US Embassy and Consulate DiscussionHELP!!!

Hello,

My fiance's interview was on a Wednesday and we picked up his passport with visa at the Santo Domingo DomEx office the following Monday. If DomEx still does not have the passport and visa is really because they have not yet received it from the Embassy. You should call the Embassy and inquire on the status of your fiance's visa. I have read about some Dominican beneficiaries having delays in getting the visa due to spelling errors on the printed visa, then to correct the errors and re-print the visa the Embassy takes its time...

Best wishes! (F)

I called the toll free number that is 7.00 per call on Wednesday and told the operator about my situation and gave her my case number and she was saying she didn't see record of where the case was approved and I told her the interviewer said you are approved and can pay at the Domex and she said she would send an email to the appropriate department and if I have not heard anything in a week to call back. I was hoping she just did not know what she was talking about and the visa would arrive to the Domex in the next couple of days. I will call them again on Monday. Thanks so much.

Ok I see. Well I wonder what's taking so long. Maybe there was an error or correction they had to make. I hope you guys get it soon.

Thank You so Much!!!

US Embassy and Consulate DiscussionHELP!!!

That sounds weird. Domex is a courier service. After your interview is approved you will receive a slip of approval from the CO and you are directed to go pay for it in the Consulate a fee of $16 before you leave. They will deliver it to your fiance's residence. If he lives in a major city (easy to travel) place then it should arrive less than a week. If he lives in harder to reach areas it may take 7-10 days.

We were approved and told to pay at the Domex. We had the option for the Visa to be delivered to him in his home in La Romana or to pick it up at the Domex in Santo Domingo. We chose for him to pick it up there because we were scared of a delay with the delivery. We were told it would be at the Domex in 3-5 days. Now everytime we call the Domex they tell us something different... First it was 3 - 5 days then it was 3 days to 2 weeks and then 1 week to 6 weeks and today they told us it could take up to 2 months.

US Embassy and Consulate DiscussionHELP!!!
Help!!! I am going Crazy here. My fiance and I were approved on March 28th for the Fiance Visa and were told the Visa would be ready in 3-5 days to pick up the Domex in Santo Domingo. We thought he would come back with me on Sat. Sat came and went and No Visa... I have been here since Sat waiting on him and the Visa is still not @ the Domex. Anybody experienced this wait? How long did it take for your Visa to arrive at the Domex? Thanks for answering.

US Embassy and Consulate Discussionage difference of couple
The biggest risk I think is when two people marry and the are in different "phases of life".

Example; He has nearly grown kids and she has never had any kids.
He has a retirement plan and she is young enough to be on a disco floor every weekend (and maybe is).

He has the benefit of life experience, and she has had very little.

Success is "possible" but the risk factor is much higher, anyone who can not face this reality might be blind to much more.

Usually I hear people comment that "they look much younger" than their actual age ... as if that has something to do with keeping a marriage together.

I certainly don't exempt myself because in my case there is a little higher than average age-gap. Even though it seems to pose not issues now, I have given it very much consideration.
And I am not so foolish to think "love conquers all" (It does as long as there is love).

It's a shame that most of the people who have posted here in the past with large age gaps rarely come back (after marriage) to share as much about what caused the break up or the struggles they have worked through, I think many of us could benefit from that.

* to the author of this thread; how did you "not plan" to be in a relationship with a large age spread ..... did it kinda sneak up on you?
IN my case my lady wrote me a letter and I decided to accept her offer to get to know each other better. It has worked out very well, but I would not claim it was not by design, as we both knew our demographics from the outset.

AND does this document go with her to the interview or sent to the service center?

US Embassy and Consulate DiscussionAhhh that pesky 1-134
I am heading to Russia next week and I thought I would bring documents with me, I suspect my 2nd notice will arrive during this travel period.

Couple brief questions on the i-134

sec 1.A (instructions) states a separate affidavit shall be filled for each person.
Should I assume a child riding on the mothers k-1 Visa does not require a separate affidavit??

Section 2 says; a sponsor must submit in *duplicate*evidence of income and resources, as appropriate.
What exactly does this "Duplicate" mean? Since I am self employed, should I print two copies of my 06 taxes?
And Have my banker make two copies of the letter verifying account info?

