This link was posted in the AOS forum a little while ago. I read it and it says help with medical bills is not a counted against you.

An alien will not be considered a "public charge" for using:
HEALTH CARE BENEFITS, including programs such as Medicaid, the Children’s Health Insurance Program (CHIP), prenatal care, or other free or low-cost medical care at clinics, health centers, or other settings (other than long-term care in a nursing home or similar institution)

K-1 Fiance(e) Visa Process & ProceduresPre K-1 Visa filing / trip to U.S. for visit
It is highly unlikely that they will give him a visitor visa if he has no job, has no money in the bank, and does not own property. He has to show significant ties to his county. They will also know he has filed for a K-1 visa. They will think he will not return home. You can try, but I think it will be a waste of time and money. Good luck.

K-1 Fiance(e) Visa Process & ProceduresWORRIED about the way I assembled I29f petition?
QUOTE (stephandmuz @ Sep 23 2007, 05:31 PM) <{POST_SNAPBACK}>
Hello Everyone,

This is my first time posting here, but I read topics from this site daily. My fiance and I mailed our petition at the end of June and it was not received by the California service center until July 5th. My question is this; When I assembled our petition for mailing, I did not use fasteners, clips of any sort to hold the petition and supporting documents together. I simply placed all paper work loosly in a large envelope and mailed it. I did not find this site until after the fact, which is unfortunate. I guess I assumed that the service center would put the petition in the order that they preferred. I am now extremely concerned that parts of the petition could get misplaced, if it hasn't allready. In everyones oppinion, do you think that we have anything to be worried about? I need some sort of peace of mind. I'm an absolute mess over this.

Thank You....

I really think it does not matter if it is clipped together or not. They take it apart anyway and rearrange it according to their rules. It is not beyond USCIS to lose something, clipped together or not. I hope that will not happen in your case. Good luck! rose.gif

Some people are given their xrays to keep and some are not. The reason, I guess is to have them on hand as a baseline, if anything comes up in the future, they can compare the new xrays with the original ones.

K-1 Fiance(e) Visa Process & ProceduresHELP!! Need to apply for K-1 but HAVE NOT met!
I have been to Algeria 3 times. The most recent trip was this past November when my husband and I went to visit his family. I have never been afraid in Algeria and I would hop on a plane to Algeria tomorrow if I had the chance. The people are wonderful and welcoming. There are areas of Algeria that you should not visit and I am sure your fiance will know these areas very well. I have two friends that just got back from visiting there fiances and they had a wonderful time. I know of several American women living in Algeria with their husbands and children. You will have to go meet him in person before filing for the K-1. You just can get around that. Also there is no way he can get a visa to come visit you so you will have to go there. A friend of mine that is married to an Algerian man, met him for the first time in Tunisia. That could be an option and you do not need a visa to visit Tunisia.
Good luck!

K-1 Fiance(e) Visa Process & ProceduresQuestions About Support and Divorce
QUOTE
Your last three years tax return with a average of your income over that time will be necessary for the affidavit of support.

Uh-oh. I've only had this job since July 2006. At best I have two tax returns that will show income from my job as an independent contractor. And for 2006, it was only half the year (although the rate of pay was the exact same). The year prior, I wasn't working at all; my husband was supporting both of us.

Is this going to work like creditors do when deciding to extend a loan - having to have a job for a set amount of time?

K-1 Fiance(e) Visa Process & ProceduresQuestions About Support and Divorce
One other question - I've known my fiance since the middle of 2004, we met on a forum not unlike this one. Will USCIS need documented proof of when we MET, or just proof of our relationship? As far as our relationship, will signed letters from friends of ours serve as proof?

