Now that you have your NOA2 you will need to call the DOS for updates, wait about a week before calling them. When you call them ask if they have the case # and if so write it down. You may get an email from the Albanian Consulate when they have received the petition. Also get docs ready for interview. I would also go to the Albania portal to ask some questions there concerning consulate, etc.

At looonnggg last, I am free to assemble and file my I 129F!!! So now, good people, I have some more questions:

 

-Items like boarding passes, passport stamps, etc: My fiance wants to scan and email these things for me to print. I had read they have to be photocopies. Which is correct? Also, are black and white or color copies more preferable for this?

 

They need to be photocopies so that if they keep you have the passport. Black and white photocopies are good. That is what my now wife and I did when we applied for fiance visa.

 

- Years ago I lived in Japan and had a few jobs there...but it was all on a US air force base. So do I need to list it as my last overseas address/job on the G 325A? Do these count as foreign addresses since military bases are US property? What if I can't get this info (it was 10 years ago and an APO address).

 

Hopefully another person can help you with this as I do not know about this situation.

 

- In this first marriage, my name didn't change, and I have no marriage certificate, and one would be near impossible to obtain. Marriage certificates are for proving name changes only. I can easily get the divorce certificate. So would a post it note explaining that in that marriage my name didn't change be enough?

 

I cannot help as I am not a USC. Am bent to think that you should as you need to say other previous marraiages.

 

- I have just gotten divorced from my second marriage where my name DID change (yeah, bad past relationships abound). For this I will have my marriage certificate. I also will have both a divorce DECREE (orders about money, property, and custody) and CERTIFICATE (just vital statistics data, stamped but not signed by a judge). Which should I include? Or both?

 

For this marriage you can put in the divorce decree.

 

- When it says I need my divorce decrees and birth certificate, front and back, do I need OFFICIAL copies or are photocopies ok? Color (for the birth certificate) or not? Does it need to be the hard to aquire long form, or will my basic short one be ok?

 

Photocopies of these are ok. Black and white is fine.

 

-At any point in this process will my fiance need his birth certificate? Does he need to send me his passport ID page, or just pictures of his stamps?

 

Yes your fiance will need his birth certificate when you guys apply for the I-129F, we included mine when we did the I-129F. Also will need long form for AOS.

 

-I've read it should be written in black ink but signed in blue. Is this true?

 

I'm pretty sure we wrote it and signed in black.

I would contact the US Embassy in Manila and explain that you made a mistake on your G-325A and what there procedures are for correction, ask if they want you to send them a copy before the interview or if they want you to just bring it to the interview and they can correct it there? If you bring it to the interview I would suggest to take 2 copies so that they can have one and that you can also have a corrected one for your records. Good luck on the rest of your journey.

Sorry yet you are correct- he has citizenship in both Albania and Greece, but he was born in Albania and so was I so we thought it would be best we apply in Albania. The embassy asked we request/submit police reports from both countries(good standing in both) during  the interview he was informed that the police certificate from the Greek authorities came back with a different spelling(this spelling does not exist in any of his documents and he has never used it).

We had requested police reports from the Greek authorities ourselves and today the embassy requested we send them that however i am just worried because of the translation of the name.   

 

Again I would go to the Greece and Albania forum for advice, although if anyone else has been through this pls chime in.

When I was in this process I filled out some forms that had to go to the Consulate incorrectly so what I did was contacted to Consulate to see what the policy was. I ended up sending a new copy of the specific form to the Consulate and then just in case had a copy with me at the interview. Since you have been approved and I assume that you have not sent anything to the Consulate I would wait till you get to having to send forms to the Consulate and send the updated/corrected G-325A with it and have a note explaining the error. I do not know if they will see this as misrepresentation or not, so if someone else could chime in about that it would be great. I think everything will be fine though if you just explain what happened. And if you could also please fill in your timeline, etc so that we know what Consulate you will be interviewing at, thank you very much. Blessings on your journey.

and that is the problem because when you translated from- Albanian into Greek and then into English it is a different spelling of his last name(short one letter and a J turns into an I)- the reason for this is because when his last name is translated to greek some of the letters get translated into unique greek symbols that then get lost when you are translating it into English so we are left with two different spellings of the same exact last name.   

 

So just to clarify again, sorry for the pain, the passport is Greek, correct? And I know that he did the interview in Albania from your previous posts. Did he do the interview in English or Albanian? If you used a Greek passport, I would translate from Greek straight to English as best you can, but would ask this question in the Greece forum/portal before doing anything. Sorry I cannot be of anymore help.

