Hey guys--

 

I just left the Post Office with empty hands - I just mailed our I-129F packet vis USPS Express Mail to the Lewisville address.  It will be delivered on Monday September 8th by 3:00pm.

 

I'm not sure if I'm the only one who as ever felt this way, but letting go of something I spent months working so hard on, has left me so emotional.  (I made two copies of everything one for me to keep and one to send my fiancé -- no worries there folks!)

 

It's just that while I am excited to have completed this very first step, I feel empty now and a little sad.  

 

Has this ever happened to anyone?  It's a hard feeling to explain - I am over the moon that we are one (tiny) step closer to being together.  But I think the idea of the many unknowns - RFE's or long waits for NOAs and case numbers or the petition in transit from one place to the next - that is making me terrified and sad. 

 

I'm gonna give my fiancé a call this evening, I think talking to him will make it better, as it always does.

Most people will say this, but here goes again...

 

First off, congratulations, as you said you are that tiny bit closer to being together, forever.. I absolutely remember the feeling (for us it was in 2010) when my now wife sent off the petition, the anxiety feeling of getting prepared was definitely met with the feeling of emptiness.  But have comfort in the fact that it's out of your hands, even though that might sound silly. Deal with RFE's if they happen, and remember they are NOT the end of the world, deal with whatever happens face on and you really don't be delayed! We got an RFE in our I-129F petition (birth certificate issue) and again in AOS (birth certificate issue again with co-sponsor), both times we took care of it and it didn't effect the outcome one tiny bit!

 

It sounds like you were ample prepared for the petition, I read your previous post about your package contents and I think you'll be fine.  All that white letter paper scattered over the floor so bad you can't see the floor? All nicely bundled into a folder and taken to the post office, "Here you go government, here's my future"..  oh yes, I think most people can feel it too?

 

One thing I will tell you, is the wait will be long and drawn out, there's simply no sugar coating that; it sucks.. but know this, right now you are building together something most people don't ever get to experience, and that's the blatant agony of being apart, the desire and appreciate to just be in the same room together, just to be able to hug, kiss and hold their hand. It's priceless and weird to say, but cherish it, and DON'T forget about it.

 

The silver lining here is though, some day soon(ish), you will be together, and then you will be walking down the isle (or however you choose to do that) and then your 'forever' (how my wife an I call it) will begin as husband and wife.. after that you WILL look back on this time as a BLIP in your forever.  you WILL look back, just like my wife and I do today and be damn PROUD of what you did.. what I'm saying is the heartache of today will strengthen and solidify your forever; forever.

 

Don't think about tomorrow, plan for your future.  My only other advise will be, stay busy, distract yourselves as best as you can and talk each and every day. Right now you get to plan your perfect future and that's something to be excited for.

 

Best of luck through your VISA journey, and yes as others have already mention, the VISA hoops will keep coming and coming. I moved here in 2011 and no I'm going through ROC, it's still that necessary thorn, but it gets easier, at least after this is done, the other hoops you can jump through hand in hand together, so know that it gets easier from now on in.

PS.. Also be thankful for today's technology, our loved ones are closer than you may think.  Don't get angry when Skype fails you, or your Facetime connection fails.. be thankful for it.. when I was going through all that, I kept reminding myself of my parents, they immigrated to Australia in 1981, two years before I was born.  My mum and dad left their families and ventured out for a new beginning.  Back then to call back to England was $2 a minute, voice calling over a scratchy and delayed line! My mum told me she could only afford to call home once or twice a year.  I guess we take for granted what we have, but I think sometime the stresses of not being together makes us not appreciate the tools we do have at our disposal! Imagine doing this 30 years ago? WOW!!

I currently hold dual citizenship (Australia/Great Britain) and have a valid passport for each country.

 

I listed both in my application, when stated citizenship I wrote 'AUSTRALIA/UNITED KINGDOM' and had no issues whatsoever.

 

Always be completely honest, that's my policy.

 

I will be applying for citizenship next year all going well.  It's my understanding through research that the USA doesn't care about what citizenship you currently hold, they don't take it into consideration when granting citizenship.  All they care about is if you're a good person that contributes to society correctly and aren't a burden to it.  Once you meet the requirements you are entitled to citizenship.  You don't need to forfeit any current citizenship you hold, this is just an additional.

Short answer, no, you cannot get married.

 

At POE, you must be the unmarried fiance/fiancee of your soon to be wife/husband. That is of course from a legal sense, you are free to have a non-legal, non-binding celebration, just as long as it does end in you being husband and wife.

 

When you enter, you will have 90 days to get married, after which you must adjust your status (AOS), you must provide in your application your marriage certificates, and that must be dated somewhere in the 90 days, otherwise AOS will be denied.

 

You COULD get married, but you'd have to then abort your current K1 petition and reapply down the correct path because K1 is not applicable to married couples.

Then Approximately $1070 When? When she gets here or when she applies for residency?

 

Once your fiancee arrives and you both get married within 90 days, the $1070 is for Adjustment of Status (AOS), which is her application for her green card (permanent resident card).  Advance Parole (AP) and Employment Authorization (EA) is free when filed along with AOS, so effectively $1070 is for all three.  AOS can take up to and sometime more than 12 months (mine took 8 months; average), but she will be able to travel outside of the US (AP) and work (EA) usually after approximately 60 days of filing, don't forget to apply for her AP/EA alongside your AOS.

 

AOS will grant her a conditional 2 year green card, after which she will need to apply for Removal of Conditions (ROC) which costs $585, that will replace her conditional 2 year green card for a 10 year standard green card (no longer conditional of marriage).

 

Technically there is no time frame for filing AOS, as long as you legally marry within 90 days, however it's strongly recommended you apply for it before the 90 days expires, because your wife will then be 'out of status' as soon as the 90 days elapses.

 

Then there's citizenship  :protest: ...

I heard about the 6 month rule, luckily it shouldn't apply to my fiance. Based on everyone's experiences the NOA2 seems so far away that I feel like relaxing for one month. I just started my new job so I can't exactly collect paystubs and bank info just yet. Sounds like you lived a nightmare though

 

I think you could absolutely wait a month  :joy: just know when it happens, it happens!

My advise would be to echo what others are saying here, start at least making a plan for the next stage, yes it'll be some months away, but better get the plan in place now while you can take your time and do it relaxed than find surprises later.

 

Speaking from experience, don't assume each thing is going to be easy, actually research so no nasties should occur in YOUR case.  I will share what happened to me:

 

I found out after I received my information from the US Consulate in Sydney, Australia, that I had to get a police clearance from England because I lived there for longer than 6 months in the last 8 years (or so). I was very lucky that England didn't require biometrics (horror stories about them taking MONTHS from other countries) but had to pay 150 pounds to get it express handled and shipped to Australia, which still took a week, it would have cost much less if I was more prepared.

 

My actual Australian federal clearance form required fingerprints and that was a whole other hassle because unlike the 'norm' I read about Australia, I had to go and get ink prints done and then sent off to Sydney by mail because the state I lived in was the only state where prints couldn't be taken electronically.

 

The point here, and the bottom line, my advise is to invest the time now to cover all of your basis ahead of your next stage so that you will feel prepared for when that day comes and all hell breaks loose (You get the your NOA2>NVC>Consulate Approvals  :rofl: ) and you lives become all about the VISA once again!

You could also have a non-legal, non-binding 'celebration' in Pakistan and then legally marry here in the US (Legally marrying can be as simple as you both going to your local courthouse one afternoon).

 

The issue here is you must be legally engaged and free to marry at POE, you must legally marry within 90 days of POE. 

 

Anything non-legally binding is okay, and I think it's acceptable to have a celebration in your home country considering you'll be moving to the US with your forever love :)

 

Either way, good luck to you both, but no-no on the legal marry before you come here  :no:

Hmmmmm, how sure are you that they won't do your fingerprints?

I lived in WA (ya know, over in Wait Awhile). When I did my K-1 Aussie police check, WA isn't linked up to the federal police database.

I had to get my fingerprints done in the Perth police headquarters, they physically handed me the fingerprints that were on the WAPol letterhead and I sent that to the Federal Police in Sydney (or was it Canberra?) can't remember now to get my AFP check.

Might be worth double checking (if you haven't already!), or perhaps call up the AFP headquarters, there might only be certain cop shops that do them (ONLY the one in Perth did them!)

While I'm not going to push judgement on you, because I nor does anyone else here know any more than the small snippet of your life you just shared with us, I will say that the reactions of people on here are somewhat fair given the information you provided.

