First and all, I don't know in which topic to ask this, so feel free to toss it around. Heh.

 

I think I'll have a problem and was wondering if anyone could help me out.

 

Since our K1 process really slowed down, way more than we expected, a problem will occur.

I am the beneficiary in Belgium, which means I live her alone and the Fiance is in MS.

My rent contract for my house expires on November 1st. If I want to stay here longer, i have to renew it for 1 year. (It's just how my landlord works)

I am afraid that I won't be able to move to MS by then, due to late paperwork.
So I guess my only option is to move back to my dad's place until further notice.

Which means that my address will be then different.

 

My question is, how does this affect the current paperwork (that is still at USCIS, waiting to be sent to NVC)?

Hey I'm new here and I'm sorry to ask that now but I thought maybe it's the right place for it now that you talk about it! How do you know how much is required to have?

Because I'm thinking right now if the tax papers are good enough for showing the support. My fiance just found a job this year in June, so she has no tax returns but we want to use her parents tax returns. She is living in a house with her daughter and her parents. So what would we need to have then?

I'm sorry but I really don't know where you got all the information how mayn money we need to prove them that it's good for us!

No, co-sponsor doesn't have to be related to your fiance(e), spouse.

As long as he/she is an USC or LPR and has enough income, he/she can be a co-sponsor.

 Do you happen to know an answer to my next question...

How does the sponsor need to count the household. He is married, so only him and his wife.

But a sponsor needs to be able to provide for both me and my fiance. (That's what the embassy told me)

So is his household 4 then?

Don't understand why you need 2 co sponsor?
If your fiancé's mom doesn't meet the requirement then you can't use her as co sponsor. I might be wrong about all these.

As long as the co- sponsor is USC then they are all eligible


 Because that's what I got told by the consulate.

I was wondering if a co-sponsor needs to be related to the fiance?

 

My fiance's mom is the co sponsor already, but I just heard that we need an extra sponsor.

The only other person in his family is his grandmother, but she is retired so can not be a sponsor due to no income.

 

But a co-worker from my fiance might be willing to be a sponsor.

Is that allowed, or can it only be family?

The co-sponsor needs to make enough for his household plus the immigrant.  The US citizen fiance of the foreign beneficiary doesn't count.  So in your case, assuming the co-sponsor has no kids, it should be a household of 3 (him, his wife and the immigrant).

Personally I would call and ask if you could supply the embassy with 2013 tax returns.. since I know the back story.. because we have talked.. ask for some time to gather that.. you said that it was a one time loss in 2012.. so if you can show current income that is more... then you should be able to come. Just a suggestion.. instead of some random Millionaire...

Hmm I could ask my mother in law to gather that. Not sure if she already has it done since she's been working an awefull lot lately.
But there's an update! John asked a co-worker, on Friday; if he could sponsor. He said he'd check the paperwork and will let John know when he comes into work for their show together on Monday evening. So it's been a loooong weekend, I hope to get a positive reply though since this guy is really the LAST hope. 

I'll update you about this when I know more.

Hi.

 

 2 ideas.. First of all, how much time do you have to find a cosponsor?

 

 Can't your husband just desperately look for a job now? If he finds one and can provide his first pay stub (and possibly a letter from a boss), that might be sufficient (Not sure if it will be, but it might, I would check with more experienced members here on the forums as to if that would be sufficient or not). He could take any job that's good enough.

 

On October 24th they told me that we need another sponsor.

They said we have until November 24th for that. 

Actually only until November 21st, because they are only open on Thursdays.

So yea, little under a month time.. 

And then the guy that was going to sponsor & now doesn't want to anymore, well he kept us hanging from October 25th until yesterday. So we already lost about a week. dry.png

 

But my fiance has a job. He works for radio since 2006, and has never steady hours. Sometimes he needs to be there an extra day, sometimes a show get cancelled and he loses a few hours, etc.

He has been checking for a second job, but it is hard because of no steady hours with the current one.

The visa will be denied if the primary sponsor's income / assets are not sufficient and you cannot find a co-sponsor. It should have no bearing on any future applications that you file (be that another K-1 or a spousal visa).

 

 Okay that makes me feel more relieved. It's good to know that we can start over without having to be worried about a possible red flag.

Your fiance does not have to "save up".  He needs to have a job with sufficient income for at least one tax year as far as I understand it. Now I could be wrong and maybe others will chime in on this.  He needs to have a job and report and file income taxes.  The he needs to provide proof of income and filing of taxes.  These same requirements apply for K-1 or CR-1.  Withdrawal or denial, I am not sure which one and do not imagine that it makes any difference.  I know of no way around this unless that millionaire shows up.  I wish you the best.  God Bless

I meant to type:

If we go for the spouse visa, then my fiance will first save up, even take on a second or a new job, until we have enough for a new affidavit. 

