IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsEveryone going through Administrative Processing in ISLAMABAD
hi my husband is not from islamabad but from palestine. he had his interview june 23rd. He passed with a very nice co BUT he wanted an addtitional document from me and was given a paper stating "we cannot issue visa at this time under 221g, and in order to complete processing of this case please submit: and it states a "no tax note from petitioner, signed and dated." The co told him when you send us this well look at it then call you to submit your passport. The embassy will have it in a few days, i made sure to send it asap.

I really hope it doesnt take long, i can feel with everyone who has some sort of delay after the interview, its very hard but its out of our hands. I wish everyone the best and inshallah we are all reunited with our loved soon.

Removing Conditions on Residency General DiscussionForm I-305 and Cancelled Immigration Bond Refund

If you do not have the original receipt (Form I-305), complete Form I-395 (Affidavit in Lieu of Lost Receipt of United States Immigration and Naturalization Service for Collateral Accepted as Security) and mail a notarized original to the address listed below. Include a copy of the bond contract (Form I-352) if you have it.

Debt Management Center
Attention: Bond Unit

Here are two links I Found that have the same information.
http://www.kennedyim...n.com/bonds.htm
http://www.immgonline.com/page/i-395

I hope at least this gets you started.... not very familiar with the subject!

I know the process, and am aware of the 395.

What I need to know is "what" exactly "is" the I-305? I cannot find a sample anywhere online, and the only form I remember us getting was the Bail Bond Receipt with photo when we posted the bail.

Is that the form? I just want to know what the 305 looks like. That receipt document doesn't have I-305 written anywhere on it--neither does any other form we own.

Alright, this post "should" be quite simple.

I know we have this I-305 document "somewhere" in a mix of hundreds of other documents.

In order to get our bond back, we just need to submit the original I-305 Receipt of DHS Official.

The problem is, I have no idea what this form looks like.

If someone could post a sample for me, it would be extraordinarily helpful. Otherwise, it may be less trouble for me to just submit the I-395.

Thank you very much!

Philippinesproblem obtaining Foreign Police Clearance
QUOTE (jasman0717 @ Nov 1 2007, 07:14 AM) <{POST_SNAPBACK}>
If you have the letter from Qatar stating this fact it should be acceptable to Manila.

Arlyn and I ran into this same hurdle.

She worked in China for 8 months, and did so with a Business Visa class that China does not offer Police Clearances for.

I will tell you exactly how we resolved it.

I contacted by email the US Department of State located in China, explaining the exact details of the situation--including where she worked and the dates she did, etc.

They responded the same day with the private email address of the American Citizen Services of China, and when I gave them the same email, they responded immediately with the answer, in writing, in the email, from the U.S. Consulate in China by a Chief Immigration Officer.

It stated specifically that what was on the reciprocity table on the U.S. department of state's website was still accurate and verified with local authorities.

Next, email the US Consulate of Manila and ask them what further action they'd have you to take.

They will send a letter to your fiancee with her Packet 4 that states exactly what to do.

They will inform her to get a copy of the letter you received from the Chief Immigration Officer, and take it to that country's (Qatar in your case) Embassy in the Philippines, then get it verified and notarized by that embassy, and then make a copy of the reciprocity table portion dealing with the issue also, and bring that to the interview along with your other evidence.

So in the end, what you need is:

1) Notarized and signed copy of the email the American Citizen Services Official sends you. (MUST be done by the Qatar Embassy of the Philippines.)
2) A copy of the reciprocity table website portion that states exactly what they verified with you in writing.
3) A verbal explanation to the Immigration Officer that interviews you that you made the attempt to obtain the Police Certificate, but the above evidence is all you were given.

In the end, the REASON certain Visa classes are not eligible for Police Records is because some Businesses do not handle Visa's correctly and do what's known as "same-day" stamping of the passport--even though the worker lives in the country far more than one day.

This is an attempt to save money on taxes and other fees, and to relieve them of liabilities they'd otherwise obtain if they were to correctly stamp the workers' passports.

As a result, they will not release Police Certificates for certain Business Visa classes or under certain timeframes depending on the country's inner ethic.

Hope this helps!

