K-1 Fiance(e) Visa Process & ProceduresPolyamory and K-1 visas
Isn't there a box on the Federal 1040 that asks if you're being someone else is claiming you as a dependent on your tax returns? If your boyfriend is, as the original poster has stated, how is this being done? They're not married. She's not receiving full-time medical care. She's not under the age of 18. How? I am very curious. If the original poster has to submit her previous tax returns as required for a K-1 petitiion, it's going to say the person who the person is that has claimed her on their taxes. Am I right? Or have I missed something?

K-1 Fiance(e) Visa Process & ProceduresPolyamory and K-1 visas
There seems to be no fraud attempt. No use stating what isn't there. I don't remember reading anywhere stating in the visa guidelines anything about "love". I've only read that the person(s) applying for a K-1 have to prove a legitimate, ongoing relationship. The government does not outline how the relationship is to be conducted between a man and his wife. Being married and having another lover on the side is more of a moral issue. It's not a legal issue. How many people are married and having affairs with another lover? They don't go to jail for having sex with another consenting adult if they are married. You certainly do not get "stoned" for it here. Imagine the consequences. People can jump on the Bible bandwagon. There's nothing illegal if someone decides they want to take on as many lovers as they want and have sex with whomever they wish. From a legal standpoint, the person can only marry ONE person at a time when they are free and able to marry.

K-1 Fiance(e) Visa Process & ProceduresWhat is the Fee
Here's one simliar to the big post yesterday. I have a girlfriend here in the US that is a citizen. I want to bring my foreign fiancee' here on a K-1 visa so we can all live together in perfect harmony. I don't make the required 125% above poverty level. So my American girlfriend is going to sponsor my foreign fiancee'. Will this be a problem in me filiing a visa? Should I disclose on my application that there is also another girlfriend? But she doesn't live with me. Will they accept my application if I send it C.O.D. to the Service Center of my choice? Do I need to personally need to apply my personal signature on documents? I would prefer to have the homeless guy in front of the liquor store do it for me because his signature is better looking than mine.

If you took this post seriously, remember to clip yourself out a "clue-pon" out of today's newpaper! :D

I'm sorry...my attempt at sarcasm fell flat. :( But thank you for being kind enough to answer.

I was just tickled that the OP had the eggs to go off on people for not liking being asked such a fundamental, easy to research question.

Please forgive me for wasting the time it took to post a real response to my fake question!

FFFFFFFUUUUUUUUUUU!!!!!!!!! YOU GOT ME!!!!!!!
I was wondering why in hell if you reached the point of having an interview, why in the world would you risk all that time and work on a possible visa denial for your fiance'?

Quick question...so my K1 just got approved and we have an open appointment for his interview. Is it okay if I just go to Mexico and marry him before the interview? Will that be a problem?

A K-1 Visa is intended for the foreign fiance(e) to marry the US citizen in the USA. If you marry him in Mexico, you will have to adjust your status to another kind of visa. It is worth the wait for him to come here to marry you since you've already reached the point of getting an interview for your K-1 application. Another potential problem is if it is discovered you married outside the US while your K-1 is in process, he can be denied a visa at the interview since it will not be in conjunction with the visa you originally applied.
I would set the date for the interview and follow through with it. You 2 can be together much faster.

I think there *is* harm being done. By not encouraging people to RTFM when they clearly haven't, especially in a post that essentially says 'OMFG I need to file NOW and I can't be bothered reading the filing instructions first!', people are hardly doing them a service... they're just inviting returned petitions, RFEs and a whole host of other problems. It's not unkind, or unhelpful, to suggest that if you're going to handle your own immigration process, you might at the very least like to consider reading the (hardly lengthy) instructions that are oh-so-helpfully provided with the form.

Absolutely! They are doing a disservice to themselves and their future spouse. It is obvious, this is THEIR life. Wouldn't they like to have as much control as possible to take care of THEIR life?

K-1 Fiance(e) Visa Process & ProceduresWhat is the Fee
It is obvious a person can tell by reading someone's post if they've attempted learning about "their" visa on their own or not. I do not mind helping that person out however I can. But when a person chooses not to actually apply half an effort to learning about "their" visa, and they are doing it without a lawyer, it becomes a really bad habit relying on anyone and everyone to give them an answer for almost every single question involved with "their" visa. This is straight up just being plain lazy and you can see how people become very annoyed at this attitude. I've only posted 5 posts on this site since joining. It was primarily with topics that had to do with self-employment where the GUIDES or the Visa FAQS didn't cover.
It is so simple to read these things and become familiar with it. I would much rather have a person try to apply themself to "their" visa to do the work. As opposed to relying on EVERYONE else to do the work for them. The reward is solely upon them.

