And if so where do we send that too? I'm almost positive that the only way you can send the petition to the Consulate is if you are doing Direct Consular Filing (DCF) which can only be done if the USC spouse is living in Canada in your case. Just got this off the USCIS website:   Although immigrant petitions are filed with USCIS, In some cases, an I-130 petition may be filed for an immediate relative (spouse, child, or parent of a U.S. citizen) with a U.S. embassy or consulate abroad. Situations where this may be applicable include: If the U.S. citizen has been authorized to be continuously residing within the jurisdiction of the consular office for at least the previous 6 months Members of the military Emergency situations Situations involving the health or safety of the petitioner When in the national interests of the United States     Hope this helps both of you. I have contacted the Franchisee and the Corporation but cannot seem to get a definite answer from them. On the G-325A I only had to do 5 years back as opposed to the DS230 which is 10 years. K-1 Fiance(e) Visa Process & Procedures	Can i visit my USC fiance while waiting for the K1?	Hi All, I am awaiting a decision on the K-1 and just travel across the Vermont/Montreal border on July 3rd, 2012 and had no issues. I got asked the usual questions, Why are you coming? Where are you headed? I answered all the questions truthfully telling the guard at the crossing that I was going to visit my fiance. I had all that I needed I-129F, letter from employer, NOA1, letter from fiance saying she was responsible for me while I was down and all the paperwork on my side for the interview. The last question he asked was, is your fiance intending to immigrate you? I told the guard that we were applying for a K-1 visa and that I had the I-129F on me and showed him the envelope it was in and he said, "You realize that you cannot immigrate until the visa is approved?" I said yes and he sent me on my way. I think the key thing is that you are honest with the guards, but I do agree that it depends on their mood. Sidenote: It was July 3rd, the day before Independence Day so I thought I was going to get grilled, but didn't. Hope this helps anyone wanting to visit their USC fiance in the future. K-1 Fiance(e) Visa Process & Procedures	Urgent Pls Help:DS-156	Hi there all, I am looking over my forms to get them ready for the interview and noticed some mistakes in my additional visits on my DS-156. I put the wrong year for some of them&accidentally forgot to put 2 visits on my form. I have called the Toronto Consulate here in Ontario and they have informed me that I can fill out another form and either mail it to the Montreal Consulate or wait till the interview. They also said that I should email the Consulate to let them know that I am filling out a new form. Are there any seasoned vets who have went through this for the Montreal Consulate and can give some advice? This is making my head go around&around. Thank you for your help in advance. Or you can contact the shipping company as there are things that can happen with them such as the scanner being broken and not able to scan the item. If he had his interview on March 28th and was approved I would suggest that he call UPS or whoever the shipping company is. They may have it sitting there. Mine was sitting in the Loomis office in Canada and they were not able to scan it so I called and got a track put on the package. Hope this helps and God bless. K-1 Fiance(e) Visa Process & Procedures	More Proof-help	Hey there,   I don't want to sound mean and I do not mean it to come of mean. For future reference, your fiancee or yourself could ask either border guard for a stamp to show that you were there for such and such time or coming back you could get a stamp to say that you exited the country. For example, I came to visit my USC fiancee and when I went back into Canada I asked the border guard to stamp my passport for immigration reasons and they did.    I do know though that if you ask at the US border there may be a $6 US charge to get a stamp. K-1 Fiance(e) Visa Process & Procedures	Problem with I-129 F Approval Validity	Hi,   I had the exact same thing. I am the now foreign husband, was the fiance. What the CO's generally do is they extend your validity date so that you can attend the interview if there are no available dates till after your validity date. What I did was I emailed a scanned copy of the NOA2 to the consulate and informed them of the validity and asked if they would extend the date. Here is a copy of the email I sent and received back:   "To Whomever It May Concern, Here are all the specifics on the petition for the K-1 Visa that has been submitted: MTL Case#: Beneficiary: DOB Beneficiary: Address of Beneficiary: Petitioner: DOB Petitioner: Address of Petitioner: Petition # from the NOA2:Starts with EAC if from VSC I think starts with WAC if from CSC Myself (my name) has already setup an interview on February 26, 2013 at the Montreal Consulate, but my fiancee has informed me that our Notice Of Action 2 (NOA2) expires on January 25, 2013. I was wondering if we could get an extension of our NOA2 expiry date as we have already setup an interview? Attached is a copy of the front of our NOA2. Thank you for your help. K-1 Fiance(e) Visa Process & Procedures	Updates?	Now that you have your NOA2 you will need to call the DOS for updates, wait about a week before calling them. When you call them ask if they have the case # and if so write it down. You may get an email from the Albanian Consulate when they have received the petition. Also get docs ready for interview.
