Removing Conditions on Residency General DiscussionI-751 rejected because of incorrect fee??!!
We've been through the same thing. We mailed my wife's I-751 on Dec. 16th w/the $205 filing fee and photo ID. Check was cashed and we received our NOA extending her permenant residence status for one year on Jan. 9th, the next day we received the Biometrics Appointment notice and she was scheduled for Jan. 22nd. We have since been to her appointment which took all of 20 minutes (5 minutes wait time, 15 minutes processing time) and her Appointment notice was stamped and initialed by the USCIS worker. Now we wait until we receive further contact/instructions. I was nervous that they may request the additional $70 fee so i brough the checkbook with us to her appointment but there was no request on either the NOA or her Appointment notice and they processed her without asking for any additional fee and I assume they would not have processed her at all without receiving additional money if required.

It's weird how everyone seems different...of course each case is different and involves different circumstances but some people have gotten their 10yr green card in under 2 months after biometrics while others have waited 6 months. I know that the Vermont Service Center is supposed to be the best/fastest so all i can do is hope we're in the 2 month category as so far everything we've submitted from the very begining has gone extremely well and we've always gotten our notices etc. much more quickly then most people it seems. Okay, we just had my wifes Biometrics appointment this morning. I was wondering approximately how long after peoples biometrics did it take for you to receive your I-751 approval notice and new 10 year green card? I asked the USCIS official at the counter and he said about 6 months but that seems kind of long when a lot of people get theirs sooner...is that just a generic answer so as to cover themselves?

1) All I-751's will now be processed out of VSC starting July 1 (with the other SC's rapidly getting rid of their inventory so the personnel can focus on other types of petitions).

2) Their service goal to processing I-751's is one year. They have now brought how they report processing times on I-751 in line with their other family based petitions.

Zyggy where did you get this info? What about those of us who were on the verge of getting our petitions processed (like our situation where they were a month away from processing our case before going backwards from November 06' to July 06')...are we just screwed over and they're going to process the other service centers July 06' petitions before they get back to ours? If so that is unbelievably unfair (is it even legal?)!!!



It's a very educated hunch based on what happened with I-129F's and I-130's in the past few years. WHat you are seeing happened with those petitions in the past

And you're not understanding what this means. IF your petition is already at a SC, it will stay and be processed at that SC (and very likely have more people put on them so they can get them out of the way and focus on other petitions). What this likely means is that starting July 1, When a petitioner sends their petition to the SC that covers the area that they live, that SC will input information, cash your check and then send your file to VSC for adjudication.

The new date doesn't mean they just stopped and went backwards.. What this means is that they have a year to process it and don't bother calling USCIS or your senator or congresspeople for help until their service goal date passes. In reality, they will be processing petitions well before the date posted on their website.

And USCIS can do whatever they want with your petition to get it processed... there is no "legal" right to having it processed at a particular place at a particular time... and life isn't fair and USCIS isn't fair either. The way they see it, you're a PR.. you don't lose any benefit by waiting for a I-751 to be processed. When I first started posting here, it took USCIS almost 2 years to process an I-751. Usually it took applying for Citizenship to get a I-751 processed and then it was processed at the DO when you were sitting for your Natz interview.

As long as they process those petitions they already have first then I'm not as upset about this. I realize life isn't fair but we've been waiting for so long and to be sooo close and then have the processing dates go BACKWARDS...well, you can imagine how shocked, disappointed and downright PISSED OFF that we were and I'm sure many more people are in the same boat as we are! I just wish the USCIS helpline representatives would/could be a little more helpful then spewing out info that we can read for ourselves on the USCIS web site.

New dates are out on the website.NSC,TSC AND CSC,THERE ARE NO DATES FOR I-751,MISSING.ONLY VSC HAS DATES WHICH WENT BACK TO JULY 2006 ?? CONFUSION? CAN SOMEONE GET MORE INFORMATION ON THIS?

