K-1 Fiance(e) Visa Process & ProceduresNeed HELP with your opinions!!!!!!

Sure, but to wish people's marriages to go to heck and to tell members to kiss his blessed assurance was flat out wrong whether he was upset or not and there is no excuse for that . I hope he finds some peace and comfort in his life.

I received a personal message from genem. What he last wrote was basically out of anger. Some people were pretty harsh on him. He regrets saying some of the things he did. But I told him it was courageous of him to bring something like this out into public for everyone to voice their opinions. I do not believe the guy is cold-hearted. He's got a good heart and his intentions were sincere with this lady. She on the other hand, did not share his vision. I think he was disillusioned with the situation which a battle ensued between his heart and mind. That is why he brought his situation here. He did take many people's opinions to heart and he ended with his fiancee. It was his decision and I think he did the right thing to move forward toward someone who waits for him that will take the loneliness away and replace it with the love he is looking for. I hope a very special lady comes along soon for him that won't try to make him sign marital agreements and ask for extremely expensive gifts. If they love you, they would never ask something like this of you. Good luck genem!

Kinzaa and altimixidi, we're screwing up this particular forum and so :ot:

I think this particular topic is finished. The original poster came back to thank people and tell others he hopes their marriages go to hell. Now that he's gotten an earful of advice that he didn't like, he's ended his relationship with his Russian fiancee. I think that leaves this thread open

I agree everything about this topic is very sad! The name of it, "Need HELP with your opinions!!!!!!". The original poster received more "opinions" then he ever wanted to hear. Looking at his responses during this whole thread, he was plagued with guilt, confusion, and was disillusioned about a relationship that did not have any foundation to stand on or to be built. It was missing the main ingredient, love

UPDATE!!!!!
For everyone that said i already had my mind made up, you will be glad to know that today i emailed my Fiancee' and told her the relationship had ended. For the selfish ones who were angry because we were ahead of you for a K-1 Visa, I HOPE YOUR MARRIAGE GOES TO HELL!!! And for the few who tried to make a "dirty" post out of a plea for help, YOU CAN KISS MY A__!!!! For the rest of you who offered sympathy and good advice, I THANK YOU VERY MUCH!!! Needless to say, i met some very nice people on this site and some real JERKS!!!

I did not realize everyone got divided into category here. Which category do you fall under? :hehe:

1) Selfish one who was angry because he was ahead of your K-1?
2) A "Dirty" poster?
3) One who offered sympathy and good advice?
4) Nice person
5) JERKS!!!

I gave this a lot of thought about what I posted on this topic. I know I'm not selfish. I understand this process is "first come, first serve". No use complaining. It's not going to get me to the front any faster. I believe I did make the criteria for #2, the "dirty" poster. I did compare this relationship to the "Titantic". But I only got half of #3, one who offered advice.
I don't know if I am a nice person or a JERK. I am going to sit myself in the corner and think about this. Which one are you?

I'd had been through a situation with another girl from Ukraine who reminded me of this guy's situation. I wrote this girl for about a month and had plans to go to Ukraine. So I thought I'd go ahead and meet her. The first time I met her, we spent a week together. I flew in her and her interpreter to the city where I was going. That was $400 with cab fare included. It was fun, etc. No sex. I did not pursue it. During this time, she asked me to get her $125 pair of boots and a $50 shirt. I did not think that much of it because I was able to afford it. I continued writing her and decided to visit her 6 months later. We took a vacation to the southern part of Ukraine. Of course, I paid for everything. Except for her cigarettes! It was not long after we got there when she asked me to buy her a purse for $150. At the next store, it was a digital camera. Notice how the items started to cost more? This is how it's going to happen to you gemen. Your lady has these signs and you say you don't have much she can get. If you cannot afford to continue everything she wants, she's going to leave you in the dust, completely financially broke! Wake it up before your sanity is thrown to the wind! :bonk:
To sum it up, I ended it with the gold-digger lady fast! I saw no signs that I could keep up fnancially going from boots to digital equipment to a BMW to a mansion! :ranting:

After watching this post grow and grow, it is funny how it includes not being sure about this lady, giving her money, asking for it back, her not being happy because she didn't get a $1200 dress, her sleeping on the couch after their 1st sexual encounter, her ending the visit 2 days early with him, asking for some kind of marriage agreement to be financially compensated if there is a divorce, absolutely each other not actually being in love, etc. It goes on and on with this guy! Asks for advice after telling us all the ####### within this relationship. And then, actually trying to defend the relationship for some oddball reason!
The man is 62 years old. Going by his own posts, he's fairly set in his ways and no matter what anyone here says, he's going to do what he wants. Regardless, all the answers to his doubts are hitting him over the head! :bonk: Even though he is trying to force something to be there when it's obvious, in his own words, that they will love each other in time.

