Removing Conditions on Residency General Discussion	On the form 751 they have a children section...do i put our child who was born in the US	QUOTE (CanAmer @ Jul 23 2009, 07:26 PM) <{POST_SNAPBACK}> For the 751 form we have a child born in the US do we put that on the from under children? I put the names of my two children on the form. Both of them are US Citizens. Just make sure that you state your child's immigration status as 'US Citizen'. Why are you twisting the meaning of the instructions to derive a conclusion which contradicts the wording both on the form and the instructions? Is it really that hard to understand the very simple English used by the USCIS here? If you put an A# in the A# column when you don't have to, like in Haole's case, then the USCIS is going to think that child is a conditional resident, so think about this carefully if your child's situation is not straight forward in this regard. If you want to forge ahead with your misinterpretation of the I-751 and its instructions, and not include your three children in part 5, then don't come back here to whine when you get an RFE or your packet is returned to you because the USCIS judged your I-751 to be incorrect or incomplete. I'm sorry for my somewhat harsh tone here, I'm just annoyed that many people seem to be twisting up the wording of this form and coming to conclusions which may put their petition in jeopardy. I've asked him for more information about his US citizen child because, by reading his post history on VJ, it's unclear to me how his child acquired US citizenship. Right now, it seems to me that his daughter was a foreign-born child of his spouse who he then adopted when she came to the US. By virtue of some legislation out there, his daughter was able to acquire US citizenship because he adopted her. In that case, she would have had an A# and a foreign birth certificate, which is obviously going to be confusing for the USCIS case adjudicator. Like I say, I want to get more info from Haole on this matter, but I would not accept his advice at face value. His interpretation of the I-751 instructions for Part 5 is based on his bad experience, and I don't agree with him that his interpretation is correct. My two kids are natural-born US citizens. They have US state birth certificates, and do not have an A#. I included those birth certificates with my petition, and listed their names under Part 5 of the I-751 with 'N/A' in the A# column for both of them. I think that was the correct thing to do because Part 5 says to list all your children, and the instructions give a reminder to include any conditional resident children who are applying with you to have their conditions removed. There is nothing which says to ONLY list conditional resident children. You have stated in your Time-line that you are in AP, yet you also have a fixed date of getting married? How do you know that the AP process will be over before this date? I don't. ...and if it's not then we will have 'some' reorganizing to do. If you have no past criminal issues, then you should be able to get your K1 with little problem, however if you have ever committed a CIMT (Crime Involving Moral Turpitude) in the past then you may have to go the I-601 route, as this is what most of the people that require I-601 waivers are on here for from my experience, well that and also getting slapped with a Mis-rep charge if they have traveled to the USA on the VWP without saying YES to the box that asks if you have ever committed a CIMT. The only 'criminal past' that i have (that i know of) is a speeding ticket and that (from what i can read) isn't a CIMT. I had my visa (K1) interview at the US Embassy, London recently. While at the ‘first window’ I was advised that there was 1 part of our documentation that they couldn’t find (I had everything in duplicate with me) which I submitted there and then. I later arrived at the ‘second window’ and was asked a few questions, had my passport and x-rays returned and told that ‘they had a few more checks to do on my case’ and I would hear ‘in about a week’. The week that I was advised of has now elapsed and I’ve not received any contact regarding my case. I had hoped to be with my fiancée next month… Given the current situation: Can I still travel to see her (a MAXIMUM of 3 weeks), and is it advisable? (as wouldn’t want to jeopardize my case or delay it further) If yes, then what effect (if any) would this have on our case? If your fiancée visa is pending, we would not recommend that you attempt to travel to the United States on the Visa Waiver Program. However, the decision about whether or not to admit you to the US on the VWP is made by the officers at the port of entry from the US Bureau of Customs and Border Protection. I mentioned earlier about ‘additional checks’ on my application, and the timescale of 1 week for a response. As this has now elapsed, how long should I expect to wait (based on an ‘average’ case)? If you were told at the time of your interview that additional administrative processing or review is needed on your case, it is impossible to give a timeline for this. Every case is different. I haven't had many of them - i'm only aware of receiving Polio a few years back when i changed doctors. I'm 27 and according to the table most aren't required for me, but my assumption is that most folks will have had the vaccine when they should have and therefore that's why they aren't required. Now, there's no point having to pay the Medical doctor in London for them if the NHS will give them to me for nothing. So... will i need to be 'filled full of holes' for all the jabs i've missed or will i just need the 'Td/Tdap' & 'MMR' ones that are applicable to me? The last month or so the 'losses' in exchange rate are equal to the sum of 'losses' of the 3 months previous. I just want to make sure i have time to get back to whatever airport in time for the flight. So take your 15:00 exit time, + 1hr to whatever airport, + 30 mins on the tube, + 1 hr before flight departure time... therefore an 18:00 flight would be too close for comfort. United Kingdom	POE Dublin	Your POE may not be Dublin. My fiance went through Dublin three weeks ago flying Continental to Newark, and he didn't pass immigration until arriving in Newark. It entirely depends on your airline and terminal, and apparently these have changed lately. Continental, for instance, used to do POE in Dublin and now they do not. Yeah, going direct to Orlando you don't (didn't - the last time i flew direct) go through pre-clearance, but i went via Boston (Logan) at the new year and went through customs in Dublin. Do your self a favor..... simply plan something to add to your day that they are not apart of....make it all you for you and your SO. For instance....try pulling the person off to the side who is marrying you and asking them to give you a moment of time in which you can speak your own special words to your SO during your vows. Or you can decide to have some special gift done for your wedding party. Don't allow your self to be left out. After all it is your day as well. Good luck! It's more the organization of it all i feel a little missing on, and really i'm not missing out on too much. I get the best part of the deal at the end of the day. HER!
