Not possible.. You could file for EAD ($380) once you enter US with K1 visa but it would be a waste of money since EAD takes 2-3 months to process and only valid till the I-94 expiration date. 

 

In the best case, you will be eligible to work for about a month, probably less.

The worst case is that the card arrives after I-94 expires and you've just donated $380 to USCIS. 

 

It is best that you send out all the forms AOS/EAD/AP (I-485/I-864/I-765/I-131) TOGETHER to USCIS Chicago address asap after marriage.

The latest fee for AOS is I-485 $985 + $85 biometric fee for a total of $1070, filing EAD and AP together is free.

I have asked my parents and they both regretfully said no. They have never met my fiance and they do not understand the commitments of co-sponsorship. They think if my fiance comes here and gets in an accident or gets sick (heaven forbid) they will be legally responsible.  Is that true? I thought it only concerned government aid.  I am not close enough with any of my cousins to ask, unfortunately.

Immigration itself is not cheap, form filing fees, Consulate Interview fees, medical fees.. AOS fees, ROC fees ..etc

 

Since you wish to be with fiance, then it should be your sole responsibility to find a job that meet the 125% poverty guidelines, which is $19,387 for household size of 2 which IMHO is considered low already.

 

If being together with your fiance is your top priority now, then defer your studies and find a job to fulfill the immigration criteria.

 

If not, then wait till you are graduate, get a well-paid job to sponsor your fiance/spouse.

 

This couple endure years of separation before the visa is finally issued.

You have more fees to pay during the later stage of the immigration process

examples: K1 Visa interview fee, required medical exam, police record.

 

After entering US, another round of Adjustment of Status (AOS) fees.

 

Thus the Approximate Total Cost (USCIS Petition, Visa, AOS) is estimated to be around USD $1650 plus your fiance airfare.

Your children will have to go through the same (or a very similar) application process as you. After you get married and apply for a green card, your K-2 children may apply along with you. Each will need to submit (by mail) a separate application for adjustment of status to U.S. Citizenship and Immigration Services (USCIS).

How about Ho Chi Minh embassy vietnam? What is it in p3? I saw my case status change from ready to ready with new updated date. So I guess my p3 was sent out . My question is should I wait for the p3? Or could I send document back as I know my p3 was sent out ?
Beside that, do I need to send p3 before schedule the interview online or can I do before it ?

3.  No you can't.  This used to be possible but I heard that around 2007 some guys girl got denied and the guy ended up assaulting the CO.  I've heard that story multiple times from multiple people, so I tend to believe it.

 

 

Sorry to sidetrack, how could the CO be assaulted, since the CO is safely separated/protected from the interviewees by glass window like this below?

For Philippines, the CO looks at the totality of case before deciding if co-sponsor is accepted or not.

 

From the search in VJ, close relatives of the petitioner seem to be preferred. Also, if the petitioner is a recent college grad and/or just joined the workforce (and thus are seen to have good earning potential ahead of them) the co-sponsor is more likely to be accepted.

 

Nothing to do with 'compassion' or even God.

That was so sad to read.  Didnt you ask for a case number to check on USCIS from your exfiancee?  Or didnt you call USCIS to check on your case status?  I think as a beneficiary, you have a right to call USCIS as well, right?

 

 

For I-129F petition, only the US citizen has the right to call USCIS for more information.

 

I tried to call USCIS before but they refused to talk to me about the petition as I was not the petitioner.

Yes to the first sentence and No to the second.

 

ALL children must be listed on the G325a (and/or 129f), regardless of immigration intent.  It is on the DS-160 that you would list any children than you wish to receive a K-2.
 

 

 

And yes if you are not married, then the K-1 is the route to go......doesn't matter if you have a child or not....USCIS does not make moral / ethical / religious judgements.

 

 

The child is the bio child of a US citizen, filing CRBA and getting a US passport is the correct way.

The US consulate won't issue the child a K2.