The only winners in a divorce are the lawyers.

I absolutely agree with you it's only the lawyers who win in a divorce case. The more they can instigate a situation, the more they make. My divorce cost me $20K also. It was all for the sake of pure greed on the part of my ex. Her stupid attorney convinced her to go after money and things that did not exist. I had to disprove all of it. Which is why it cost me so damn much! But it wasn't only me that paid for it. My children did too. In her quest for what she thought was going to be free money, I fought and I don't have to pay her a damn dime! In reality now, I sit in the position she should be paying me! She's lucky I am not a greedy or vindictive ####### like she was in the divorce! All in all, she's said and done things which my children have lost much of their respect for her. And nothing I had do with it either! My fiancee wants all my children to be living with us full-time after we are married. Instead of 50% of the time. I only expect things to get better as time rolls on. Life has a funny way of working things out, don't it? :D
With the way how divorces are glamourized here in the U.S., pre-nup agreements should be mandatory before any marriage. And updated as property or assets are acquired. I would love to see divorce attorneys start taking a hit to wallet!

Bottom line, if you all these thoughts are going through your mind and you've got doubts, let her go! She's made you unhappy the little time you were with her. That should be enough of a clue that is how it's going to be with her after you're with her full-time. No one needs ####### like that! If you still plan to be go through it all and be with her, better take your money and find somewhere it can be hidden and not found for the divorce court! :bonk:

K-1 Fiance(e) Visa Process & ProceduresHow does getting a work visa compare

If the fiance is here on a valid, legally obtained work visa, there's really not going to be a problem unless someone had the ability to fabricate an entire US corporation that could obtain the work visa and no employment actually existed - which I'm going to go ahead and assume is no where NEAR what the OP is asking about here. And I'm not sure what the met-within-2-years requirement has to do with the work visa question. All they have to have done for the K1 is to have been in the same geographic place together within the last 2 years. Not met as in formally introduced to each other, etc. And that requirement is for K1 which presumes the fiance is not currently present in the US. If the fiance were legally present under a valid work visa, then there'd be no K1 process, just an adjustment of status.

What the OP is talking about is not an attempt at visa fraud. A relationship with an American does not foreclose a foreign citizen's ability to seek a work visa to obtain employment. There are plenty of requirements and checks for legitimacy under those visa application procedures. We're trying to compare apples and oranges without the benefit of formal agricultural training, if you follow my analogy.

Sure I follow the analogy. I live in an agricultural region. :P
As I had said, "I would consult an immigration attorney if you really wish to find out other alternatives".

K-1 Fiance(e) Visa Process & ProceduresHow does getting a work visa compare

So I'm just about to send off my I-129F Petition for a fiancee visa and was wondering... if my fiancee could (I realize it's difficult but possible) get a job in the States, how would this compare to the K-1 fiancee visa? For example, if she was working in the States could we get married and then could she remain there? Does that make it much more complicated? I was just thinking about the different options and want to make sure I'm doing the right thing. Any thoughts would be appreciated :)

Cheers

The suggestion you're making is considered to attempt visa fraud. If your fiancee was to come here on a work visa and THEN you two had met after her arrival, that would be a completely different story entirely. Since you two do know each other and are engaged, I think you would have to create a ton of lies to say how you've actually met in the last 2 years, etc. Getting caught lying on the visa application would quite possibly get the visa denied. I know it's a long process. Some thinks are just worth the wait to do it the right way.
I would consult an immigration attorney if you really wish to find out other alternatives.

K-1 Fiance(e) Visa Process & Proceduresno gender on my authenticated birth certificate
I hope activism groups aren't watching this thread and get any bright ideas! That will give them an idea to lobby for some political reform to be "politically correct", so that future birth certificates not have a gender indicated. This way a person can choose which gender a person think they should be. And not with what nature has obviously gave a person's body to tell if the person is "male" or "female"! :bonk:

K-1 Fiance(e) Visa Process & ProceduresTax return

Ok
Here is my question, my fiance and I have been self employed, duel members of an LLC for almost the last 2 years. We were told not to put it on the application because the ...oh Catholic Charities people said it didnt matter.

