What 'requirements' are you looking at? This? (from travel.state.gov)

* They have complied with the conditions of previous admissions under the Visa Waiver Program, and have not been found ineligible for a U.S. visa; and
* If arriving by air or sea, they are traveling on an approved carrier (almost all major airlines and cruise ship companies are currently approved carriers - copies of carrier lists may be requested from the Department of Homeland Security’s National Fines Office at 1525 Wilson Blvd., Arlington, VA. 22209), and have a return trip ticket to any foreign destination.*; or
* They can demonstrate the intent to stay 90 days or less in the United States and demonstrate sufficient funds to support themselves while in the United States. Learn more on the CBP website.

Discretion for admittance to the US is always in the hands of the CBP officer. But you are fretting over the second stipulation and not looking at the third. If your fiance' has the proof you say he does of going onto Canada (and he smiles sweetly at the officer) he should pass muster.

PS - I don't think it will be Shannon where he encounters the CBP - depending on his route it will either be Dublin or his first stopping point in the US. At either rate, Good Luck to you both and post back to us tomorrow!

We could use y'all's good energy - my fiance is leaving Ireland tomorrow to meet me in Pittsburgh - I'm up with a late night attack of the panics that he'll get denied at Shannon - He's planning on stating clearly that his intent is to marry me and then go to school in Canada - he's got with him:

- mortgage on apartment in Scotland (where he lived before)
- student visa for school program in Canada where he'll be attending from Sept - May
- acceptance letter for said program
- one way plane ticket to Canada (four weeks hence)

I just read on the Visa Waiver Program page (Department of State) that one of the requirements is a roundtrip ticket or a ticket to a "territory not boarding the United States", and now i'm really nervous - does that include Canada or are they talking about a US territory like Puerto Rico? He does not yet have a ticket to Ireland, as he will wait to see when his interview will be after we successfully file...

Please help assuage my fears! We've exhaustively researched this website ahead of time for this plan (except obviously the VWP website, which I didn't think of until just now...)

Don't confuse "getting away with it" with "legal". This is not legal. It is visa fraud.

As I see it, you're advocating visa fraud. The fraudulent scenario you are describing is based on the idea that if the wedding takes place more than 60 days after entry, you have a better chance of convincing USCIS that your lie is truth. The lie you must tell for this fraudulent scheme to work is that the decision to marry, took place after entry. I advise against this path in the strongest possible way. IMO, the post containing the suggestion as well as my reply quoting it should be deleted by a moderator ASAP.


I quite beg your pardon, pshbrk. Let me tell you - I've been sweating since January trying to figure out the best and LEGAL way for my honey to come here and live. We are doing everything by the book, letter etc, and I would never knowingly advocate visa fraud to anyone; this was perhaps stupid, but I thought since the officer at the POE talked about route mentioned above, it was okay. This is evidently my mistake. Next time i'll just let you answer the question, that's for sure!

Hey all

We just got married in September, and the I130 was filed and received about 2 weeks ago. However, you probably all know how long NOAs and check cashing is taking at the moment. We may be several more weeks/months before anything happens.

Technically I know that I am not allowed enter the US until my petition is approved, and I enter the US on a K3 (or is this correct?). I am the non USC husband now living in Canada until approval time, but I'd like to visit my wife in North Carolina for a few days before Christmas en route to Ireland for vacation. However, will US Immigration know I have an application in progress? I assume they pull up my history when they scan my passport, but at what stage is the I130 petition added to the computer. After NOA1 or NOA2? It may be that they won't know anything about the immigration petition, considering current processing times? I am an Irish citizen, so qualify for VWP ordinarily.

Assuming they know, does anyone have experience of coming in temporarily to visit the US during the application process? I will have all flights booked to prove I am leaving after a few days. I am also in school and renting accommodation in Canada, so I could have documentation of this with me to prove Canada is final destination after the vacation. Will this be enough, or should I shelve this whole idea, and just go straight to Ireland?