PhilippinesOne-Way Ticket for USC?
QUOTE (Roserick @ Dec 18 2007, 09:23 AM) <{POST_SNAPBACK}>
I bought the $720 one @ priceline.com flew United from JFK to Tokyo transferred to Japan Airlines from Tokyo to Manila.

As for the other one I got it through my local agent.. (Filipino)

Yes, there are cheaper tickets available for me--even at priceline. Priceline had the same date tickets available for $1227. The airlines that I mentioned charging higher prices were ones that allowed you to buy tickets from non-US departure airports.

However, the problem with priceline.com = "Sorry! Currently, all tickets purchased from Priceline.com require a US departure airport."

I cannot buy Arlyn's return ticket through priceline, and the agents we spoke with in the Philippines were charging us upwards $1400+ for a similar return flight because the 1-way was "more expensive" and they couldn't even get the flights to match on the complete return. Although they did find 1-way tickets that didn't match my return on separate days for $650 range--but that would have defeated the purpose for us returning home together.

Unfortunately, Arlyn is still working full-time until I arrive, and she doesn't have time to venture out looking for agents everywhere to shop for a couple hundred $$ savings.

Well, with continental, I was not only able to buy her ticket from my end, I was able to get it to match my return exactly and get neighboring seats the entire way back.

Although I will certainly say, $720 is a great deal. You got a bargain on that. I wish there could have been prices like that this year. I guess international flights have increased greatly in price since USCIS mentioned that there were 2.5 million + petitions filed this year as opposed to last years 1.3 million.

As for me, though, I'll gladly fork out $400 extra for the convenience and service I got from Continental. Heck, it's worth it just to speak to a clear, English speaking customer service rep, haha!

Sorry.. I think paying 1600 for a round trip to Philippines is roughly expensive..

Think now for a second . . . I bought it on the 15th of December for the 30th of December. Holiday season--New Years Eve--two weeks away!

I think it's very cheap for 15-day notice seeing that ALL other airlines were charging $2200-4500+ for the exact same flight on such short notice.

If I had been capable of getting it in advance, it would have been under $1000 like it was when I checked before we knew our K1 interview date.

I was the fortunate guy who grabbed the last available flight for the route/price I got. After I made my purchase, I searched the exact same flight, and there were none available for that day except in first class and one with a rediculous 29 hour layover--even it was still $2044 itself. Considering my other options, I think it was a fantastic deal. good.gif

My first trip to the Philippines was $1100, and that included the insurance, tax and all--but I also flew during a non-holiday season and bought my tickets two months in advance.

So is it higher than normal? Yes. Is it reasonable? Given the situation, Yes. Is it worth spending an extra $400 to be with my asawa on her interview date and having matching return trip tickets home with her? Do I even have to answer that?

Let me also mention I am flying from the east coast and must depart out of Atlanta as well--which forces me to fly to an international airport from Atlanta (adds to the cost of the flight).

QUOTE (edp333 @ Dec 15 2007, 03:59 PM) <{POST_SNAPBACK}>
Sounds like a good deal for you Stibnite. My only suggestion is that 45 minutes between flights is not enough time. Most travel sites suggest a minmum of two hours between flights to allow for passing through security checks and flight delays.

Have a great flight.

The 45 minute times were only domestic stopovers, not plane changes. The international changes/stopovers are 1hr 45 min avg. Far as I can tell, it's decent time.

The only problem I would forsee is if we get stopped and/or interrogated/searched or something between flights and forced into missing the departure... but my last trip I went through nothing of the like. Other than delays from plane maintenance, everything on my former flight was very swift and on time. Although, that was with a different airline. So we'll see. I hope the times are enough.

PhilippinesOne-Way Ticket for USC?
Thanks for the advice all!

I finally found the best airlines hands down for people in my situation.

CONTINENTAL AIRLINES!

First, thier website is the BEST of any I've seen with flexibility.

Second, they have an amazing 90 day - 6 month no pay option, as well as their own World Master Card program where you get 20,000 bonus miles just for obtaining.

Third, they allow you to purchase tickets for anyone, anywhere, with your OnePass membership, and the only thing you need is that person's Passport Number and expiration date.

Fourthly, you can pull up two separate windows (using Ctrl + N while in a web browser), and search a round trip for yourself, and then find a one-way matching return trip for your fiance(e). Just make sure when you make the actual purchase of the round trip ticket, then you close the other window, or else your PC will get confused. Then, make sure to log out, find the one-way ticket as an anon user, and then log in during the purchasing process--otherwise it will not show the one-way when you search for it because you're already booked for that flight.