Now I wonder about some of the advice they gave us

The whole thing boils down to making sure the person you are petitioning for a fiance(e) will not become a public charge once they are here. The government wants to make certain you are able to provide adequate financial support. Petitioners for the K-1 will need to prove they do meet the 2007 Federal Poverty Guidelines. If you are able to show that you are, you've met the requirement. If you do not meet that poverty guideline, you can use your assests or have a co-sponsor for the visa. I think it's great you are working in the same LLC. Unfortunately, I do not believe they will include her income. It is usually just the petitioner. I could be misinformed about this since the two of you are duel members of a LLC. I hope there will be more input on this situation for you from people in a similiar situation as yours or has already gone through it.
As far as what you read from this forum or what you hear from Catholic Charities, you should always research further to confirm advice. People on here are not immigration lawyers. If you are unsure, you may want to contact a competent immigration attorney.

K-1 Fiance(e) Visa Process & ProceduresTax return

I am a Sub "S" corp. The profits from my biz go to my W2. I can not get my personel tax returns untill the company returns are complete. We are not going to file untill the deadline in Sept.
I do not have any problem meeting the minimum income requirements so that is not an issue. I can show all my bank statements, checking and saving as well as my investment accounts as well as payroll stubs from the biz. I am not going to be able to provide end of year tax statements for 2006 untill who knows when.

I'm a sole proprietorship. I am not familiar with "S" corporations. Hopefully, someone will come along soon and offer a little more to you. I know for sure that meeting the financial requirement is the same for all of us. I see on here sometimes people stating their "business" makes more than the adequate amount required. The one thing that is pointed out, it's not the business petitioning for the visa, it's the person. Now, it all comes down to "proving" it to the embassy when the time is right.

K-1 Fiance(e) Visa Process & ProceduresTax return

Oh I am doing the finishing 2005, personal and self employed, 2006 personal and self employed.

Have a self employed question to ask, but I dont want to ask in the open forum and really only want to ask someone who has strong strong knowledge about the K-1 process and employment.
Bobbie

It's always best to ask in an open forum. If anyone is saying something to you that may be incorrect, it allows other people the opportunity to point out what may be incorrect advice you are receiving. Or others can add something that may be beneficial to you. Never be afraid to ask something! We're all going through the same process and trying to reach the same goal together!

K-1 Fiance(e) Visa Process & ProceduresTax return

I am a Feb. filer thru CSC. I have a while to wait, our interview could or should be in August.
My question: I am self employed and due to some last minute changes in the tax law, many companies are having to file for an extension on filing their taxes. I am one of them. I will not recieve my tax returns for the 2006 year untill after September. If my interview is in August or September my most recent return will be for the 2005 year. Is that going to cause me problems? If so I want to start on an alternative plan now as these things can take a long time to resolve. I will get my timeline up when I have something to post. as of now CSC recieved our papers on Feb. 2nd, since then it has been the usual, nada!

Another self-employed person like me. I'll share with you what I know to help you. Give your fiance(e) copies your last 3 tax returns. To make up for not having 2006 taxes by the time you're expecting the interview, back it up with copies of your bank statements. Include the extension filed. You never know, you may get your 2006 tax returns back in time to give a copy to your fiance(e) for the interview. And if you meet the 2007 Federal Poverty Guidelines, you may not need to use the copies of bank statements. If you do not meet the required amount it states for your situation, you can use assests or you may have to find a co-sponsor. I gave my fiancee the last 3 years of tax returns and all of last year's bank statements. I will be sending her this year's bank statements also. So she would have them on hand for her interview when the time rolls around. Even though I did meet the 2007 Federal Poverty Guidelines.
As always, I tell people to research further. If in doubt, seek the expert advice of an immigration lawyer.

Thanks,

Something related to this was brought up the other day. Official documents, such as your birth certificate, divorce decrees, etc., must be translated by a certified translator. It was mentioned that it is best to check your embassy's website for actual confirmation on which official documents need to be translated by a certified translator.