I am considering using Detroit as a main airport hub, and crossing the border from Canada by road for my out and return journey [Cross border to Detroit by road; fly to Greenboro, NC; fly to Shannon, Ireland; fly Ireland to Detroit; cross the border to Canada by road]? Is it easier to pass US Immigration at an airport, or by road, considering what I am proposing? Would my return journey be made easier at Immigration if I had flights booked straight through to Canada, or will they accept a coach journey booking, along with school/accommodation proof.

Sahil908 followed the instructions and received their NOA1 for I-129f already. I received mine in 2 days. If you want to go with the I-129f and you don't care about getting that processed faster and spending the extra money, then go for it. It looks like it is going to be quite some time before you received the NOA1 for the I-130 so I wouldn't hold out hope anytime soon.


Man oh man, is this what I was needing to know! I'm going to get the packet together in the next two days!!!

DId you send the I-130 or the I-129f in August? If not maybe you should try that - it's more expensive in the long run but...
we are also figuring out alternatives too, although i have more hope now that we have at least one NOA1.

That seems pretty quick.

But i'm sure the rest of it won't be - haven't even heard about our I130, and that was filed a month earlier!

This was also WITHOUT a cancelled check from the I-130 - just a copy of the I-130 and a copy of the check written out, and it was NOT filed at the same time.

My hubby is an Irish citizen but he is in school in Canada and has been able to successfully visit me (by getting a decent agent, by telling the truth and having strong ties - the Student visa and such in hand, but they didn't even ask for documentation). We also had a lawyer suggest the 60 day thing (get married on the 61st day of visit and Adjust Status) - that is why we ditched the lawyer.

As for the separation, people do it, indeed - but it is hard. MIke and I stay in constant contact - we talk every day without fail, and have since we starting getting serious. He went Mac to get a computer with a camera so we can iChat each other and see each other's faces...we also do Skype. There's lots of ways - i suggest starting to invest in some technology, stat!

So check this out... not my fault in any way, it's the same address that they sent our NOA1 for the 129f, AND the NOA1 for the I-130, yet for some reason it the whatever it was for the 129-f got kicked back to the gov and when I called today they informed me that it would take 30 to 45 days to get it back again.

There's not much info about this I could find, so I hope someone can help me, please. I know it is technically legal to to apply for a H-1B while K3 is in the pipeline and that they are independently adjudicated, but does anyone have any experience with it? I crossed the border from Canada on VWP recently, and mentioned to the Immigration Officer that I might have an employer who would sponsor me for H-1B - [I know, I know, WAY too much information, but he still let me in, so it was okay]. He was pleasant about it, but said he didn't think USCIS approved H-1Bs under those conditions very often.

I'm hoping he was misinformed. Can anyone tell me otherwise? We filed Oct 07, and our current timeline suggests I-130 fully approved in April 09, so we are looking at workarounds. My would-be-employer is kosher and above-board, he needs a worker and I fullfill all the crieteria, so I think I would ordinarily get the permit if I wasn't applying for residency. BEST of all, he's in the town where my wife lives, so all good!

I dont get it lol. when I asked if he can tell me why they want to explain it to him and not to me on the phone he said that its the law that they have to talk to him first before telling me. Hello & Pryvit everyone.


I'm directing this mainly to other couples from Ukraine, but I'm sure others might have had the same experience.


I went to Ukraine with the intent of Marrying Iryna, and filing for the I-130/K-3. We had a beautiful wedding! However when we went to make our marriage 'legal', Ukraine wouldn't accept some of my paperwork.

The paper in question was a NC certificate of non-marriage. Not typically the type of paper people use in the states, it was hard to find and expensive. but the records only searched up to September 07 and our marriage was May 08. So Ukraine wouldn't accept it based on the fact that I may have been married to someone else within this 8 month period.


I'm curious if anyone else had an issue like this before and what they did about it.


I took an alternative route and applied for the K-1 visa and we'll just have a smaller wedding once she gets to the states.

good point. I double checked with Iryna and I realized nothing needed sent in. just a little mix up on my part for being too rushed.

I didn't think our interview would be scheduled so quickly (after everything else takes so long)

and I'm used to calling Iryna my wife because we had a religious wedding in Ukraine, and went to get it done lawfully but some of my paperwork wasn't accepted.

I had to rush back to the U.S. though so instead of doing the K-3 we just applied for a K-1 and didn't mention a religious wedding to the USCIS, because I didn't have an opportunity to go back to Ukraine for a while.

no point in waiting too long eh?

