IR-1 / CR-1 Spouse Visa Process & Procedureswho schedules the interview????
It depends on whether your embassy will be standard or appointment processing in terms of NVC. If your embassy is a standard post processing embassy, the embassy will schedule the interviews. If it is an appointment post processing embassy, NVC will schedule the interview. You can determine what type of post your embassy is by going here: Applicant Document Processing

New Delhi is a Standard Post processing embassy and so your embassy will scheduled the interview. The website I have indicated here will give you more information on what you will need for your case to be processed at the embassy.

Best of luck to you!!! good.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresHaven't received NOA2 in mail as yet
I have been checking every other day to see if they received my dad's case at the NVC and still no record of it. Tash, you can try to see if they have received yours.
When you call the number (603) 334-0700; the options are 1, 1, 1 after this third 1, you may want to listen for the 3 letters before the numbers. If it is WAC, that is option 4; once you confirm the 3 letters, enter in the 10 digits followed by the # sign. I hope it is finally at NVC. If nothing yet, check back with them in January.

Best of luck to you biggrin.gif

QUOTE (Tash @ Dec 24 2007, 03:21 PM) <{POST_SNAPBACK}>
Hello,

On Dec 11th, I received an email from CRIS stating my I-130 petition was approved and that a letter was mailed out. It's now going on 2 weeks and I have not yet receive this letter. They have the correct address as when I received my NOA1, everything was correct. Is this normal or maybe it's the holiday and it's taking way longer then usual? Any advice on what to do?

I would appreciate it. Thanks

Hey Tash,

I got my email that my father's case was approved on Dec. 8th and we received the letter in the mail on the 13th. I am sure the letter is in the mail and maybe it has been delayed with the holiday. I hope you receive it soon, but otherwise at least you know it's done with USCIS and it is on to NVC!!! kicking.gif kicking.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresHow to file my US taxes??
I had these same questions recently as I had to amend my 2006 tax returns so that my husband could get his financial aid. I emailed the IRS and this is the response that I received from them as it pertained to married filing separately or jointly...

QUOTE
The Answer To Your Question Is:
Thank you for your inquiry regarding your 2006 tax return. We apologize for the delay.

You stated that your husband did not become a permanent resident until October 2007. In 2006 he was still a nonresident alien. Based on this information, a nonresident alien is not required to report foreign source income. However, since you are a United States, (U.S.) citizen, and if you choose to treat your spouse as a resident alien and file a joint return, your spouse's worldwide income must be included on your U.S. tax return. Please see Publication 54, Tax Guide for U.S. Citizens and Resident Aliens Abroad, for more information about filing a joint return.

If you choose to file as married filing separately, your nonresident alien spouse's foreign source income would not be reported on a U.S. tax return.

IR-1 / CR-1 Spouse Visa Process & Procedureswho did it?
Once you are naturalized, you can travel whenever and wherever you want. Get your US passport issued.

Case in point - I was sworn in as a US citizen in April of 2006. The same day that I swore in, I was on a plane to Jamaica, using my naturalization certificate as my travel document. Please note: in these new travel times, I will not recommend traveling on your naturalization certificate, so please go ahead and apply for your passport. The backlog that was seen a year ago is no longer there and you should have your shiny new passport in no time good.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresHAS ANYONE GOTTEN IR-1 INTERVIEW DATE LATELY
Dimples and Lita -- here is how it's going with the interview scheduling. NVC is scheduling the interviews for IR1/CR1 interviews. In Jason and Gill's case, because they are doing K1/K3 visas, the Jamaican embassy is scheduling those directly.

I am not sure how NVC does it, but here is my scenario based on what I went through (I was one of the first cases that NVC started scheduling for Kingston). On the Kingston website, it probably still says that they only do IV interviews on Tuesdays and Thursdays. My case, my interview was on a Friday and that caused a bit of confusion with some yardies that are used to the old way. I called NVC and they said, they scheduled my interview. They apparently put down the date and the time - then let Kingston know this is the day and time scheduled for an individual's interview. It took about 2 weeks for it to be finally updated in the Embassy's computer the day & time of my interview.

I know, long answer, but that's how it's going now.

Does anyone know if NVC has a web site at all?

Thanks.

There is a website where you can get information on the processing through the NVC. You will not be able to check the status of your case as you are able to do on the USCIS site. For updates on your case you will have to call 603-334-0700. Best of luck to you good.gif

IR-1 / CR-1 Spouse Visa Process & Proceduresquestion about green card and ss card
I feel bad saying this, but hubby got his SSC within a week of POE. We are still waiting on the greencard and having a similar issue in that the stamp in his passport is not being recognized as the temp "green card". We are trying to apply for his financial aid for school in March, but the Fin Aid rep at his university is not sure what the A# is. I remember when I first entered the US when I became a LPR it was handwritten in my passport, but now with the MRIV, no one is sure. I have been told that the A# is the registration number - does anyone know if this is so?
Thanks and I hope that those who are waiting for SSC will receive it soon.