I wrote my personal check to "Department of Homeland Security" and not "US Department of Homeland Security" is that ok?

Also, I moved in the past couple months and my checks still have my old adress on them, should that be a problem?

Thanks

Your check should cash fine without having "US" in front of the "Department of Homeland Security". If you've moved in the past couple of months, I hope you have let you bank know about the change of address. Your cancelled checks and statements will be returned to them if the new person at the address does not throw it away.

thank you so much kim and khalid :help:

Hello! Welcome to VJ! First, you should read the guides and the Visa FAQ pages of this website. If you follow the guides carefully, you should have no problem doing the K-1 on your own. If you anticipate any legal problems that may affect your petition for your fiance's visa, you may want to seek legal advice from a qualified immigration attorney. I would seriously familiarize yourself with everything pertaining to apply for a K-1 visa and you should do fine! Good luck!

We got the list of doctors & forms from the Internet & she did the medical last week.

Your replies are very chaotic! I cannot tell who you are replying to without having to jump back over a lot of posts to see where which person your reply is directed. I am curious, from what I've read about the medical for interview. It's supposed to be completed at a designated medical facility by the consulate/embassy fairly close to the date of the interview?

K-1 Fiance(e) Visa Process & ProceduresProof of relationship on K1 visa app.

I now realize that I may not have provided sufficient proof of relationship on my K1 visa app. I provided three photos of us, one each from each of our trips to meet each other. I dated the photos and specified the location taken, however, after reading this site, it appears that may not be sufficient.

Assuming that additional proof of relationship is going to be asked of me, is it something that I can provide in advance, or do I have to wait until requested? In other words, can I supplement my petition right now (before being asked)? Is this wise?

Also, does the level of proof of relationship required vary by country? In other words, do certain countries raise more "red flags"?

Your passport stamped with dates of arrival(s) and departure(s) from her country when you visited her, boarding passes, flight itineraries, and hotel receipts are a good start to begin gathering them. I'm sure you will receive more input from many more people on here.

I just read where I should send my fiance's birth certifcate with my petition. I have his BC but it is in Danish. How do I get a translated copy? Can this be something my fiance can do? Can he translate it into English and then submit that along with his Danish BC?

If he is competent in both English and Danish, he can do it himself. I would probably advise him having it notarized before sending it to you if he does it himself. Or if anyone else does it also, notarized it. Hope this helps! ;)

Obviously there was no receiver present to receive the package. Wait it out. If they return it to you, then you just have to resend it.

Thank you! But how it can be possibel? I guess our adventure starts from here

It is so simple- just to deliver. My fiance tells "We send on P.O. Box (how I-129F instructions tell you) so may be it means that nobody should sing for it", but again??? I am so confused and so upset

I saw this topic and I thought the end of the world was happening! Relax Elmira. After traveling to many different places all over the world, I can say with 100% certainty the US Postal system is much better than any other place I've encountered. If it was sent to the wrong address, it will be sent back. In that case, you've only lost a few days. Things will be fine. Someone will sing for it if it's made it to where it needs to go. ;)

I like to thank everybody for all the input
we decided to pull the visa complete and wait when the divorce is done in which should be soon and then we will reapply
don't want to take chance

FYI Hong Kong courts ..cost $86.00 can complete a divorce and it is recognized buy the US consulate as noted on there web site but it is not recognized buy the Philippines not a big deal for either one of us

we did a CENOMAR that when we found out it was listed it was a surprise for both of us she was informed several years ago that it wasn't I'm sure it wasn't formal as we did she had a friend that worked in NSO

So my next step is to contact American Consulate in Hong Kong to send it back to me ...wonder if they can keep it and we can submit the corrected documents later ...just a thought

Sounds like some sensible thinking young man! Glad to see you're not running the risk of seeing if they find it or not. The good thing about this is that it should be a breeze the next time you go to submit! You already know what's got to be submitted. It should eliminate the stress of trying to figure it out again! Best of luck to you! :star:

K-1 Fiance(e) Visa Process & Proceduresplease help..still married but filed K1
What a situation to end up in. It's too bad that the both of you didn't have proof of the annulment before you filed. What date did you list on the I-129F as when she was divorced? If she gets the annulment, the dates won't correspond with what was put on the I-129F. Maybe they won't see it. Maybe they will. Best of luck to you and keep your fingers crossed!
