Most people here have not used lawyers. I can only say one word ... CAUTION.

I think its better and smarter to do your research in here. We have many folks here that are much better and it wont cost you a thing.

Watch yourself Krikit... that doesn't apply in this case.

CRA and the IRS generally recognize that on the day you received your GC, you ceased to be a tax resident of Canada and became a tax resident of the US. You should use the resident date on your GC as the date you left Canada on your Leaving Canada return. Form 2555 cannot be used to exclude any foreign income once you became a tax resident of the US, but can be used to exclude foreign income that was earned prior to issuance of your GC. You can claim a foreign tax credit against your US taxes for any income earned in Canada after your Green Card was issued using Form 1116.

TO the OP, at this point in time, you would be better off requesting that your employer not withhold any Canadian taxes on your income and instead see if they can treat you as a contractor and you pay estimated tax payments to the IRS for US self-employment taxes if you can. If not, you would most likely be better off informing them of your non-resident status and be taxed at the non-resident rate of 25%. In any case if you continue to work in Canada, you will lose out on the foreign tax credit as Canada taxes a lot higher than the US especially with the currencies almost at par. You can only obtain a credit against the maximum the US would tax you at.

You most likely should have informed your employer of your status as a tax non-resident at the time of you received permanent resident status. If you didn't, you're probably going to be hit with a large tax bill this year as your deductions end with your leaving Canada date. I would suggest looking into your situation and consider informing your employer of your non-resident status and request to be taxed at the non-resident rate of 25%. But that may not be the case depending on your income, but in most cases it is.

In your case, if you are going to continue residing in the US and working in Canada, it is imperative that you consult with a cross-border tax expert who can help you make the right choices to minimize your cross-border tax burden.

Again, these statements would be based on an interpretation or misinterpretation of facts or words. Wow, this got complicated. I guess I was looking at this too simplisticly. I do fully agree there are tax issues that need to be properly addressed. No biggie as long as it's done correctly to satisfy IRS and/or Revenue Canada requirements. You want to make sure you also don't get double taxed. Do consult with a good tax accountant.

I still don't agree that it is illegal for him to work for a Canadian company while living in the US. My understanding is also that he is legally living in the US.

On the other hand if he was visiting temporarily I also dont see the issue. Many people visit the US on business or even vacation and are still connected to work with their foreign company.

What made you decide on Alaska? I went to the Caribbean.

I hear the Panama cruise is nice but thats 10 days I believe. Mediterranean is another option but those are both more expensive. All depends what you want to do I guess. I do love the sun and beach and I sure miss that.

Its been quite a while since I have been on a cruise (8 years ago) and I can only hope to have the money to go again one day.

I went with Princess cruise lines. They were really great. It left a good impression on my boys as well at the time wink.gif

My brother also went with Royal Caribbean once and he said they were great as well.

Celebrity cruises is also good and I think they cater to adults more. If you went with one of those 3 cruise line I dont think you can go wrong.

I really don't understand the issue. The US side is armed and and now the Canadian side being armed becomes a problem for them? They seem to think the Canadian border agents will become trigger happy.

I know there was an elderly US couple recently killed at that Canadian crossing because they were rammed by someone on the run with a van full of cigs.

I dunno, but I think there are bigger fish to fry.

A visitor is admitted for 6 months or less - not indefinitely.

I agree with Krikit - do not leave the US but withdraw your previous application and submit an AOS from within the US. Once the AOS is approved your overstay will be forgiven. If you wish to leave the US under the belief that there is no overstay, that is your choice. All choices have consequences - it is up to you to figure out which ones you want to face.


I know a couple with a similar story... Girl moves to the US, they live together for more than a year. Summer vacations come, they drive back to see her family in Canada. Returning home, questions about previous stays from the young CBP (Summer internship or something) - he was really zealous and happy to make is first "arrest" and seized their car because in his opinion my friend was trying to smuggle his girlfriend back in the US... Sounds stupid, but it took them nearly a year until she was able to come back in the US (I think they had to request a waiver + work permit; I had no interest in this administrative process back then so, the details are a little blurry). Other CBPs told them that they would not have acted the same way, but once the young one started the process, it was hard and long for them to overcome...

You sure do what you want, but, me, I would be way to nervous to put my life into the hands of someone (CO) who has so much discretional power...

I agree. I mean the thing is they are businessmen/women. So I get it. When i was in Korea I felt that a LOT. So, me being the stubborn person I am, I decided not to give them my business. I realize now though, if I keep up that mentality I will be stubborn.......and toothless laughing.gif When i finally found one I liked in Korea, it was a month before I left and I only had time to get the 1 root canal (free I will say again!! Well, like $20, insurance covered the rest..here that Delta Dental!? - yes, I am still bitter wink.gif )

I will shop around for sure, and like I said, those 9 "cavities" are not even getting looked at for a year. 5 dentists in 1 year and this is the first I have heard about even having something wrong OTHER than with the 3 teeth I know need done. Grrr.