On the part of the i-134 to be filled out;
at section 7. where it asks about my income (I have included a copy of my taxes) do they want my income after all deductions are made and I am left with my taxable amount?

Of course there is also a place to include real estate value and mortgage balance. Is there no request for proof of this or are they "taking the applicants word" on this?

As to question 10.
It asks if I have submitted a visa petition on behalf of the following persons...
Does this pertain to a possible person before filling for this K-1?
I would *not* put my fiances name in there?

Anyone than can help, in whole or part, I would be grateful,
Danny

K-3 Spouse Visa Process & ProceduresUrgent K3 visa problem: Different names on birth certificate and passport
QUOTE (kinglear @ Jun 9 2008, 09:32 PM) <{POST_SNAPBACK}>
Thanks a lot!

I'd suggest that since you haven't filed the petition yet, why not try to find out why there is a difference in the names on your BC and your Passport. Usually, one has to submit their US BC as proof of their citizenship in the USA when attempting to obtain a passport. If the names are different, that would suggest either administrative error or something else going on, and it's worthy of investigation by you. Might slow up the K3 process or if you elect to just send the passport pages, maybe you can squeak by. Me, I'm a "completist." If something doesn't gel with the facts, I give all the facts (or documents) and explain any discrepancies in letter form. J has a middle name from birth that she used all through school (to include college), but she found not long before we started the K1 process that that middle name was never on her official BC in the Phils. Instead of hiding the name, we simply included all the required and relevant documents (her passport, BC without the middle name, G-325A form with her missing middle name as an AKA or other name, etc.) and explained the middle name issue with a letter signed by her. It didn't delay our petition's process through the red tape one bit. And at least if you send everything and just explain any differences logically and clearly, you won't get any RFE's (hopefully).

K-3 Spouse Visa Process & ProceduresIs AOS really this complicated??
QUOTE (Firstenburg @ Jul 23 2008, 07:03 AM) <{POST_SNAPBACK}>
My lovely wife and I have been together for a month now. This whole month I haven't wanted ANYTHING to do with immigration - so tired of dealing with the whole process. But tonight I figured I better start preparing for AOS, and I went to the GUIDES section and read up on the process...

IT LOOKS JUST LIKE K3!!

Have I missed something here? Am I reading correctly? Do I really need to pay $1010 just to file???? Our I-130 was approved at the same time as the I-129 and is currently sitting at NVC. What would be the cost/process if I proceeded with the I-130 now instead of the I-129?

Hope someone has better news for me than I have to fill out all the same forms and get all the same translations, etc, AGAIN!!! AND PAY $1010!!

According to the guides, you would have to also submit all of the AOS paperwork (it's a big headache...I wish it was just one or two forms), and yes, sadly the $1010, too. Fees are exhorbitent, but in the end, it's worth it. Just budget for it all you can.

In the interest of saving trees, we only printed select emails from a 2-year period. Since we didn't make many phone calls, I only submitted minimal evidence of that. I didn't even want to think about printing our chats, and none of our chats have ever been printed out. I'm sure you'll be fine so long as there are no difficulties with what has already been submitted, so don't worry.

US Embassy and Consulate DiscussionI-134 Affadavit of Support Form
Am working on post-NOA2 paperwork/packet to send to my fiancée. I must say real quickly that the NVC is VERY difficult to get in to speak with someone about K visa application statuses even after their recommended 6pm call-in times! I spent from 5:30 till 8:10 EDT this evening getting busy signals and/or getting kicked out of the call system due to all the operators being busy. Still no sign of our paperwork at NVC...they keep telling me "it's still a little too early. The average wait is 2-4 weeks." ANYWAY, aside from that, I have three questions about the I-134 Affadavit of Support form, if I may.

1) For my annual salary, it varies because I'm hourly and overtime can make that more or lack of overtime can make it less...to be safe, I assume I should put last year's wages...but do I put the exact amount of gross income (pre-tax, pre-deductions) or net income?

2) Since I'm not self-employed, do I still have to submit copies of my Income tax filings at all? It seems from the instructions on the form that I don't.

