Just a quick question.... does anybody know...with all this evidence and supporting documents we include with the ROC, do the IO's actually check up on this info? (For example, if I include a bank statement or health insurance cards, do they call the bank or health insurance company to confirm that both names are on the account and to ensure the info is legit)....Or do they just look at the papers to make sure everything is in order with names and addresses etc and just basically make their decision from looking at the papers?

Ive been reading in other posts that highlighting is a No No ! Because the IO actually scans your documents, and the highlighted works get blurry or grayed out and is no longer readable - because they scan black and white - not color!
If you highlight, i would suggest doing it in yellow. Its light enough not to show on the scanned document. And just for good effort, i would try it out for yourself at home if you have a scanner - get a document, highlight words, scan it black & white then see how it prints out.
i think i will highlight in yellow!

well the way i see it...USCIS want you to apply jointly OR as divorced. you arent divorced, so the obvious choice is joint in this case. you have all the paperwork and eveidence to prove you entered the marriage in good faith plus all the other stuff. so i dont see why it would be a problem to send in the papers jointly. then, if USCIS call you in for an interview then you can explain your circumstances...who knows, you may be back together with him?!?!?

but this is my opinion, you need to do what makes you feel comfortable and what feels right for your situation...

hi all! so here is a question... me and hubby have joint car insurance, however the actual car title is just under my name. so when im sending in my evidence, im sending in the joint car insurance info...but should i also give a copy of the car title too and explain that its just under my name and that i wanted to include it so you can see my address?

or should i leave out the title completely...but i would then think that USCIS might RFE me and question me why we have joint car insurance but no car title??

hi! well thats a tricky one.... for the past couple of years, when you have both submitted your taxes...did you submit as "joint"? and what address did you both put on there? did you put the same address? or different address? also, with your drivers license, do you both have the same state issued id with the same address?
if you have same addresses and all the other evidence you mentioned i think that should be ok. my situation is almost similar to yours, i live in NC and spouse works in PA .....BUT even though he rents a place in PA while he's there, he's only there Monday-Thursday and comes to be with me all other times, and we use our NC address for everything, and NC is our real home. i dont intend to tell USCIS when i submit my ROC papers next month about out second place in PA because this will raise questions i think.

Hi! well we didnt submit together because USC spouse owes thousands of $$ going back to before we got married... years before! and we really needed as much $$ refunded to us at the time, so we thought it best to submit married but seperate so at least my monies will come back and also because my USC spouse didnt want me to owe for his debt. really good idea at the time, but im kinda thinking we should have done the married together filing option.

hi all, i have a question, now that im gathering up my tax stuff, i have this issue:

Me and my USC spouse got married in March 2009. USC submitted his taxes (for 2008) in Feb 2009 - and he was "head of household"

Then in 2010, me and USC submitted taxes (for 2009) as "married but seperate" - USC had previous taxes owing so we did it seperate so my refund wasnt going to be affected by USC's debt.

Then for this year 2011, I have submitted my taxes (for 2010) as "married but seperate" - again for the same reason as above. BUT..... now my USC Spouse has NOT submitted his taxes yet this year, instead he has applied for an "extension" on his taxes, which is confirmed and he wont be submitting his taxes till the end of the year when we actually have some money to pay for all the previous debts.

i will submit to USCIS the following as evidence:
USC 2008 transcript "head of household"
Mine and USC 2009 transcript "married but seperate"
My 2010 transcript "married but seperate"
USC copy of the extension form we submitted and the confirmation of "extension" being approved.

is this going to be a problem? do i need to explain this on the cover letter?? should i leave something out?? will this raise questions or an RFE?

hey! the affidavita dont need to me notarized. you could actually type something up yourself and have your friend just sign it. (of course with the correct info on it...by doing it this way all you need isa few minutes to put together something and your friends just have to sign it).

and if possible...i would definitely try to get more evidence - copies of joint phone bills, joint lease agreement, joint insurance, joint car title and even photos of all of yall together.

we were randomly selected for the interview, and we were living together until the 4 days before the interview date. and my wife did not call USCIS to report anything neither I. my wife was physiologically crazy after she saw the interview letter, and i left the house because she start waking up in a middle of nite and starting fighting with me. yes she has been seen therapist about her craziness for the last year up to today.
I dont know your circumstances, i hope you will get your card


wow, just your luck to get called for an interview! just imagine, you wouldnt be going through all this for the GC if they didnt call you in!! thats just really good luck or really bad luck!!! right now my circumstances are fine, and the relationship i have with my USC spouse is getting better, it has its ups and downs like all other marriages, but its always in the back of my head IF something happens! i will pray for you as well, i hope you get your GC!

hi chyme!! in my opinion, it sounds like you have everything you need and i wouldnt go with an attorney!! there is no extra benefit for an attorney at this point except for the convenience of someone dotting your I's and crossing your T's.

spend a few minutes on the website and you'll get all the help you need -maybe send in few photos and and affidavit!! but it sounds like you are set - I-751 form/check for $590/evidence and send to USCIS !