My advice for the nice, beautiful (and hopefully not crazy Posted Image) girl you do make your wife and hope to bring back to the US, is to keep in mind how your story will look to the USCIS, who will have their own opinion on your story, and ultimate have your balls in their hands, so to speak.

While you may have known these girls for a long time (which is completely understandable), you should think about how this will play out at K-1/AOS interviews.

"How did you guys meet?" Will be one of the questions you will be asked. Think about how your decisions will eventually be seen from a third person, who doesn't know all the ins and outs of your relationships.

Perhaps give yourself some time to collect yourself before making any life-long decisions buddy. If you find a girl while you're over there, and you fall in love then that love will conquer time and money and all those other materialistic things. No need to rush into anything, let life (and love) happen as it should, and certainly not let materialistic things dictate your path.

Hi Visa Journey,

I just filled out the DS-156 form for my K-1 VISA application, most parts were okay, thanks to the help of VisaJourney's example forms.... :dance: :dance:

Just one question related to Question 2: Place of Issuance (Passport)

I needed to fill in the City, Country and State/Province.

Our passports just don't give all of this information, and we apply for them at our local post offices, and they are posted back to us, so I have no way of knowing if these are issued in each state, or centrally.

The only field on my passport related to this is 'Code of issuing State', which simply says 'AUS'.

So what I did was this;
City: NOT SHOWN ON PASSPORT
Country: AUSTRALIA
State/Province: AUS

Do you think this is acceptable? I just don't want to state a City, as I have no way of knowing.

What I gathered do you mean does the beneficiary have their interview from the country they filed from, or the country they legally reside in?

If that is true then the interview will take place at the US embassy where the beneficiary legally resides (ie the country where the beneficiary is a citizen), from what I can gather for Kenya this will be in Nairobi.

I brought my wife into the US with CR-1 Visa. She has two-year Green Card and it needs to be renewal in about 11 months. I seek information so I can prepare for the renewal and thank you for providing me with the information.

My questions are:

Do I have to wait for the Immigration office to send me official letter to inform me before I can apply?
No they do not contact you to inform you of anything, this information is sent when the green card was first issued.

Or wait one more year, and when you file for citizenship get it all done free of charge with simply filling out the N-400 form.

 

 

Just wanted to add some notes here, you're probably already aware but you mention that your green card is almost expiring.  Make sure you file BEFORE the green card expires.. just a friendly note, unlike AOS, if you do not file before the expiry of your 2 year green card they will order removal processes against you.

Thank you for your responses. I did submit the address change through the post office. Also the woman who bought our house said she would watch for any mail from USCIS and forward it to me and the friends that we stayed with temporarily are still currently living at their home. So if anything was sent to our two previous addresses then I should find out about it. However, I read that the postal service will not forward mail from USCIS. Any USCIS mail is suppose to get sent back to USCIS. That is what I am worried about. 

 

Ahh I did not know that but after some research yes USPS should not forward government mail, instead bounce to sender.

 

If sounds like if the folk at previous addresses are on the lookout then you might have been counter productive to set up the mail forward.. wow. Did you cancel the forwarder?

 

I think the silver lining here is the USCIS should know that the mail was not delivered because it should have been returned. If you changed your address online with the USCIS and they still sent it to old addresses that should have been returned, then you have a good case should that be the case.

 

But, this all could be for nothing! I would call and find out, cross that bridge if you come to it. It could just be a slow moving case, at least you're hear and there's no real disadvantage!  I think the most important thing here is that you're actively seeking updates, not just sitting around 'carelessly'.

During this critical time and reading other people's stories changing your address with the USCIS doesn't happen immediately, so it might just be your second line of defense.

Yes, I echo that thought, give them a call, it will leave a trace that you were concerned and actively monitoring the status.  Not responding to the RFE within the allocated time can be seen as you abandoning the petition.  If you call and voice your concern you will be doing two things:
1. You are seeking an update, which might even speed things along for you.

2. You are stating that you did NOT receive an RFE.

 

Worth doing, but I'm sure everything will turn out just fine.  Good luck!  :joy:

I just re-read the NOA1 and it had no mention of the case being transferred.

 

Here's the NOA1 summary.

 

Paragraph 1: Conditional Resident status extended 1 year, I can work and travel.

