I agree with all the above posters and worst case scenario they will give her and I-94 Arrival-Departure Record which states when she entered and when she needs to leave by. But as was said in other posts as long as she has strong ties to Chile and a return ticket she should be good. Also concerning the comment about CBP making her aware that she cannot AOS until immigrating, that could happen. I had one visit after we applied for the K-1 where I was told by CBP that I could not adjust status (AOS) until my petition was approved and got the visa. Nonetheless it should be a smooth process and kudos for not wanting to lie.

CaribbeanElectronic copy of packet 4 for medical exam?

I am the beneficiary and once I had the Packet 4 by email, I just printed that off and used that for the interview, etc and had no problem at all whatsoever. You will need to print the page with the interview date off the CSC website for the med exam, etc as well to show that you have an interview set up.

Are you K-1 or Spouse visa? Either way it will go to NVC, if it is a K-1 it will go to NVC for a few days then go on to the Consulate. As well it will go to the Consulate that you wrote down on the original petition that you sent in.

These are just questions as things would be a whole lot simpler if you left the country and did not gain illegal employment. I know you made the claim that you having illegal employment is almost the same as a person filing VAWA, but the fact is that they will ask you about employment on certain forms and they will find out. I'm sorry, but this is the truth. Honesty is the key when filing out immigration paperwork.

As Harpa said, they will extend your validity period at the interview and everything will be fine. In my case in Canada I got my medical, etc done before the validity period was up and then my interview was after my validity period and I am here in the USA with my, then fiancee, now wife. I and I am sure there are others, are proof positive that just because the validity period passes does not mean they deny you. Take everything that you need to the interview including a updated letter of intent dated within 30 days of interview and you should be fine. Hope this gives you peace of mind. You are not able to get your medical done until you have an appt with the Consulate as at the medical they will ask you for your appt confirmation. What you can be doing is getting all of the paperwork ready to be sent off to the Consulate. Check, double, triple, even quadruple check to make sure it is all filled out correctly. I am not able to navigate the German Consulate website so I would ask around in the German forum to see what forms, etc you will need. You could start printing off skype logs, photos, itineraries of visits, etc for the interview. Hope this helps.

I would suggest not scheduling an interview until you receive your P4 as that is what the IV Unit told you through email. Usually they say that if you schedule an interview ahead of the P4 that it will automatically be cancelled. Again I would suggest to prevent any further delay to wait for your P4 to come before you schedule. Did you give them your or your fiancee's email? If so they will send you P4 in an email, this is how they sent me P4 in Canada. Best of luck.

What happens with the medical is you get the medical close to when your K-1 interview will be, but well enough in advance that the Doctor can send you back the results or send the results to the Consulate depending on the Consulate. Once you are approved for the K-1 the visa expires 6 months after the medical. Once you enter the states as long as you do the AOS within one year the medical done for the Consulate interview is still valid to provide as proof of a medical for your AOS.

My interview was exactly 5 months to the day of my NOA2 approval. Approved Sept 26, interview was Feb 26...I have looked at another couple from Canada and they were approved end of June and have there interview early Oct. So it is looking like a 3 and bit month - 5 month wait looking at other timelines as well. So it depends on what is available. You could also end up getting an earlier date if you keep looking to see what dates are available. Hope this helps

To give you some peace of mind. My petition expired in January of 2013 and my K-1 interview was on February 26, 2013. I am here in the USA, married and adjusting status. As I said earlier they will automatically extend the expiration date. Look in the Indian forum to see if there are any specifics (ex. notarized letter of intent) you need for them to extend the expiration. If the Consulate will not schedule an interview until after they have received the medical results, that is on them, though, I would call the Mumbai Consulate to see if they have received the medical results and whether they have sched. an interview or not.

The only approved physicians are the ones listed. Toronto would be the closest for you unless you get your medical done before your interview in Montreal. In that case you would need to spend 1 wk or 1wk and a half in Montreal depending on the day of your interview so that you can get your medical done and back in time for the interview at the Consulate.

The best time to schedule your medical would be as close to your interview as possible, but have enough time and then some to receive your results back for the interview. Usually takes 3 days to get the results back. What happens is once you get the medical and then the visa gets approved, the expiry date is 6 months from when you got your medical. I got my medical done on January 7, 2013, my interview was Febraury 26, then once my visa got approved, the visa was good until sometime in June or July. The medical is not good for only 10 days, once you get your medical back I would suggest making a copies of the worksheet (DS-3025) that the Dr. fills out for you. You may or may not need the DS-3025 for AOS once you move to the USA. What I would suggest is that once you get here to the States and are in the AOS process PM me with a copy of your DS-3025 and I will give you further instructions on whether you need a Civil Surgeon to transcribe the record for you or not. As long as you apply for AOS within a year of receiving your overseas medical you will be fine concerning AOS.

 

As far as the DS-260 or 261, it would be the DS-260 that you would fill out and you need to take a copy of the confirmation page along with all the other proof of relationship, etc to the interview.

You do not need to worry concerning the validity date. At the interview the CO will automatically give you an extension. That is what happened for me. My petition's validity was only good till around the same date as your and my interview was in February. At my interview I was approved and am now in the USA. No need to worry about this. On a side note, you would not be able to be issued a K-1 at a POE as you have to go before a Consular Officer and then the Consulate prints your visa. I know that certain non-immigrant visas can be issued at POE's but K-1 is a non-immigrant/immigrant visa.

I would also suggest going to the London Portal and seeing what the consensus is there as some countries are different then others. I would say do not worry about the expiration date as they will extend it at the interview and the email proves that they still have all of your stuff. But if someone who has went through London could chime in that would be great.

If you have been through the CR-1/IR-1 process then when you cross the border you will receive the stamp with your immigrant visa in the passport. If your immigrant visa is a CR-1/IR-1, it will most likely say something like, "Serves as temporary GC for one year" which means that you can travel back to Canada to wrap things up then come back to the US. In terms of your SSN, you would probably need to go to the SSN office and show them the required visa, etc (http://www.ssa.gov/p...EN-05-10096.pdf) and fill out a SS-5 and they will send you an SSN without the "Only Valid With DHS Authorization." It will take about a week to get the new SSN card. If I am incorrect in any way someone pls correct me.

I found this thread as I am in the same/similar boat. We received our NOA2 for our k1 visa last week, but just realized that my mothers maiden name is incorrect by a single letter (we had a lawyer draft everything up, but I should have checked closer, lesson learned)

Will this cause any issues at NVC or the embassy? Or should I bring an updated g325a form to my interview? My ds-160 form and birth certificate have the correct information.

I know that when you apply for citizenship that they want to see child support payments cashed out of your bank account if you have children living at another address or out of the country. I was wondering if you were to pay said child support and the person who is responsible for receiving it did not accept it and sent it back to you. So, just to get things clear, mom and child lived in Kuwait. Mom divorced Dad and then filed I-129F and both mom and child came to the USA, mom got married to USA citizen and is now filing for citizenship. 

 

If the above is the case she could have filed two years ago as if you come down on an I-129F and you get CPR(Conditional Premanent Residence) 2 year GC and then get the 10 year. Irregardless, I am 99% positive that if mom is granted US Citizenship that child will be automatically a US Citizen as well. I will leave it to others to correct me if I am wrong.