Does anyone ever read the GUIDES or the Visa FAQs sections any more? Or the USCIS website? The answers to these easy questions are provided. I'm surprised a lot of people come onto this site and it looks like they want the answers to "their" visa to be provided by other people. Without having much knowledge of the visa being applied, even though all this simple information is right at your fingertips, how do you know you're receiving the right answers for you? Especially, if you don't know the process or do the research confirming the information? The visa process, read it, learn it, live it.

K-1 Fiance(e) Visa Process & ProceduresHello and a G-325A question

Hi all -

New guy here...

I am just about all set to submit the I-129F and the G-325As.

My question is:

Can I have my Fiancee send me signed, but otherwise blank, copies of her G-325A and I fill out the information for her? It will be pretty obvious that the handwriting is mine and would hate for the application to be delayed or rejected because I filled it out and she "just" signed it.

Other than that - wow! It's great to see that we are not alone and that others are going through this crazy-long process as well.

Looking forward to your replies and correspondence =)

--B

I see this question alot, my question is, if they have the form and sign it, why cant they fill it out? Am I the only one who made my man fill it out and write his letter of intent (although I think we did this wrong, I said why we are perfect for each other, and his was a drop dead love letter. ....made me cry.. :)...anyway, so whats up, is it the english that kicks them? I am sure it would help to have the form in their own language, translation is really hard.

And your answer to the question is what? Huh?

In the interest of expediting everything (since the mail takes apprx 1 week from Asia) she signed it and put it in the mail so we could compile all the info and double check it before submitting it in the meantime. Her English is perfect but every saved week and day is something.

Sure. She could send you blank G325's with her signature on it.

Tell your friend to give it a shot. It's up to whomever is going to conduct the interview. They're the person that's going to give the approval on the visa. If she's got a clean police record from that time, I don't see how it would be problem. But I'm not the one approving the visa. Maybe the best thing is to tell your friend to consult with a good immigration attorney for expert advice on the situation. That's about all I can tell you.

Thats ok, no hard feelings here, we're all in the same position here looking for the same thing. When I said that "taking this too serious" I meant about posting and replying questions and not about the K-1 process, of course she's worth it. Just to be too harsh to others and if its really a dumb question, then dont answer it, let someone else do it that way you feel that you gave someone a lesson for not investigating enough and go on and asnwer a more "intelligent" question. Good luck to you and to all of those who are filling.

Welcome to Ukraine! That's what I have to say whenever I'm there and have to deal with strange things like you had described. It's become quite common practice to have bribe cops, etc. When I was there last month, I got jacked by the cops while walking down the street with my fiancee. All for the sole purpose because they could and it was obvious I was not a national there. They wanted to see my passport, but I would only give them a copy of it. They wanted to take me the station. I told both the cops I would give them $10 each. And if they didn't want what I offered, then to take me to the station. But I would not give them my original passport. They took the money and left because they knew if I reached the station, they weren't going to get anything from me. If they would have gotten ahold of my original passport, they could've extorted $200 or more from me. I'm glad I took the advice of my friend that lives there to never give up my passport!
Men traveling there, this is good advice to know. It is legal to give only a copy of your passport to the cops. Stick $50UAH ($10USD) in it and keep it with you at all times!

US Embassy and Consulate DiscussionCo-sponsor & NOA2 question.

Woohoo. Another stupid question from yours truly.

As a January filer, I'm anticipating (crosses fingers) that the NOA2 will come some time this month.

My initial plan was to have my father co-sponsor; he's pretty well off, whatever. But he's also rather lazy and stubborn. *His* idea is to "loan" me $15,000, which will greatly increase the money in my bank account and be easier for him than having to hunt down all the information he needs for the I-134. But I'm worried that someone will find it kind of suspicious that I suddenly had a rather large sum of money fall out of the sky? Has anyone had any experience with a co-sponsor that they could share with me?

Thank you in advance!

