IR-1 / CR-1 Spouse Visa Process & ProceduresQuestions about ITIN for filing
This isn't 100% correct from what I've been told. Even if filing Married filing separately you need to have the ITIN because they need to have the spouses SSN or ITIN on the return. You need it for both.

I´m a US and Colombian dual citizen married to a Colombian national. I have been living in Colombia for 4 years and have worked here since 2008. We are filing our affidavit of support with a joint sponsor. I am currently filing my 2008 return to submit with the joint´s sposnors taxes. I have sent my Colombian income information to an accountant in the US and he claims I must state Single status on my 1040 because my husband doesn´t have a US social security number. Is this true? Will this cause problems with immigration, since we are married and are applying for a spousal visa?

Thanks for your time,
Patricia Herrera

You can file jointly if you file a W7 to get a ITIN. The W7 has to be submitted with your return.

http://www.irs.gov/pub/irs-pdf/fw7.pdf

Exactly, file for an ITIN! Do not file single as you are not single! You can certainly file Married filing separately if you aren't reporting any income from your SO. You can also file married filing jointly

I would definitely send a letter from your current employer that includes your start date and your pay. If you get a paystub by then I would scan that to him as well.

IR-1 / CR-1 Spouse Visa Process & ProceduresGetting started... CR-1 application
Get started on just having the forms filled out. Don't date or sign them but have them ready... Understand what each form requires as proof and always make sure to make copies of what you send in.

My advice... don't waste your time on the K3. It will only save you a few weeks and in the end once your husband is here will be more hassle than it was worth. Go with the CR-1 as is provides many more benefits for the immigrant.

Don't start getting police certificates yet, they're easy to obtain in Morocco and I believe they expire. So don't worry about that. I would make sure he is up to date on his vaccinations and see if he can get record of them from his doctor. Make sure you read the guides!!!! Also, the Ling Che shortcut is amazing once you're off to the NVC.

Don't wait to ask questions.. if you're unsure ask right away, everyone here has either been through this or is going through this and is willing to help, but you've gotta make sure that you can give people enough time to help.

Start printing out your proof... DO NOT keep all the information on your computer.. we've seen horror stories of computers crashing and all the evidence being lost.

Last but not least, realize this is Casablanca... though it may not be the worst out there, it can be tough. If you're well prepared you can make it a lot easier on yourself. Your husband needs to be prepared for trick questions and for answering pretty much anything about you, so might not be a bad idea to read the sample questions and have him start practicing. I had my husband practice with a friend so that it was more like an interview rather than his wife helping him smile.gif

You do NOT need this. My husband went for the CR-1 visa with no question of funds in the bank account. I used my tax records and my paystubs on the I-864 to prove income.

IR-1 / CR-1 Spouse Visa Process & ProceduresK3 or CR1?
QUOTE (hindocha @ Nov 17 2009, 09:17 AM) <{POST_SNAPBACK}>
CR-1

Ability to work when you arrive
conditional resident for 2 years; then you remove conditions
almost $700 cheaper

K3

have to apply for EAD
have to apply for AOS within 2 years
gets you to your spouse quicker...price less

yes i know the pros and cons between them both.

In the past it was a lot faster to go the K3 route.. however now you're only saving a few weeks. The price may be less to file the papers.. but not in the long run. It's much more expensive to go the K3 route.

CR-1 is the way to go!

IR-1 / CR-1 Spouse Visa Process & ProceduresTo those who are interested to know about in name check
My understanding is that AP isn't simply just a name check in some countries. I believe it also includes home visits and family background checks.

So it's possible in Egypt that the name check will be done in 3 months but the other checks may take longer.

That's true, if you never file for the K3 you won't have a chance of it getting confused. Simply don't send in the I-129F.

Read the guides definitely so you understand what the process is.

Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresAdditional processing for CR1, is that normal ?
QUOTE (portlib_jc @ Dec 10 2009, 06:55 AM) <{POST_SNAPBACK}>
Hi all,
we are in nvc stage for CR1 petetion, and its been 4-5 weeks since we sent out documents (AOS & IV package) Until now NVC operator was telling me that they were reviewing our packages. Now they are telling us its in Additional Processing. So they have no time frame. I have heard Additional Processing for K3 visa. Is this normal for CR1 also ? has anyone been through additional processing for CR1 ? whats the timeframe for that ?

thanks in advance!

It is common for the CR-1, K1, and K3. The timeframe varies from case to case, country to country. My husband received his visa after about 2 weeks of AP following his CR-1 interview.

I would put your new address and send it to the service center for that state (check the I130 instructions).

Absolutely, if that will be your permanent address and you aren't just visiting there you should put the new address.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow do I know which Visa I am applying ?
IMHO, this is a place where you need to be open to the advice you're asking for. People aren't here to wrap the advice in a big pink bow and hand it over to you with warm fuzzies. This is a place where people will give you honest and direct opinions.

I read and re-read Darnell's post and I can't see anything in it that would be rude to your fiance. Anyway, if you didn't think it was rude... why even post that your fiance thought it was?

Yup, if she didn't file it then you aren't applying for it.

Also, if she did file it... when you get assigned an interview date for it.. just cancel it or try to switch it to a CR-1 interview.

No fee's are paid for the Immigrant visa interviews. They are all paid at the NVC. If you were going for a K visa you would have the $131 fee. I'm not sure if you have to pay for express mail charges while you're there if they plan on mailing the visa.

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit examples?

There's many things on that list of 6 types o stuff that you may not have, if you are a newleywed..

But - affadavits from people can be useful.

If you check the detailed instructions on that - yikes - they want lots of information from 'that ' person writing an affadavit, yes?

Off the top of my head its:

Name, ID # , address, telephone #, then in the body of the letter - how that person knows YOU TWO, and how that person knows the two of you are married.

IMO, ya, an affadavit should be notarized. Most banks do that , for free.

As for 'necessary in first package' - wei - send off as much as you have, as much as you can, for the first submittal.
Remember - the ConOff at the Embassy/Consulate will Review this information, prior to interview day, and on interview day - so the more you can 'front-load' , the better.

If you did not send off the info - well, you MIGHT have opportunity on Interview Day - MAYBE - you can certainly bring it, but the ConOff won't have much time to review it.

Here's what I did, for initial I-130 submittal - http://www.visajourn...p;#entry3324240

But note, that I front loaded as much as possible - because Guangzhou is a 'tough' consulate.

I'm with Darnell on this one. We actually included affidavits 3 people who know me and 3 people from my husband. We went through Casablanca which is not known to be easy. We front loaded the application and then brought the new information with us to the consulate.

It does say that it is not necessary to translate if it's in the native language however, this is Morocco. I would definitely get it translated because you know if you don't they're going to request it.

I remember that Casa put out a list of certified translators by city. I would recommend that you e-mail them for that list.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling married but seperately- Federal Income Tax
Ok, so you shouldn't file single because you are in fact married. You will need to get him an ITIN whether you file jointly or separately. No way around it. You won't get approved for an SSN until you get the visa approval... you will need to prove your taxes have been paid and filed prior to that happening. Get started on it now, it will delay the process but it's necessary to do this.

It does need to be notarized from a US Consulate. Have your husband take his passport there and make a copy and get it notarized, I believe it's a $30 fee or close to that.

Well, if the visa is denied it will be sent back to the USCIS at which point you will have a chance to send in additional information or documents to help overcome the deniel. Many times with K1 the petition will have expired before it can be re-affirmed so some people will work to overcome the reason for the deniel and file again for K1 while others have gotten married and filed for Cr1

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC Case processing?
My case was closed about a week after they received everything. As far as the actual scheduling of the interview that will not be done at the same time. I know for us my husband is going through the Montreal consulate for his interview and they do their own scheduling, so after NVC closed the case they forwarded it onto Montreal who then did the scheduling. I'm not sure if all embassy's do their own scheduling but either way it will take a little bit after your case is closed to be notified of the interview date.