3) For Item #11, "I intend or do not intend to make specific contributions...etc.", since I don't plan to specifically just give my fiancée (soon to be wife) money for room and board and food, etc., would I put "Do Not Intend to..." on the form? It is kinda confusing. I mean, yeah, I will furnish room and board and food and all that for her through the house we live in and the food in our cupboard or out in town...but "specific contributions" sounds almost like donations or charity, as if I'm giving her money to live off of. How did some of the post-NOA2ers do theirs? The filled form in the "example forms" does not have a checkmark for either "Do" or "Do Not" intend...etc.

Thanks.

David

US Embassy and Consulate DiscussionI-134 Question
I see I may have some overkill in what I'm about to send Jacki for her interview in Manila. I've been bugging my banks to get me letters, and I told them I wanted them notarized. However, one of the banks sent me a letter but did not notarize the letters, as requested. I was going to chew them out tomorrow for not following my explicit, repeated many times instructions, but maybe I'll just drop it since my income is above 30K. I have pay stubs dating back to 4/23/06, I think, and all bank statements since early 2006. How does one go about getting tax transcripts from the IRS? Can anyone give me a good telephone number to call to request this. Can the IRS also provide photocopies/microfiche copies of a prior tax return that I can't seem to find? I have 2006 and 2005 everything, but am at a loss as to where my 2004 filing is located at present. And also, just to clarify, does the ONLY thing that needs to be notarized at this point need to be the signed I-134. Any of the employer or bank letters?

As for the user's question about DS-156, I know for the Manila Embassy at least that this does have to be submitted. It has to be filled out via an online web form on their web site now, then I think it throws the data into a printable PDF for the beneficiary to print. Or maybe the data just automatically goes into the computer system at the Manila Embassy. But to answer the question of "is it needed," I would imagine it would depend on the consulate, but the safe answer would probably be a universal "yes" for K1 or K3 (I think).

hey u must dial 001.. OKAY u stated 011 thats wrong
please follow the this number in order not pain for ya!!!

i hope its clear for ya!! i am sure u can ahold ...

Thanks pushbrk for the US # and jarl for the 001 info. I got home too late today to talk to the USA # before 5pm, so will do it on Monday, I guess. Regarding the 001/011 number, I tried it both ways (just to test...I know they're closed at this hour/day) and got the same message I got before about international calls. I've got to go see my cell phone provider about another problem tomorrow anyway, so I'll speak with them about it then. But it's a little silly (in my opinion) to get international calling service at presumably a higher service charge just for a few phone calls to see if our Visa petition has arrived in Manila yet. I wish I had SMART service, coz Jacki is on SMART cell phone there in Phils and it would be very nice to be able to talk to her and even transfer load to her from my phone when she needs it. Oh well. Thanks again for all your help. Still wondering if anyone out there could help to give us pointers on how to best adjust to this new environment, especially confronting the being physically away from family aspect. If I didn't care about how Jacki felt, I wouldn't be asking such a question, but even if you're not from the Phils and you had trouble adjusting to life away from your family, I would love to hear how you coped or how you helped your foreign fiance or wife (who's leaving or has left everything they hold dear to them just to be with you) adjust and cope with this big change in their lives. Granted, I'm not going to prevent her from conversing with them and such, but with AP and all that ####### and not being able to go home immediately to visit, it could get very difficult for her and us, too. Her concerns and worries become my worries and concerns, and we need to work them out together. I've never been engaged or married before, unlike some others out there. Any advice would be great. Thanks.

US Embassy and Consulate DiscussionQuestion for those who have Filipino Fiance/Wife

The lady at 5184 was just wonderful! Good luck

I have the telephone 011 63, etc. number given in the posts...however, as I said, my call to the Phils number was unable to be completed and I need a way of calling a number in the US that might could give me a status. I am unable to call outside the USA for some very odd reason. I can text my fiancee all day long, but the 011 or 001 stuff isn't working for the telephone call. It wasn't a line busy message that I got. It was from my cell service provider. Anybody have any other ideas???

