I received Matte as well from where I had my passport photos done. Since we were replying to an RFE I made sure they were Glossy, but I don't know if Matte will be accepted or not. The store I went to redid my photos free of charge.

The intending immigrant would provide an I-864A as a member of US citizen spouse/Primary Sponsor.

QUOTE
How Can the Intending Immigrant Be Considered a Household Member?

Listed below are two ways that the intending immigrant may be considered to be a household member for the purposes of pooling income with the sponsor to meet the Affidavit of Support requirements:
  • The intending immigrant has the same principal residence as the sponsor and the intending immigrant can establish that his or her income will continue from the same source, even after acquisition of permanent residence.
  • The intending immigrant is the sponsor's spouse and the intending immigrant can show that his or her income will continue from the same source after acquisition of permanent residence.

This is fairly common for a NON resident living in the USA on a TN or perhaps K-3 who has a US based job.

A word of caution about "Commuting", A green card is intended for living and working in the USA.

Just a note - you will not need an I-864A - your income will simply be included on your wife's I-864 - at item 24 and then you will check off item 24 e.

Oh an Neiks was one of the people who still works in Canada.

Form I-864 says that you can include the intending immigrants income in certain cases.

Since I can potentially take retirement from the company I work for next summer (2009), can I include this income on this form? What is the chance of success?

Or are we safer to find a joint sponser since my wife is a bit short of the income requirement.

Thanks

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion on Translating Marriage Certificate & Others
QUOTE (Argentina @ Oct 1 2008, 01:24 AM) <{POST_SNAPBACK}>
Hi Everybody!

I've been a lurker here on VJ for a few months and this is my first post.

I'm a US Citizen and I am in the process of gathering everything to send in an I-130 for my husband, a Jordanian citizen living in Italy. I have a few questions I wanted to knock out in one-post and hopefully you guys can help me!

My question is this, I have a copy of our marriage certificate from the city in Italy where we were married. The marriage certificate is two pages long. The first page is in Italian - with large numbers next to every information field. The second page of this document is a list of all the numbers (1 through 12) with the translation in Nine language. The document is "Extract from marriage registration no." I have this document apostilled.

My question is - is this document valid to submit as a marriage certificate? Should I not risk it? When I requested other copies of our marriage certificate from the Commune, they gave me an Italian-only form with the exact same information as this "extract" form (which I also have aspostilled).

Do I need to have the huge, decorative certificate we received from the City at our ceremony certified translated? I am very confused by all of this.

I think I will submit the multi-lingual form the City gave us (and re-submit in case of any problems), but I wanted to hear what everyone else would say (I can link to a scan of the multi-lingual form if it helps).

My other questions are: Should I submit third-party affidavits of bona fides as photocopies or as originals?

Also, does differing paper size (A4 vs. US sized paper) matter at all?

Thank you all very much for your help/feedback!

-Argentina

This sounds like an international form. This was the case for my birth certificate and I still got it translated. I read of someone getting an RFE so I did not want to take any chances. The certified translation did not cost much anyways.

Hi There,

I just submitted one and it was the police certificate provided by the RCMP. At the time, I wasn't sure if they wanted the one with my fingerprint or just the certificate itself. Anyways, I decided to get the fingerprinted one, just to be sure. My case was completed on Aug. 28 and my interview is scheduled for Oct 28. So yes, I believe you only need one from the RCMP.

Goodluck!!

Again, thank you so much for your quick responses. I think I already got the RCMP one.

If you happen to live in Montreal like I do you will have to get it from a third party security company such as Garda. Both the local Police and RCMP told me they no longer do it in Montreal.

So I'm Canadian, and my girlfriend is from California.I'm going down to visit soon, and while my intention is to just visit, I have a feeling she might ask me to marry her. So my question is if that ends up happening, what are my chances / approximately how long would it take? I know with the IR1/CR1 I wouldn't be allowed back into the US until it goes through (or can a Canadian with a passport still enter for visiting purposes?)

If we ended up waiting and filed a K-1 and it's approved, how long would it take upon entry with a K-1 visa to get an AOS and begin being able to work in the US?

I can deal with waiting, since they both involve it, my biggest priority would be being able to work so we can find an apartment and everything.

Thanks!

Hi guys:

I have a terrible question: In my country you can have international birth and marriage certificates. They are in Portuguese, and lots of other languages, they have all the stamps and everything. I'm sending those to NVC: am I going to get RFE?? Are those considered copies or originals? I had no problem with USCIS, but now I'm worried...

Thanks, and good luck!

e-migra

I sent in an international birth certificate and also included an official translation just in case. I would just wait and see if you get an RFE. If you do then worst case would be you will be required to send in an official translation. It only cost me $30 to have mine translated.

My advice though would be to never say you will be "working" while in the US since that could be easily taken the wrong way. Even more so if you happen to be self employed.

We are trying to make sure we have all the documents together. My fiance is American. I am Canadian but born in Austria. They sent me my certificate on an international form and I want to make sure that would not be a problem down the road.

