For all wanting to know this is what the Consulate sent back in regards to the petitioner accompanying the beneficiary at the interview:

Good day,

The petitioner is not required to attend the interview. However, American Citizens are allowed to accompany applicants if space constraints permit and they bring their U.S. passport. Also, as part of our security procedures, all backpacks, bags, luggage, or large purses are prohibited inside the U.S. Consulate. Any visitor who refuses to follow these security procedures is prohibited from entering the Consulate facilities.

I was just checking the Montreal Embassy and seeing that it says that the US petitioner cannot accompany the applicant. I am applying for a K-1 and think this would be optimal proof of a bonafide relationship. Is this true or can my fiance come to the interview with me?

I'm not sure exactly what step you did there but it's unlikely you can pay as wire from a Canadian bank. I believe in the notes I saw from fellow VJ's you send a money order from the Canadian side.

In our situation I had the money order at the bank and then forwarded this with the documenation.

Hey there all,

Was wondering if anybody else has had any problems with paying their fee through Scotiabank. I paid my fee in cash yesterday at the local Scotiabank, tried entering the SN multiple times today from the Consolidated Cash Deposit Plan that I printed out and it is not working. Have since sent an email to see what is going on. Again wondering if anyone else has had any issues with paying by Scotiabank?

When I was in Orillia, Ontario, Canada back in February I had to do the interview in Montreal. That I know of Montreal and Vancouver are the only US Consulates in Canada that do K-1 visas. I would prepare for a mini vacation in Montreal.

Hey there,

 

If you both are not married there are 2 options stateside that you could do.

 

1)You could apply for a K-1 fiance visa to bring your Canadian boyfriend to the States in which case you would need to file an I-129F petition to bring him down. The petition that you need to send in costs $340 and you would need to provide proof of meeting and ongoing relationship within the last 2 years (see guide on VJ concerning I-129F petition docs you need). After approval, getting visa and entering the USA you both would need to get married within 90 days. After getting married you would need to apply for Adjustment of Status (AOS) for him to adjust from being the fiance of a US Citizen to being a spouse of a US Citizen as well as applying for Employment Authorization (EAD) and Advanced Parole (AP). AP in case he needs to go back to Canada for some reason while the AOS is being processed. The AOS, EAD, AP all would cost a total of $1070 USD. After 2 years you would have to apply to remove conditons on LPR card which would also cost a designated amount of money which right now is $590.

 

2)You both could get married either in the USA or in Canada and then apply for a CR-1/IR-1 visa and go through that process. If someone could please post about the fees concerning CR-1/IR-1 visa that would be great!

 

For both of these visas your boyfriend would also need to go get a medical exam and the cost would depend on where he gets the medical, I paid 300 for mine in Toronto at Dr. Seidens. As well for both of these options you would need to show proof that a US Citizen could sponsor you guys if you do not make enough money (explained on I-864 instructions:http://www.uscis.gov.../i-864instr.pdf)

The CR-1/IR-1 and the Fiance visa take about the same time. Depending on where he is in Canada the fiance Visa interview would either be in Montreal or Vancouver and if you went the CR-1/IR-1 route the visa interview would definitely be in Montreal. The time frame for these visas is around 5 months they say on the USCIS website, but a general consensus I am getting from the VJ forums is more like 6 or 7 months before the approval and then there can be some time in between before the interview. For instance my wife and I who did the Fiance visa got approved by USCIS in 6 months then waited another 5 months for the interview as the Montreal consulate was busy. But sometimes earlier opening appear so it depends on the business of the consulate and how often you check to see if there is an earlier opening for an interview.

 

3)You could get married in Canada or the USA and he could bring you to Canada on a Spousal Visa. Here is some information you could look at on the Canadian Immigration page:http://www.cic.gc.ca...nsor/spouse.asp

You do not need the MTL case number, but what you will need to do is scan one of your passport photos. You will also need need your SIN because the form asks for a National Identification Number, which is you Social Insurance Number.

-On your passport there is a page that has your photo with your info on it, where you were born, where passport was issued, issue and expiration date, that is the biographic page.

-Yes they would like a letter of intent to know that you still intend to get married and this time they want one from the petitioner within 30 days of the interview. Remember the letter of intent that you sent with the original I-129F? You can use that one and just change the date and addresses. Instead of the Lockbox it would  be whatever Consulate you are interviewing at.

Hello VJers! 

 

I have some questions about Packet 3 checklist as well as about the embassies in Canada.

 

- According to the US Embassy in Vancouver, they do not process immigrant applications/files. I was under the impression that I could interview there, as I have seen other VJers indicate they have interviewed there. 

Yes the Vancouver Consulate does do K-1 Visa's. A K-1 is a nonimmigrant visa with immigrant intent. You are going to interview in Vancouver.

 

 

- On that note, the Vancouver embassy website directs all immigrant visa inquiries to the Montreal consulate. Does this mean I will have to fly back to Montreal for my interview when it is scheduled? (This seems crazy to me, that only one embassy in Canada handles all immigrant visa cases)

This is only if you are applying for something like a CR-1 spousal visa. The CR-1 interviews are only done in Montreal no matter where you live in Canada.