US Embassy and Consulate DiscussionQuestion for those who have Filipino Fiance/Wife
Hello,

I'm specifically asking for information about how to find out if our packet has gotten to the Manila consulate yet. I tried 011/63 25286300 that another poster responded in a previous post with as a telephone, but for some reason my cell phone will not allow me to connect to this number. I know I have wide open service, and I can receive calls from my fiancée. I can't even call her number. Anyway, I know there is an 888 number where you can connect to the Manila consulate office and pay a service charge for each call, but I was wondering if there is a number in the USA that is toll free or even long distance (like the NVC #) or an email address I could write to to inquire as to whether or not our packet has been received. I tried the interview appointments web site and it's obviously still too early for our interview to have been put into the system yet. We just left the NVC on June 26. Anybody have any pointers for the Manila Embassy?

PS- I only have my cell phone. No landline at home. International calls are HIGHLY discouraged at my work...so dunno what to do from here. I don't want to have to pay a service fee for an 888 number where I run the risk of being told that the petition isn't even there yet. Looking at some timelines online, it looks like it could have arrived by now. Thoughts anyone? Thanks-

Also, anyone who did the K1/K3 route and your fiancee is about to come here to USA or is already here...do you have any pointers or suggestions that might help with easing the pain of my fiancee having to leave her family and living in a new and yes, strange place with a strange person like me? As you well know, the Filipino culture is much more family centered than here in USA, and it's obviously very tough for someone to have to leave their family and friends for one person. Anything that might help us, especially my fiancee, in this very difficult and real situation, please post or PM me and I will pass along your messages to Jacki. Jacki has already tried to reach out to Filipinos on here, specifically those speaking her native Visayan, in NC or at least nearby, and she hasn't gotten a lot of responses. We would greatly appreciate any and all help/advice in these matters. Thank you.

US Embassy and Consulate DiscussionApproved (Manila!)
Hello all,

I just wanted to give the good news in a post in this forum that J's K1 visa has been approved. She had her interview on Monday morning her time, or Sunday night my time, and it went very smoothly and quickly. We were expecting her to be at the embassy for many hours waiting, but she had gotten back home and had told me the good news by 9:46pm my time last night. We had both read horror stories about the Manila embassy and questions used to manipulate or confuse people, and also downright mean CO's. However, J gave me a description of her process yesterday as well as the questions she was asked, and nothing bad that I or she had heard or read on here and other places came true. I think the most interesting question they asked her that I didn't think to "rehearse" her on was when she was asked if I had told her about the difference in weather here versus there in the Phils. J of course said yes, because I've mentioned it gets a little cold here in the winters, especially cold to a Filipina! It's not as bad cold-wise as it is farther inland or up north, but it does get cold. They asked her a related question about snow, too, and she responded correctly that we don't get a lot of snow here on the coast of NC. It snows here maybe once every three years. Glad I already told her about the weather, I guess, since she was asked so much about it!!!

One thing that I think we've both taken from the interview process in Manila, at least, is to not over-prepare your packets. I don't know how many pounds J's final packets weighed (what I sent to her was 8lbs), but it was heavy. During her pre-interview time, they asked for her appt letter and various forms that she had filled out, plus my affadavit of support, my last W2, one letter from/to me, one email to/from me, one card, and five photos. We'll just say that 95% of the papers she brought with her from various packets were never needed. But that doesn't mean that everyone just needs to bring only one of each item. I believe she brought roughly 100 pictures of us together. I think the CO was already largely convinced based on the evidence I sent with my original submission, so not a lot was required except newer more recent materials.

The CO was described as a younger lady, first name Clara, approximately 30 years old, who was likely a Protestant Christian because she seemed happy to hear that J and I were not Catholic during the interview.

The questions J indicated she was asked were:

What is my age? Where did we meet? Where and when did J first see me in person? When was my last trip to the Philippines? Why did she choose to chat with me? They appear to have asked her again, how old I am. Then they asked how old she is. How many visits have I made to RP? What state am I from? Did D tell you about the weather where he lives? Snow? Tell me a little about your fiancé.

After those were answered, the lady basically said "That's about it" and then said to sit back down and wait for her priority number to be called again, if they need to see more docs, she'd be asked asked again. If not, they will give you a slip for Delbros window/fee. Her number was posted and she got a pink slip and the pictures, letter, card, email were returned to her. J paid her Delbros fee and was told 1-3 business days before she receives her passport with the Visa attached. They also told her via the slip, I believe, not to make travel plans before having the visa in hand.

Anyway, that's the bulk of the interview story for Manila. Thank God we are approved!!!!