No they didn't keep the passport- just torn if we should send the document we have or because of the last name difference and the fact that the document we have was requested from his Greek passport and due to the Greek alphabet it doesn't get translated one to one. The last name listened on the document is the Greek translation of his actual last name we listed on our paperwork. just want to make sure we do it correctly so we  don't get delayed. 

 

I would make sure that the document that you send is translated into his name in English.

I didn't listed my fiancee daughter in the i129f , because we decided to file for her later just because he is not in good terms with her mother . I am sorry I am not 100% sure, was it on the petition or on the G-325A? If on the petition I do not know what to say as I have not been in this situation, if someone else has pls feel free to chime in, but if it is on the G-325A, I would correct it and send it in to the Consulate and then take a copy with you to the interview in case it does not make it to the Consulate in time or they want another copy.

We were contacted today by then and they asked we send them a report with the correct last name. This is no problem because we have this document on hand however this document was requested with his Greek passport and we filed in Albania since that is where we are both form.

 

Do you have any advise for us? 

 

I would say that them wanting the passport is a good sign as that usually means that they will issue the visa. As to how long you are going to be in AP I cannot advise. I would wait send all the Consulate has asked for and wait for a response from them saying that they received the documents that they requested.

Hi all,

 

I am from Thailand and I have tourist visa for multi entry. I would like to go visit my fiance in the state while I m waiting for NOA2.

This is totally possible. What I had when I came to visit was all the paperwork to show that I was doing the process the legal way. You would also need to show the border guards that you are not going to stay and adjust status, so you need to have strong ties to Thailand. Letter from work saying that you are on vacation and are expected back on such and such date. I would also suggest that you plan out your visit and get a return ticket.

 

I got NOA1 since May 31. Since I m not sure how long it will take  but i just want to go visit him and his family. Is it ok if I will get NOA2 (or even package3) send to my home in Thailand  when I am still in US ? then when my family in Thailand inform me that  the package3 has arrived I will fly back to Thailand and have an interview.

Again this is fine, but you need to be back in Thailand for your interview.

 

   and  does package 3 has time limited , I mean how long we can gather all the document before we submit package 3 to US Embassy in Thailand?

Once you get your NOA2, your petition will go through the NVC(National Visa Center) and they will assign a case number. Mine was MTLXXXXXXXXXX as I went to the Montreal, Canada consulate. After they assign a case # they will send the petition to the appropriate consulate and you will receive either in the mail or email your packet 3. Not sure if in Thailand you can send all your P3 docs in ahead or not though. I would suggest asking that question in the Thailand portal.

sorry - the petitioner is the primary sponsor and has a list of docs that are required.

 

for which docs - it varies by US Embassy/IV Unit - but in general - must to show:

1.  one year of prior year (2012 at the moment) and

2.  a letter from employer showing current annual income (2013 at the moment)

3.  optional - pay stubs in 2013.

 

even if all of 'that' proves up that the Petitioner falls short of the mark listed in I-864P .

 

The I-134 is not optional for the petitioner, even if zero income. 

Even if your fiance(e) did not make anything you would still have to present an I-134 on behalf of him at the Consulate when you go for the interview.

So your fiance will have an interview and yes he needs to wait for Packet 3 which tells you the forms that you need to send back to the US Consulate, then once they get that they will send out Packet 4. Once you receive Packet 4 you are good to schedule an interview.

All the websites that you have visited are true. You have 6 months to enter the USA and then 90 days from there to get married. I don't think the officer would have put anything in the sealed envelope. Go with the 6 months to enter the USA, though if you had the medical a month or two ahead of the interview, the expiration of the VISA will be 6 months from the date of the medical. Go with the 6 months to come to the USA and then the 90 days and you should be good.

Question for the experts here!

 

Since they (Smilingeyes and her fiance) already have a long established relationship, could they just get married in Canada (even a small wedding) and then let her husband file the I-130 instead of going for the K-1 visa? I read in the Guide that the processing time between the two is just about the same - probably about 2 months less for the K-1, and it makes more sense to just file the I-130.

It all depends on what they want to do. If the USC fiance is in Canada then it is possible that they could get married in Canada and do a spousal visa (I-130) DCF (Direct Consular Filing) if they have not already sent in the I-129F. Even if they have they could withdraw the I-129F and do spousal visa DCF. I am not sure what Canada's rules are if you overstay, but OP could check that out here: www.cic.gc.ca . Suggesting this site as it may affect whether or not he can travel back to Canada in the future. OP's fiance overstaying in Canada should not affect the USA visa process.

