What a situation to end up in. It's too bad that the both of you didn't have proof of the annulment before you filed. What date did you list on the I-129F as when she was divorced? If she gets the annulment, the dates won't correspond with what was put on the I-129F. Maybe they won't see it. Maybe they will. Best of luck to you and keep your fingers crossed!

My fiance lives in Florida, so we would be filing it with Texas and then i think it moves to California?

When you get the visa do you really have 6 months to come out on it (and then the 90days to get married)? I thought i read somewhere you only had 4 months. I'd rather apply early and have plenty of time than worrying about not getting it on time.

To be honest i don't think my family would be happy with us getting married without them here and then having a big wedding with them all. I'm the first of my siblings to get married and its a really big thing for my family. I know they recommend not to make plans til you have the visa in hand, but my family needs to book their holiday a year in advance to secure hotel and flights.

I understand that its a popular and more convenient way to get married first and then have a ceremony with your family after. My fiance and I have talked about it and we would rather just have our whole family there and just have one ceremony. I know its a risk.

Yes. Florida filers are now being processed at the California Service Center. Be prepared for a wait. As far as how long a visa is good for, check the US embassy website of the country where you're from. After arriving to the US, you only have 90 days to be married before the visa expires and you will find yourself heading for home.
I can see how your family will not be happy getting married without them being there. The realistic fact of the visa is that you do not know when you're going to receive it and anything could happen to cause a delay. This is why many people on here do not make definite plans for a wedding ahead of time. It is always recommended that never make wedding arrangements until you have the visa in your hand and you're actually here past the point of entry into the USA. You never know if you will be stopped or turned away when arriving. Hopefully, you can talk to your family and have them understand how the process works here. I discussed it with my fiancee' about having a small civil ceremony at the local courthouse to fulfill the visa requirements. We will plan after that for the church wedding where everyone can attend. She was great about it and understood completely. Depending on your religion, weddings that do not take place in the church are not valid before God. But it will be valid in the eyes of US government and you can stay with your loved one. The choice is yours. :yes:

When would be roughly the best time to apply for the K1 visa for a wedding in August 2008? I'm thinking September / October would be time enough? I never realised how many RFE's you can get, and how much it may delay the application. I know once you get the visa you have up to 4 months i think to come out to the US on it and then get married within 90days.

The visa process is very unpredictable. Dates you seen on here vary quite a bit. There is actually nothing solid about when you could receive your K-1 approval.

Is it possible to come out to the US for a holiday to visit my fiance while the I-129F is pending, before it gets sent to the US Consulate in the UK?

I have read from other users on that you. But also, you can't. I've seen the success stories about visiting while having a K-1 application in processing. I've heard of others being denied to enter the USA. You'll probably hear more on this from other users.

What is all the package and NOA's that everyone has been receiving and mailing back?

The best advice that you will see on here is to familiarize yourself with the K-1 process. There is basically, a step-by-step guide section and a FAQ page. Some people come here and ask the most simple questions that is easily answered if they would have taken the time to just look at the guides on this website. Please check those out.

Is my fiance able to petition me to be with her in the United States whilst I am there on my visa waiver tourist thing? If this is possible how much time scale on average does a K-1 take to come thru? If we are looking at within the 90days then do I have to attend an embassy in the United States or would I have to return to my home country to be issued the visa to then return to the US under the K-1?

Your fiance can petition while you are in the US on your tourist visa. When the time arrives for an interview with the US consulate of your country, you will have to attend that consulate. Unless the petition requested another embassy and it was granted. So, yes, you will have to be home to be issued your visa. Then return on the K-1 visa if you are approved.
Since you say you are engaged, it is not recommended that you come to the US and get married. That will move you to another type of visa and whole other set of rules. Remember this, you have to prove when you first met and provide documentation supporting your relationship. If it is discovered you arrived in the US other than just "visiting" your fiance and ended up getting married, you may be denied receiving a visa for a while.
I would highly suggest you read up on the guides section this website has to offer. Information is power and having that power is what will make good decisions throughout the visa process. Good luck! ;)

Has anyone printed their chat sessions from Yahoo Messenger? Sao and I both tried to print a few of our chat sessions and all it will print is one page. Anyone having the same problems and if you did, were you able to print more than one page? :unsure:

Sure. I print mine all the time! If you have the chat sessions logged, you will have to open up the Message Archive where they are all kept. You will see the sessions of each person you've chatted with. That is if you set the option to log chat sessions. If you click on their folder name, you should see all the sessions from each date. If you click on any of the dated sessions, you will have to then "Save" the session somewhere onto your computer. It will only save it as a text file, "Notepad". It won't be bright and colorful and have all those little emoticons except for how they are typed on a keyboard. You should be able to print the entire session after you have saved it. Good luck!

On the USCIS Website where the forms can be downloaded, it says "Fees should be made payable to Department of Homeland Security or U.S. Citizenship and Immigration Services." You can make your check out to me if you like! :lol:

My fiancée and I are just completing the forms necessary for the K1 visa and are confused about the G-325A form. Do we both need to complete one of these forms? If so, who is the applicant? I am the US citizen, but there are questions like "Applicant's last address outside the USA for more than 1 year" and "Alien Registration number" that do not really pertain to me.

Who is the applicant?? Me, my fiancée or both?