 

Paragraph 2: Notice I'll be receiving biometrics appointment letter.

 

Paragraph 3: if you overseas in the military you won't get an appointment.

 

Paragraph 4: Provide evidence if you haven't already.

 

Paragraph 5: You can track the status via CRI89.

 

Paragraph 6: If I check E or F, you can't change your address online.

 

Does that mean it's still at the CSC?

 

 


There is absolute no mention of ANY service center on the NOA1, the address at the very bottom however states a CA Post Office Box. But that's it.

 

The biometrics letter is the only letter that states VSC.

 

And of course I definitely without question filed with the CSC :)

Hi Good People of VJ,

 

Hey I have a super quick question.

 

I live in Montana so my filing location was the CSC.  I sent that all off in July (see timeline), no problem.

 

I got my NOA1 and Biometrics letter, again no problems, went and got the fingerprints done and photo's taken (You wouldn't want to decide to change careers and become a criminal with the detailed prints they take eh?,  :protest: ).

Anyway, I noticed on my biometrics letter the service center was listed as VSC? No problem, perhaps the VSC is helping out the CSC, right?

 

My thought though, where is my case officially being dealt at? I thought that usually they will write and tell me that the case is being transferred, if that is at all the case?

 

My question is, can the VSC help will part of the application, while still being officially dealt with by the CSC? Or does this mean the case has been transferred? Either way doesn't matter to me but was definitely curious.

Somehow, this is how I imagine every single desk at the CSC to be.

 

"It's that one right there, the white one, with the alligator clip on it, no not that one, the one underneath"  :cry:

 

And then every 12 months they do some cleaning and find all the ones that fell underneath their desks.

Well, putting the stress of 'the wait' aside, at least ROC plays absolutely no part in the long term timeframe of things to come.  I was devastated when I first heard Citizenship is 3 years from when the Green Card was first issued, and NOT from arriving here.  That added 8 months to the eventual 'citizenship date'.

 

At least this wait comes without any affect on us long term, right?  :)

 

That being said, CMON, September is the month for July filers, I can feel it in my bones  :jest:

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsDiscouraged. Will it ever end...

Excuse my novel, I need to vent.

My husband and I started this process a year and a half ago. His interview was September 1st and the CO told my husband he was lying and gave him a paper to submit more evidence of our relationship, specifically Facebook messages, since that is usually the most convenient way for us to speak. He really had an issue with there being a language barrier, something we both knew might be a problem.

We had red flags like most. Met through mutual friends and had a short courtship before we got married. There's definitely a language barrier, which has actually strengthened our communication considerably. We really take the time to listen to each other and talk things through.

Right now, I just feel numb. We submitted the extra evidence same day as the interview but I can't get ahold of the embassy to confirm if they recieved it. I've got a terrible cold which is not helping me physically or emotionally, nor is the fact I suffer from clinical depression and anxiety. I feel so exhausted with this process. Not having my husband here is taking its toll day by day. Cairo is known for lengthy AP and thinking about it just makes me sick to my stomach. I really thought things would be fine. I've made 3, month long trips to see him and we had plenty of photos with family and friends. We showed proof of ongoing communication and cards from special occasions. Receipts from two hotels booked in both our names. It all went the opposite of what we were praying for.

All I am doing now is retracing the steps, wondering what we could have done better. I know not having an actual wedding probably worked against us, but we really didn't have the money for one and I didn't want anything.

Going to Egypt wreaks havoc on my body. Not once did I come home and not end up in the hospital. My last trip I went to 2 different Egyptian hospitals and the ended up in the ER in Chicago on my way back home. Our backup plan is for me to move there and I just don't know how I will handle it physically. I don't even know how I will manage another trip there if I have to.

I'm not looking for tough love. I've been harassed one too many times on this site. I really am just looking for people who understand this feeling. We're all in this together.











 

I would like to say first off, hang in there, and no one deserves to give you tough love.  Love is the catalyst here and love goes beyond superficial limits like language, color, age. So I applaud you, when you've found 'the one' you've found it and you and only you has the right to validate that.  I think a lot of people on here (including me and my wife) were put until scrutiny for suggesting one half of you ups and leaves their home country forever.

 

The way I like to see it (and saw it); Let people bring it on, it only increases the amount of egg on their face when you prove them wrong! That was definitely the case for us.

