Do you have a birth certificate? 

If yes, there will be discrepancy with your birth date.

 

It is best that you get your passport reissued in the correct birth date before the K1 visa interview.

You don't want the wrong birth date to snowball into bigger issue down the immigration path.

 

Border agencies keep records and this record-keeping is becoming more and more sophisticated - and if they find a discrepancy for the same person on something like that you may have problems travelling anywhere.

When you receive your visa on Monday, look at the expiration date written on the K1 visa.

The expiration date on the visa is when you must enter the US by.

If the US citizen signed  birth certificate (when he is not the biological father), the US consulate might think that the child has claims to US citizenship when in fact it is not.

I am sorry, but so what?  Not sure he should ever need to consider traveling all the way to Pakistan, when there are other options.  Having seen passengers on my trips from Morocco coming from that part of the world, they have been traveling for more than 30 hours.  Certainly not something any kidney patient should be doing.  Just because it is possible doesn't make it reasonable.  

 

 

He is stating that her country does not have peritoneal dialysis facilities. I found one to prove him wrong.

 

Not saying that he should go to Pakistan in his conditions.

Why do i have an attitude?

I have decided to end my visa journey for the following reasons?. Fiance is SUPER controlling? Demands to see my bank statements to track my spending, Tells me when i move to the USA i have to make a good effort to fit in to his life and he doesn't want to hear me complaining, numerous times i have had to wire him across money, refuses to make a trip to australia because its "to expensive" so i have to take the trips to the USA and cover the expenses. Tells me it would be "pointless" for me to finish my studies?. and the list goes on!

Beyond "how do we get through the interviews?", ask yourself, how will I provide for my wife once she's here?  If you do K-visa, it will take ~4 months after her arrival before she gets a green card and can start looking for work.  She may need more time to adjust, to become successful at applying for jobs ...  Maybe you will have to survive on your income (which is currently $0) for ~ 1 year before she can make contributions.  This could become very stressful, you may have to beg your parents for money, you may feel guilty for not giving her a good life, she may have a hard time adjusting her expectations to reality ...  

 

In all visa / immigration issues, FIRST think about the people - how will this work out for us?  Is this what we want?  Does this match the reality of our lives?  THEN think about the paperwork and how to ace it.

 

There's nothing wrong in general with having your parents as cosponsors (but apparently Manila doesn't like it ?) -- but don't be surprised if your parents or sister are hesitant to do you this favor.  They would sign a legally binding contract that the government can take their salary away to pay for your wife's support for as long as she's in the US.  My ex-wife was a student without income herself and one of her relatives agreed to be my immigration sponsor -- technically this person is still liable for me even though she and I divorced.  I'm still kind of amazed that he agreed to do it.

You can file I-765 with fees but the EAD will take 2-3 months to arrive and only valid till your I-94 expiration date.

So at best you will get a couple of weeks in which you can actually work using this EAD. It is a waste of money.

 

Hence, it is advised to file I-765 & I-131 together (no fees) with AOS ($1070).

Which means IF you could get a visa you could come back but there is almost no chance of getting a visa in the near ( like next 5-10 years) You might qualify for a waiver if you were the spouse of a USC. But currently you aren't looking at travelling to the US for a very long time.

Thanks everyone, had a little bit of a mental break there. This whole process of waiting is driving me crazy. I understood that from the beginning. Just trying to deal with family and work planning. I work in a hospital, if that helps anyone understand my craziness due to scheduling (we have to have our vacay time in 6 months in advance). Just wanted to know if there was anything I may be missing that may help with this whole planning process. I just read that it was good to have these things set and copies of them provided during interview. Just at my wits end, b/c all the venues I have spoken to are booked up completely for the entire fall schedule. As soon as we are approved he will be coming here and we want to get married this year. I actually was going to have the ceremony and reception separate. Eh, once again all about the waiting game. :whistle:


No worries,, just tell them like you just described and all will be good. We haven't made any plans also.. We will tell them we are getting married in Vegas or justice of the peace(I know so romantic),,, but then we will return to the Philippines maybe after 6 months and get married with family and friends with a big reception.

Ok, I will try and offer this. You are looking to purchase a new/used car and are about to graduate from college with a degree, in high demand, in the marketplace and have many job offers... You offer overwhelming documentation/evidence that you can "walk on water" in regards to your education and future employment prospects. Do you think the car company is going to be willing to sell/loan you money for a car without verifiable current income? Personal example, I have a BBA in Accounting, a BBA in Information Systems, an MBA, and 2/3rds of a MS in computer science. I get lots of pats on my back, "good job," but no guarantee of current, let alone, future income.
I will also add that you provide excellent info.
I also don't think much of "senior" members that are not willing to sign their posts - a personal peve of mine...

Read that link, should help you out. I think your fine as it states that the USCIS looks very closely to your current income, which you have enough. There are always other options, list all assets you have will help. If they wanted more at the interview, you wouldn't necessarily get denied, might need a co-sponser(worst case scenario)..

You're so close I wouldn't worry about it, if you were to fail you already have stated your next step. Just a longer journey. Good luck..

I made under the 125% level of income last year, but this year I'm making more income due to obtaining my CNA license and not going to school anymore (for now) and working more than 40+ hours per week. Am I likely going to be denied because I haven't had the required income for over a certain amount of time? I also have changed jobs this year due to my previous client moving to a Nursing home, and now i'm working in a Nursing home myself.

I just don't want to risk getting denied because of this issue. If it's even a decent chance of denial, my fiance and I would rather just go with the DCF visa option and get married and live together in the Philippines. I just don't want to waste any more time, money, and suffering for
something that might turn out to be a big waste....


I guess more info is needed. How close were you to the cut-off last year while you were working and going to school? And if your currently in a permanent job making enough money, I think that is what mostly is required. I would absolutely have a good letter from your employer stating income, permanent job, length of time at job ect.. And if they had questions at the interview its not an automatic denial. If you've already started the process I would keep plowing forward. You're currently making enough now, diba?