We filed my wife's I-751 back on December 16, 2006 and the last time it was touched* was on January 23, 2007 which was one day after she had her Biometrics appointment. We have been waiting patiently (umm...yeah, okay...lol) ever since then as we know the Vermont Service Center takes the longest to process this particular form and that most people have to wait 6 months before they hear anything (some lucky ones hear sooner). Well, it's been 6 months and still no word but the processing date was up to November 1, 2006 so we figured we were very close and decided to wait just a while longer before calling. After not being updated for almost a month we were on pins and needles as to when the next update would appear and then it did this past weekend but to our astonishment the processing time had gone backwards to July 06'. Frustrated beyond belief I called the USCIS this morning. The agent I spoke with was less then helpful. She was a by-the-book type person who merely regurgitated whatever she was told by her superiors onto the public she spoke to. I explained the situation and she said that they legally have 1 year in which to process my wife's case so they can't/won't initiate any type of an inquiry until a year has passed. I aksed about the Vermont Service Center going backwards in processing times and she said she didn't know the reason but that it was not unheard of and she's seen it happen frequently and that sometimes certain service center's take the load from other service centers for some reason or other. By the end of our conversation I was starting to lose my temper :angry: and let her hear it in the tone of my voice as all in all she was of no help what so ever. I swear they should just have the whole helpline automated and move the real live people they have working it now to the service centers for extra help processing petitions, they are absolutely useless to talk to and know nothing more then you do most of the time...maybe then we'd actually see some progress!!!

Upon further review, Naturalization will have to wait until mid December as that's the earliest we can file as you have to submit your petition 90 days before your anniversary date of gaining your permanent residency. The fee's are getting ridiculous though...seems like they're going up exponentially but we're not seeing an equal increase in the quality and efficiency of the USCIS processing procedure :protest: .

Finally after watching people who submitted their applications around the same time as us getting approved at VSC we finally received the email saying my wife's card production has been ordered as of June 25, 2007 :dance: !!! We were getting frustrated...especially once we saw that glitch they had when the processing date went from November 06' back to June 06' :help: . Our forced patience was finally rewarded though and to those who submitted around the same time as we did but haven't received any notification yet all I can say is continue to have faith, you will be notified so just keep checking your email and your case status on the USCIS web site. Up next, Naturalization (Citizenship) in late November (the earliest my wife can apply I believe) :clock: .

We sent in her I-751 on December 16, 2006; Received an NOA of Receipt along with Biometrics Appointment Notice on December 22, 2006; Had Biometrics done on January 22, 2007; Petition was "Touched" on January 23, 2007;Waited and waited and waited and...well, you get the picture; Received email notification that card production had been ordered on June 25, 2007; Petition was "Touched" on June 25, 2007; Received a duplicate email saying card production had been ordered on June 26, 2007; Received email saying letter of notification of approval was sent on July 2, 2007; Received new Green Card on July 3, 2007.

Well, we had already received an email saying my wifes card production had been ordered but it's always nice to actually physically be able to hold the card in your hands and it arrived on July 3rd from the Vermont Service Center. Funny thing is after the initial email my wife received notifying her of the card production on June 25th she received an exact duplicate email on the 26th...we wait for months on end and hear nothing and now we hear from them every day...lol :rolleyes: We are still awaiting the letter congratulating my wife on one step closer to becoming a US citizen :D

PhilippinesHong Kong Police Clearance?
My wife is trying to bring my mother-in-law here to the U.S. After gathering the info needed and submitting it we find that she needs a Hong Kong Police Clearance as she worked there for 4 years. This is kind of confusing as the HKPD web site states that "A photocopy of a letter from the relevant Consulate / Immigration Authority / Government Authority, which contains his or her name and clearly indicates that the production of the Certificate is required." is needed, how do we get this? We are at the stage where we are about to submit the AOS package with the next package due for submission being the DS230 which requires the above clearance from the HKPD. Does anybody have experience with this?