The thing is, we've known each other over a long period of time, but our relationship (aside from meeting in person) has been entirely electronic - calling overseas would be a ridiculous expense, so we just use voice chat for free. I've had program and disk crashes since we first met and a time or two in between, and I had no idea we'd eventually be getting married, so it didn't occur to me to hang on to every last scrap of history between the two of us. We do have lots of pictures of us from when he visited here, lots of which are affectionate, but it sounds like those would just be proof of our having met - not proof that we have a relationship. He's got copies of text messages (he sends me texts via his email address, I get them on my phone) stored up since September of last year. And I may have a few blog entries talking about his trip out here. Will things like that work?

I'm just nervous that, because we don't spend way too much money to actually call overseas to each other or save every scrap of communication between us, we'll be thought of as not a real couple.

K-1 Fiance(e) Visa Process & ProceduresQuestions About Support and Divorce
Hi, all. As a bit of background info, I'm a U.S. citizen, born and bred, and my fiance is a native of London. Currently, I'm still legally married, though my ex and I have been separated since April 1, 2007 (different residences; our relationship ended even before that, but we still lived together for financial reasons). My court date for the divorce is this Friday (2/22/08), by which I should be a free woman. Immediately thereafter, I intend to gather everything we need and file the I-129F.

Just out of curiosity, does immigration really care when a relationship begins in the wake of a marriage? Our relationship began before I moved out of our home and long before our divorce, obviously - but, emotionally, there was no relationship left when I met my fiance. I never cheated on my ex, he knew I wanted I divorce before things began with my UK guy. It's simply that I prepared all of our divorce papers myself out of an aversion to involving lawyers in any aspect of our divorce, so it took me a little longer to understand the in's and out's and feel confident I was drawing up the correct thing. Then I had to file, and my state has a mandatory 60-day waiting period (I guess hoping people will reconsider). Will USCIS scrutinize this? Can they try to claim that there was some kind of marital infidelity and reject our application on some trumped-up moral basis? I wish I could say I was half-joking, but I'm not.

Also - I'm employed as an independent contractor. That's legally (and for tax purposes) my job title, although I really only work for one organization. I get paid the same thing on a monthly basis, I'm just not considered an employee. I receive a desk check in the mail every month, no taxes withheld, etc. So I don't have paystubs. How can I prove my income? Will they accept 1040 tax forms and bank statements, rather than paycheck stubs? Should I start photocopying my checks for the next couple of months? Help!

K-1 Fiance(e) Visa Process & ProceduresDuplicate of I-129F package
Thank you all so much; this must be a very popular board, answers here are so quick!

I think what I'm going to do is have an exact copy for me in the event that I need it, and just scan everything into the computer and send it to him via email. He's already having to send me copies of his passport stamp and tickets, his photo, and statements through the post; no telling what the postage would end up looking like if we did everything in paper. If all he needs it for is reference purposes, then a scanned-in copy should do, I think.

K-1 Fiance(e) Visa Process & ProceduresDuplicate of I-129F package
So I've been scouring the guides and have found some really great advice (thanks a million to the people - or person - who compiled all that info!).

I notice that, when told to make an exact copy of the I-129F package to eventually send to your fiance abroad, it also includes the check or money order with fees. Not to sound stupid, but does this mean we have to pay the $455 filing fee twice? What exactly is he going to have to do with the duplicate package?

K-1 Fiance(e) Visa Process & ProceduresBiographic Information Form
Actually, my bad, he DOES have his name. My fiance's grandmother GUESSED at his birthdate, but I've got a feeling a guess wouldn't be advisable, needs to be verifiable or nothing at all. The main snag is an address - hasn't seen him a SEVERAL, several years (since he was a child), so he wouldn't have that.

K-1 Fiance(e) Visa Process & ProceduresPassport photos
So, my fiance is in the UK, and I'm here in the US, and we both need to gather our photos. However, as could be expected, their passport photos differ in the UK from US photos. Has anyone had experience with having to use photos taken in a different country that don't adhere to the same standards? Do they care as long as the pic is generally compliant (white background, full frontal shot, etc)?