I am from North Carolina. I sent off my package to Texas Service Center a month ago and today I recevied a NOA from California Service Center. I was all excited that I finally received a NOA, then I looked at the bottom of the paper where it listed the mailing address of California Service Center. I started to have a bad feeling... I am afraid that there was a mix up while my case was being processed and ended up in California Service Center instead of Texas Service Center. I am afraid that they are gonna schedule my fingerprinting thingy in California office... Has this happened to anybody?

Hi, I have read the faq and seen the example form but am still a bit confused about the following things:

Question 3: Name of spouse and children accompanying - should my daughter (aged 11) be listed here?

Question 8: 'The following people are wholly/partially dependant on me...' - should my daughter and I be listed on this? The beneficiary is NOT listed in the example but we will be dependant on my fiance until I start work out there?

Question 10: 'I have submitted a visa application on behalf of the following people....' Should both myself and my daughter be listed or just me?

It is also the link given in the Packet 3 top download the forms required. If you look in the box on the right hand side of the screen titled 'More', it lists 'IV-15 and checklist' to send back and not DS-2001.

Hi, i'm terrified that I am going to mess up the packet 3 stuff like I did the I-129f! Please can you check the list below if you have time!! to see if what I have listed to send back to the embassy is correct. Also, I am sending copies of forms for my 11 year old...not sure if I need to fill all of them out for her:

1 copy only of IV-15 checklist but with my daughter named on applicants statement.
1 copy of DS-230 part 1 for myself, and 1 copy for my daughter
1 copy of DS-157 for me and 1 copy for my daughter
1 copy of DS-156K for me and 1 copy for my daughter
2 copies of DS-156 for me and 2 copies for my daughter
Additional sheet with continued employment history and trips to US listed.

I do not sign ANY of these forms, correct? I have put my name on my daughters DS-230 part one, question 34 as I filled it in for her, I'm assuming that is the right thing?

I do not send ANY supplementary documents/evidence/photos (that is all provided at interview and I must show originals and have copies available right?)

I do not need to send any medical stuff back to them, I have arranged the medicals seperately and simply take the medical forms/records/photos and ourselves on the day to the medical?

Is this right do you think? Now, I am getting this ready for when I receive the packet 3 (embassy received case on 2nd March), so I only have the info I have read from here to go by. Do I definitely need to send 2 DS-156's for each of us?


I have one last tricky question. My daughters biological father has not been on the scene for over 10 years, I do not know where he lives and am not 100% certain on his date of birth (i'm only 95% certain!):

On DS-230 part 1, should I leave his DOB blank or put what I think it is?
For his address I have put 'UNKNOWN'' Is this ok?

Neither parent is listed on her original birth certificate (short form) but the full cert I have requested especially for visa interview lists us both, again no DOB. I have had to list him on the forms therefore but do not know if there is a way of proving absolutely no contact?

I have read a previous thread that told me I needed a copy of something that proves he has no legal custody order for her. I have got this but do I need a letter from a solicitor as weel to 'notorize' it? Will this be sufficient? And finally, on the IV-15 checklist where it asks for 'custody decree' do I tick it as I have a simple letter or leave it blank?

Hi,

I am hoping someone out there may be able to shed some light on this situation.

A friend of mine has lived in the US since they were 3, they have a permanent resident number and had a greencard. Their mother took care of all of this but has since passed and now his grandmother is ill and he wants to be able to go and see her. He isn't sure of his status, he doesn;t remember anything about renewal and always took it for granted he was a PR.

He has a SSN and also served in the US marine Corps for 8 years where they issued him with a waiver. He made an appointment to go and see an immigration lawyer to find out more about his situation.

I know this is a very general description but if any of you have any help/advice to offer it would be appreciated.

I have a question about DS-230 form sent by the embassy to me (beneficiary). I received the visa instructions for Fiance visa... It writes...

FIRST: Complete and return immediately to this office Form DS-230 Part I and Part II (and Part II was slashed, which means I don't have to submit Part II), Immigrant Visa Application - Biographic Data along with a copy of your passport (1st biographic page only). This office cannot process your case until they are received.

SECOND: Obtain the following documents in this checklist. Check off the box next to each document as yu obtain it. Then return to us ONLY this checklist along with completed and signed "Applicant Statement".

THIRD: ...... regarding DS-156 forms to bring on the day of appointment.

So.... my question is: Do I send only the part I of DS-230 back to the embassy first?? how do I do this? from what I found out on this site, a lot of the topics say that I have to send my DS-230 form together with all the documents (i.e. birth cert, police cert, etc...). I'm really confused.

Have anyone come across this before? Do I send in the DS-230 PART I first? Then the other documents later????

Please advice!!!!!