Fifthly, they have the best prices I found ANYWHERE with the extreme short notice I have. I got my round trip for $1600 starting just two weeks away, and I got her one way for $700 in mid-January, AND we have matching flights and are seated next to each other with window views the whole way home!

Sixthly, their follow-up system is very quick and responsive, and the eTickets that are printed out for you are very neat and detailed. You can continue to change and arrange your seat manually until your flight. Flight contracted through Delta, though, you need to call customer service.

Seventhly, the customer service was AMAZING!!! You get three options, 1, 2, 3. I pressed 2, and almost instantly a woman answered and was obviously not foreign at all. She spoke plain, proper English, and was very easy to understand for me. She fixed a conflict in one of my flights, and as a result gave us a free upgrade at no charge to us, and arranged us the seating we wanted, and it was all done in about 5 minutes from the time I dialed.

Eightly, Continental flights connect through Hawaii instead of flying over the "North Pole" like NWA, etc. The flight is much quicker as a result, and the time between plane changes and stopovers is only 45min - 2 hours each. I may not need my jacket this time!

Ninthly, you earn double miles as a OnePass member flying international, and the bonuses and perks you receive with Continental are better than any I've seen offered from other airlines.

Tenthly, every flight has a nice schedule of meals! If you're like me, you like to eat when flying. The seating in the planes look much less cramped than those I flew on with NWA.

All in all, I give them a perfect 10 for now!

I await to see what their service on the airplanes are like, and how they handle you in the airports, as well as if there are delays or issues, etc. That all remains yet to be seen.

I'm eager to give this company a shot.

I also would like to praise God for giving us the strength to endure all of this, and for finally making a way when there seemed to be no way--especially with only a couple of weeks left for any chance at all.

We serve an almightly God! Praise His Name!

The only problem is--all flights are sold out until late January.

But I will be buying a roundtrip ticket with an open return flight, so when she get her Visa we can schedule our flights together.

I'm completely new to air travel. Visiting Arlyn was only my second time flying.

What exactly is an open return ticket and how do I get one? Does it cost considerably more? I'm assuming it is a ticket without a return date?

The unfortunate thing is my time restrictions.

I cannot leave until the 27th of December, and I "must" be home by January 11-15 range for work.

Her interview is January 3.

I want to be ther,e and I need to be home on time, and want us to fly together coming home ... does it look possible?

Also, I checked out www.evaair.com, and their rates were 3 times the prices I got from NWA.

PhilippinesOne-Way Ticket for USC?
I am wanting to know if it is possible to buy a one-way ticket to the Philippines as a USC without being turned around by Philippine Immigration or something after arriving?

Basically, I have found a good deal on a 1-way ticket, and Arlyn and I want to fly back together, so plan to find some matching one-way tickets for us both from a travel agent in the Philippines.

I have been unsuccessful in finding any matching one-way flight for her to return with me on, in any round trip ticket I've searched for.

...and yes, money is an object.

I need to find the best deal/price I can. I care less about delays or times between airplace changes/stopovers.

I just want to be there with my asawa when she goes through the interview, and fly back home with her.

We need advice ... it's only two weeks away. :|

Just old fashion thinking I guess. I just read a story yesterday that said cell phone spending will exceed land-line spending in the U.S. for the first time this year.

Cell phones are a much more reliable way to contact a person.

Soon as cellphones can send faxes, there will no longer be a need for landlines.

Mine is like a miniature laptop with high-speed internet in metro city areas already--and regular speed internet anywhere else. Heck, when Arlyn and I were castaway 6 days on a deserted island in the 100 Islands of the Philippines, we were able to browse the web with a crystal clear signal; with gps, microsoft office mobile, navigation for my car, touch-screen, bluetooth and keyboard, etc. The only thing I lack is faxing. Chances are, there's probably a work-around for that too that I just don't know about yet.

Once the faxing thing is resolved, there will not be any more need for landline's except in a world crisis where all cellphone towers are halted somehow--like a world war or alien invasion laughing.gif

They say millions of Americans no longer have land-line phones. I have not had one in about 4 years. I can't imagine why it would matter.

