I had my interview today, passed and received oath letter. I also requested name change but the oath letter is still showing my unchanged name.

Was wondering if anybody had their name changed and received oath letter showing 'new name'?

Oath letter will still be for old name(same for my wife). Your new name takes effect only after the judge changes it which will be on the oath day.

During the interview when he asked me if I was every arrested or any other issues I told him about the traffic ticket and he said he does not need to know about traffic tickets.

Hello,  

 

I have some concerns with the documents I've gathered and how long they last.  I'm applying for a citizenship through marriage and my brother is sponsoring my wife and I.  However I got the documents from him back in November of 2013 and I haven't filed yet since I've had to put the money together etc etc.  I'm wondering if the papers he sent me will still be fine with me filing this month of February 2014.

don't understand your question. If you are applying for a citizenship thru marriage then your wife should be a US Citizen. Why is your brother sponsoring her?

I need some advice. Filed N400 application (Jan 2014) at the same time with wife.

We prepared two separate applications, wrote two separate checks, put them in two separate files but within one single fedex envelope.

Both checks were cashed within one week. 

 

I thought this was going in the right direction: until I received no notification of the application versus my wife received two e-mails with two separate receipt numbers but directed to her. And I received nothing. 

When I checked the case files online it said they are both processing. But cant see under whose name the applications are.

Today we received my wifes I-797C in the mail. And still nothing for me.

 

Is there a chance (although they cashed two checks separately and assigned two different receipt numbers) theymixed applications and attached both case numebrs to my wife ? 

What would be the best way to deal with this ? Any suggestions ?

No that is how they work. They use only one g1145. It was the same thing for me too. They sent the emails to my wife and the texts too. But the other one is for you.

What you are proposing is illegal. You are also missing the point of my question. Even if I could use my passport, which I won't, I don't have anyway to get back into the US as they take the your green card away at the ceremony. This question isn't about dual citizenship. It is about timing. How to time your ceremony so you have your old citizenship, go abroad on that, come back with the green card and then go through the ceremony.

Yes it is illegal to use the old passport to travel to your country. But you can get a US passport on the same day too if it is urgent. But getting the visa is the tough part.

No current passport doesn't allow dual citizenship. But even if it did, there's the matter of getting the US passport! That can take at least a month. So the timing is an issue. They do actually take your green card away at the ceremony. I know, because they did that to me. At that precise moment, you don't have a travel document of any kind. So you scramble and get a US passport first.
 


 

Yes, I think we may end up doing that. She can mention that directly at the interview when she reaches that stage.  We just want to do things right because if you just don't show up, that could mean that you have abandoned the process.  I am looking for people who have actually done this.  I mean there's got to be recourse for folks who can't make it to the ceremony for a particular date.
 


Remember every stage you get a letter from uscis and there is an option of changing the dates. This holds true for fingerprinting, interview and oath. Once you get those letter you need to call the number specified to move it. Just make sure someone is back here to receive the mail and push the dates.

I don't know the answer to your question, and I don't know the specifics of how things work in your spouse's country of origin, but you said this and I wanted to address that specifically:


How would they know that you got dual citizenship? People from a lot of countries that are in the same situation (i.e. their country of origin does not allow dual citizenship and they're acquiring US citizenship) don't have to tell their country of origin that they have acquired a new citizenship. If you don't tell them, you keep your original passport, you get your US passport, you present the former when going home, and you present the latter when entering the US. Is that not an option for you?


 

From his name I will take that he is from India as I am. And dual citizenship is not allowed in India. I am supposed to surrender the Indian passport back to India once I get a citizenship in US. That is the law. What you are asking him to do is felony. If caught you can be in prison in India for upto 12 years or/and fine.


There is such a thing as expedited passport issuance - if you're close to a passport agency and book your appointment in time. When wife knows when her oath date is she can schedule her appointment (they take them up to two weeks ahead of time), go to oath ceremony, complete the forms for the passport bring the pictures and proof of travel and pay the fees. I've seen people in Chicago agency who were returned from O'Hare and managed to get their passport done in time for their flights. I had travel lined up two weeks after oath ceremony and had my passport 3 days later.

You can get the US passport in 3 days. But we also need to surrender our indian passport and get an Indian visa which takes some time. Unless you are staying in the state where there is an Indian embassy it takes time to get those.

It`s been around 10 days and my status still shows "sent you NoA notice"... Havent changed to "sent you biometric notice"

When you mean signed up you do not mean g1145 right. that is only for the noa. For the rest you need to signup in uscis website with the nbc number. Sometimes it might take time based on the load on your local asc.

