K-1 Fiance(e) Visa Case Filing and Progress ReportsK-1 Visa was denied today

We met June 30th 2012 through his cousin

This is likely your red flag, besides that you're older than him.

K-1 Fiance(e) Visa Case Filing and Progress ReportsUS AND NIGERIAN FIANCEE

If I understood your post, he has family in the US? that can be a red flag. Can you visit him again? You're going through the toughest consulate, you need to have TONS of GOOD evidence. Also get joint sponsor, arrange this now, since people might be reluctant to volunteer for that

K-1 Fiance(e) Visa Case Filing and Progress ReportsCasablanca, You made a big mistake! :'( (merged)

First of all I'm sorry you're going through this.

Second, can you get married (perhaps in a third country even) and apply for a CR1?

Middle East and North AfricaTired woman here!

You don't really love him; you love what you want him to be.

I'm not part of this regional forum but ^^ that's genius.

You need to leave him and never look back.

He's taking advantage of you.

Don't let him. There's someone out there for you who will respect you, care for you, treat you and your daughter like you deserve. If he's like this now, he won't be a good dad either...

So kick him to the curb!

They can totally deny you twice for the same reasons, if you didn't fix those previous reasnos.

Middle East and North Africaneed help pls- visa CR1
YOU NEED TO BRING EVIDENCE. Sorry for the caps, but just can't state this enough. Casablanca is a difficult consulate, so this applies even more so to you.

Pictures, boarding passes of trips taken to visit each other, joint bank accounts/bills, proof of children had together, affidavits from friends/family members, etc

Sounds like a typical interview at a high fraud consulate. I wouldn't worry too much (I know easier said than done).

AP can be as long as even a year ore more. Why do you want to cancel it? If it's that you want to re-file, it won't work, you'll just be starting over.

Middle East and North AfricaK1 Visa with a substantial age difference

OHHHHHHHHHHHHHHHHHHH I am so sick of this double standard with immigration and even what I see here on VJ. If you are a man who is 15 or 20 yrs older than your sweet little oriental or russian bride, guess what?!! NO RED FLAGS!!! Heaven forbid your a a woman with a younger man.

Jen, I am sorry for all the joking and ridicule you have experienced. I say "go for it and more power to you!!". Who cares what people think. what matters is your happy!

Thanks to a few bad apples and given the fact it is the Middle East automatically most cases are put on AP. Even with the CO's in Jordan there seems to be a double standard. If you get a female CO they are more respectful while the one male CO will probably rake you over the coals and ask every question under the sun and all out short of saying "FRAUD" so I am sorry be prepared for anything and everything.

It won't hurt to be there for the interview so if you can try and be there. insha'Allah everything will workout!

You're missing the point. Since it's not common in MENA countries, it's viewed as a red flag.
AmyWritesFemaleRussia2012-09-10 09:54:00
Middle East and North AfricaK1 Visa with a substantial age difference
You have enough red flags to make this very difficult and nearly guaranteed AP.

Also, I know you'll absolutely ignore this, but the reasons the age differences, the fact that he has family in the US, that he seemingly doesn't care you have kids his age, etc, are red flags is because women like yourself are prime targets from green card scammers from certain areas around the world. It's very common for people to bring others over on a K-1 visa only to find out they "changed" and either don't love the person anymore, if not just flat out disappear once they enter the US and establish their contacts. I'd recommend you read through this forum, the "Effects of Family Changes on Immigration" one (that's the one full of "He left me now what?!" stories), and also, the "Waivers (I-601 and I-212) and Administrative Processes (221g)" one, since you're very likely to face AP.

I'm the USC, but I've calculated it... my SO and I are almost guaranteed to have a better life in Moscow, at least for now. I don't know where both countries are headed, but America offers me less opportunities than Moscow right now.

I'd give it a try if I were you, but always have enough money in case you want to head back to the UK with your wife...

Supply the stamps on the passports and if he ordered the tickets through a website maybe you or him got an email confirming the purchase?

Any siblings you have that can provide letters supporting the relationship? close friends? Maybe you can add him or he can add you to each other's bank accounts with a copy of your passport + notarized letter?

Pictures of the rings?

I find it strange you got this RFE so late. Do you have anything that might be considered a red flag? Any previous petitions? Divorces? Etc?

CO's are aggressive and many times even rude just because it's their job to weed out fraud.

Get a co-sponsor and this will end.