US Embassy and Consulate DiscussionRejected!

i am sorry for this...you said her family is best friend with your aunts, well, if your aunts live in the states that means they got you, if not, i think you have to contact an attorney who is professional dealing with denialed petitions...good luck

myaunt lives in india very close to her

Reading the notice text you gave, it appears that the NOA2 (approval) notice expired a few days before the interview. There is a letter in the examples section (http://www.visajourn...nd-approval.doc) that should be sent to the USCIS requesting an extension of the approval notice for another 4 months. The letter basically states that you still love each other and continue to desire to pursue marriage when your fiancee arrives in the States. If the 4 month approval expired and was not renewed before the deadline, it could have been a sign to the embassy that you were not pursuing the petition anymore. Remember, the embassy does not know you or your intentions or even the present status of your relationship. They only have what's on paper. I would recommend filling out and submitting the letter, and perhaps calling your congressman/woman, too. Hope this helps.

US Embassy and Consulate DiscussionLovers Quarrel??
QUOTE (mayumi_anthony @ Apr 18 2008, 09:45 AM) <{POST_SNAPBACK}>
Hi gang! here i am again and wondering and thinking about all the couples here like me who has long distance relationship. We all know its so normal to have misunderstanding in any relationship...
How often do you have misundestandings/quarrel with your partner ? mad.gif
and how do you manage to settle it? What is the stupidiest thing you fought about?? headbonk.gif

Its so hard to be in a LDR!!!!!! wink.gif yes.gif

I see your SO is a Filipina, too. Misunderstandings are common with Filipinas, especially early in a relationship. One thing I work very hard to not do is also get angry at her for being angry. Both people angry never solves a problem. Your SO is probably just having what is called in the Philippines, a "tampo," or temper fit. You probably said something or did something that touched off a nerve in her for whatever reason, and usually they will talk to you after a certain amount of time has passed (usually 30 minutes to 6 hours). Say you're sorry...often, that's most of what they want to hear...but be genuine in your sorrow...don't just say "I'm sorry" and expect for it to fix itself quickly. Just give her some time, unless you did something really bad or said something really bad. As you get to know one another better, you will learn what ticks her off and what the boundaries are...if you know her this intimately and learn to live with or say things that don't cross those boundaries, you will have less fights. That goes for any relationship, not just avoiding the famous Filipina tampo. And don't think because it's a LDR that it makes it any tougher. It can seem worse in person, at times. Just be patient with her, and work together to avoid a similar situation. J is my first and hopefully last wife, and I can tell you that in the end, it's worth all the fights that happened early on.

As for the stupidest thing we have fought about so far, well, I probably should not say. If I were to say, I'd be crossing one of those boundaries mentioned above...Filipinas are very private and don't like their personal lives alone or together with you discussed in detail. I will say that it was just something I said about something that had nothing to do with her or even really with me. I'll leave it at that, I think. Hope this helps.

hello,

I have my k-1 interview on wednesday, and I'm just looking up my next steps, if I get approved.

First of all, can I bring a binder to my interview? I have those clear binder sheets and I put all my stuff in order in them. I was wondering if a binder is okay to bring? I also have a file folder and an accordian file folder, but I'm afraid of having all the pages loose. Let me know what you guys did for your interviews, if you have any suggestions, or if you think my set up is okay.

Also, I am hoping to move to the states next week, but our wedding wont be until aug 16. So I'm wondering, can I get a ssn and work right away? or will I need to fill out an ead/aos first? and if i do, do I need to wait til after the wedding to fill it out?

money is getting tight, and I'd like to work as soon as possible. I think I have enough to make do, but I just want to know if i can start looking for work right away or not.

Thanks for all the help that this site provides, any help on this subject would be appreciated.