So here's our next issue

my wife called our embassy and they scheduled an interview in just 5 days time. So next week she should travel to her embassy to have her interview.
However she hasn't yet sent in the D-156/k and D-230 etc. is this an issue? Is it alright to bring the documents to the interview with her? Please help us out here so we can reschedule if necessary.

After six months it finally happened.
Iryna called the embassy in Kiev about every other day, when they finally received our case they scheduled her interview only 5 days away.
She was able to get her medical exam easily, however the Financial documents I mailed her had not made it yet. And me being an idiot I mailed her the Original I-134.
In the end she went to the embassy interview with just copies of my financial information that I emailed to her (no I-134) and still was approved. She told me the interview was easy, the people were very friendly, and it only took about three hours.

So thanks VJ and members for every bit of information you've passed on to us.

We're on to our next challenge. Getting plane tickets in the holiday season for a reasonable price wacko.gif

Fiance's visa interivew is scheduled for May 13th

He'll be travelling to the States on April 30th, and staying here until we return to London for the interview, will that create any problems?

Second question: After the interview, we are planning to go to the Isle of Wight for a few days before returning back to the States. If the interview is on Wednesday at 8 am, will the passport (most likely) be returned before that Sunday?

Third Question: Can someone else sign for his passport when they deliver the package if we're in the IOW?

Fourth Question: Would it be better to have the passport courier to the address in the Isle of Wight?

How soon have interviewees (when there isn't a problem) been receiving their passports back after the interview?

Hi All
Just to let you know, I kept my appointment with the Immigration Officer and I'm so glad I did.

We had a really helpful man, who showed us exactly the forms to fill in, gave us copies of them all (and duplicates where needed) and described the best ways to go about proving sponsor-support and such..

now all I have to do is fill in this mountain of paperwork - boo! haha smile.gif

I don't doubt your advice at all, I'm just wondering if this is the general consensus from all members? To steer clear of the immigration officer..

The reason I made the appointment is because the form says this:

If you are not included in the above categories, but believe

I think I can cancel my appointment but it is quite soon.

I would advise against meeting with them first but if you do, please report back. I advised you to consult an immigration attorney, not an immigration officer.


Do you think it will jeopardise my application? I figured it was just cheaper to ask an officer (free) than an attorney (not free) haha. Thanks

I've just been going through the requirements for an adjustment of status - it gets a bit confusing when you get down to eligibility

Is it true that I CAN apply as a spouse of a US citizen who came here for a visit on the Visa Waiver Program?

Thanks for that reply, I am defintiely interested in this adjustment thing, I think given our mortgage, pet passport and car ownership over in the UK (and possibly a letter from my pastor telling of our involvement in church) we could prove our intentions smile.gif

My husband is a UK resident and a USA citizen. We have both lived in the UK for two and a half years so he does fulfil those requirements, however -
Although I can wait to start my job, he really needs to start his as soon as possible and so we don't want to be apart if possible - I understand the way you mentioned is 'quicker' but I wonder if there is an alternative 'you don't have to be apart' way to do it? (being that we are currently in the USA)

Did you intend to stay in the US before you came over to visit?

-- We did not, no. We own a home, car - are involved members of our church etc all at home. We got a house sitter for the three months as well. We also brought our dog here to the US with us for this trip (it was too long to leave her) but prior to that, we went through the long and expensive process of getting her a 'European Pet Passport' which allows her to re-enter the UK without having to go through quarantine (this could be confirmed through our vet I presume).


Do you need to go back to England to take care of anything pressing?
-- No (other than talking to the parents - JUST KIDDING) - all of our bills are direct debited and our house sitter is enjoying using our house! (sidenote: we live in Northern Ireland (part of the UK) but that is no issue)



Do you have flexibility as to when your new jobs will start, and will your new employer have to get you a work visa?
Yes I have one hundred percent flexibility, it will wait for me (and my husband can start his straight away I assume). I am also assuming that once I was to be approved for a green card I could work, up until then we can manage on my husband's wage and we will initially be living with his parents (they have a basement apartment that we can use)
