Oh, and one more thing.  I did not go to the Philippines to marry a younger woman.  I went to the Philippines to meet in person the girl I fell in live with on-line.  Yes, she's 36 years younger than me but we are so in love and are now together in the US.  I am living the dream, married to a beautiful Filipina that is so beautiful inside that she glows.

Folks, if you could deny visas based on ugliness, then pretty much all visa applicants from RUB countries, Thailand, Philipines; ie. anywhere American men go to marry younger women, would be denied.

Whatever the case is, you need to do two things;

- follow Darnell's advice

- talk to her, get every. single. detail. about the interview

- gather, re-gather as much evidence of your relationship as possible, in case of a second interview or a NOIR.

Google translate is usually ok, but for this it failed. I find it highly odd she just barely talks about the interview, seems like it's  no big deal. I would think that, failing the visa interview, meaning that she can't live with you for a long time, would merit a much bigger response than a few sentences.

Thank you everyone for your input, your respectfulness and your maturity. I had no idea this would be such a mess :-( Since when, as an American does someone else get to make life decisions for me? It's sad to learn. If I believe his heart and intentions to be genuine, who is someone else to have the right to question it? It simply seems very wrong :-( I'm not referring to you guys or even looking for a response for my short rant. Just expressing. It makes no sense that they won't even allow him to come here with the understanding that if we decided (for some strange reason) not to marry then he'd simply go back. It's very difficult to have that requirement waived. I doubt you will, he can meet you in a closer third country, and YOU are healthy, and friend is in a nursing facility.

 

But even if you did overcome it...

 

He's from Ghana. High fraud embassy. Without meeting, him being so much younger than you, it screams visa fraud and will be denied a visa.

I think that's the safest approach, yes. I can't think of another scenario that doesn't sound fishy as heck.

 

If he explains it to a CO, he might get a pissed off/suspicious one and get denied or worse.

OP, at this point I don't think you need a lawyer. Most people here did this all by themselves.

 

I would, if I were you, withdraw the app and re-file for a CR1. You can wait for the interview and try to explain it, but I don't recommend that since;
a. consular officers usually have already decided before the interview

b. a more suspicious consular officer might think you're doing something fishy, slap you with misrepresentation or AP or something.

Have you talked to a lawyer about this? Some give free consultations and they might be able to provide you with some answers as opposed to VJ people's opinions. There might be lawyers who specialize in these types of cases and can give you professional guidance.

Not necessary for now, could be worse if the lawyer isn't aware of the particularities of this post. And even if he was put in AP and such, lawyers can't do much about that. I think, better save that money for another trip together or something.

I know AP means administrative processing, but what does that mean? What do they do?

This is not meant toward anyone, it is my frustration, but people all over the world leave their spouses for other people everyday. After 20 years of marriage, my uncle left my aunt for another woman, whom he married. It happens. This "it automatically means he only wants a Visa" stuff is crazy.





 

AP is essentially them researching this person more. Could take a few weeks, few months, a year.

 

I really, really recommend you head over to the MENA forum, to talk to other people who are also dealing with the same consulate.

To mimolicious and Ihavequestions, and BeccaBecca, and others, thank you for your responses. I know my relationship. I know what happens sometimes with fraud. Whether Muslim men can marry three wives or four wives in Egypt is really not relevant here. I thank you all for pointing that out to me, and I appreciate your knowledge, but I'm seeking advice on how to overcome the red flags. I am aware of the red flags, which was the point of the post in the first place. No one has actually given me any advice solid about what to do about it and how he can prepare for the interview.

 

Evidence of talking a lot, meeting in person, spending time with each other's family. So, Skype logs, boarding passes, photos, maybe FB/email logs.  IMO, I think even with this, with him being from Egypt and leaving his wife to be with you (looks a lot like he just wants to move stateside), you'll go through AP anyway.

IMO a red flag here is you don't seem to know much about his culture.... and yes, he leaving kids, his wife, etc, will be red flags. Get a lot of evidence to overcome it.