Depending on where you enter the USA, you may or may not be issued a temporary EAD (Work authorization). This is typically valid for only 90 days and may have to be asked for. If it is given, you would receive a stamp on the back of your I-94 form. JFK airport typically DOES give this. However, after 90 days from POE, you would not be eligible to work. You might could work at home as a babysitter or whatever and take in a little bit of extra income that way, but my view is that doing something like that would not be entirely legal. You can apply for a SSN within the first 90 days, but the card you receive would state that you are only authorized to work with USCIS authorization, and I believe my wife's has a date on it, too. Various states may have different laws about drivers' licenses, but North Carolina allows for State ID's and learner's permits, and DL's, but they are only valid for that 90 day period. Kinda sucks, if you ask me. I know about finances being tight, but it's just something you have to deal with the best you can as a couple until things can be straightened out by your EAD that you apply for after you get married. I'd apply for EAD as soon as you possibly can after marriage (I think it does have to be done AFTER the marriage, unless you want to try to do it and pay a separate $300+ fee just for EAD...the AOS fee, $1010, automatically includes the EAD fee, but it must be applied for with AOS, not before) so you won't have to wait so long. Me and J waited almost a month and a half after our marriage to apply for AOS/EAD/AP, and I think we're both regretting waiting that long now. C'est la vie.

D

My wife had a different location for her interview, obviously, but she used several clearbooks to carry all of her paperwork in. She separated the various types of documents and what they proved into smaller folders, and had a very organized package to show the consular officer should they have asked for anything. It might not hurt to check with the embassy via the telephone and see what kind of binders or clearbooks or other organizational stuff you are allowed to bring in, and how much. I know that J could not bring any electronics, digital media (including CD's), or especially not her cell phone into the embassy with her. I'd imagine that is the same in most other embassies.

PS- We were told by our local SS office that we should wait 2 weeks after POE to apply for SSN. This is because your name and A#, etc. has to pass from POE through the various US Gooberment systems. And depending on where you are settling, you could expect a hassle. Always make sure that if they do give you a hassle and say you are not eligible, there is a circular floating around on other areas of this site showing that K1 visa holders can apply for and receive a SSN (within the Work Authorization period on the I-94). If they say "We don't have that circular. I've been working here for x years and I know she is not eligible" and you know that you have that stamp on the back of your I-94, tell them to run your Alien number (A#) through their system and see if you have work authorization. That's what I had to do for J...the lady almost threw us out of the office before she looked up her A# and saw that she was wrong in telling us (quite emphatically) that J was not eligible. The A#, if it has gone through the systems (remember, 2 weeks after POE, at least from JFK), will clearly show them if you are eligible or not.

US Embassy and Consulate DiscussionInterview language,..?
Since you're interviewing at a US Embassy or Consulate, I imagine they will have the ability to speak and understand the native language of the country they are working in plus English, obviously, but I'm reasonably certain that all Visa interviews are conducted in English. Remember, all supporting documents not written in English must be translated into English by someone certified to do so, so it would only be natural that the person conducting the interview would also conduct the interview in English, and expect replies in English.

K-3 Spouse Visa Process & ProceduresContradictory information! Please help

The canadian embassy won't think it's weird that neither of us live there permanently?

It's neither here nor there if neither of you live there in any manner. The policy requirement is for the K-3 to be adjudicated in the country where the marriage took place so it's not up to the consulate to think anything of it. For example , if you took a holiday to the south of France, got caught in the romance and on a whim married .....you'd be going there for an interview.

Something to consider .....and not to throw a wet blanket on any plans you're getting excited about......

If for some reason his interview in Montreal doesn't happen by April when he finishes school, is it going to be possible for him to remain in Canada for a bit longer until he gets it?
As of right now, interviews in Montreal are taking up to 6 months +/- from the time the file reaches Montreal. So calculate USCIS processing + travel time to the NVC and its couple day process + a possible 6 month wait for an interview in Montreal.

So I've talked to the lawyer and he's saying we're going to need to file for an I-130 and NOT an I-129f, as they are taking a long time just now, and the I-130 interview is in country of origin, regardless of where the marriage is. So I think we're going to do it here, and make a proper ceremony of it.

This stuff makes my head hurt.

http://travel.state....types_2993.html

After the USCIS approves the I-129F, it sends it to the National Visa Center (NVC). The NVC sends the petition electronically to the embassy or consulate in the country where the marriage took place. If your marriage took place in the United States, the NVC sends the petition to the embassy or consulate that issues visas in the country of your spouse's nationality.

the lawyer may have been thinking about the CR-1 interview.

Okay, so i read that the CR-1 interview is in the foreign embassy, but if the petition for the I-129F gets sent to the embassy in the country where the marriage took place, that means that he'll have the K-3 interview at that embassy, (Canada), whearas if it's in the US the embassy will be in Dublin. I think I have this straight now? The canadian embassy won't think it's weird that neither of us live there permanently?

