IR-1 / CR-1 Spouse Visa Process & ProceduresCompletely Lost and Heartbroken
I'm in the very beginning stages of the CR-1 (have yet to send it out due to some complications). I was denied at a US POE in February. Since then, my husband and I decided that until I have a visa in hand, I will stay in Canada and he will visit me. We had a VERY difficult time with customs when I was denied, and I want to avoid them as much as possible.

In the past 2 years, he has come to visit 4 times w/out any problems. He was supposed to arrive today for another visit, when the US border guard denied him due to his criminal history. He committed 4 felonies when he was a teenager, which was over 10 years ago.

Let me say that he made some major mistakes when he was a teenager, but he is such a different person now. Despite my immigration problems, he has NEVER had an issue crossing the border into Canada until now. The border guard insisted that I could go down to visit, but he knows nothing about our situation. I firmly believe that trying to enter the US again will most likely damage my situation further.

Now my husband is at a hotel in Burlington, just 2 hours south of here, and I can't even see him. I feel like everything is working against us and I'm so broken down and tired. I love him more than anything and won't give up until we have the visa in hand...but has anyone experienced this before? Apparently there's a waiver for criminal inadmissibility, but I don't even think he's eligible to apply, based on the number of years that has passed! I could be wrong. I would just appreciate some insight based on past experience...this is excruciating. I just don't understand WHY the border guard denied him entry, when the past 4 times the other guards saw NO problem (the last time just being 2 months ago!!)

I need some good advice..

I was denied entry from the border twice at the beginning of the month due to my own sheer stupidity - my hubby tried to drive me back to the US with him and we truly didn't know that I couldn't move there and THEN apply for a visa. Stupid, I realize that now, but I don't like to dwell on that.

Our "fake" wedding for the family is at the end of March; the first border told us that I couldn't move down, but if I wanted to visit, I could. They said they would turn me around, but that I could try another border. We tried another border and got rejected..again.

We will be applying for a K-3 or CR-1 shortly, but we had already made arrangements for our wedding - people had booked flights and booked time off of work, so I desperately want to keep the date. If I go as a visitor and bring as much documentation possible, what are my chances? I think my biggest disadvantage is that I've been turned around twice.

Also, when I get questioned, should I tell them that I'm going to visit my husband, or just say my fiance, since I'm going there for the wedding anyway?? I feel like saying "husband" over "fiance" will make them even MORE suspicous..

The documents I will bring are:
- letter from an employer w/most recent pay stub
- letter from the bank confirming my active account w/most recent bank statement
- most recent phone bill
- return ticket
- letter from parents stating that I live at home and that my personal goods are still there
- receipts from booking hotel rooms for our guests, receipt for our reception venue, honeymoon itinerary

As previously mentioned, we haven't applied for a visa yet - should I wait until I get back to do so, or apply now and potentially not even have documentation to show them?

My parents will be driving down to the States for the wedding and will have the dress with them - will that be a problem for them? I will be flying solo for two reasons: 1) I want to get there a few days earlier to help him clean for our company and make any last minute wedding arrangements, and 2) we secretly eloped last year, and if I was questioned by customs with my family around, they might find out that we're married sad.gif

It's a really complicated situation...not due to bad intentions on our part, but more due to impulsive emotional decisions and straight out carelessness overtaking logic and common sense. I'm trying to rectify this situation and am becoming more and more agitated - any words of advice??? sad.gif

I'm not looking for judgement, just support - you all seem to be so great to each other and I could really use that right now...

The people who met on WoW I am a bit concerned for. WoW was blatantly not made for making marriages lol but it is a payment in exchange for contact with other people run by a business. Albeit a business that is making games and entertainment not bloomin' international marriages!


One thing though. We are paying to play a game, but there is no personnal information given anywhere to attract anyone.

There is absolutely no informations in WOW, they dont refer anybody. Its up to you if you want to give info or not and there is nothing that tells you that "there is the description of this person, send him a a message if you are interested".

Ill try to ask about that before sending my K-1.


Was about to say the same thing.

