Our lawyer filled out and signed the iogtaphical form for my fiancee'. Her letter of intent was emailed to her. She print it, signed it, and faxed it back. The lawyer used this in our application and said it would be fine. I hope she is right. B)

On Form G325A, all 4 pages need to have original signatures on them. Also, be very careful because all 4 pages look identical. But they're not. You will see the difference at the bottom left of each corner for each page. They're designated to go to different places. So print each page of form G-325A.

I do not know what you can do about the J1 restriction. Consult an attorney maybe if you do not find your answer here. If you discover there is nothing she can do about the restriction, both of you can use the time until November getting your case together by gathering evidence of your relationship from the beginning up-until-the-day you decide to submit for your K-1.

A couple other queries: I've been thinking about paying the $1000 bux or so to an attorney to help, since they claim to have 100% success in obtaining the visas. Does anyone have experience with these companies, or think that it's unnecessary?

The only problem I can think of with our criteria is that, well, we just met in February, and although it hasn't been that long, we are completely sure we want to spend our lives together, and especially since it's going to take a LONG TIME to process these documents, we don't want to waste any time "dating" from overseas...Would they deny us on the basis that we didn't date for very long?
Also, while I was in Brazil, through some dumb fluke I only got a 30 day tourist visa, which I overstayed for about 2 months.
And, we only have but ONE photo of us together (since my camera was stolen 2 days after we met :( and he didn't have one at the time.)
Are these issues a big deal, do you think?

It doesn't matter whether you met in February or not. As long as you've met within the last 2 years of filing for a K1. As far as your proof, photos are secondary evidence. You have your passport with the dated stamps showing you were in that country at the time of meeting? You have your flight itinerary? Boarding passes? Receipts, etc.?
About the attorney, that's up to you if you wish to hire one. Most of us here at VJ, were able to do the work ourselves. We were the only ones who could guarantee OUR 100% success rate. As long as you don't think there are difficulties in your case, you may not need one. But, as I have said, that decision is up to you. Best of luck!

Welcome to the waiting game. Everyone on here is a participate and no person is an exception. 18 years of age is considered the legal age in US to be an adult. Being "out of status" are usually not good words. The best advice I think any of us could give you and your fiancee' is for her to consult with a family-based immigration attorney which you could receive probably more options and/or better advice to your situation that no one here would know about. This is just a visa discussion forum. Getting sound, legal advice from someone who specializes in immigration visas I think would be more helpful to you both.

I don't want to rain on your parade. But there are realizations to the visa process. You have to keep in mind there are a lot of factors that could come into play and could cause delays. Keep reading these posts and look at people's timelines on this site. Some have gone fast, some at a normal pace, some have gone slow, some are sitting and waiting in an abyss without any knowledge where they sit in adminstrative review. You can get a generalization of the visa process. But there's no guarantee any of this process can be completed in 6 months or less.

We are worried about the content of this letter because I have read that sometimes imigration ask for more evidence. I´m not sure if in case of the RFE be necessary, it comes with the NOA1 or if they may ask for the RFE in another mail?
When we check our case on USCIS page this information do not change since 2-3 wk ago... The same happen when we check about the processing times on CSC...
What is happening? It´s a normal thing?

Are you doing a K-1 or K-3 visa? It says K-1 is what you are filing for. But then you referred to your "husband". Are you married to him? When I read that, I was thinking you need to be filing for a K-3 visa. Not a K-1. The K-1 visa is to bring your fiance(e) to the US to be married.

I would put that she is single and has a child.
It is not illegal in US to have a child without beeing married ans she was not legally married.
If they ask her on the interview i would say that she had a child with this man and he left her, wnent to Malasia and passed there.

It will depend who is listed as the child's father on the birth certificate. The US consulate in her country may request to see proof of the child's other parent's approval that it is okay for the child to immigrate to the US. If she does not have it, then a death certificate may be requested. As I have stated earlier, it's best to seek the advice of compentent, qualified family-based immigration lawyer. It would suck to get the interview and find out these surprises.

I have a couple questions for you guys about former marriages.Ok, so my fiancee is from Thailand and when she was 18 her family pressured her into marrying. They never registered it with the government and she never changed her name. She also had a daughter out of this. The husband and her finished after 3 months and he moved to Malaysia and he died there. They do not have death certificates because they were sent to his fanmily becuse she was never "legally married" because they never registered it with the govt.
On some forms for the K-1 Visa it asks if your fiancee is SINGLE, divorced, or widowed. Do you think I should say she is single, or widowed? Remember, she never registered it, so the government never knew she was married. What should she say about the child? If they ask?

Well, you are going to have to list the child in the application if she is bringing her daughter with her when they immigrate. I do not know the laws that govern her country on removing a child with or without consent of the other parent. Or if the US consulate there will ask for approval stating the other giving consent to the child leaving.
You will receive more advice about this as others look at it. But I think in your situation, it would probably be best if you consulted with a compentent, family-based immigration lawyer. It could not hurt getting legal advice from someone who is trained & certified in this area. VisaJourney is only a forum of public opinions and advice. Good luck to ya! ;)

however there is a guy on theworldoffilipinas.com who just receved his NOA2 approval from CSC, and he has never met his filipina fiance. he has mental fatigue and financial hardships he says and got a lawyer to say he cant travel. he got approved yesterday. it will be interesting to see if his fiance is approved in manila. and he is not wheelchair bound etc. he looks fine to me. i dont know how me will afford her expenses there for the visa or the AOS here in the states. im not even sure how he afforded a lawyer. he seems to still live at home. his posts said he asked his dad if he could marry the girl. they have chatted online since 2004. He did get a RFE for more on the relationship, so he wrote them a letter telling them it. he posted his letter back in may. he filed in march but the way.
in the end, he did get approved. he posted the email stating the approval.

