One more puzzle.

I got married in 2008 and also fall under the IRS's Substantial Presence Test. Because I lived and worked in Canada in 2008, my tax home is Canada.

Can I just chose whether I take the Foreign income exclusion versus the Foreign tax credit?

I have Quebec employment income. What do I report as income in the US .... the Canada T4 amount or the Quebec amount?
I have Canadian deductions at source such as RRSP's and alimony. What do I report as income in the US ... the net amount or the gross amount. If it's the gross amount, how and where do I apply the deduction on the US tax forms?
Which Canadian taxes do I include to calculate the foreign tax credit .... does this include deductions for QPP and UI tax?

Yes, aside from taxes you need to weigh all the pros and cons of living in one country versus the other. Tax liabilites and tax laws are an animal on there own.

There are many personal and financial aspects to consider for where you really want to live. As you said as long as you are with your soul mate thats the main thing. Just be wary of taking any risks that could jeopardize your plans. Green cards can be revoked and governments will take whatever money they believe is their's to keep.

That would fall under out of country insurance and would only be for emergencies.

Trailmix was right when he said to maintain your permanent resident status in the U.S. you cannot be gone from the States for more than 365 days which would never happen. That would mean I would be living 6 months in Canada and 6 months in the U.S.

USCIS likes to see tax returns. As long as your returns were marked as married filing separately, the spouse was listed on the return, and the address is the same, then you should be good to go. They know that some scenarios, it is best to file separately and not jointly for better tax return deductions, so it is not negative point against you.

Hi. We are in the process of gathering evidence for the I-751 submission next month. We were wondering about the tax returns and whether to submit it as evidence since we did not file a joint income tax return. We both filed a separate return since it was better in our case.

How important is the tax return evidence? Should we still use it as evidence even though it was filed separately?

We do have evidence for our house, car and bank accounts etc.

Hi Sly, my permanent resident card expired in July so I just carry a copy of my extension letter when I commute back and forth each day. They rarely ask to see my permanent resident card in the Nexus lane but when they do, I just hand them the card and the extension letter and no problem at all.

Correct. This is exactly as I understand the part 5 must be to fill out. I would do that way without a doubt. Also, may I add that if the applicant (GC holder spouse) has US citizens children, include those as well and put (US citizen) as Immigration status and none on A#.

Although it is a "joint" petition, I understood it to be pretty clear when you read the information headings on the form I-751, it is all about YOU the Permanent Resident initiating the form. Where they want information about the USC spouse, they specifically ask for it.
Part 1: Information About You
Part 2: Basis for Petition
Part 3:Additional Information About You
Part 4: Information About the Spouse or Parent Through Whom You Gained Your Conditional Residence
Part 5: Information About Your Children-List All Your Children
Part 6: Accomodations for Individuals.....
Part 7: Signature

...I just listed ALL MY children and my I-751 was submitted a while back, so I'll know soon if my interpretation is correct :-)

Yes, thats my understanding as well even if they are not part of the petition. I recall having to provide children info on the DS230 form when we applied for the CR1. Wanted to see what others have done on the I-751 just to be sure.

I agree, the instructions are not clear in regards to Part 5 and the form only says list all children.

That is my feeling as well. I am a few months away from filing but I plan to only list my adult children living in Canada.

This topic has been discussed many times but I have yet to see a definitive answer on the subject as there seems to be multiple interpretations. :wacko:


My concern is that USCIS will get confused and think that they are included in the petition. You know how easily they can get confused eh ;)

I most cases I would agree. This was not the case for us last year and a separate filing worked out better for us.

We live in California but my H has a license from another state. Is that going to be a problem at the time we

You would only have an issue if you did not live together .... same address. You are not required to submit driver's license info.

I would go with the 747 bus, that's how I do it when I go back to Montreal and no one is available to pick me up at the airport.

If you take a look at the route map, you should be able to get close to your hotel. The train is not great; you have to wait for the bus to the train station and then wait for the train... Not impossible, but kind of a hassle; I prefer to just sit on the bus.

Your spouse can translate it. The translations should be formatted to match the original form.
There is a template in the guides or forms, etc. for a self translation certification for them to sign

Montreal had special requirements when I had my interview and they discussed the accuracy of a translation made by a member of the Association of Translators and Interpreters of Ontario instead of the Quebec Association...

You can find an "approved" translator here: http://ottiaq.org/ - or you could write and ask the consulate. Oh, and don't forget to get an extra copy or two, it's usually not costly and then you have them, in case you ever need them.

Faux fur accessories you can probably find downtown, I would go to Simons: http://www.simons.ca/ It is really close to the consulate, five-minute walk or so. Harricana has beautiful things made of recycled fur, might be a little more expensive though http://www.harricana.qc.ca
If you are looking for more traditional wedding accessories, St-Hubert Street is where you want to go, you can take the metro to Jean-Talon or Beaubien (orange line) and you will find at least 15 wedding apparel stores. If not more. http://en.maplaza.ca/