We met in Everquest but we were just chating, not flirting/dating. Only lasted a couple of days as she quited the game soon after(she had logged back after a month or two to check if her friends were still playing before permanently quiting). That's where we started to chat via emails, yahoo messenger and finally MSN messenger.

MMORPGs (the popular ones I know) offers an intertainement service where you pay a monthly fee to be able to play. This payment is needed because the game is always updated. They add new content, etc. Servers need to be maintained.

If you meet someone while playing an online game, it's the same thing as if you met someone while on a vacation in real life.

Anyway, I hope those RFE won't take too long. California's Center was about 2-3 months behind. They are now over 5 months behind! :angry:

If the parent joint sponsor's income qualifies, then it's much simpler to file two I-864's than take the household member route anyway. You cad do this regardless of whether they are part of the same household. The I-864a is intended for people in the same household to combine their incomes and/or assets to qualify when no individual qualifies on their own.

I would say no, he would fill out the I-864. His permanent address is not the same. He lives in Conneticut. That is just my opinion though - without researching what they might consider technically as the "principal residence".

Unless your FIL claimed your Husband as a dependant.

No my father-in-law didn't claim my husband as a dependent... I think we'd ask him to fill out a separate I-864 as a joint-sponsor.

Although my husband's current residence is in Connecticut, he's moving back to Illinois for the summer (July & August) to save rent. So I think it makes more sense for us to use his parent's address in Illinois as permanent address. The thing is we do plan on living in Connecticut once I receive the proper VISA, hopefully by the end of the year. I hope this switching-the-address-back-and-forth thing won't cause too much trouble during the immigration process...

We're preparing the documents for the NVC stage and are confused about whether using I-864 or I-864A.

My husband is the petitioner hence the principal sponsor. His dad will be the co/joint-sponsor. From what I understood by reading the posts here and the instruction on I-864,
I-864a is for someone who lives with the principle sponsor to fill out, whereas
I-864 is for someone who does not live with the principle sponsor.

My husband lives in Connecticut because he goes to school there. But his permanent address is still in Illinois, where his parents live, and he filed his federal tax return under the same address as his parents.

So technically his dad doesn't live with him, but on the tax return he and my husband are under the same address. Does that make him a household member of my husband?

Thanks for the advice...The RCMP station in Westmount, does it right there on the spot. No waiting. I think that is another good option. I did mine there a couple of years back for another reason.

I am also doing the CR-1....just wondering, but when do you have to send the police report? Or do you bring it to the interview. I am at a later stage than you (according to your timeline) but I have not gotten this yet.

According the the RCMP website, http://www.rcmp-grc..../detach-eng.htm, the Montreal headquarters do not offer Police Certificates or Fingerprinting services anymore. That's why I had to go to a third agent to have it done... :blink: Lucky for those who could do it at their local police station for free!

Like OBX said, you'll need to submit the Police Certificate at the NVC stage, with DS-230. The certificate is valid for a year, from what I've read at the USCIS website.

They charge 40$ (only cash accepted) for the Police Certificate based on name search. You will need to provide two pieces of ID.

I was there this morning and the whole process took about 10 minutes. They called me about 2 hours later to let me know they received the result and it's ready to be picked up. (They don't mail it to you.)

The only thing I'd suggest is to show up early in the morning so you could avoid the wait. Their office hour is Monday-Friday, 8am to 3:30pm (lunch break from 12 to 1). I was there last Friday afternoon and waited 2 hours for nothing because there were 4 clients before me and there was only 1 lady working. :(

This is asking for an address that the person filling out the form may have lived outside of the US for a year or more. For example, if I lived in Brazil for 1 1/2 years at any point in my life.

There is already a portion for you to fill out your residence for the last 5 years.


I filled out that part as well, but my fiancé was saying that I need to fill that one bit out as well. I wouldn't think so, since I've lived outside the US my entire life, but he seems to think so.

Is there penalty for putting in the last place I lived for over a year if it is not necessary?

Hi there,

We're in the midst of getting our I-129F package ready for mailing next week, but there's one uncertainty:

The G-325A form asks for "Applicant's last address outside the United States of more than 1 year.". Do I, as the beneficiary have to fill that part out?

