Why even worry about the lifting of conditions when you haven't even gotten married yet?


did you even read my original post?

If it is at the time of interview we may as well put the wedding back but if it is on entry then we would rather go ahead with the July wedding so we will have reached the 2 year mark.....

Ok......here goes....

Like the good girl that I am :D I have been doing some research on how I stand if we are married over 2 years vs less when we return to the States. We are due to marry in July this year, but won't be leaving for US til sept '08 (DCF). My SO is military and has a 6 week training thingy starting immediately after the wedding so we have been thinking about putting it off until end of Sept.

It struck me that there was something about the length of time you are married which can make some difference in the lifting of conditions so I went to look.

My question is does the 2 yrs thing count from the day of entry to the US or the day of the interview?? cos I have come across both these statements on the guide section....

"Due to immigration fraud, the CIS gives ALL immigrants by marriage a conditional permanent residency green card unless the couple has been married for over 2 years at the time of interview."

and this....

Note: If you have been married for less than 2 years when you enter the US, your Permanent Resident status has ?conditions?. A CR-1 PR is no less a PR than anyone else, but they do have an additional step to take 2 years after they enter the US. Please see the Guides for Removal of Conditions (form I-751).

Am I missing something or am I right to be confused? :blink:

Went to the SS office to update my records on Wednesday, and got my Certificate of Naturalization back in the mail today.

:goofy: A couple question pleases. My husband had his interview and oath ceremony today in Atlanta. We just got home and live near Mobile, AL and will be applying by mail for his U.S. Passport.

1. Some of you have talked about updating your social security card. My husband's card looks just like mine without anything on it referring to him as a Permanent Resident, etc. when he got it (other than when he first came to U.S. he had one before he got his work permit and after he got that they took that language off his social security card). So does he have to go down to Social Security or not? If he does, won't he have to take his Cert. of Naturalization? I ask because this poster said he/she went to the SS office but didn't get Cert. of Nat. back from Passport office until the next day.
2. Since my husband has to change his driver's license as it shows FN for foreign national and if if the above is true with needing an updated social security card, wouldn't it be best to get those two things done by using the Cert. of Nat. before applying for his U.S. Passport as applying for the passport first his Cert. of Nat. will be sent off and not be available for weeks?
3. And lastly, just a clarification, if/when my husband leaves the U.S. he shows his U.S. passport and when he enters the U.K. uses his U.K. passport which they will stamp. Visa versa when he leaves the U.K. where he uses his U.K. passport and when he enters the U.S. he uses his U.S. passport and gets his return stamp in that one correct? He is worried that he should have both stamps (coming and going) in one passport but it will be fine with one in each correct?

Ohhh ouch North Vancouver is the part of Vancouver about the farthest away from the border you can get so you would've had to get to Vancouver, drive through it, and then cross another bridge to get over the Fraser River again to get to North Vancouver. You could probably commute from those three areas but Richmond is basically on the opposite side of Vancouver - I think Coquitlam and Burnaby would be a better option since they are along Highway 1 that heads to North Vancouver eventually. But I wonder if it might be even better to live in a community close to North Van on the other side of the river instead.... not sure what communities are around there to be honest. Could be time to stare at Google maps!

CanadaUS Citizens might be moving to Vancouver

I cross the border to Blaine frequently to visit my fiance further down in Washington. There are two border crossings you can use about 5 minutes apart from each other - one is the Peace Arch crossing and the other is the Pacific Highway / Truck Crossing. The problem with living in Blaine and driving to work in Vancouver is twofold.

First, the traffic to Vancouver in the mornings is indeed terrible. The thing with Vancouver is, it's crammed into a narrow line between the border to the south, the mountains to the north and east, and the ocean to the west. There are also several rivers notably the Fraser River in particular that crosscross the area. Long story short there are tunnels and bridges you have to cross and they always create large bottlenecks. Commuting to Vancouver in the evening on a quiet day can take me 45 minutes from where I live in Surrey, but if I was to drive in to a possible job around 8am it could easily take me over one and a half hours, if not more. If you take the bus from here it would easily take over 2 hours.

Then there is the problem of the border crossing - you are never ever guaranteed to have a quick crossing and unless your husband's job is okay if he shows up for work late often or maybe comes in early often that will be an issue. Rarely, I can cross down to WA in 10 minutes but it's usually at least half an hour for me and lately it's been more like an hour. Now mind you I'm going south in the morning so I can't really say what the crossing up north is like but it's usually a decent wait for me in the evenings when I come back too.

If you had a Nexus card, they are open from I believe 7am to midnight and it will only take you at the most 5 or 10 minutes to cross - so if you can get Nexus that might be an option. But just be aware.

Your best bet is as the other poster said to look up neighbouring communities a little closer than mine. It might be a little more expensive than Surrey but you would have to deal with a little bit less of a commute as well.




:goofy: I appreciate the input. I suppose I will look into Vancouver area now. The location of the job is in North Van, just over the Harbour. Someone suggested the areas of Coquitlam, Burnaby and/or Richmond. Would you concur with those since the job in in North Van? Thanks! :goofy:

And again, the gas is sooooo high in Canada - YUCK! I just seems like we would have more $ living in Washington between housing costs and gas costs. :goofy:

I would suggest looking into living in a smaller suburb (Coquitlam, Burnaby, Richmond) because housing costs will be less, but still expensive. A 3BR home would be at least $1500 to rent, probably more. It depends on the landlord though.