Hi all,
I have an identity crisis right now and need your help!
Interview was yesterday, passed and should be getting a phone call or letter with oath date.
I haven't asked for name change on n400 because I was worried about it being too difficult.
The officer asked me if I wanted to change my name during the interview and I said yes. I really wanted to keep my maiden name as My middle name and use my husbands last name as my last name. I am being totally honest here, so please don't make me feel stupid...I asked her if I could do that and she said that I could only change my last name and not my middle name...because that will need court approval...I swear this is what she told me and I was very anxious and wanted to finish as soon as possible. So I agreed...and she changed my name to name/middle name/husband's last name. So my maiden name disappeared...
When I got home and started to research this, I have noticed that I could change my name the way I wanted and I started to feel really bad about losing my maiden name in the us, especially because I carry two other citizenships.
Can I please have some insight on this? Can this be changed before the oath ceremony? Do I have any chance of getting this the way I wanted?
Please, only constructive comments, I am stressed enough right now and will not like to see a "you should have done this in another way" type of comment, because it is not going to help since it is done.
I appreciate any comment that will actually clarify this.

I don't think you can do much now. The only thing you can do now is to change your name again after the citizenship to the way you want.

This might seem like a strange question to some and I'm not knocking your decision, but I have noticed that most people on VJ see gaining US citizenship as something of a certainty

 

My question is why?

 

I know as a citizen you can vote, but the system is broken so that doesn't really appeal to me

You can commit a felony without being deported, but again as I'm not a criminal that isn't important

So the only other benefit I can see is you remove the need to deal with the USCIS every ten years

 

I'm not American, I never will be and I am proud of where I come from

 

But why is it that most people seem to consider it as an inevitable part of the migration process

I do not know why once in a while this same question is asked and there are thousands of reply for and against. There are lots reasons for each person to apply. There is no right or wrong answer. It is all upto the individual. There are thousands of questions like this and all ends up with the same answer it is upto each individual

 

Other questions like

1) Why do you have to get married

2) Why do you want to have kids

etc.... your question also falls in the same category.

I am almost 2yrs into a 10 yr GC and myself and our 2 kids did the whole GC process to get here.

Can my Wife who is the USC just go and apply for a passport for them since they are under 18yrs?? or do they also have to wait 3 years like I do?

 

the kids biological parent needs to be USC to apply for passport. So if the wife is the biological parent then yes she can apply for passports for the kids

So I test-filled out the N400 and was wondering if, when I don't know the exact day that I moved from an address or started/stopped a job is it okay to put only mm/yyyy? It specifically says mm/dd/yyyy. So, should I just guestimate or put 01 for the day of those months?

guestimate is fine for address and job. You need the exact dates only for the travel piece.

My five years will be completed on August 29, 2014. Can I still apply under the five year rule right now or is it too soon? It says in the instructions that we should apply only 90 days prior to our 3 yr or 5 yrs are complete, not sooner. 90 days date before my 5 yr GC will be May 29. Do I need to wait another 2.5 months to apply under 5 year rule? I really want to do it right now ..will my application be rejected if i do?

You can file under the 3 year rule right now and it won't get denied but you will have to send all the paperworks - lease, bank statements, tax returns etc...... But if you can wait till May then you can apply under 5 year rule and no paperwork needed. So you need to decide which is better.

Hi,
I got married in 2008 and received my GC in August 2009. I filed with the help of a lawyer here in Chicago (much to the annoyance of my husband ..he didn't want to spend 1000+ dollars on lawyer fees). My dad insisted that I file with the help of a lawyer ..there were a lot of unpleasant arguments that occurred between us and fast forward to now, my husband really hates to talk about anything having to do with my immigration (or citizenship)

So I need help bc I'm on my own and I want to file for citizenship this week. I became eligible in August 2012 (3 yrs) and since then I have had my forms ready, but never mailed them out because I don't have our tax papers and I didn't want to ask him for them. I am a stay at home mom and I do know that he files them jointly. So here are my questions:

1. Is there anyway I can obtain our tax records online
2. I live in Chicago, so what address should I mail my n-400 form to for the quickest response
3. I didn't know I could have applied for my parents' GC when I applied to remove conditions from my own GC..so missed that opportunity. My family arrived in 1999 with us on my dad's H1 and overstayed. I really want to apply for my parents ASAP. Is there any form I could send for them along with my n-400 which would start their GC process?

Since it will be almost 5 years you can file under the 5 year rule. Then all you need to send is the copy of your green card/passport pictures and the check. I think that will be the easy route. During the interview you will need the tax transcripts which you can get from the irs website.

I asked this question in the passport section but nobody answered it, so I'm asking here hoping that I get some kind of answer. I'm scheduled for y oath next week on February 28th. I have couple of questions regarding filing for a passport, by the way I want to apply for just a book passport:

- I know that the fee is $110 for the US passport and $25 for USPS, do they need to be in money order form? or what?

- as I said my oath is on February 28th. Can I fill up the application online and print it out or do I have to wait until after I become a citizen? (Last step, I don't want to claim that I am a citizen when I'm not yet).