 

- The packet 3 checklist of things required for the interview seems to duplicate A LOT of the items required for our original K1 application, including color photographs of both of us, a letter of intent to marry, a valid passport, etc. The only major different that is applicable to me is having a criminal record check from Canada (my home country). If our file is being forwarded to the embassy in Vancouver, as our approval letter states, then why would the require yet another set of duplicate items that have already been submitted? I would think if our file is being forwarded, so would the evidence/supporting documents. Am I wrong in this assumption? (I feel like I might be).

I would assume that they ask you to bring the same documents because they could get lost in the mail or something. With the passport photos if there was any significant change in facial features they will use the most current photos, thus the photos for the interview. My, then fiancee and I (the foreign finace) took everything we included with the K-1 petition, plus more evidence from the time the petition was filed to the time of the interview. They will also want an updated letter of intent from the petitioner. We took a letter of intent signed by both of us within 30 days of the interview.

 

Alright, those are all the questions I have for now.

The purpose of your Loomis account is so that you get your passport back with your visa in it as well as the thick package that says "DO NOT OPEN." This is the package with all of your paperwork from the Consulate in it and will be handed in at your POE.

 

I have a very ugrent questions that I need to get answer ASAP because my interview is next week. I am a Canadian citizen and my wife is sponsoring me to the US. I submitted all my information via email and now I have the interview letter with the scheduled date for next week. Can someone explain why do I need to register and pay the imigration VISA? I have no issue paying but my interview letter does not say anything about this. I am going through the IR/CR1 process. Please help. I am running out of time.

So from what you said I see no misrepresentation, so I do not see why this might hold everything up. You may get asked about your previous denial at your interview in Montreal, but I see no reason that your P4 is being held up. It says on the Canada Immigration guide to keep calling DOS until your P4 has been sent out. I would also keep checking your email to see if you have received your P4 by email.

When you went to the interview did they give you a reason for them denying your J-1 au pair? Common reasons why J-1 Visas are denied include:

  • If the Embassy thinks the Au Pair does not intend to return home.
- Au Pairs are considered ?intending immigrants? until they can prove their reason to return to their home country is stronger than that of staying in America.
  • The Embassy compares metrics of other Au Pairs from the same country.
- If many past J-1 Visa holders from the applicant?s home country eventually stayed as immigrants in the U.S., the chance of getting denied is higher.
  •  If the Au Pair?s home country is experiencing economic or political problems like in Libya, denial rates rise.
  • Au Pairs must be able to speak adequate conversational English.
  • The Embassy may check other visas belonging to the Au Pair and their family members

 

Are any of the above reasons what you were told? If so please state which reason you were told.

on 04 - 09 -2013 ..But why this woman says that they havent received it yet ..

If so, I do not think that Lachine City, QB is the end stop. If you check DHL it should say that someone has received the package. It will say for instance "J. Doe has signed for said package." If it does not then it has not arrived at the Consulate yet. Look at my profile for our I-129F timeline.

Hey there Statesbound,

 

The only way it will show a calendar is if there are available dates, otherwise it will not show a calendar as there are no dates available. You are doing this the right way. You do not have to cancel as it says right on the page "Would you like to change your info and reschedule your appt." I would just keep checking daily if you want an earlier date.

I would send them in, email the Vancouver Consulate, explain the situation and ask them what you should do? If you book your appt too early it will get cancelled. I would hold off for now booking the interview and medical to be on the safe side.

They should have emailed you packet 3 which is the forms that they want you to fill out (DS-156,DS-156K, forms&docs checklist, etc) before sending pcaket 4 saying that you can schedule your medical and interview.

Also, anyone correct if I am wrong, but you are not suppose to schedule interview before receiving P4, and if you do then the interview usually gets cancelled. That's what it says on the P3 sheet. OP I am sorry that your lawyer informed you of the incorrect time to schedule the interview. I hope everything works out quickly for you in Montreal and you get a reasonably soon interview date. As others have posted, most likely Montreal will not transfer you case to Vancouver as you are in Montreal's district sort of speak.

The general consensus is that if you are a K-1/K-2 you have a 50/50 chance of getting your interview waived. If you look at my timeline you will see what has transpired over the last few months. Also as was mentioned above it is not necessarily a country specific thing. Hope this helps and good luck on your journey

You should be prepared to answer any questions the USCBP asks such as the fact that they need to confirm that address you will be living at as they need to send the package on to after you enter. They may ask other questions so be prepared to answer them. I believe that the POE will be in Winnipeg even though you are traveling through Toronto, because I assume that you would be on the American side when you land in Toronto. If I am wrong could someone please correct. And yes have the package from the Consulate. Also it is often suggested to not book the flight until the visa is in hand, so when you book the flight ask or research if you can switch it for another flight if the visa does not return to you on time for the flight. My Green Card is in production. I got my notice today that it was approved after about 4 months after the interview waiver letter.
