I would think twice about doing an FOIA. I filed an FOIA to view the consular notes and it would have taken 12-18 months to complete. CSC could not look at my case until the FOIA was finished. I ended up canceling the request. Then csc found my case and told me it was expired.

Here is what is happening to me when the consulate sent back our case.
My case was denied at HCMC 221g in October 2006. The consulate sent it back to NVC and they sent it to CSC. When I originally filed the I129-f , i sent it to NSC. Now CSC tells me they don't know why the case was sent to them and it should be sent to NSC but they never said they will send it to NSC. I am now working on having the case sent to Nebraska so I can rebut the consulars findings.

here is what CSC wrote:
We do have the case here at our office, although I'm not sure why we have it since the Nebraska Service Center adjudicated the I-129F Petition. We really should not review a Consulate return from a decision issued by another office. We really should send this back to the Nebraska Service Center.

Additionally, at this time, due to our limited resources, our office is not sending the Petitioner any further notification from an Embassy or Consulate return on I-129F Petitions since the validity period has already expired (4 months), and we will not revalidate the petition. There would be no further action for the USCIS to take since we would not be revoking an approval that already expired. For the most part, concerning I-129F Petitions, the Embassy or Consulate returns the case to the USCIS as cancelled since the visa was not issued during the authorized period. The Petitioner may file a new I-129F Petition.


I thought about accepting this answer and file a new I129-F petition but my attorney says it is the consulates policy to return "do-over" petitions when the original returned petition was never adjucated by USCIS. So I could be wasting a lot of time filing a new case and having it denied again because the old case was never officially resolved.

Martindart gives me hope that happy endings do exist!

I've been doing some research about the police cetificate/s needed for the visa interview and have one question for anyone who can help.
Do you need a police certificate from every area of the UK you have lived. For example. My fiancee now lives near Nottingham, she used to live in a borough of London. Does she need a subject access form from both Nottinghamshire and the metropolitan police?
Any help would be appreciated :)

I am in the same boat as you are, January 14, 2012. I got an amail from consulate once, saying that your case requires additional processing, we will contact you when we have finished your case. Therefore, You have to hang in there and hoping you will here something soon.

Embassy Delhi India sent me petition to USCIS to either re-affirm or revoke, GOT NOID (notice of intent to revoke) from USCIS.
I have end of month to respond.
I have all the quesiton answered, which was in NOID.... with supporting documents. It was mistake on our part not to submit all together... long story..

Now, I am ready and gathering evidence and I have almost 6 inch thick papers that are arranged professionally and with reference to each other.
I have response to NOID...... Document list with reference defined, checked, double checked.....
1. Please advise for any thing..... PLEASE, I need your help.
2. How long does USCIS take to look at the response to NOID? What am I going to expect now? Please explain in details.

Thanks in advance for all the responses/comments/suggestions.

I was waiting for 3 months before i received package from USCIS and resubmitted documents, wait other 2 months for approved. There is no matter how thick or large the documents, their must be answered correctly, what the OC is looking for on the slip. Good luck

The fact that they were already going to send it back IMO is the hurdle they have to get over... they will not respond any differently unless there is something that has changed.. they will send the same canned response... I wouldn't be surprised if they did to you guys what they did to seattlerain last week.. having his SO give them the email PW so they could check the correspondence... Age isn't a big deal and the length of time since divorces seems good.. the number of divorces could be an issue..


Since you think number of divorces could be ann issue, there is/are ways to clearify this issue. Also you mentioned seatllerrain situation, his case is in the same boat as me. Thanks

Its in AP and you should have your senator or congressman check the status for you but in the scheme of things it hasn't been in AP long... What do you think caused the AP? Red flags ? Recent divorce? Previous filing? Short relationship? Few visits? introduced by friend or relative? Most of the time there is little that can be done aside from wait.. extra docs will only help in some cases where docuemhtation may resolve an issue... it all depends on why they think something funny is going on...

I am 58 yrs old petitioner usc and my wife (Vietnamese) is 47 yrs old, benificiary. I divorced 3 times, last time was 21 years ago. I married all us citizens women. I went to Vietnam 5 times. My wife she divorced her ex-husband 10 yrs ago. Do you see any red flags here?
A few things could be red flags: common language. I speak english and do not speak vietnamese, my wife speaks english little. But we can communicate okey. Also her first interview with consulate, 11/2008, the case was sent back to US and intent to revolk, because the common language.
secondly, OC might still believed that my wife and ex-husband in contact with each other. The truth is she has not seen in the divorce court. Anything that you might think of to clarify this issue? Also Can lawyer there have her ex-husband (behalfs himself) write an affidavit and sign it and submit to the consulate? Advice please
lastly, it could be my age too, but i have seen people little older than me, they have no trouble at all.
Regarding, senator. I went to her office, she mailed to the consulate, got the response back: saying that the consulate officer interviewed my on 12/15/2011. Submitted additional documents on 1/15/2012. The case was reviewed on 1/18/2012. However the case was required further review. Due to large number of applicants need to be reviewed, can not view out of sequence.
My lawyer just got a response from consute 4/6/2012 again. It basecly said the same thing as first response. Please give me ideas what could red flags thanks.

Since I was in AP at HCMC for quite some time, I submitted extra evidence one time. I would submit anything that could potentially address the issue they have. It will not be a quick fix, but it can help. It is said the additional docs can cause additional delay... How long have you been in AP? have they done the middle of the night phone call Q&A yet? any investigators come to the SO's house checking out the relationship?

What did they ask for in the first blue slip?

