You need the physical green card for naturalization. If you lost it then you need to apply for one. You can do it both together. First fill for the green card replacement form. Send it and attach the receipt of that to the N-400 application.

Since you have been in US for more than 10 years you can file for N400 with the 5 year rule and not by marriage. That will reduce the amount of paperwork you need to submit. Under the 5 year rule all you need apart from the N400 are two pictures and a copy of GC. You will need the tax papers during interview.

 

Make sure you select you are filing under 5 year rule in part 2.

I do not agree with the above but I am might be wrong.

 

See the instructions as given in uscis website

 

A. Write the total number of days you spent outside of the United States (including military service) during the last five years. Count the days of every trip that lasted 24 hours or longer.

B. Write the number of trips you have taken outside the United States during the last five years. Count every trip that lasted 24 hours or longer.

C. Provide the requested information for every trip that you have taken outside the United States since you became a lawful permanent resident. Begin with your most recent trip

 

See for how for A and B he clearly states exclude trips less that 24 hours but for C he did not mention it. Which to me means I need to write all trips less than 24 hours for question C.

Go to the instructions in the above link. Go to part 7. It clearly states that you do not have to count the number of trips less than 24 hours for the total number of days outside US or count to the total number of trips. But when it comes to mention the trips it does not explicitly says that you need to omit trips less than 24 hours.

check the instructions on how to fill N400 part 7. For counting the number of trips and days outside US you do not have to count the ones less than 24 hours trips. But you need to specify all the trips though in the detail.

Ask her parents the day that one of her parents became a US citizen she became one as a minor. Good luck. 

Exactly as even for N600 you will need this date. So all you need is the date her parents became citizen and put that date and send the copy of her us passport which is proof enough that she is a US citizen.

I have a question about a name change.  If you have your name changed during the Naturalization process do you need to change everything in your home country?  If you do, will they take the Naturalization document as legal proof?

You will have to follow your home country name change procedure to change it there. They might not care about US government Naturalization document.

Hi guys, I received a fax of Oath Ceremony notice.  On the fax, they only showed the location and time but nothing else.  What should I bring to the Oath ceremony?  Do I have to fill out form N-445? Is  anybody  in the same situation like me?  Please help.  I will have Oath Ceremony at LA convention center.

From what I have seen from these chats the only two things you need for the oath is 1) Green Card and 2) the Oath letter.

let me explain more , we are married since 8 years and still . i got my immigrant visa before 2 days , i was planing to go to the state sometime in June this year ( before the expiry of the visa ) and stay by myself for 1 year and a half , "18 months" as my wife want to keep her job here in Dubai , so the question is , if i stayed in the state for this period "18 months " sure i will be having the green card , and i left after that for the same period , so total will be 3 years , may i apply after that to the citizenship and the passport , keeping in my mind i will be still keeping my greencard after leaving by coming to the state every 6 months. hope this is clear by now.

I agree with the last person. You will need much more than just staying in the US to get the citizenship. You need to show proof of residence for the past three years in the US. Tax Returns and not just yours but filing jointly with your wife. More proof of the marriage like lease in both names etc. 

 

So as the previous person suggested I would say to just stay in Dubai and take this whole process if your whole family wants to come back to the US.

So Im currently elgible to apply for citizenship woohoo!
but I will be going out of the country for a week in the Spring April

I'm afraid if i apply now I will get bio appointment and maybe interview appt right by my vacation?

What do you guys think?
I live in IL so i will be sending my papers to Arizona office and interview would be at Chicago.

I would just file as you are going on vacation only for a week. Not a big thing. worst case you can push the appointment. For all appointment you will have atleast two weeks lead time except the oath.

I think there might be a small misconception here. I haven't been outside the US continuously for more than a year at any time. From all the inputs I have received it seems I should just wait it out and apply in 2018 for naturalisation.

You are married to a US citizen right? And if yes and you are still married to that USC then you will have to wait just 3 years and file on 2016. You need to give only last three years details if filing by marriage

People have said that to me, but I don't see the same mentioned anywhere on the website. For example, on the web page at this link,

http://www.uscis.gov...-us-citizenship , what I see are these points,

 

  • Have lived within the state, or USCIS district with jurisdiction over the applicant?s place of residence, for at least 3 months prior to the date of filing the application
  • Have continuous residence in the United States as a green card holder for at least 5 years immediately preceding the date of filing the application
  • Be physically present in the United States for at least 30 months out of the 5 years immediately preceding the date of filing the application
  • Reside continuously within the United States from the date of application for naturalization up to the time of naturalization

It doesn't say that my absence from the US for more than 6 months would cause me to postpone my application. The way I see it is, I need to be in the US physically for the last 30 months of that 5 year period.

 

Which is why I am having my doubts. What do you think?

I agree with shub above. You will be asked a lot of question during the interview and without an N-470 it might get rejected. Rather be happy that they did not take away the green card and wait till 2018 for filing the N-400.

US Citizenship General DiscussionGC is expiring before my Interview. Need some help

 

My concern is that in the interview the officer will notice that my GC expired and he/she will want me to renew my GC. This means that I need to pay the fee for a GC that I will never use, putting on stand-by my citizenship case.

 

I don't know if it is a good option asking for a favor to extend my card for 3 or 6 months?
 

The greencard does not need to be current during the interview or the oath. As long it is not revoked you are fine. And also there is nothing like to extend it just by 3 to 6 months.

 

The only issue with an expired greencard is that you cannot leave the country. Once you leave you are out of status and will not be able to come back into the country and you lose your greencard.
