, I don't want them to think that I'm rushing into doing this. If I was to follow the exact timeline, I would've been gone to the US by June/July 09. However, if I'm able to delay, then I'll be leaving for the US in Sept/Oct 09, that allows me more time to convince my parents and also to settle all the things that I have over here.

I hope someone can shed some light on this.

Heya, I'll try to comment on this a bit.. i'm not sure how correct mine is but i'm sure other people will help you on this. anyways, i think you have to cancel your K-1 visa petition first.... write to USCIS and tell them you want to cancel it. then only file for K-3 visa. i don't think you can apply for both together... coz you're already married... so you can't continue with the K-1 fiance visa...

It's amazing to read so many different scenarios but so close to heart at once... i guess it really takes time for parents/family to understand why we do the things we do sometimes... and this is totally one of them, to go sooo far away for that particular someone, when you can just find someone over here. but the thing is, that someone isn't just anyone. he/she is the one.

i've talked to my parents again and they seem to be taking it better now knowing that I'm taking my time on it... not rushing through things. hopefully i'll be able to talk to them face to face when i'm back at home and see how it goes smile.gif

Gosh... I'm really sorry to hear both experiences sad.gif it's just so hard to accept something out of the norm sometimes... especially when it's a long distance relationship... i mean, think about the olden days, there's hardly an LDR because internet did not exist then. So i guess it's very hard for parents to cope with that if their thinking is too conventional... I hope to talk to my parents about it and make them understand that this is the road that i'm gonna take.

Wow... I'm surprised but glad that so many people replied! At least I know that I'm not the only one out there who's having some issues in talking/convincing parents about it. Thank you for sharing your stories. I respect my parents and I love them and I don't want them to worry for me. They just want me to be happy, it'll be better if I could be staying in Malaysia instead... but I can't choose who to love, it just happened that I'm so in love with my fiance and I want to be with him. I understand my parents' concerns... especially it's a long distance relationship and I've never been with him longer than 2 weeks at a time... just hope that time will help me to convince them and make them realise that my fiance is the one that I want to be with for the rest of my life.

I hope all of you get to be in good terms with your family and family in laws... that's what I hope for everyone!! I'm sorry to hear about some where you don't get along with your parents but hopefully time will heal.

I was just wondering of the beneficiaries... how do your parents/family take it when you tell them that you're leaving to the US? Do they take it in good stride or do they object?? I'm just wondering how I should talk to my parents about it :/ They basically told me to think it over carefully coz they don't want me to regret in the future. They want to make sure that I'm totally serious about it. They're also very worried about me not getting a job over there since the economy is not looking good... I'm working as an engineer in the oil & gas industry at the moment...

Anyways, I would like to know your stories... how do you cope with leaving your family and how do they take it?

i don't think it matters how many times you visit your fiance... once is enough if you have enough evidence to show them, i.e. loads of photos, phone logs, emails, any other modes of communication between the both of you... as in my case, my fiance and i met only 3 times, each lasting around 2 weeks... we sent a few pics and a lot of email.. with plane tickets, hotel receipts... i like to keep everything lol... so it's good enough for us to get approved smile.gif

heya i'm from Malaysia too smile.gif Anyways, I did try applying for B2 tourist visa 2 years ago, it wasn't successful. Well, the officer had every reason to say no to me. That's coz I had no ties with my home country at all at that time (i.e. no job, already out of school, no car payments, etc) so apparently I seemed like a threat to go to the US and never leave the country. Anyways, I also had my fiance (boyfriend then) with me during the interview, a bad bad idea.... well anyways, I've never been to the US since then. I was kinda traumatized by the whole incident, just so abrupt how they say no. Well, however it is, there's no harm in trying, I think... it's better to know the truth than just knowing what-ifs.

Anyways, I'm now in the process of K1 visa and my interview's on Thursday! Totally excited smile.gif

Personally, I don't think it's a problem at all. I went for the interview and I told the interviewer that we met online.. he was very nice and kind and he's like, oh tons of people met that way. Then, he asked how many times we've met, etc... it's pretty interesting and all he wants to know is how genuine the relationship is after knowing each other the first time. that's all that matters smile.gif

I think it's best to send in the original signature copy as it is an official document... and it's best to avoid any more delays or problems later down the road. You should ask her to post it fast through DHL or something, make sure it's registered post too so that you don't lose it!

Hey there,

In my opinion, send in as many evidence as possible that you both met before within 2 years. It could be anything... airplane boarding passes are the best (make sure you're only sending in copies), photos being together, hotel receipts.... anything. The more relevant evidences, the better!! :)

Thanks everybody for the posts. As it turns out my NOA1 was dated the 29th of may and wasn't mailed for over a week later.


And as NIch-Nick said, I just really wanted verification that the process started. I did all of our paperwork and checked it fifty times but still wasn't sure if I had messed anything up. Though this site made it a lot easier.

I sent my I-129F to the Vermont Service Center two weeks ago and have not received any notification yet.

I understand that it was a holiday earlier this week but regardless I expected at least my NOA1 already.


I checked my bank account and my check hasn't even been withdrawn.

Does anyone know what could be up?