I don't think your father giving you a loan will be "proof" of your actual income. This may work on getting a home loan. But this is a different situation. It's too bad about the "lazy and stubborn" part you described. Having him be a co-sponsor isn't a difficult process. Maybe if you fill in a I-134 for him and show him there is not much to submit as support of the co-sponsor. Hopefully, he will give that little extra bit to help you out the right way.

Form DS-156k says that she needs "evidence of engagement". She really doesn't want me spending money on a ring, so I'm wondering if anyone else has used something other than a ring as evidence.
We of course did the letters of intent to marry.

I believe it is the "Letter of Intent to Marry" that is the evidence of engagement. I know a new one must be submitted again for the interview.

Yes, this is a VERY helpful site. FWAGUY is very knowledgeable, too! He answered this question for me a month ago. I wished to confirm, my fiancee does not believe me!

She has horror stories of treatment from doctors in Kiev, and wishes to avoid Ukrainian doctors.

George

I am lucky on 1 aspect for the medical in Kiev. My fiancee's mother is good friends with one of the doctors the consulate appoints to conduct the medical. She's already spoke with him and he will take of it for my fiancee. Not that she has any health problems.
Now if I had known she was friends with one of the big militsa bosses in Odessa, I could've avoided getting jacked for $20 by some young cops! But I know now! ;)

If she can't prove what innoculations she is supposed to have according to the requirements, be prepared that she will most likely receive them again. She needs documentation proof. That is the point of the medical exam, to make certain she is fully immunized and passes to be issued her visa before entering the US. I don't have the list of immunization shots on hand the embassy requires. I know my fiancee has it. I will ask her for a copy of them and let you know if you don't receive a list if anyone hasn't mentioned it here after I receive them.

Thank you,

My wife from Ukraine also doesn't know what vaccinations she has and doesn't believe her doctors have records, so she's probably going to need to get them again also. Can they do this at the time of the medical exam?

US Embassy and Consulate DiscussionUrgent I-134 Help Please

Can anyone help me out with my situation please? My fiancee has interview in Mumbai consulate in April. I have sent I-134 along with employment letter, pay stubs (December - (reflects whole year income) to February), Savings account bank letter, tax returns for (2006 to 2004).

Now, the question is that I graduated from University in 2005 and didn't start my full time job until Sep, 2005, which is reflected in 2004 and 2005 tax returns (below poverty line income). However, my income in 2006 tax return reflects full time job and pay (about 300% more than 125% poverty guidelines for the household of 2 people), and hv savings about (7k). Do I need to worry that my income from 2004 and 2005 will disqualify me as a sponsor? Can anyone please tell me how do they determine affidavit of support qualification? I am really nervous. Any suggestions.

Greatly appreciate everyone's help.

Add in your most recent pay stubs. How far back? It's up to you. But I do not think you have anything to worry about for 2004 & 2005. It's your current status that matters.

The employer is more than likely thinking along these lines. He probably doesn't want to put it in writing your "annual" amount. If he decides to cut back on your hours for whatever reason, you won't have anything from him in writing stating that you "were" supposed to make "X-amount" of money for the entire year.

To be honest with you, I'm not sure right now. For some reason, I recall reading about this somewhere some time back about one or two of the forms needing to be filled out in her native language. I told her to watch the expiration dates on those forms closely. I'll probably go back over them before it's time for her interview.

US Embassy and Consulate DiscussionBringing future daughter America

Our interview is planned for April 27 and after approval my Elena plans to come to visit me in America. She is planning to leave her daughter Anastasia ( who is 3 years old) at home with her mother for about a month . Elena has heard so many horror stories on Russian T.V. about women being abused, forced into prostitution, or made to be prisoners in their own home, etc. She wants to insure that she will not be subjecting her daughter to any undesirable environment. She insures me that she cares for me deeply but she also needs to protect her daughter. I have a couple questions. 1. After Elena arrives and finds out that everything is OK. How can we get Anastasia here ? From what I understand Elena will not be able to return to Russia for quite some time and airline will not allow a child her age to travel alone. 2. Is it possible for me to go to Russia and bring her back with me and if it is, what type of paperwork/documentation is required.

Why don't you and Elena check into an advanced parole? It seems like something like this would be issued where Elena can leave the country and return after you are married. From what I've read, by the time she would receive the advanced parole, it would be in about the same time frame of the investingating she wants to do before she brings her daughter to be with you.
Someone correct me if I am wrong. But it sounds a little more simple.