- What documents do I need to bring with me beside the certificate of naturalization and a social security card and my drivers license?

You can fill the form online and print it out now and take it. You just need your certificate and the passport pictures. Most of the places accepts credit card. I paid with credit card.

My wife received her Green Card June 10 2012 she then spent 184 consecutive days in the US until she left and spent 180 days abroad returning in 2013.. In 2013 she spent 184 days in the US and then left the US with plans to return in another 180 days in 2014 from abroad. Each of her trips abroad have been just short of the 6 month absence limitation to maintain the LPR status. The question is if she repeats this schedule of presence into 2015 by spending 184 days in the US in 2014 then leaving for 180 days and returning in 2015 will she still be eligible to file March 10 of 2015 if she has not yet been In the country for a total of 6 month or 183 days as of March 10 2015?

They will def. flag it and you need to prove why you are going away for 6 months. It will look suspicious that she is away most of the time. BTW are you still filing taxes(jointly) here and bills are on her name too?

My husband was here illegally since he was around 19.  He got his permanent residency in 2010 at the age of 29.  He is now 33.  He has never registered for Selective Services.  We didn't even know about it.  I'm wondering if we should just check yes or no.  Anyone else with this situation?  It seems a lot of questions are just since permanent residency.

He should have registered but since he is 33 it is no longer an issue now since it has crossed more than 5 years. I remember one person in this forum filed when he was 30 and he did not register for selective services and uscis rejected his application during interview and asked him apply after he becomes 31.

 

So don't worry about it and go ahead and file.

If you are asking if you need an non expired passport during the application process then no. As long you have the passports with you then it is enough.

Its been already 2 months since I did my biometrics. I got yellow letter before 3 weeks. After that nothing. No inline or anything. Philly really sucks.

According to your signature you got the green card on 12/24/2010 which means you will change to inline only a month before your anniversary which is 11/24/2013. You can file 90 days before but they do not change you to inline till you are just one month away from the anniversary

I have so many questions!  How many people can I invite to my interview/oath?  Baltimore does the oath same day and I'd really like to invite my entire US family, toddler, kids and all.  Do you think they'll let a party of around 10 in?

First check with the local office if they allow same day oath on regular basis. Some offices does do same day oath. Some regularly, some only if it is urgent. So no point dragging everybody to the interview if you do not get the oath the same day.

Changing color. Feel so good about it. 

 

The ceremony was good and lasted for 1 hour. Also the deputy director of immigration's miami was the key note speaker and his wife from Brazil also got the citizenship today.

 

First they had a welcome speech and national anthem, then they called everybody to stand as they called their country, After that we also said the oath and pledge. We were then given the certificate.

Interview was on thu 1/16 7:45 AM - Case moved directly to letter sent on 1/17 Friday afternoon 1 PM and got the physical letter on 1/18

No still has moved, still says finger prints. I got a yellow letter a week ago. I filed after my anniversary date because my I-751 was still not done.

Very sorry to hear that. Did you try calling them or atleast setup an infopass. According to trackit site oaklandpark is not that slow.

According to track it(http://www.trackitt....n-trackers/n400) I see lot of them for Louisville, KY is around 2 months for Oath letter.

I gotta question for you all. I had my interview on January 2nd and I passed the officer told me I should have the oath around the beginning of February, end of January. My status changed to scheduling que on January 6th but since then I didn't hear anything from them. The end of January is getting close and I started to get worried. Should I wait more or should I call the 1800 number? How long do you think it should take if you think I should wait?

I would wait for 90 days before you call. This is the problem with small places where you get the interview fast right after fingerprinting but end up waiting for the Oath as they want enough people to conduct the same. I would not worry. But for me it was the other way, we had to wait for 2 months before they setup the interview. But they have several oaths in the month and will get oath faster.

I did take my two year old and they had no issues bringing the kids. And my 2 year also behaved well. She sat with me during the interview without disturbing us. The whole interview was less than 10 mins. We went to the office at 7:35 AM and we were both out in the car at 8:20.

So today I got a notice saying I need to bring the last 3 tax returns to the interview, but i have not been scheduled of interview yet. Anyone else get one of these yellow notices? How much longer till they schedule my interview?

There is no time relation to this yellow letter to when you get scheduled. Some people get the yellow letter after the interview and some people do not even get a yellow letter.

Because I searched and did see some people take their kids but it was in 2009. I am still searching the forums now for a new post.

Please anyone need your input. I have an interview coming up on 16th Jan at 7:45 AM and so does my wife at exactly the same time. I have a 2 year old whom I can't leave with anyone. Is it ok if I take my kid to the interview or is that not allowed. Not sure what else I can do.

Why haven't I gotten my interview yet ? ??

Oakland park office is also very slow like Hialeah- close to 2-3 months. I finished my bio on 9/23 and I got the letter on 12/8 and I see you are close to month away from me and hence wait another week or so.