 

So as I said before, it could all work out for the future if we apply for a different/new visa.

 

I was just wondering what could be done with the current one.
But okay, you pretty much answered that too. :thumbs:

 

I'm just concered that a denial will cause issues for the new application..

Same problem with spouse visa.  You have to prove that you can support her or have a co-sponsor.  As far as I know there is no way around that.  But then again would it be wise to bring him/her here if you cannot afford to eat and have a roof over your heads?  They will most likely ask for a co-sponsor.  If you cannot provide that the case will just be denied and/or closed.  I suppose when they ask for a sponsor you should then inform them that you do not have one.  Good luck.

The thing is that my fiance isn't rich, but he lives comfortable.

But his house was destroyed in hurriance Isaac in 2012, which caused him having to take off a lot of days from work so he could rebuild.

So he did not make enough money this year.

Had we filed a year earlier, then all would've been fine. But no one could've predicted that hurriance disaster.

So his mom wanted to co-sponsor, but same problem.

 

Nonetheless I did go to the interview and explained everything, with supporting documents. And also with assets, like 2 savings accounts, a house without mortage, etc etc.

But the embassy decided that this was not enough and that we need another sponsor.

 

After asking around for a long time (my fiance has only his mother, his retired grandma and few close friends due to distance).
Then we did find someone, all was set but last minute he decided not to do it. That's the problem.

 

So now we don't know what to do, since we tried everything so far and still can't find anyone.. because there isn't anyone left. Unless some millionaire drops out of the sky and decides to do it. Lol.

 

If we go for the spouse visa, then my fiance will first save up until we have enough for a new affidavit. So this is not an issue for the future.
I'm talking about now, just making that clear.

 

So when I inform the embassy, as you said, do they just withdraw the petion or does that count as a denial?

If it does get denied.. will that raise any red flags or cause issues, if we decide to marry & apply for a spouse visa?

Oh yes, I've noticed that a lot got transfered, while our case is just stuck there. As you indeed saw inmy signature, we've been having trouble with it for sure.

It's just really frustrating to see others that applied later than us either been transfered or approved.
So that's why I asked.

Anyway, did not try getting in contact with anyone besides USCIS. I actually have no clue how to do that, where or what it would cost.
Any help would be appreciated.

I have been checking Igor's list for quite a while now to check how others are doing.
To be specific, I only look at K1 in Vermont, approved petitions.

 

I have noticed that there are less frequent updates, less approvals compared to a while ago.

 

Does that mean that Vermont is slowing down, or that people don't update their timelines, or ...?

 

 

I'm just wondering, what are y'all thinking it could be?

 

 

 

Note: I do know that not everyone with a K1 in Vermont is a member of VJ of course.

Well watever is happening in embassy DOS knows about that they got all ur record each nd everything coz they are interconnected with DOS all the US embassies in world. . Don't tell them anything just ask them wats going on with your case and see wat they tell u

I would really like my questions to be answered because I am going bonkers here. cray5ol.gif

 

My interview for K1 was on October 10th. It was really short and all the lady looked at was the I-134 (affidavit of support) & the co-sponsors documents.

Then she gave me a 221g form and checked the 'other' box and wrote 'under review - income' and said they'd contact me in the beginning of next week, if not I have to email; and then she told me to leave 'because she had to go to a meeting in 8 minutes'.

 

Afterwards I checked the 221g and discovered that it was not for K1 but for a student visa.

So I emailed the embassy straight away to say this, and also asked if I needed a different form or if it didn't matter since nothing was checked besides 'other'.
I never had a reply.

 

I also checked my status online, which has been on 'ready' since September 19th. And I saw it was updated on October 10th. But it remained on ready. I have been checked the status ever since and it got updated again on October 11th, October 14th and October 15th. It is still on 'ready'.

What does this mean? Are they working on it? If so, why doesn't it change? If my case is 'under review', then why don't they put that on there? What is going on?

 

I emailed the embassy again on October 15th, stating that I had to contact them etc etc interview etc, basically the same what I sent before. Plus asked what my next steps are, if they needed more documents or something.

Still no reply.

 

I called them today, wanting to ask a few questions. I never had the chance. After I said "I'm calling regarding my visa and..", the lady said "Call back." I was baffled and asked why because I was talking to her right now. She said "Call back." again. I asked her why, because the embassy is open from Monday to Friday 8am until 5pm and it was 1pm when I called. Again she said "Call back tomorrow or something." and she hung up.

What is that supposed to mean?

 

And on another note as far as I know an 221g is a 'checklist' with requests for more evidence/which  papers you need to bring in & how much time you have for that. Right?

But what do I do when there is nothing checked at all?

 

What is going on? Does anyone know?

I'm just being kept in the dark without any reason or how I can fix anything.