K-1 Fiance(e) Visa Process & ProceduresOdd employment situation
My fiance already technically has an American job - he writes for a website based in Florida and receives his payment through PayPal. I see that it takes awhile between getting married and applying for AOS to get employment authorization. How would we go about doing this legally without his having to stop writing for any length of time? I've heard mention of a temporary work authorization? How and when would one receive that?

K-1 Fiance(e) Visa Process & ProceduresI-864 Affadavit of support Question
I'm not sure about the other, but I think I remember reading that they only need your most recent tax return. I could be wrong, though. I hope I'm not. I don't HAVE my return from three years back, only two.
SterlingGirlFemaleUnited Kingdom2008-03-30 18:55:00
K-1 Fiance(e) Visa Process & ProceduresYet another I-134 question
I know it's good to have all the evidence you possibly can to send along with any affidavit, but if I'm self-employed (and, for tax purposes, seen as a contractor) then I don't really need a letter from an employer, right? Will the letter from the bank officer, bank statements, and the past year's tax return suffice? (And, judging from the instructions on the current I-134 application, it appears I'd only need one year).

Is that about right, or am I missing something?

K-1 Fiance(e) Visa Process & ProceduresPassport stamps?
If you send a passport entry stamp as proof of meeting, do you need to copy ALL pages of the passport or does just the page with the stamp suffice?
SterlingGirlFemaleUnited Kingdom2008-04-21 14:28:00
K-1 Fiance(e) Visa Process & ProceduresSo, I'm a complete idiot
Well, not really. I have very strong opinions as to the orderliness and accuracy of USCIS's website, however.

I just realized that I sent my I-129F to the TSC - which apparently no longer accepts them. I went by the form where you put in your ZIP code and it tells you which center to apply for. Going further, I found a page which specifically listed the I-129F's mailing address for the TSC. I've now discovered that that is no longer accurate.

So . . . has anyone else done this in error before? Will they simply send it back, forward it to the correct center or what?

At least if they send the whole thing back, I can correct the passport photo issue. However, the address at the top of my fiance's letter of intent is that of the TSC. Should I White-Out that part and put the correct address, or will it compromise the letter to alter it in any way?

*kicks USCIS's ill-maintained website*

K-1 Fiance(e) Visa Process & ProceduresNoticing an awful lot of people who fly into POE with fiance
Just curious, but I've noticed there are a lot of stories about American fiance/e's flying to their partner's country and flying back in with them to the POE - is this necessary or required? I only ask because of money issues; do they require the American spouse to be there? Our plan was to have him fly in through JFK (to get his EAD) and then fly out here.

Will they send an RFE if you forgot to label your passport photos on the G-325a, or just send the entire thing back? Or have the common sense to know that the photo of the male behind the G-325a bearing a male's name is probably that person?

Thank you SO much. I'm not sure if the US has exit stamps or not. I think it's because we don't often care who leaves (unless they're fleeing prosecution), just who gets in!

Got my fingers crossed. I've been surprised at the wait times thus far; not nearly as long as I thought. I'll definitely post here if I get an RFE, though.
SterlingGirlFemaleUnited Kingdom2008-04-10 15:17:00
K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List
I've read a few things in this thread that have made me nervous - the biggest is that even having boarding passes/stamps/pictures sometimes doesn't seem to convince the adjudicators.

I sent them every single boarding pass my fiance had when he visited. The trip went something like this for him: London-NYC-Cinncinati-my airport. I put all of his boarding passes in order of his connecting flights, both for his arrival and his departure. Are they going to look at those connecting flights and decide those passes don't prove he was in my state (even though we HAVE the boarding pass that puts him in the airport in my state). We also had a passport stamp, but I've been hearing about entry/exit stamps. He only had one stamp, with "WT" signed on it. Other than that, there is nothing else on any of the pages of his passport. Was sending just that one stamp for nothing?

It's so frustrating thinking of what some people will accept and what others won't accept.