If you are a K-1 you would get married to your USC fiance(e) within 90 days of entering the USA. As soon as possible after marriage you would apply for AOS(I-485), EAD(I-765), AP(I-131). Your EAD/AP will be adjudicated and approved within 90 days. The EAD is your authorization to work and your AP allows you to travel abroad and back to the USA. Your AOS could take anywhere from 4 months to 1 year to be approved with or without an interview if you are a K-1. Hope this helps.

OP, just to clarify, your wedding is set for July 12, 2014, but you would like your fiance here for April 12, 2014? If this true, you and your fiance need to marry within 90 days of his entry or else you have to file a I-130 concurrently with an I-485 as you did not get married within the 90 days. Am I correct if the above is the situation A&B?

First let me say thanks to all those who have sent me suggestions and answered questions and posted replies?a helpful community for sure.

 

I have read so many threads and looked at various forums and searched different topics but some questions I am not finding the answer to or the answer that is mentioned doesn?t really fit my out of the box situation?

 

Ok here are just a few of the latest brain farts that have me puzzled.

 

On the fiancé letter it calls for an address:

 

United States Department of Homeland Security

U.S. Citizenship and Immigration Services

[ADDRESS OF FILING LOCATION]

or when submitting for interview

 

Now this first one could just be me being too thick to see the answer that is in front of me...My address in the USA is Reno Nevada. What would be the address I would use (Filing Location) and what does or when submitting for interview mean? How do I know which approach to take? Are the addresses different?

 

I'm sorry I cannot speak for the last half of your post, but can tell you about the fiance letter of intent. The first address will be where you are sending the package in the USA.

 

For instance:

Your first letter will have the below address on it:

 

United States Department of Homeland Security

United States Citizenship and Immigration Service

P.O. Box 660151
Dallas, TX 75266

 

The second letter that you do will be for the Consulate, for instance, this is what I did as I was interviewing at the Montreal, QC, Canada Consulate:

 

United States of America Consulate

1155 Rue St. Alexandre

Montreal, Quebec, Canada

Postal Code

 

If you are at different Consulate look up the address as it will be different from the one above and yes the address on the letter of intent that you do for USCIS will different from the one that you do for the Consulate.

The next thing to happen is the petition will make its way to the NVC (National Visa Center) so that it can be given a Case # for the Consulate. I would suggest calling DOS (Dept. of State) after about 2 weeks to get your case # @ this number: 1-202-485-7600. When you call you will the benficiary and petitioner information such as name and DOB. If they give you a case # then ask if the petition has left the NVC. After this I would suggest going to the Netherlands Portal. Hope this helps.

You are able to visit while the visa is being processed. Just be honest with the border guards concerning the questions and bring your paperwork to show the guards that you are doing things the legal way and ties to Canada to show them that you will not stay in the USA until you receive your visa. Here is what happened on one of my visits. I was taking the bus from Montreal to Vermont.

 

US CBP: What's the purpose of your visit today

Me:Visit my fiancee. 

US CBP: Where does she live?

Me: Such and such city

 

I forget when but I think that I told him that we were going through the K-1 process and that I could show him the paperwork if he wanted to see it. He did not want to see it, but here is what he said.

 

US CBP: You do understand that you cannot adjust or stay permanently in the USA until you have received your visa?

Me: Yes

US CBP: Have a good day

The first part of the process is filling out the I-129F and sending it to the USCIS in the USA. Where are you getting that you have to file in Kazakhstan? Have you asked others from Turkey or an array of different nationalities. If you asked an array of different nationalities then I would say that you would get a different answer for each nationality as it is different country to country. For example I am from Canada and my interview was a breeze, was asked 4 questions, had petitioner there and they approved us in 5 mins. Although Canada is a low fraud country. Now if you asked someone from a country where there is high fraud, they may say that they were asked questions and then were in AP (Administrative Processing) for 1 year or so before the visa was issued. And also every case is different, so with every person you will get a different answer. Hope this helps. And by the way, the general consensus on this site is that even though you may have been denied a tourist visa, it will not necessarily effect you K-1. Again, hope this helps.

To the OP if you are east of Ontario or in Ontario you will be interviewing at the Montreal Consulate. Manitoba west you will be interviewing at the Vancouver Consulate.

I agree with all the above posters and worst case scenario they will give her and I-94 Arrival-Departure Record which states when she entered and when she needs to leave by. But as was said in other posts as long as she has strong ties to Chile and a return ticket she should be good. Also concerning the comment about CBP making her aware that she cannot AOS until immigrating, that could happen. I had one visit after we applied for the K-1 where I was told by CBP that I could not adjust status (AOS) until my petition was approved and got the visa. Nonetheless it should be a smooth process and kudos for not wanting to lie.