Hi everyone, as i said i need urgent advice it's bcoz that i am on AP Since 11 JUNE 2008 and it's about 4 years so now i came to realize that i need to go for MANDAMUS law suit as soon as possible,can anyone suggest or tell me if it's the right option for me or not.Actually till now i was unaware of mandamus and i thaught that this would be the usual or normal waiting time for visa or u can say that i was asleep.
Interview date 11 june 2008.
Spouse visa.
every thing was fine in interview but i guess the region in which i live mattered for so long AP i.e Swat- Khyber pakhtonkhwa.
but i think it's too much time so kindly guide me and also if someone know best immigration lawyer in Islamabad? or i shod process the case through US attorney?

For those of you who contacted your senator or congress-person...how long did they take to get back to you? I contacted my senator (Kirsten Gillibrand - New York) about a month ago (03/19) and I am still waiting to hear back...I'm sure they are busy because it's a New York office and I'm sure the embassy also takes a while to respond to the inquiry...but I'm getting anxious...I talked to them over the phone a while ago and they had all of the info they needed...but how long should I expect to wait for a response? This whole process really tests your patience...

WOW, Benita, that ultrasound looked awesome! I am glad the immigration appt is coming up soon. Hopefully you’ll be able to put all that behind ya soon.

So, my news is I am 10 weeks pregnant. Pretty crazy. I heard the heartbeat yesterday and it was absolutely amazing. I can’t wait to see news from Charity about her being a soon-to-be-mommy too. We’ve all be in this so long together and it is nice to see us all moving on with life together too.

Sorry I am not around much but my life is kinda hectic now.

I am so happy you have filed for divorce and happy that soon he won’t be able to be here legally but while he IS here legally…you might want to check into getting child support. Take him to the cleaners Marta. You deserve the best.

And finally, NONE OF THIS IS YOUR FAULT. You entered the marriage and the immigration process thinking a certain way and it is not your fault that he changed who he was. Don’t accept his wrongdoings as your fault or something you could have changed or seen. Sh*t happens and we learn from it. You will become a stronger person moving on with your son and thankfully little Joshua won’t learn to be a man from your ex. You are a good mom, Marta. Think of you and your son. If you need to move or sell a vehicle, you can do it. So what if you will live in a smaller place or have not such a nice car for a while…you will be the winner because you will have done it yourself!

Benita…sorry to hear about Alex. It’ll be a rude awakening the day somebody isn’t waiting for him. They always realize too late. We’ve been having some of the same issues. I think a lot has to do with Miguel having so much freedom and no one to be accountable to while he was in Mexico. We are going through a lot of adjustments. I am hoping for the best.

However, my opinion is if you put off the appt you may not be able to get in for a while and that may frustrate you both more.
The money situation will work itself out. Maybe not tomorrow, but it will.

I had a grimace on my face the whole time I saw David Blaine. I had heard about it all week and saw it when I was flipping channels. I kept on saying out loud “that guy is crazy” and I got freaked out when he started almost convulsing right before they brought him out. I don’t know why anyone would do that. A fear of mine is going off a bridge in a car into water and not being able to get the windows down fast enough (which is why I wish my car had manual window-roller-downers v. electric ones) so I don’t get why anyone would put themselves in that position….except, of course, if that isn’t a fear of theirs.

Hope the check stuff gets worked out Charity. I am with you about Miguel finding a new job at times too. Hard to live when you have to depend on the weather to get a paycheck. But I can’t see Miguel indoors. So we depend on the weather and pray it is nice. ;)

Since Monday I decided I might want to go to nursing school so I've been running around like a chicken without a head trying to figure out which school I could go to, what it'll cost, how long it'll take, blah, blah, blah. Plus the receptionist at my work quit her job so we've all had to take on her duties...which include answering the phones. ICK! I hate that.

Well cinco de mayo is here and I haven't had a helote yet...something is seriously wrong. My mouth is watering thinking about it. hmmmm, where can I go at 10:15pm to get one....maybe tomorrow. :lol:

HOLY CUTE KID BENITA!!! Wow, such a beauty little Emily is. And pretty sure she’ll have a cute little brother or sister. How excited you must be!!!! I like the serious photo of her on the upper right. Serious photos are just as precious as the ones when the kids are super smiley!!

Melissa…good luck on all of that. I have no idea about any of that but it seems a lot more complicated than getting married here in the US. Believe in yourself and each other and you’ll be able to get it done.

And remember the important part about all of this isn’t how your dress looks, how the food tastes, how the flowers smell or if the guests are enjoying themselves….it is about the fact that you are marrying the person you want to spend the rest of your life with!

Charity….I am glad you got in so quickly!! And I am sure you’ll hear good things because that is your anniversary too! A good omen. In other news, you were in my dream last night. It was weird. You worked at my old college and I remember being so baffled that I had never seen you when I went to school there. VJ is creeping into my unconscious thoughts!! Ha, ha.

Benita…glad to hear you and baby are doing well. Hope the next appt goes just as smoothly.

I am thinking of changing careers. I know that sounds crazy but I think I need a bit more action. Sure this paralegal/interpreter stuff is fun at times but there is such a routine that at times I feel like a robot. I am thinking nursing. However Miguel keeps saying, if you become a nurse remember to be nice to the patients. I was like what?! And then I remember that I am at times “brava” and rather sarcastic. So I said, well I’ll just save that for YOU when I get home. Ha, ha. I go on Thurs to an info session and on Friday to meet with an advisor. It might just be a crazy idea right now but perhaps it’ll turn into something. Nothing like when things calm down I gotta put stress and financial uncertainty back into our lives. Ha, ha.
