Not a problem that is what we are all here for is to help each other. As was said previously there are guides to all of the process. If you got to the top where it says GUIDES and then look there it will tell you what to do for AOS under "AOS from K-1 visa." I have to say that this website is a wealth of information and will help you through the whole process. All the forms that I mentioned earlier as well as the instructions that go with them are on the uscis.gov website (I-485 for AOS, I-765 for EAD, I-131 for AP). As far as the cost, all 3 forms cost $1070 ($985 apps fee + $85 biometrics fee). And you can wait till January 2, 2014 to apply. My wife and I do understand the stress and dizziness of all the paperwork and are now thankful that we have some time off until the next set of paperwork in 2015. Have a blessed Christmas together.

I just got my passport back today !! . Wondering what comes after and what is a POE - btw it says that this visa will expire may 2014 ..what are the next steps

 


 


 

Yea God!!! So you have the visa in the passport and the envelope that says "Do Not Open." What happens next is you enter the USA through a POE (Port Of Entry) such as the airport or a land border crossing. What happens is when you get to the POE is you will go to secondary, the CBP officer will take your envelope and verify some of the information on your petition such as the address you will be living at. Then after you have cleared the POE you and Kyle will get married within 90 days of your entry. After getting married you will wait for your marriage certificate and then file forms I-485 AOS (Adjustment Of Status), I-131 AP(Advanced Parole) so that you can travel and I-765 EAD(Employment Authorization Document) so that you can work while the AOS is in process. The AP/EAD will take from 60-90 days to get approved and then it will take anywhere from 4mths-1yr for you AOS to be approved. After AOS is approved you will receive your 2 yr GC(Green Card). With the SSN you have the choice of getting it before or after you get married. I would suggest getting it before and just changing your name on it once you get married.

I got mine one week to date, only because the scanner at the Loomis facility was broke. If it has left the consulate and you do not receive it by end of next week I would call Loomis and ask for the number to get it tracked to see where it is. Did they give you a waybill number yet? If so, keep checking the Loomis website to see where the visa is at. Blessings and will be praying that you get your visa soon and have a smooth POE.

So if I file as married do I have to add my USC wife to my taxes, put N/A for Social Insurance Number and add her USA income to the taxes as foreign income?

I can't give you advice, but can share my own experiences from last year. The Canadian taxes for your terminal year will have to be calculated and filed manually. I had my terminal taxes to file last year and asked both CRA and Intuit if I could use Turbotax. They both answered yes. The real answer was no. In my case, I was able to prepare most of it via software, but the extra forms had to be done manually and you can't file electronically. I filed on time, spoke with CRA, who tell me it was received on time and is being processed, but have yet to see the notice of assessment.  It was an ugly package. Don't forget your deemed dispositions.

 

What do you mean by deemed dispositions?

Hi there,

 

I know that I posted something somewhere, but am not able to find it now. I entered the US on a K-1 visa and was wondering how I would do both my Canadian and American taxes this coming tax year?

 

I worked in Canada from January-March 2013 and will have worked in America end of September to December. Is there any special way that I have to do my tax on either side of the border?

 

Any help would be greatly appreciated.

Thank you for the info, but I am not inquiring about USA taxes. I am doing my last tax return for Canada and was wondering if due to the fact that I am paying child support in 2014 for a child that I have in Canada if I would have to do a Canadian tax return next year (2015) for tax year 2014 or not due to paying child support. Don't think that I have to as child support is probably not taxable. Want to be sure though.

Some of that is so true. My wife and I will be watching a movie and I'll be like so and so is Canadian or this movie was filmed in Canada. And a few weeks ago we had a discussion about how to pronounce been. I pronounce it bean and she pronounces it bin. I have also got weird looks when I tell people at work we pronounce it as zed not see. Got a . Laugh out of the majority of that, thank you for posting

Is his mother a US citizen?  I'm not sure I follow how you will bring him here as a citizen.

 

 

If your US wife is just his step parent - he cannot be immigrated as a US Citizen - not sure what you mean by that.

 

Sorry I didn't mean to say that I was going to immigrate him as a citizen. As NLR said, I am the PR holder and my wife who is his stepmom is the US citizen. Sorry for the confusion.

Was he under the age of 18 when my wife and I got married? Yes, we were married April 2013, so he would have been 11.

 

I understand about the letter from Mom...Mom is addicted to substances and alcohol so it unlikely that I will get a letter from her. She can come and visit her son, but only if Nana says that she can. Nana has full custody, therefore having the ability to deny or approve visitation. 

 

What if he openly confesses before a judge or we get an affidavit that he wants to live with my wife and I, do we still need a letter from mom?

Hey there All,

 

I have been on here quite a bit with my own K-1 visa and for AOS after getting married and everyone has been a huge help. First I want to say thank you.

 

Awesome things have happened since I moved to the USA. One of them being getting back into contact with my son from Canada.

 

My wife and I as well as Nana are considering him immigrating to the USA if that is what he wants. I would not be immigrating him as a PR, but my wife would be immigrating him as a US citizen since it is faster that way.

 

My question is what are the chances that the Montreal Consulate is going to make us both do a DNA test? I have pictures of him and I when he was a baby to around 2ish. As well I have pics of him and I in 2008 and now pics of our visits now. As well I have the receipts for the money transfers of me paying child support, as well we are going to get the birth certificate which I believe has me named as the father. With all this would it be enough or is it an up in the air thing as all CO's are different?

 

Also since Nana has custody right now, would she have to sign over custody for me to immigrate him? Even though Nana has custody would I still have to get something from the bio mom saying that I can immigrate him?

 

This is not urgent as we are still rebuilding our relationship, but I believe this is going to be a possibility within the next 6 months to a year.

Someone can correct if I am wrong, but I needed my long form birth certificate for all interactions with immigration including the interview at the Consulate. I am 99% sure that short form birth certificate will not suffice.

My interview was on Tues Feb 26th and I got an email on Fri March 1st from DHL saying that they picked u the passport from the Consulate.