Both the petitioner and beneficiary, you and your fiancee, are the applicants for the G-325A and need to be completed and signed. There is a total of 4 pages for the both of you that you must fill in and each page requires original signatures on each one. Do not photocopy the signatures for submission to USCIS. Each page may look the same. But they ARE different at the bottom of each G-325A. Pay attention to this! I didn't and wait for USCIS to request new G-325A's from me and my fiancee.
If you lived outside the USA for more than 1 year, you need to list it. If you are not a naturalized citizen, you will have an "Alien Restration Number". If you were born in the USA, you're not an alien. So you won't have one. If your fiancee had resided in the USA, she was probably issued an Alien Registration Number.
Be sure to read the GUIDES and FAQ's section on this site. It will make the visa process much easier for you. Good luck!

No apology needed. It is funny because apartments I've rented in Ukraine, the washing machine is in the bathroom along with the bathtub and sink. There was only enough room to walk into the bathroom. If someone had a really big booty, they would not be able to sit on the pot! They would have been stuck between the washing machine and the wall! Doing without some luxuries is not that bad! :lol:

Truce? I think we may have to agree to disagree. I see the primary language issue having nothing to do with laziness however I see you are not trying to insult anyone here. It's certainly something that we should all think about given the always growing number of immigrants to the US. I once read an article in Newsweek that was questioning who's version of English is more 'right'? After all, the countries and populations that speak English have grown significantly throughout the ages of Imperialism. When a language is forced upon a population can we really say how they are allowed to speak it? There may become a day where there are more non-standard speakers than standard speakers. That will be something!
But for now, no hard feelings...just some good old intellectual debate.

Ebonics in public schools would have allowed local teachers to speak in a local dialect while teaching certain subjects and then to use Standard English during English class.

I remember when this big promotion of Ebonics was occuring, "local dialect" was not mentioned. That is one thing. But where were the majority of children born attending US public schools? More likely the U.S., correct? That push for government funding, we as a nation witnessed, was for it to be taught in public schools coast-to-coast. I remember the rallies going on in Oakland and Los Angeles. I cannot be convinced there were that many parents of the children attending school at that time had immigrated here speaking an Ebonics dialect.
I go to Ukraine where my fiancee lives. Just like Elena being from Moldova, they were forced to speak Russian under communist rule. Me being an American, I knew I was going to another country. I certainly did not want them catering to me and telling them to only speak English. Out of respect, I learned the language and get around fine without the assistance of an interpreter. I have respect for ANY country and their local language. Please do not think I am insulting another dialect or languages spoken in other countries. Because I am not. I want to make it perfectly clear that I am only referring to "laziness" in actually learning to speak properly and/or the "refusal" of not wanting to learn the official language where one chooses to live.

This way children would not miss out on content but would also learn the standard english needed to succeed in the public world.

On this one, I don't see how substituting one language to take the place of the official language was going to help them learn any faster or properly. It must be obvious that standards of this society are constatly lowered to cater to those who really do not make the effort to actually learn. I doesn't matter where they are from. The requirements for becoming a U.S. citizen long ago, used to require knowing at least some quotes from The Constitution, The Preamble, Gettsburg Address, etc., before being becoming naturalized. I would really hate to see the beginning words of The Constitution being changed over time to, "Weez Da Peepo O Da Unight Stades...". Don't think that example is pointed toward any one race. I live in California and this is how I hear a lot young children, teenagers, and adults of EVERY skin color speak this way. I know they are not being taught this in school...it is coming from another sub-culture of music.

Thanks for the insight Sue. I learned something new today. I was not speaking about another country's native language. When I spoke of Ebonics, I was speaking about the poor annunciation of English words that are commonly heard in hip-hop songs. Black actors, such as, James Earl Jones were against the promotion of the laziness that the "Ebonics" presented here to be taught in US schools. He felt the same that it promoted laziness in learning our native language of English. ;)

You have got to be kidding?!! Ebonics was actually taught in a school? Be glad that so-called "language" didn't stick with you! Obviously, you're educated enough to know "Ebonics" is just a poor excuse to not speak English properly and the pronouciation to combine 1,2, or 3 English words together. Arm yourself with the knowledge. It's not hard at all. Most of us here didn't use attorneys because it is that simple. Unless you have some legal issues from the past or have a complicated situation.

All of you who jump right on "this is so wrong" train need to get over yourselves. Wrong according to who? Your beliefs aren't shared by everyone. I'm pretty certain that we each do something or have done something in our lives that someone else believes is morally bankrupt. Unless you follow your particular faith to the letter and will soon be nominated for sainthood, you should be concerned with your own practices.

The OP has not done anything illegal. She may have a difficult time making a case with USCIS but none of us are going to be the ones to decide whether her petition is approved or not. She didn't ask for your judgments, she asked for practical advice. If you can't be helpful, why bother posting? Take your judgments to church.

This is what she said from her first post, "Either of my parents could qualify for this but I think my boyfriend would be the best choice as I am a dependent on his taxes and live soley with him". She has got to submit her tax returns for the K-1. It's going to state on her taxes who was able to claim her as a dependent on their taxes. This may be the roadblock to filing any time soon. :o

Isn't there a box on the Federal 1040 that asks if you're being someone else is claiming you as a dependent on your tax returns? If your boyfriend is, as the original poster has stated, how is this being done? They're not married. She's not receiving full-time medical care. She's not under the age of 18. How? I am very curious. If the original poster has to submit her previous tax returns as required for a K-1 petitiion, it's going to say the person who the person is that has claimed her on their taxes. Am I right? Or have I missed something? :unsure:
