I have a quick question regarding original documents at the interview.
My husband was enrolled in electronic processing so all of his documents were scanned and sent into NVC. I know he has to bring all of the originals to the interview. Will they keep all of these or give them back after looking them over?
For most of the things I could care less if they keep them or not. But I am really hoping they don't keep our original marriage cert. Do you think they will give it back? Or will they keep it?

So in me and my husbands move out to Montreal (we came out here a month early for his interview) we managed to loose our wedding DVD (I am so mad but I will live).
Anyway I do have the video posted online, I posted it a couple days after our wedding. I wanted my hubby to bring in the DVD to his interview but do you think they would be find with him just giving the link to the video online since we no longer have the actual DVD?
Or do you think they won't really care and wouldn't watch it anyway?

If it is the case that USCIS employees read this site, then please can you try to get your mis-information line sorted out.. You guys really need to stop giving out information that is inaccurate !!! Especailly when that infomation takes money out of our pocket or has a detrimental effect on petitions and applications.

This journey is enough of a mine field already without having to get our legs blown of by receving WRONG information!

OKAY! I have been reading all of the consulate interviews and there is a large percentage of time that they ask if the beneficiary has visited the US! My husband has never been here. I am going there, but I think he needs to come here for a week. We are married...okay...granted...I just want to spend more time with him, LOL. But, we have to establish a relationship and I am very concerned that we saw each other physically for the first time and got married in the same week in Hong Kong.

Rosy--was he using the VWP, or did he have to get a formal visa--it is quite different for folks that have to get a B1/B2, and of course he was armed to the teeth in case he was asked. Poet has a different problem--India is not part of the VWP.

My husband (UKC) has come to the states 2 times while our I-130 is pending.. We are also December filers.. The first visit he stayed 11 days and the second was 17.. At the POE he was armed with ties to the UK, work letter, rental agreement and was not even asked anything..


Thank you! That is exactly what I was thinking! We are not trying to circumvent the process, just spend a week or two together when we can. I am going to India in 13 days for a week and I am thinking it would be good for him to come here for a week before his interview. He can get added to our lease and start the work networking and adjustment period....which may be circumvented by our desire to stare in each others eyes for hours...LOL.

It won't put your spousal visa at risk, but he is unlikely to be approved for a tourist visa while he has a spousal visa in process.


Thank you for your response. The Kolkata consulate does not know he has an I-130 with the CSC. Why would it be denied?

My husband is in India, and I am a US Citizen. Will it be confusing to the Mumbai Embassy if he applies for a non-immigrant tourist visa so that he can visit us while we are waiting on the CR-1? <<<We are December 2010 NOA1 filers>>> ... Is it okay for him to come and visit for a week or two? I would really appreciate any advise in this matter...especially from those with Indian embassy experience. My husband feels it is a risk, so I am going to Kolkata in a few weeks...but if this process takes as long as it looks like it is going to take, we would really like to have him here in the US for a visit as well later in the summer. Will that put our visa at risk?

Thanks. 5 months and 1 day from first text message of NOA1 to second text message. Got a call from my senator's intern this afternoon saying it had been approved but did not receive text until a couple hours later. Guess who I am voting for next election??? *grins*

My husband just got out of his interview in Mumbai. He was interviewed by three ladies and they asked him lots of questions about my two previous marriages and they seemed to be unhappy about our getting married in Hong Kong.

Then, they wanted our original marriage certificate and hotel receipts which they already had those too. Then my husband tried to submit them to the Mumbai VFS, but they said since he was from Kolkata that he would have to wait and submit them there.

What is going on?

In fact, the 864 instructions under #29 shows a clear example of this, technically, the USC should be able to show 3x whereas using the intending immigrants savings would be 5x. We used assets and had to show 3x the 125% in the bank under my (the USC) name, this was the specific request of the Naples CO.

For example,if you earn $15,000 you fall approx $4,000 below the income requirements, so you can deposit 3 x 4k into an account under you so $12,000 which should suffice to prove you can support him...

OR you can look for a co-sponsor


Is this something you did or know someone who did it? Do you know where I could possible cross reference this information with a legitmate legal source? I.E where did you learn about it?

Really? That would be wonderful! I don't know that he necesarily has those assets YET but I'm going to talk to him about wether that would be a realistic option for us. There are some possible options he has for a co-sponsor, but I know he would feel better if he didn't HAVE to use that route. I had scoured around and it seemed like there was simply NOTHING we could do but find a co-sponsor or bust. This is great news!


The I-864 is not used in a fiance visa case. The Consulate may choose to consider the beneficiary's income or assets but it is entirely up to them.


Well, we would not be using the I-864. We would be married at the time of filing our paperwork. We would be getting the IR-C1 (Um, I always screw up the name of it). Would this make a difference or?

So, here is the deal.

I am a US citizen, fiance is from India. He has and makes a great deal more of money than I do, including a good size amount in savings. I am working and have held the same job for more than a year, but I fall below the US poverty guidelines; much less make 125% ABOVE.

What can we possibly do? I am totally stumped right now.

Take time to read the guides and get organized! If someone throws an acronym out that you aren't sure of, just ask them to explain. But most important.. take the time upfront to make sure you have everything in order, you don't want to waste time having to send additional documents.

It was my husbands first time flying so I made sure to explain to him about turbulence and that it's normal and nothing to be afraid of. Thankfully I did because the flight from Casa to JFK was quite turbulent. Be ready for the funny stories and to explain things you never thought you would have to explain!

It's quite a journey, wouldn't trade it for the world!

There may be questions at the interview if the fiance is not also a muslim. I would be prepared to answer that. I don't think they would deny you, but it is outside the cultural norms, so just be aware that it would be a hurdle for you to get past.

Casa doesn't always call the day before. In fact, if I hadn't called the consulate the day before my husband got his visa and found out we were getting it the next day we wouldn't have known until that very day.

They called him around 2pm to see if he could come to the consulate to pick it up the day they wanted him to pick it up.