In the end, it isn't the dentists fault. I mean, when you think about it, they SHOULD charge a lot, otherwise if you didn't know you would make a lot of money, why would you go to school for that long and pay all that money for schooling?? The problem is with the government not subsidizing it. Yes, I am for full government intervention on our lives biggrin.gif biggrin.gif biggrin.gif But I don't know. Something needs to be done because dental care should be no different from medical care. It is the SAME thing!!! The teeth are in your body!!


I've had super service from the dentistry school. Especially good for the basic cleaning, real cheap. Call me crazy but for $35, it's better than a pedicure tongue.gif

Anyway, if you live near some university, it may be worth it to look into it...

Kathryn41: we do the treatments at home too. I have the fluids, the tubes, the needles... I am not able to do it by myself, even after two years, we have a 2-person system; one handling the needle, one handling the cat. It's a five minute thing and the cat does not even twitch or react at the needle insertion.

I hope your cat will get better.

My cat has Chronic Renal Failure... she had a big "crisis" 2 years ago, not eating (we thought her teeth were infected)... Anyway, she stayed 3 days with the vet, with IV and all... Now, she's doing really good. She has to take a mini-pill every day, and once a week, we give her subcutanous fluids. Her latest blood test show near-normal results. In her daily life, she looks like a happy kitty smile.gif

The initial treatments (vet stay) were $$$, but now, it's not much...

When it got serious with my man he asked his aunt (lawyer) about what we should do and then we decided to get married. I was not sure about the NAFTA work permit and well, we wanted to be together. I was looking into the French stuff available in Boston and I found the reference to VJ on Bienvenue à Boston, a website for francophones living in Boston. VJ is still the usual answer there when people ask about "how can I stay in the US now that I fell in love..."

(Bienvenue à Boston has a great directory of where to find good food in Boston though, and of things to do in French (job-school-activities...))

Hi everyone,

So I have not received packet 3 yet but i'm prepping all my stuff for it and I came across this for the DS-230

25. List dates of all previous visits to or residence in the United States. (If never, write "never") Give type of visa status, if known. Give DHS "A" number if any.

This is my question:

I lived in the states from age 3-9 (under what visa status i don't know, my mother cannot remember.) However, we would not stay more than 6 months because I was always in Montreal all summer long between the end of May and end of August and for all other major holidays. I attended elementary school there for grade 1, 2 and 3.)

Then I was back in Canada between the age of 9 until 15.

At 15 I moved back to the states to attend a private high school until i graduated at the age of 18. (Once again, I would be home for all holidays and all summer long here in Canada.) I do not remember every having a visa for going to high school there as it was a private institution and I don't think they required one.

When I write all of this down when I get the DS-230 should I be going back as far as 3 years old? Even my mother cannot recall the addresses we lived in all the way back to the 1980s. I do recall from high school on though what our address was for our home there. Will my having gone to school there affect anything on my K-1? Should I be writing that I was there during school months?

As a side note. I did attend University in the states on a student visa for 2 years at the age of 19. Again, I don't recall ever overstaying during this time because i would come home for summer break and x-mas.

I don't know if any of you can help but it would be greatly appreciated. I didn't think my having gone to school there would be such a pain in the butt now when I have to go fill out this paperwork

Thanks everybody! Worse comes to worse i figure I'll get the interview if its 4 months by December/January. LOL. that means i'll be able to get my
x-mas bonus from my company before i leave for good which means extra money for me and extra money is always a good thing. it'll help with the moving costs for sure.

Also it means that if i have to stay here til then that i will be able to completely pay off all my debts completely and leave canada debt free and with extra cash in hand. thats awesome.

and if god willing i do get the interview within 2 months i definitely won't be crying...except tears of joy of course smile.gif

Originally Igor's list said we would be approved somewhere towards the middle of July. Now its looking like the beginning of June. I'm very happy about this but worried at the same time.

I made travel plans to go to Florida to visit him for a week at the end of June. Do you think it will be a problem travelling if we receive the NOA2 before I am scheduled to go??? I will have all my proof of tiews to Canada so no worries there but I'm wondering if I will be flagged in the system or something.

Also, does anyone know right now how much time approximately it is taking to get an interview from when they sent in their documents to the embassy? I was figuring I would be here until at least October and now that may change but it would be good to know how long its taking from faxing the info to the actual interview date

And the fact that his name is Joseph Luc should not really matter. I don't know why the govt. would care that he goes by his middle name if all of his other documents were using that. My friend goes by his middle name and never had a problem with the immigration process.

Did they explain why that would be an issue? Maybe I can find some info on that too.

Hi there Kate. So i called the etat civil here in Montreal for you. They let me know that as long as he has that baptismal certificate that his priest had to register your husbands birth with the province of Quebec. Therefore he can get a birth certificate (long version of it is what he will need.) His green card will also work if he has one.

He needs a valid photo i.s. document which would be his Canadian Passport.
He also needs something for proof of residence. If he has his Quebec drivers license, any govt. correspondance from less than a year old, his medicare card...these would all work.

At that website you have all the information, phone numbers in the contact us section if you should have to call them back and also the papers to download and fill out are there. I don't know why they would be asking you for any kind of tax information. You do not need that to get a birth certificate here. You can also have this expedited immediately for a fee.