:goofy: A couple things I have seen is that in Canada they do not have any of our cell phone companies (Verizon, AT&T, T-Mobile, etc.) and we just signed a new 2-year contract with Verizon last month that we couldn't use and would pay a hefty sum to get out of. Then I wonder what the fees are for getting a driver's license and for registering a car in Canada too. :goofy:

That way the housing may be cheaper and the gas would be cheaper. I don't really know any cities over the border and would certainly not consider as far south as Seattle as that would be over a 2 hour drive, but looks like a 1 hour drive just into Washington. :goofy: Hello. My English husband just received his U.S. citizenship last month. He is now being considered for a job in Vancouver that just came up. The salary is very good but I know the cost of living in Vancouver is high.


Would some of you that currently do or did live in Vancouver give me your thoughts on the area and housing prices for renting and/or buying. We currently live on the Gulf Coast in Alabama and I know right away there will be a HUGE climate difference. We currently rent a 3 bedroom, 2 bath home, one level, attached 2-car garage with a medium sized front and backyard in a subdivision for $1050.00 a month. Our electricity (no gas) averages $90 in the winter and $175 in the summer. How might these prices compare to Vancouver and does Vancouver had houses to rent or only apartments? Any information on Vancouver you could give me money-wise would be greatly appreciated. THANK YOU! :goofy:

Canada and the US have a tax treaty between the two countries that effectively stops double taxation. When a US citizen works in Canada he is still required to file a US tax return, however the tax treaty rules that the individual will pay taxes in the country in which he resides - so he would pay taxes in Canada and then on his US return file for a foreign tax credit to cover the tax paid to Canada. You will find that while you may pay more in taxes (depends on how much you are earning and what your tax credits are in Canada) you will also be getting more for your taxes, especially in terms of health care and social benefits so it is a good trade.

It wouldn't be a bad idea to talk with a knowledgeable cross-border financial adviser as there are a number of cross-border issues that might come up such as retirement pensions and such. Good luck with the job - Vancouver is a wonderful city in which to live and I am sure you would both enjoy living there very much.

My English husband just got his U.S. citizenship last month but is being considered for a job in Vancouver, Canada. I believe I have read that if you are a U.S. citizen and move to another country and work, you still have to pay U.S. income taxes or at least file them. Does anyone know for certain if we move to Canada, will my husband have to pay both Canadian income taxes and U.S. income taxes? It might not be worth the move if he is taxed twice. My step-son (K2), age 20, wants to stay here (Alabama) as he has a job, friends, etc. When we fill out the I751 in mid-February, I guess we put two separete addresses (the K1's and K-2's) and they will send two different biometrics appts. (one in Florida, one in Alabama), but if we have to do an interview (are they still doing some for I751s?), will the K2 have to go to where the K1 is or will he have a separate interview (doubt it). But regarding the address change we already sent our change of address to the USCIS so they will be looking for bills, etc. with our names at that address (in Tampa). Keith has been at that address since mid-October and our lease, power bill, and water bill will be in both of our names there. Then we each have a Walmart account that shows both of our names at the Tampa address. If we only sent in our utilities from our B'ham address wouldn't it look even worse and they would wonder why we have B'ham bills but a Tampa address and no Tampa utilites in both our names?

Regarding Keith's son (I think you were asking about, not mine), he will be 21 in February and plans on going back to England for good by the end of the year. We didn't have any more problems with him per say, but his head is still of a teenager and he does not want to show responsibility and grow up and be an adult now relating to work and financial responsibility. He wants to go home and be with this friends and his mom and sister. It is a shame as he didn't even want to stay a few months longer and have his conditions lifted. We will send our I-751 paperwork mid-February and biometrics would be approximately April or May, but he doesn't want to stay that long to wait, and he doesn't have the money to fly back for biometrics and then back to England again. But, that is his decision and we can only explain situations and can not force him to wait, though four or five months for a ten year green card would be worth the wait. Anyhow . . . . goofy.gif

goofy.gif Happy Holidays to All!!! I will become a regular poster on this forum in the next few weeks as we make our way to package up our I-751 material.

Here is my question. Since our wedding over two years ago we have lived in Birmingham, Alabama and obvioulsy have utility bills, bank statements, etc., in our names at that address. We are now moving to Tampa, Florida. Actually my husband moved down there nearly 8 weeks ago to start his job and I was waiting on my high school daughter to finish her semester exams and will be moving down next Wednesday. When we get our documents together for proof of our marriage do I need to explain anywhere why we have some bills with one address and some bills with another address or will it be obvious? We did fill out the change of address form on line and also sent the appropriate form to the Texas Service Center.

Also, I had read where some people send letters from friends, co-workers, etc. and I have four letters but I just realized they are supposed to be notarized or something. Do you still think I can send our letters with just their signatures, addresses and phone numbers? Since all these people are from Birmingham, I don't want to have to make them figure out how they can get them notarized since I am moving next week. UGH! goofy.gif

Most everything you send are copies, but because the letters from our friends have the raised notary seal do we send the originals so they have the original notarized form? I cannot find any specifics on this. All I see is: " . . . you MAY include affidavits from people who know you as a couple (see examples), confirming your marital relationship -- note that they are not required". goofy.gif Hello all. We are about to mail our I-751. My husband's son (K-2) came over with him and got his 2 year GC but has since gone back to England and will not be applying for his I-751. Do we need to note this anywhere in my husband's I-751 cover letter since they came over together?

On the I-751, Part 5, we did list him under "information about your children" along with his A# (as there is a space for it), and then obviously answered where asked "If in U.S., give address/immigration status" we put "N/A - moved back to England". I suppose this is okay? goofy.gif