QUOTE (waiting06 @ Feb 1 2008, 02:22 PM) <{POST_SNAPBACK}>
can someone tell me how long it takes the visa to expire?
I heard 6 months..but I read 4 months somewhere else..

and also.. Once you get the visa and cannot come right away... what happens with the green card? For instance my husband cannot come right after he gets the visa and so he is just planning to come 5 months after getting the visa (before the expiration) ..in this case what will happen with his green card?

QUICK REPLY NEEDED PLZ

I am not sure if you got the response to your second question. As was stated earlier, your husband has 6 months to enter the country on the I551 stamp that he is issued in his passport. Once he enters the US, they will complete the processing of his case and within 7-8 weeks he should receive his green card. Best of luck to you.

I agree. It's a tremendous amount of paperwork and processing. It's amazing anyone can jump through all the hoops without making a few mistakes.

Yes and as you mention, the 'rules' keep changing. Why are we required to send in things they don't tell us about? I actually have a theory on this. I think they assume that most people will be using a lawyer who - through the grapevine, or bulletins, will somehow get this information.

This process is not designed to be user friendly. They also don't care if you get an RFE for items they don't request in their instructions good.gif

Anyway Shamim, hang in there, I went through a lot of hassles with NVC too - eventually it gets approved smile.gif

And the lawyers don't know either. When I applied for my husband, I used a lawyer and I was the one telling them what to expect (VJ is a blessing). I think I should send them a bill for my consulting fees. I decided not to waste my money with my dad's application; all the info I need I can find out on VJ.

Shamim - keep your head up. It'll soon be done. Keep us posted as to the RFE that you received.

I am tired with the game that the NVC playing with me. First they told me to send DS230-I and passport photocopy, then they sent me a checklist for missing documents, which are birth certificate, marriage certificate and DS230-II. After responding that, while I was waiting for my case to be completed, they have prepared another checklist for missing document which is benificiary's photograph. As soon as I have heard that, I have overnighted it. Now wait another 2-4 weeks to learn some other documents are missing ! What those could be? My wife's bood, flesh, skin.....................

Perhaps the police report. But call and ask.

I think you're right. I had to send in my husband's birth cert, our marriage cert and the police report with the DS-230.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is going on with NVC mail?
You can go ahead and use the shortcut for the Choice of Agent form (DS 3032). I had my dad email his Choice of Agent decision to the NVC and they updated the info within a week.

My dad emailed the following:

QUOTE
Dear Sir or Madam,

My name is xxx, my visa case number is KNGxxxxxxxxxx.

Unfortunately I cannot locate my DS-3032 and would like to appoint my
daughter as my agent of choice to receive all the correspondence from
NVC.
Her name and address is:

Name
Address,
City, State Zip

All mail from the U.S. Department of State concerning my immigration
visa application should be sent to the address above. Thank you for your
help.

Sincerely yours,

I hope this helps. Hopefully you'll get the Affidavit of Support fee bill soon.

tafeagans - my heart goes out for you. I also lost my step-mom (she was my mom, best friend) to cancer and I wish she was alive to see me married. I will be praying that USCIS finally gets moving on your petition.

Susie, the one thing I hope will come from this interview, is that those at USCIS who obviously lack the skills for customer service, are replaced with individuals who are at least empathetic to the things we petitioners and beneficiaries face through this process.

K-1 Fiance(e) Visa Process & ProceduresHELP!! Need Info Jamaica Embassy interview in 2 weeks

Hello -

Our interview dat is in 2 weeks and I just wanted to know if I needed to complete an affidavit of support? The consulate did not request one, but I read that it is good to complete. Also, does anyone know how long it takes to recieve the police certificate ? and how much it cost? Lastly, how much does the ds156k cost to complete I've read $100.00 and $300.

Hi Denise, it took my husband 3 days to get the police certificate using the expedited service; regular service is 21 days. Hopefully someone else can answer the additional question for you. Good luck on the interview

There really isn't a need for people to be mean-spirited in their answers, either answer the specific question or move on. He stated that he was not familiar with the process and also keep in mind that for many years Americans were not required to have a passport. Americans in general have no need for visas so until the new law was passed a passport was not required.
It is responses like a few that I have seen on here why people are hesitant to ask questions. You may find it dumb and irrelevant, but there is someone else out there that it will help. Gosh, lighten up and :help: , that's what we are all on here for, to help and to be helped!

My husband is French. We were married in March 2007 and are travelling to Hawaii in November 2007. If he hasn't received his visa yet, it won't be a problem for him getting back to CA from HI, right? I appreciate anyone's commentary who has experienced this before! smile.gif

IMO - I would say do it yourself. I am using a lawyer currently on my I-130 and I wish I had not. No offense to them, but no one has my best interest at heart more than me. I followed up on my case and think I would have done a much better job than they did. Because of the lawyer's oversight at one stage of this process, it has taken longer for our case to be completed.
Best of luck to you on your journey good.gif