This is so helpful!

And unfortunately he'll not be that close to vancouver - Western Ontario (London).

If I were you I'd get married in Canada and apply for a K-3

except then he'd have to go to Canada for the K3 interview, and he lives in Scotland. Kind of a round about way, and with added expense I'm sure they'd rather not have to pay.

The fiance will soon be attending school in Canada. K3 visas, by law, must be adjudicated in the country the marriage took place, so wherever he was at the time of the interview, he would travel to Montreal for the interview.

Perhaps he would still be in school in Canada. Perhaps he would be visiting his wife in the USA. We don't know.

Hmm... well I went to the lawyer today, and liked him much better than the other! He informed me that Mike will have to go do the interview in the country of origin, that being Ireland - he said it really didn't matter which country we got married in. can you show me where your info is? That sure would save us some money if he could do the interview in Canada! but the lawyer seemed pretty certain... i think we've decided to go ahead and get married in Aug/Sept before he goes to school - now the big dilemma is whether to have a big ceremony or save that for the date that I already have saved, May 3, with the possibility that the green card won't be ready yet by then....
ARGH!

Wow - we didn't even consider this. So he goes to school in Canada last week in August, we could get married then, and he will be in school until April, and we would hopefully get an interview before then? So the interview takes place in the country of the marriage, and not of origin?

thanks everyone!

I know 3 couples personally who have gone about this process in the way your lawyer recommended on the advice of their lawyers. The advice they were given was wait a few months into the visit to get married.

We knew it was an option when we started our journey but had heavy concerns with the risks.......we are the poster children for Murphy's Law and I am always POSITIVE I'll get caught lying.

Good Luck whatever you decide to do :)

CutienPurg, what did you end up doing? Another lawyer has suggested getting married when he visits here, and then have him leave, and somehow this will be okay if we have a signed affidavit from the lawyer? Have you heard of this?

we got married and he went back to Canada. we filed for a K-3 and Cr-1. I was too worried about the whole intent thing even though I think proving intent can be difficult if you dont get married for awhile.

So he came in on a visitor's visa and then you got married and then he went back? that sounds like the okay thing to do here--but we'll see what lawer number 2 says!

thanks for everyone's help/advice!

Rhiannon,

Immigration official.

Some people say, 'it's just semantics', but improper use of terminology is a leading cause of mis-communication. When you speak with this other attorney be sure that you both have the same understanding of what the terms that you use mean.

Well yes actually I meant immigration official, and when we talked we talked immigration. but thanks for catching the slip. my head is whirling with all this stuff! and it IS all about the details, from what I can see!

Rhiannon,

I suggest that you take the opposite approach to resolving your confusion - write down all of the reasons you read on VJ as to why this is not necessarily a good idea (I like the way you state it!) and then ask the lawyer to address those reasons. Ask not only about the risks, but about the consequences. (Some people approve of nuclear power because the risks are low and the benefits are demonstrable. Other people disapprove of nuclear power because although the risks are low the consequences are high - high enough to outweigh the benefits.)

---

Hey thanks- that's a good idea. I'm getting a second opinion with a lawyer who has come personally recommended by someone who is going through the same process, and I'll bring a sheet of questions. I went to the other lawyer with a pretty thorough timeline, which I thought should be enough for $200! I still can't believe she was blithely expecting him to lie to the customs official when he came here for the wedding. I don't really want to do ANYTHING that might jeopardize our situation.

Hey y'all - i've been lurking about these boards just about since I got engaged - and I've just had my first legal consultation and it's contradicting info gleaned from these boards -

My fiance is from Ireland but currently lives in Scotland and will soon be going to school in Canada for 8 months (how's that for complicated) - we're planning on having ceremonies in Ireland (march 22 - on his easter break) and the US (may 3 - after he is done with the program) of next year, and he wants to come here for good in May. This lawyer has suggested that he comes in May on a visitor visa and then stay after we get married - but i've read here that is not necessarily a good idea - I called her back and she said that's what we have to do....so what's up?

Please help! Thanks - we've read all the guidelines and lots of posts etc..