I think about the US citizen husbands and wives who marry and have children with an illegal alien. Do they actually think about before having children with an illegal alien, they could lose their spouse at any given time and the same situation can happen to them also?

I wish most of us did know how hard it would be when having children with someone who is illegal. My ex-husband was an illegal alien from Mexico. I never knew how hard it would be as far as getting him legalized. We have two children together. I went to the Service center located in my city and they gave me so much wrong information. They made it seem so simple...file the I-129F, he goes back to his country in time for the interview, gets visa, then comes back. That was the process that I was told, not knowing that it was truly much more complicated than that. No, I don't think most people who have fallen in love with someone who happens to be illegal think about the consequences of it. Just imagine how many people are following the "word on the street" and whatever misinformation USCIS tells them and you have a lot of false hopes and children who may never see that parent again. Yes, it is a sad situation, and my children don't see their father either. Last I heard, he had also gotten caught and might be getting deported back to Mexico.
To the OP, sorry that I don't have any concrete answers for your situation. I wish you the best and hope you can get this resolved in an easy and timely manner.

After thinking about your situation for a while. I can't help but wonder if people who are in the US illegally, realize ahead of time what the consequences are after getting married in the US. Then having children, getting caught later on, and being deported back to their country alone. I just think of the mess that has been left behind with a 3 year old and a newborn baby. Having to basically deal with all this on your own and find solutions to unite your family again. But in a legal fashion. I can't help but think of your children and them not being able to see their father for however long it's going to take when all of you can be together again. Unless, you and the children fly to his country to visit on somewhat of a regular basis. Or you decide to take the children and move there to be with him.

I'm sorry, I should have mentioned that he was here illegally and got caught. He spent some time in immigration jail and was released on $6,000 bond. The judge allowed him time to stay here so he could be here for the birth of our daughter.

Thank you for filling in more of the story. I am unsure about where you can turn at this point because he was here illegally. Most of the time, if the situation doesn't have any complex issues, most people can go about applying for a visa without the consultation of an attorney. I would consult the expert advice of a good, qualified immigration attorney. :yes:

Knowing what you are dealing with is important and it will save you a lot of time and aggravation not understanding what people are trying to say to you. Please try to give as much information pertaining to your situation so that the whole picture is painted for us.
You said he left on a "voluntary departure" last week. Did he overstay his visa? If he did, how long? This could be an important factor.
If you're considering a K-1 fiance' visa, the wait time can vary before he can receive a visa. Check out the timelines on this site. They're more accurate than the timelines at the USCIS site.
All the forms you will need for your visa are listed in the GUIDES and Visa FAQ sections of this site. Forms can be downloaded for free from here or the USCIS website at www.uscis.gov.
If you do not meet the require 125% above poverty level, you can always have someone co-sponsor with you. Provided their income for the entire home, including the co-sponsor, meets or exceeds the 2007 Federal Poverty Guidelines.

Im sorry i was not clear enough.. I overstayed for 2 months and i came back in my country..now im home in Romania, we apply now for k1 visa because he is getting his divorced signed soon..(he is waiting for her signature)..


Personally, I don't think a 2 month overstay is going to be very serious at all. You're back in Romania now which was the best thing to do before heading for your K-1 visa. I would suggest heading forward for with your K-1 plans and having him send in all the required paperwork only AFTER your fiance(e)'s divorce is FINAL! I would use this time to gather to help him start gathering all the evidence of your meeting each other, etc.
By the way, I would love to visit your country some day! Eastern Europe is absolutely beautiful! :yes:

I hate to say it. But it looks like you entered the U.S. under a tourist visa with advanced knowledge and plans to marry your fiance(e). It's going to be perceived as potential visa fraud by most people. Did you enter the U.S. first and then met your fiance(e) after entry? Or did you know your fiance(e) before and discussed getting married with your fiance(e) before you entered the U.S.?

How did you get here on a K-1 Visa if your fiance' was not fully divorced and free to marry you? I thought it was requirement before a visa was approved for the beneficiary. Are you sure it was a K-1 Visa you entered the U.S.? :blink:

Looking at all the posts you've made in such a short time, 5 new posts in 3 days. I think people are perceiving it they are doing your work for you and are becoming annoyed. Just follow the guides and it will walk you through all the same process we are all going through. Anyone doing this process on their own without help from an attorney, really needs to familiarize themselves with EVERYTHING in accordance to the K-1. It's best to ask questions when you're really stuck on something when your research has failed. Or after you've finished following the guides and have your K-1 ready to be sent and need to double check something. People can read a post from someone and tell right away if they've actually made the effort on their own to learn the process or not. This will probably help you avoid some hostility from others over questions you're asking.

My fiancee has signed new G-325A's with corrections and they will be brought over at the end of this week with a guy who's seeing her friend! I'll be ready when the RFE arrives! :thumbs:

My service center is California. Can I mail my package Certified-Return Receipt to the PO Box address or do I send it to the physical address? :help:

It should be whatever address you list on the label that will be attached to the package requiring a signature. Physical address or PO Box is fine. Flip a coin! The choice is yours where you want to receive the return receipt. ;)