They told her that it was required in case my cellphone was lost, stolen, or turned off. They needed a secured permananet phone to contact the petitioner in the event that something happened to Arlyn in the Philippines. The office number was just fine--as long as they had a working land-line to be able to make contact with me.

Arlyn is at her medical right now.

She just got online a brief moment, but I wasn't available.

She sent a quick text saying she needed to talk to me now, that the CFO is wanting to know what my landline number is.

I dont have a landline number. We have no need for one because we all use cellphones for both business and personal.

The only landline I have access to is my work phone at the facility, and the work fax.

Will this be a problem?

I did not manage to get online in time to contact her and let her know I do not have a landline.

I tried calling her phone, but I'm assuming she left it at home or it is off.

I'm quite worried about this.

Anyone have experience dealing with this situation?

PhilippinesIs the beneficiary allowed to travel using tickets purchased in the petitioner's country?
The Philippine citizen must have a stable job, show ties that require return to the Philippines, show proof of not becoming a public charge in the US, and must have more than 1 year's salary of the current US poverty level in savings to get a Tourist Visa.

Arlyn started to go this route, but then she got an amazing job offer in California and decided to get a work visa. Then, she fell in love with me, and threw it all away so we could file K1.

We ended up staying at the Pan Pacific! It was fantastic.

We really enjoyed the view of the Manila Bay we had, and the city of Manila. There was a great weight room for my exercises, and a nice pool. The place looked luxurious inside. The service was extraordinary--they are offended if you even come close to touching your luggage!

Just a few "tips" for those staying there--do not TIP anyone. They include a 15% service charge for EVERYTHING! That includes the $40 all-you-can-eat breakfast they serve each morning. The employees there are all highly educated and make very high top-wages for Filipinos compared to employees in other surrounding businesses--so don't think they are in "need" of any extra compensations.

Other than the few "hidden" fees here and there, the stay was great and very secure. It was the most relaxing time I've had in the Philippines, and we were very much rested and prepared for our interview. I think we were the only "couple" on January 3rd's interview that were carefree, excited, and tension-free. We still had the tummy-flies, but we settled those with laughter, conversation, and confidence that the Lord held everything securely in His hands.

Once we were approved, we came out of the Officer's room dancing across the floor as if our favorite football team just won the Super Bowl. It was a great time.

I'm quite sure staying at the comfortable Pan Pacific was a great way to have the needed relaxation before the interview. Almost everyone else there was very quiet, frustrated, exhausted in appearance, and extremely stressed--with the exception of one lady who was very outgoing.

By the way, the Pan will stop a metered taxi for you if you wish not to use their own service, and their security scans the taxi for bombs, dangerous objects, and screens the plate and cab number. They'll make sure you get a quality ride--and it's only a few minutes away from the embassy.

We may try the Diamond next time for comparitive reasons, but we'd certainly stay in the Pan Pacific again in the future.

That's my 63 cents.

I'm not looking for affordable; I'm looking for quality and luxury for those few days.

I'm not at all interested in Bayview. I'm looking at the hotels in the $100-$160 per night range--of course I still want to get the better value for my dollar. Everyone says the Diamond and Pan Pacific are great--according to their reviews on AsiaRooms.

I dont know about either place. When I went there, I rented a condo for 2 weeks because it was a lot cheaper than a hotel plus it had a kitchen. It looks like you will be there for 18 days and a nice hotel will be quite expensive. Good luck at the interview, please let everyone know if you were allowed to sit in during the interview process. As that will probably be my deciding factor if I go there for Rose's interview.

First, yes, it is already confirmed by many others that you can sit in with your fiancee during the interview--in fact it's encouraged.

As for 18 days, Lord no! We're not staying in the nice hotel for 18 days. We are only staying there until the day after the interview. When I arrive, I want a nice, safe, and comfortable place to overcome my jet lag, and have the most relaxed atmosphere possible the few days before our interview. After that interview, we have a rental home a small distance off that only costs us $6 USD a day, and has stove, AC, etc. Nothing fancy, but easy enough to survive in for the remainder of the trip.

We spend most of our time traveling anyhow once there--we'll rarely be in the same town more than 2 days.

Officer was very impressed with the documents presented and how precise of order they were in.

Questions asked were:

(To Both of us) Who organized these documents?
I answered: I did.

(To Arlyn) How did you meet?
We explained.

(To Arlyn) Does Adam have any children from his previous marriage?
We answered.

(To Arlyn) When did you first begin your communications?
We answered.

(To Arlyn) How long did you work in China?
She answered.

(To Adam) How many times have you been to the Philippines?
I answered.

Then, I started asking him questions about his trip to the Philippines.

He then goes into a dialogue about his trips to the Philippines and his vacation last month. He states that he saw fireworks from above when returning to Manila on New Years, etc. He was extremely friendly and conversational.

Now that we're all done questioning each other, he grabs the paperwork and comments on its extraordinary neatness again, and says, "There are certainly no problems here; you're approved! Congratulations. You've both earned it!"

That was it. We thanked him and wished him a wonderful New Years and went outside to present our return tickets so we could schedule the Visa Pick-Up and we went out to celebrate for the rest of the evening.

The interview is NOTHING to stress over AT ALL.

My suggestion is to be yourself and relax. The people in the Manila embassy are courteous and are not going to reject you unless you are simply not providing proper documentation.

Out of the 52 K1 Interviews done on January 3, 51 were approved and one was placed in AR due to lack of paperwork and evidence from using a poor attorney.

That's a pretty good turnout if you ask me.

God bless, and we wish you all the best of success on your future interviews!

Adam, I attended the medical with Beth on 12-20 and 21. We went in the afternoon around 1pm and we were done by two hours on each day, very quick and no crowds, they had empty seats for me to wait. Also FYI for any SO's who want to accompany their fiance during the medical I was allowed inside with her no problem and went with her from floor to floor until we were done.

I will also be with Beth on Jan 3rd at the interview so maybe we will see you guys there. PM me if you would like to exchange phone numbers. We will be staying at Bayview. Good luck to you!

There were crowds the entire day there on the 27th sadly. She was there from 5 am to 9:30 pm. She said they were taking about 100ish numbers at a time, and breaking them in lots of 15.

I really wish she'd gone earlier on a much less busy day like you two did.

Also, yes, I will be there for the interview on the 3rd. We're possibly staying at the Pan Pacific for the first few days, then going to our rental home.

I don't mind sharing numbers at all. Once I'm there, though, call Arlyn, because it will cost me $2.39 a minute through AT&T to receive calls while there, hehe.

Arlyn has completed Day 1 of her medical.

She arrived 2 hours early, and was still #353 out of nearly 500 people at St. Lukes.

I was quite astonished!

it's really better to be there in the afternoon. around 1pm.

Her "appointment" was 7am, so figured she had to be there for that on time.

There were actually over 650 people, and she wasn't done until after 9pm her time.

She's back today for two immunization shots and she's done.

Hi all,

You can add us to the January interview list. Elisa has her K1 interview scheduled for Thrs Jan 3.

I'm on pins and needles. I can't wait. We've already had the medical so the interview is all that remains (I'm being optomistic here).

Best of luck to everyone

Arlyn and I will get to meet Elisa.

I am going to be there with Arlyn during the interview on January 3. I look forward to seeing a lot of the people I've met here. smile.gif

THANKS A LOT...

I'm gonna post my mainit-init / fresh from the oven (hehe) medical experience here asap.

GOD BLESS US ALL and always pray, use your charm and smiles!

Woohoo!

Way to go, I know you're relieved!

We are hoping to have an early medical next week also. Arlyn is going to go ahead and get her vaccinations also since it's already included in the price at St Lukes.

If I can foot the bill after paying for Christmas for my kids, I plan to be there for the interview on the 3rd. Perhaps I will see some of you at the Embassy.

We will be the perfectly matched, young Danish/Pinay couple, holding each other in the chairs in the lobby before everyone else arrives. smile.gif

Everything is going well. My baby notarized our I-134 today (so expensive, $10 each copy for 4 copies grrrrrrr). and I will be receving the docs from him by next week.

~beng

Why did you need 4 copies???

Also, if he has a bank account, his bank should do it for free.

At least Wachovia did it for me. smile.gif

I'm still confused, though. Are we supposed to have 4 copies of that?

PhilippinesNeed Some Advice For My Fiancee and I She is 17
A few things to consider here in your situation.

First and foremost, I recall in one of your posts that her aunt is your cousin.

In order for that to happen, that means your fiancee's parents are your cousins also. In addition, her parents or aunt are the children of one of your parent's brothers or sisters. That means you are planning to marry your second cousin.

If you mention this in any way to the consulate, you can watch yourself get denied on the spot--or some issues if they find out later somehow. They are not going to allow you to marry a member of your family--especially when one or more of the relatives are already in the United States. They will assume you are trying to bring a family member into the US using a quicker VISA method, rather than petitioning the correct way for a family member.

Perhaps I understood you incorrectly, but if you are serious about marrying her and love her, then take my advice and never mention she's related to you again. remove it from your vocabulary.

Next, when my wife and I went through the Fiancee Visa process, we were in communication with a number of other couples and we did what we could to assist them--just as others had assisted us.

One couple was young--actually both were 17 when they filed, and were 18 at the time of the processing. They filed with notarized documents offering parental consent on behalf of them both.

They met when they were 16 in the Botanicals of Baguio City when the boy's parents took the family for a vacation into the Philippines. Love at first sight, etc., etc.

They filed while still both 17, and only 2 months remaining until turning 18. By the time everything went through the system, the age seemed to not make any difference to either of them. All documents were approved with only 1 RFE, and they received their interview date.

The shock came when I took my now wife to the CFO office. That young couple was there also, along with both sets of parents who came along for support, and we spoke to them briefly before the officers made us guys go sit in the waiting room. No offense to the kid, but he really didn't look a day over 14, and his fiancee looked to be about 12 in my opinion. I personally have no idea how a couple that young could succeed in modern day United States, but that's not for me to judge thankfully. Even the officer thought the "kids" were just there while the adults were attending, and they started by asking the children to go to the waiting room--until they specified they were the ones petitioning--not their parents.

It was comical, I won't hesitate to say, but understand they were not at all interested in either of the parents accompanying the 18 yr old girl. They told them all to go sit in the waiting room.

After waiting a good hour, my wife comes back and is done with the first portion and was requesting a document she had left with me accidentally. While she was there, she whispered to me that the young girl was having problems and was crying.

She went back to the CFO upstairs, and upon hearing this I spoke to the boy and let him know his fiancee was crying and he should probably make sure she is OK. Unfortunately for him, he jumps up and starts causing a scene--acting quite immature *cough*, and gets his parents worked up into a frenzy. Everyone tries to calm him down, and all 5 of them went out the door and upstairs to find out what was wrong. You can only imagine the thoughts going through the minds of the filipino security guards when 3 Americans and 2 Filipinos charge up toward the office. They refused to let them up, so they went around the building and entered into the front door.

Long story short, the CFO refused to give her any stamp and scolded her harshly for making any attempt at getting married at 18 to an 18 year old boy. They did not care about her parents consent or presence, and suggested that she wait until she's 21 or older before making such a life altering commitment. They also told her since she had just so recently turned 18, then she must have petitioned while she was 17, and that was considered an unacceptable practice, etc.

The girl was obviously devastated, and they were forced to leave that day without the stamp.

The parents of the girl actually went as far as to get an authorized letter from the Philippine Governor or such, and they came back a couple of weeks later. According to them, they went through the process the second time and didn't even have to present the letter. This time the CFO was nice to her, and they just gave her doomsday stories about american marriages.

Bottom line is, you can petition while 17, but you are opening up a door of potential problems and headaches down the road. They "could" even go as far as to say that you were both ineligible to file when you started the petition and force you to file over again--but chances are they won't catch that.

I know another couple who simply dated all of the petitioning documents the day after the girl's birthday, and by the time their case went into the works, the date and age was accurate and the issue never came up. I'm not sure whether to advise that plan of action or not.

The CFO seems to be hit or miss, so perhaps it depends who is there that day.

I will tell you this one secret, though. If ever you file, try to time it so that your process all falls around a holiday. That way, the normal workers are off on vacations and there are fill-ins taking their place temporarily. My wife and I were fortunate to have ours on New Years, and as a result, EVERY single person we spoke with was a VERY kind, fill-in individual who didn't seem to be troubled like the normal workers will be. They seemed "less" experienced, if you get my drift.

Anyhow, why are you marrying your second cousin? I'm guessing you were raised in Alabama, sadly.