Also, does this mean the last place I lived in for over a year? For example I've been where I currently live for six months this month. I was at the last place for three years. Do I put the last place, or the current place despite having been there for six months?

Any help/tips would be appreciated!

At 12:28PM today I sent out our I-129F package via Purolator. It will be there, at the Texas processing center, tomorrow morning by 10:30AM!

It's been stressful, and I hope we didn't miss anything along the way. I'm hoping it will go by quickly and smoothly- keeping fingers crossed and optimism high! :)

Don't sign up for interview yet, but it will tell you when the next available interview is. :) And this is also where you will sign up for your interview and your courier services so you can get your passport back after approval. :) You're on the home stretch now! Its all going to go smoothly. Not much of a wait. Start preparing for the big move, wedding...etc. Keep your mind occupied.



You can always check back for cancellations. If theres one, snatch up the slot! The thing with Montreal, is the time of day doesn't matter as much as the day itself. Its on a first come first serve basis. So you still end up getting there at like 6:30AM and getting in even if your appt isn't scheduled until 2PM.

I check the interview dates regularly to see what the dates are like, I just want to know when I will be getting my interview date, as in when will I be getting the letter that says what day my interview date is!

So the I can keep looking for openings, but with reason, haha!

And who knows, maybe we'll have our interview on the same day!

Montreal is running about 68 days between sending you Packet 4 and interviews. So you've got a little bit. :) But thats plenty of time to get your medical done and get all the paperwork together that you might need for the interview. We are sending in Packet 3 this weekend. I checked and right now, the next interview from today is 68 days away. So good luck.

At the point of our process where we have our interview date, I entered the US for a six week vacation with my fiancé. I should mention the fact that this would be the thurd time I am in Colorado this year, the second time being in August. This time was end of September, so they had reason to be questioning our intentions. Here's how it all went down:

We got to the airport, checked in, checked our suitcases. Once we were going through customs, they asked the standard question, took my ID and fingerprints and we got taken to and held in the customs room.

After waiting 10-15 minutes, we were seen by a customs agent who took me [the Canadian] to the back and went through my purse, phone [incl. e-mail, text messages, etc.], and asked me a ton of questions.

  • Why are you going into the US for so long?
"Visiting family and friends, leisure."

  • Why do you have so much baggage?
[I had two suitcases checked, one large, one medium and two carry ons- my laptop bag, and my purse. I would think that's a normal amount for a six week trip, but meh.]
"I've packed the necessary for me, for my six week stay, as well as some of the stuff he's left behind from his work Visa term that just ended. He s bringing his stuff back home."

At this point I mentioned the Visa process and that I did have the paperwork on me to prove it, as well as a return ticket. He asked to see it.

He sent me back to my seat. About 10 minutes later, he called on us and told us that if we didn't have our Visa paperwork with us, this may not have gone as well as we had hoped. He said there's concern about people coming to the US and staying indefinitely with no real intent on going back, without a Visa of any sort.

He went over all of the Visa processes with us and made sure we were aware of the terms and sent us off to catch our flight. We were late for our flight, however the plane was waiting for us, and someone came looking for us at the customs office to bring us to our flight! [We were those people everyone hates because they have to wait for one more person to board the plane! However, there was one other person after us, so it wasn't all our fault! :P]

visitor for a month should not be a problem right

If you are visiting for a month - do you have a job back in Canada? If you don't then this is a big red flag entering into US and then trying to prove that you have substantial ties that will indeed take you back to Canada.

I just started my own small business and work part time for a family member. So is there something of my business that I should bring while traveling to prove this.

Unfortunately, we did not include the photos, and they requested we send back the G325a for both me and the petitioner. So we proceeded. When I received the Matte, I read in the instructions for the form I-129F and I had researched on here that if they say glossy then that is what they should get.

I received Matte as well from where I had my passport photos done. Since we were replying to an RFE I made sure they were Glossy, but I don't know if Matte will be accepted or not. The store I went to redid my photos free of charge.