IR-1 / CR-1 Spouse Visa Process & ProceduresApping before marriage ?
Where would I get the best information as to what is best to do in my situation ?

Almost sounds like getting married in a courthouse is the easiest way, then filing for a CR-1 and then getting married in a church in Montreal while the file is being processed. That's not illegal is it ? Basically the paperwork that's done after a wedding ceremony would already be done. That's the only difference ?

IR-1 / CR-1 Spouse Visa Process & ProceduresApping before marriage ?

Hi Catou1181,

I do not think you can file for a spousal visa - in your case it would be CR1 (less than 2 years married) before you are actually married. The main reason being that you need to submit your marriage certificate with the I-130. I know this because I went with my husband to the embassy 2 weeks after we were married and we had to submit the marriage certificate (and they even looked at our wedding pics before approving us on the spot).

Good luck with your visa journey!

Yeah I started reading up on the files you need to send, and I saw the marriage certificate was one of them

So basically, my only option would be to get married in court soon and then start the CR-1 ? (which is the I-130 right ?).

If not, are there absolutely no options that allow us to get married in Canada and have me move there within the month ? Or before if needed ?

IR-1 / CR-1 Spouse Visa Process & ProceduresApping before marriage ?
Hi :)

I just called the AMCITS to get some information on what would be best for my situation. Im Canadian, planning to marry an American and moving there this fall. The wedding is planned to occur in Montreal for a few reasons(so my family can attend more easily, since Im moving there, we thought it would be nice to get married here).

So from all that Ive read and heard, that crossed out the fiance visa option as we wouldn't be getting married in the States.

So Ive been looking, and worrying and just about to have my head explode lol... I called the AMCITS and they told me that it's possible for my fiance to apply for a Spousal Visa before we are married. Is that true ? The girl didn't seem sure herself of the information she was giving me.

From what I understood from her, is that we could apply for the Spousal Visa which is supposed to take from 6 to 12 months. In the meantime, we would get married(possibly in 6-8 months) and if the visa is issued I could move there right away, and if not, I would only have to wait 1-6 months before being able to be with my husband; as opposed to applying for the Visa after being married and having to wait 6-12 months to be with my husband.

Is any of this information correct ? I need to make a decision about my current lease and job within a month so Im sorta stressed out about the whole process and what's the best thing for us to do.

Any insight ? Can anyone confirm that we can in fact file the petiton for a spousal visa before getting married ?

Thanks so much
Cat

IR-1 / CR-1 Spouse Visa Process & ProceduresVisiting the US
Hi there,

Ive filed for a K3, and right now, my timeline is saying my I-130 will be approved 2 months before the I-129f(which keeps pushing further and further away).

So Ive been reading up on the IR1/CR1.. and have a few questions that may help me and my husband make a decision.

If my I-130 is approved first, can it be sent to the NVC even if my I-129f is filed ? And can I still see where the I-129f takes us, or is it best to have it cancelled/stopped/put away

My honeymoon is in October. We're taking a small road trip across the West Coast and then going to Hawaii. I read that with the IR1/CR1 there's a good chance that I can't go to the US... Is that true ? Or is it like the K3 ? If I have proof of ties to my country(Canada) they will most likely let me through ? Proof of ties - lease, car insurance, bills, letter from employer, etc.

NVC schedules the interview correct ? And not the consulate like for the K3 ?

Thanks for your time and helping us make an informed decision.

We asked for two just to be safe, but in retrospect we really only needed one. We sent a photocopy with the i-130 and I will need to have the original on hand at the interview in Montreal. So, yeah 12 would be a bit excessive, in my opinion (and expensive too).

No, he can visit you too. He should bring proof of ties to Canada, ie letter from employer, lease etc. I have actually never been asked for these things but bring them with me just in case. There are stories of people getting denied entry at the border, because in the end it is up to the border guard, I was paranoid the first time I had to say I was visiting my husband but the guard was really nice and let me through no problem, we hadn't even filed our I-130 yet so I was making myself sick thinking I would get denied for suspicion that I was heading over to stay and do AOS.

This process would be unbearable if we couldn't visit each other, some days it feels like it's going to drag on forever.

My husband and I got married in Ottawa at city hall, the lady who married us was a sweet, tiny french lady. We took a printout of the required docs for the I-130 (highlighting the marriage certificate part) and a quick note asking for our marriage certificate to be rushed, we filled out the order form for the certificate (they'll give you one) and the officiant sent it all away with the licence. We got our certificate in the mail in less than two weeks.

Also, if you are getting married at city hall the Embassy Hotel and Suites is only half a block away and very reasonable.

Good Luck!

There should be no problem but allowing your husband to enter is the decision of the individual border guard. Bring lots of proof that he intends to return; your NOA1 ( to prove you are doing the immigration the right way) copy of a lease, return ticket, letter from an employer stating he is expected to return. Also make sure the return ticket does not have him overstaying the visitors visa (6 mos I think). Good luck!