 

Anyway now that that is addressed, I want to address your issue:

 

I am sorry this is happening, it seems by what you're saying your evidence and proof of genuine relationship is solid and I am a firm believer that eventually this will pay off for you, keep on keeping on and don't give up the fight; ever!  Not familiar with Cairo, but it might be one of their tactics, to accuse you to see the response.. a fraudulent application might just stop there "oh they got us", but you are genuine and must keep on the trail...

 

Every single person on here will feel your pain, you WILL have your husband here soon, it WILL happen, you just wait and see... remember you have the leg up, and don't even know it. you have a genuine relationship with plenty of love to boot, remember that and be strong.

 

And gosh, I hope you feel better soon, these process take down the best of us, that is true.  Just remind yourself that when this is all done and your husband is home where he belongs, all this will be worth it.

Gosh I'm so so sorry to hear about your circumstance. Right now you need to think about your daughter and yourself.

Like Tintin and Mike said, don't chase it, no matter how badly you want to (I know this from personal experience!).

I wish you the very very best of luck, try not to think too much about your friends and family making fun of you, I'm sure they will soon come around and support you and your daughter.

No matter what, you and your daughter will both be in my prayers. Be safe, and happy Posted Image You will come out of this a better, stronger person, no doubt about it.

And a side note, stay strong and true to what is right for your daughter. Kids don't understand 'life', and at times they might even make you out to be the bad person. Stay true to what's right and I absolutely guarantee you when they grow older they will thank you for everything you did. I've seen that in two differences instances with very close friends of mine.

First of all, I would just like to express my personal appreciation to all of the good folks that started this website, the long time members, and new members alike, for all of the support and information on this website. I was very fortunate to discover this website even before my first visit to China to visit my finacee Lei. The information here is very valuable and the good people that take the time to share their experiences, help all of us "newbies" very much. Now it is my turn to share some thoughts :-)

I just mailed off my completed I-129F package today! After some great advise from another VJ member I waited until after my 2nd trip to China ro send my petition. My I-129F package has a total of 122 pages. Here is a summary:

- Payment in the amount of $ 340.00 (personal check).
- G-1145 Form
- I-129F (hand printed, all CAPS, in black ink)
- I-129F Supplement: Part B, Question 18, explanation of meeting in person (1 page)
- G-325A and (2) passport style photos (Petitioner)
- G-325A and (2) passport style photos (Beneficiary)
- US Passport (Petitioner) - (cover-to=cover in color)
- Letter certifying intent to marry (Petitioner and Beneficiary)
- Proof of prior marriages legally terminated (27 pages - complete)
- Evolution of Relationship Letter (2 pages)
- Proof of having met in person in the past two years (36 pages total including; (19) 5 x 7 photos from my 2 trips to
China showing my Finacee, Lei, her daughter, her mother and father, etc., trip itineraries, airline boarding passes,
hotel receipts, ATM receipts, currency exchange receipts, misc. receipts)
- Proof of ongoing relationship (16 pages of e-mails from 6/2011 - 2/2012, engagement ring receipt)

Our package is two-hole pucnhed at the top, subject tabs at the bottom. I mailed it today in a USPS Priority Mail box, via certified mail with return receipt requested.

The only thing I don;t have now is phone records because we I have been using "1 cent China" calling cards to call Lei. But now I have signed up for "flatrateonline.come" (from the advice of another member) so we have a record of our phone calls for Lei's interview. I made 1 complete replica copy and have all of the pages copied for a third copy if required.

I welcome any comments from other members :-) Here are a few of my observations about the whole process of making the package:

"Triple Check" everything! I followed this advise and found an empty box on my G-125A on my third check.

I tried "blacking out" personal information in several e-mails, but it just didn't look or "feel right" LOL. I recommend just picking several "mild" cordial e-mails to send ( if you can)

I recommend making an "I-129F Kit" at the very beginning; I bought a used ACCO (2) hole punch on eBay for $6.00 including shipping, a box of ACCO fasteners, a pack of subject tabs, black pens, yellow higlighters, etc.

During the information gather process, try to read the recent posts on this site and "gleen" information on a daily basis.

I just wanted to provide some ideas to offer help as others have helped me. One "intangible" thing about this long waiting process is that it gives you and your sweetheart time to see each other through a difficult time while separated by miles and lets the relationship grow.