IR-1 / CR-1 Spouse Visa Process & ProceduresRE: How is this happening

Sorry if you took offense to what I wrote.. I understand that sometimes there are very good reasons to expedite a case and for medical reasons especially, I completely understand that...

it is cases like this:
http://www.visajourn...pic/369418-yay/

That frustrate me... meeting and getting married in 3 months... getting NOA2 in 10 days... this person obviously knew they planned long term to live in the US. they didn't make a life abroad and suddenly have to return to the US.. they were abroad and filed.

Again, I wasn't trying to offend anyone, I'm just saying... I feel like the goverment and USCIS should "have a heart" and get separated couples together in a more timely fashion :(
Not that I wish long waits or ill-will on anyone filing, but it seems to me that this waiting game would be A LOT easier if I was already with my husband :(

Not offended at all, just trying to maybe think of another reason why cases abroad take less time.
AmyWritesFemaleRussia2012-05-24 10:13:00
IR-1 / CR-1 Spouse Visa Process & ProceduresRE: How is this happening

I guess what doesn't make any sense to me is.....
Why do the people who are already with their loved ones get priority over the ones who cannot be together until the process is complete?

This doesn't seem right or fair in my opinion. I'd be happy to wait 5-6 months for NOA2 if I was able to be with my husband every day in England until we were done.
It seems to me that they have things backwards.... the people who are married and in love and then have to wait months and months to see eachother should be the ones that are "fast tracked" not the ones who are already able to spend their time together.

It's hard adjusting to "married life" especially when even 4 months later I'm still being told "congrats" and "where is your husband?" "when is he coming here? "do you miss him?" "when will you see him again?"
It's heart breaking to have people asking me these things all the time.... Of course I MISS HIM! And it kills me to have to explain over and over that we have NO IDEA... not even a decent estimate of when he will be here or when we will next see eachother, etc.

Why don't the people going through that pain every day get "priority"???

Maybe just my opinion....

Besides what Musashii said, also, people living abroad who suddenly file for their spouses, it means they need to return to the US quickly. You don't make a life abroad and then decide, hey I'm bored let's go back to the States. In my case I had to run and file because I have a medical condition that I can get better treatment for in the US.

Expedited or DCF. Worse thing you can do is start comparing timelines.... I got my I-130 approved much longer than most DCFers in my country, it just stressed me out more.

It was a red flag for me (we got married quickly and filed the I-130 after a month of being married, but didn't meet on a dating site), but I agree that the fact that you've been living with her is a great thing. Just bring maybe more evidence, affidavits, etc.

IR-1 / CR-1 Spouse Visa Process & ProceduresExpedite for Pregnancy in Pakistan?
I have severe endometriosis too and I didn't have organs cut from my body and they absolutely did not care about my reason to expedite... personally getting for organs cut sounds a tad far fetched, and more importantly, you don't even HAVE it yet. But again, even if you did have severe endometriosis like I do, they won't care, my embassy was easier and they said "We have a schedule, no expedite, etc..."

IMO, endometriosis sucks, but it's not a good enough reason.

IR-1 / CR-1 Spouse Visa Process & Proceduresneed advise on how to proceed

Actually in many tribes the child "belongs" to the father ( and the wife in old times ) The issue being that a first born son by traditional ways inherts everything of the father and the mother of that child hold a position of power no matter where she stands in the marriage order. She may not be first at the present but her child will be in the future. My father in law had 3 wives and the stories could put a soap opera to shame. Depending on how involved with Nigeria the OP's husband plans on being will have a huge effect on the headaches ahead. I know some that have come and never returned. ( Rare) and others that travel back for the holidays and other times ( more typical) Most Nigerians are very connected to family and blended families are never without their bumps

That's real interesting, but, maybe the CO won't know this. When my husband and I were interviewed, he literally knew nothing about Russian culture. If that's the case it'll just scream "huge red flag".

Hmmm, guy from one a country with likely the worst consulate on Earth makes another woman pregnant, she magically doesn't want the child, AND now daddy wants to petition kid?

Here's what it looks like: he wants to get to the US, leave you, petition for her.

You're a wonderful woman for ever forgiving this.

I don't see how this case will ever be approved. Even if this is not his intention, this is Lagos and you will be put through hell with this. Be prepared to pay your life away to a lawyer.

Your story is similar to many other couples' stories. You're not any more special. It's already a relatively unfair advantage that Canadians don't need a tourist visa to visit the US, so she could visit throughout the process pretty often if she wanted to. People who married Africans, Asians, etc, have to wait it out. You're lucky. Don't keep pushing it.