Its not her residency she had to do it was just an observership which is working in a hospital and observing what the doctor shes shadowing does. She couldnt get it done here so she had it done in Pakistan. Now when she comes it would be her residency she needs to do after taking her licencing exams which takes up to a year to study for and pass. 
And about this 'since you are capable of working and school you are capable to visit her'... with all due respect, till u guys live my life and see how i manage my condition since birth, u cannot assume its simple to pick things up and go because im capable of working and schooling. I dont go to school in canada and work in mexico... I work at home and take classes on a campus about 15 minutes away, and try to do online classes when I can. Just because people dont see me as walking death, doesnt mean I am not suffering through issues. Also since i grew up with the issue its not like I am not used to how the condition affects me or how to live with it. A person doesnt go through life wanting to be different then their peers, and knowing i had this condition, I did the best i could to assimilate w/ society considering my issues to where it looks like im perfectly ok. No one knows what I go through the other 12 hours of the day during dialysis besides my close family members and Amna

 

I have a chronic condition as well that is horrible. In fact it came up during hubby's interview process.

 

You're not getting that it's not us who don't sympathize, it's that USCIS/CO's are trained to essentially not sympathize, and doubt that the relationship is valid. That's their job, and with your girl being from Pakistan, it's even more difficult. Thus, it's your job to make sure there's no space for them to plant any doubt about your relationship. Because all the questions that you've been asked here, a CO will ask your partner, only that they have the power to make your life hell.

 

So, essentially, prove that you can't even go to Canada/Mexico/etc, that she's been denied a tourist visa (more than once), that you are incapable of leaving your area for more than a few hours. Above that, you need to prove the relationship itself is real.

 

And yeah, make sure you can actually marry your cousin in Florida.

Go to Canada. Have her take a course at a local university. You haven't exhausted all options. If you want the waiver approved, then, you need to show that you have.

 

Meeting is a requirement for the K-1.

 

Even if you get this waiver approved (which, seeing now that you can work and study, I don't see it happening, it's not as bad as everyone here thought it was), you're going through a very difficult consulate.

OK ... So, change of Tactic ... I am going to Pursue ... CR-1 Route.

 

So, now I have to scour the VJ pages to see what is needed for me to do BEFORE I fly to Moscow and get married ...

 

1) Like, what will I need to do or take with me so my Marriage over there is all LEGAL and Validated.

 

2) What I need to Brign Back with me from there ... while I am in Moscow with Her and Her Family ... Parents and all.

Read the guides, it'll tell you what docs you need from her.

 

I'd say, at this point, gather evidence. Chat logs, phone call logs, pics of you together, vacations you've taken together, etc. Document everything. If you have a joint bank account, by all means inslude some evidence of that too.

 

To get married in Russia, you need 30 days and your passport.

Read in your other post you haven't seen her in more than two years. I'd fix that first, and then think about filing. You're not eligible for the K1 otherwise, and you'll have a hard time proving a bonafide marriage if you haven't seen her in so long.

The complexity of racial/ethnic things is always lost on Americans who think they have "race issues".  We also think OUR government is corrupt.

 

Hitler killed 22 milion "slavs" because they were "less than human" while they seem to be a much more refined version of any example of "white" or "caucasion" race than anything referred to as "Aryan" yet they, themselves, do not want to be called "causcasion" because to them it means "from the caucasus" region which most of them are not.  They also consider Jewsih people as a race, not a religion, and even have various degrees of Jewish races.  "Black Jewish" or "Red Jewish" for example. Dare we even mention "Gypsies" ?  

 

It is interesting actually.  In Odessa there is a great Anthropological Museum if anyone ever gets the chance to see it.

 

I have trouble keeping up myself.  In the USA Alla refers to herself as "Ukrainian" but in Ukraine she would say she is "Russian".  Not sure where the change occurs, probably somwhere over Greenland during the flight from JFK.

 

I like the Eastern European way better. I'm Hispanic, and Caucasian Americans (hah) think that it's a race... it was simpler when I lived in Russia to explain these things to them, because they don't have the force-fed PC thing to worry about.
