He overstayed, which means he'll probably need a waiver, which means this is not a DIY case and you should get a lawyer. Also, if he was working by pretending to be a US citizen, you're in deeper problems. This isn't going to be easy.

I don't think it will matter, but, American healthcare is stupidly expensive, so as a person with a chronic condition too... I'd rather get healthcare abroad. Or make sure you'll have great insurance in the US.

I really hate the K1 visa for many reasons, this is one of them. It's not a test drive. Don't make it slower by everyone else by applying for a fiance visa if you're not even sure you'll get married. Also, you got it because you said you'd get married!

He's merely pointing out that it's a gigantic red flag in some consulates if the USC is a much older woman, as unfair as that is.

First off, did you even read the instuctions to the I-129F petition? It clearly states that one of the requirements is that you must have met (physically) at least once within the past 2 years. You should never have filed in the first place. They didn't even look at any evidence you sent them once they saw that you had never met. I can't imagine what kind of proof you sent in for somebody you've never met. Most of us who met our fiancees usually has sme worries about having enough proof, but never meeting?

Nigeria is one of the top fraud countries. I assume you are now aware of this fact and you would still attempt to bring over a person who you have never met? I know you believe all that "God knows best" stuff, but you are setting yourself up big time. You seem to be a perfect mark; somebody who seems to be somewhat naive and blindly accepts whatever happens. If this guy plays you, you will probably be here telling us how it was God's plan.

How did you meet? Who made the first contact?
What kind of work does he do? Have you seen any proof? (I will not give my opinion on what I think he does for a living; yes, it's a generalization, but lets be real)
What is the age difference between you two? Are you fairly close in age or is he much younger? If the latter, that should be a red flag for you.

I already know that nothing anybody here says will change your mind (most people have to learn the hard way), especially since you think God will protect you, but I hope you are not back here in a year teling us how you were used.


Yep, this thread reminds me of the one made by the 19 year old who wanted to move to South Africa or Nigeria alone with a guy she'd never met.

If I'm wrong, you're in for perhaps the most difficult US consulate to interview in the world, and this will likely be a very difficult process for you. You need to extensively prepare.

I'm sorry, but Gowon is right. You will face huge scrutiny and he will most likely be put in AP which can take anywhere from a few months to a year and in some horrible cases more. Everyone here who says "it won't matter" is from low-fraud consulates, that's not your case.

I don't think relationship time matters. What DOES matter is your consulate. An easier consulate means you can get away with shorter periods of time together, a difficult consulate means they'll question you that much more. From what TBoneX said, it's not an easy one, so I'd prepare extensively if I were you. But yes, you CAN, and should, given the actual interview date will be months away, file now.

Thank you everyone for the input ans advice. I should have clarified some things in my original post. I have visited Syria many times before but not in the past two years. I know her well and she knows me well, people in Syria always tell us we make a good couple. I talk to her regularly on Facebook, she is very flirty and expecting me to propose. This is not an arranged marriage. My original plan was to wait until she was 18 and I was done medcial school before I propose. I have dated many girls in high school and I know they are emotionally fragile, that is why I never spoke to her about relationships or marriage, in case things don't work out, I don't want her to get hurt. As the situation in Syria keeps getting worst, I though Why wait, let me ask her ( I know she is waiting to hear it) and bring her here. She has been out of school for a year, living in an apartment with three other families, not the situation I want my sweetheart to be in. The most important thing to me is not to mention "marrige" to her If it's not possible to bring her, her emotions will be crushed.

I think I will continue to talk to her and see if the situation in Syria cools down a bit so that I can go see her. On the K1 form it stays they can give an exception to the 2 year visit thing, if the US citizen traveling to see her will cause him extrem hardship, and the US embassy is advising Americans to stay out of Syria bc of kidnapping dangers.

Yeah, sure, have the unofficial wedding, then get your visa denied on their grounds, and have to be a long distance relationship for another year or so.

Call your venues and ask if you can put a deposit now but that you'll find out the date later on. Once you get to the pre-interview stage, assuming your fiance doesnt go through AP, you'll have a better idea on your timeline.

Best thing to do is to wait to have the visa in hand.

Be prepared to be questioned about it once the interview comes. I had a previous K-1 (from years ago) and they questioned me more on that than they ever questioned my foreign spouse. I think it'll look more suspicious for you given it's both K-1 petitions and within a short amount of time.

I'd do the I-130. They get denied less often, and even if he legally resides in Spain, I've heard stories here of guys from MENA countries put into AP/denied even if they're legally in Europe; just the MENA background is "bad" enough, sadly.

You can't DCF in Spain, so that's a no go... and even if you could, I had a HORRIBLE DCF interview in Moscow, one of the reasons being that I am young (not as young as you, but young enough). I don't see how 18 year old married to a guy from a high fraud country would go any better.

If I were you, I would get married, establish a life together, gather up the evidence, THEN file a CR1. I don't see how your case would be approved in Casa.

Yeah, but if she said something like that in the interview, it screams fraud. I at least got a CO (for the first interview) who was very, very unaware of a lot of aspects of my husband's culture. Maybe that's what happened to OP.

I've seen people say all sorts - it'll vary by how busy the POE is when you get there and how many other people are also needing secondary.  Some have said they've done it in half an hour, others nearer 3!

 

What'll happen is you should ask when you go in which queue you should join - they'll probably direct you to the USC/LPR line.  Some POEs have a special line just for "new immigrants" (I know I've seen one - I think JFK has one, but it may not always be open), so you might get seen immediately.  You'll go to a separate screening, so they can open your packet and input your data and whatnot.  Nothing scary, just processing! In itself, that bit shouldn't take more than 30 minutes.

 

I think a 4 hour layover should be sufficient.  Don't do less than 3 hours, imho.  Better to sit about bored for a while in an airport if you're through fast than worry about making a connection.

 

No they won't, I went through POE in JFK in August, LPRs had to go into the non-USC line. Still took us under an hour though.

Well, i figured out the BS factor and now I am pissed. I actually lived with her and everything was fine. The last few weeks I have been fed a bunch of lies. When I confront her saying I know she lied about something and I just ask her to tell the truth. It is all I want. The embassy in Kiev contacted me and said she never even scheduled an interview. I did get her on the phone today and I will speak to her in a few minutes on Skype. She does not know I know the truth. This will be interesting.

Good news is that you didn't bring her to the US with you (which, as much as this sounds horrible right now, had she come to the US, things would have gotten much, much worse for you), and her lie was so stupid, I'd go to one of the many website that list these scammers and put her up there, pic and all.
