I received this e-mail reply when I was requesting to talk to the consulate. When I arrived in Vietnam and went to the consulate I had to submit a request in writing. They got back to me the next day(12/27/06). They refused my request because they said my case was closed and everyone was on vacation.

If you would like to meet a consular office to discus about this case, you can request for an appointment upon your arrival in Hochiminh City. At that time, you should send your request to the Information Unit. You can send your request by fax, email or in person at the Consulate. We regret that we can schedule an appointment in advance.

NVC will send your case to CSC. CSC doesn't send out any NOID or NOIR any more. Most likely your case will expire and you can file a new one. Here is a reply CSC sent to my congressman.

We do have the case here at our office, although I'm not sure why we have it since the Nebraska Service Center adjudicated the I-129F Petition. We really should not review a Consulate return from a decision issued by another office. We really should send this back to the Nebraska Service Center.

Additionally, at this time, due to our limited resources, our office is not sending the Petitioner any further notification from an Embassy or Consulate return on I-129F Petitions since the validity period has already expired (4 months), and we will not revalidate the petition. There would be no further action for the USCIS to take since we would not be revoking an approval that already expired. For the most part, concerning I-129F Petitions, the Embassy or Consulate returns the case to the USCIS as cancelled since the visa was not issued during the authorized period. The Petitioner may file a new I-129F Petition.

My case was sent back December 2006 and it took until May to find this out.

It wouldn't hurt to put together a package of evidence to rebut the consular's findings just in case CSC sends you an NOIR or NOID. If they don't, you can include all that evidence in your new petition.

We received an email from CSC saying that our case is requested for review...I am very happy because CSC received our case. But we just wonder how long does it take for processing at CSC?

If you decide to have an egagement ceromony on your first trip, I would suggest having it near the end of the trip rather than the beginning. In my case, they were suspicious that we had had our Dam Hoi within a few days of my arrival on my first trip to Vietnam. They also had a problem that I only made one trip before filing for the K1 along with my extreme lack of evidence prior to our Dam Hoi. I have tough mountain to climb to covince them that we are legit. Good Luck to you on whatever you decide to do.

One reason our visa was denied was because I made only 1 trip. It stated that in the green slip. I made a second trip after we were denied. I am planning a third trip when she has her interview in Feb-April time frame. I was also thinking about going during our mandatory Christmas Break at work. That gets to be very expensive. I'm not saying they deny every case for only 1 trip but they sometimes do. I would consider a second trip.

Thao lives is Ben Tre. Every letter and package I sent has made it to her house. It takes a long time though. Sometimes up two weeks. They get to HCMC fast but I don't know what happens after that. I think they deliver mail by bicycle.

Our case was denied Oct 26,2006 and it was sent back December 6, 2006. It finally was received at CSC 2-6-07. In May 2007, they told me my case was expired and they won't adjucate expired visas.
My case was a little different because the petition was originally approved at NSC.
Here are some emails from CSC after our case was returned. Things could have changed between then and now. I only wish I could have kept the case at HCMC and fought it there with M.E. 's help.

Sorry To hear that Kevin. It is very important to try to keep the case at HCMC before they ship it back to the states. Once it is sent back, you will most likely have to start over. I'm not an expert at this but a senator,congressman or an attorney may be able to request the case remain at the consulate for further review. There's an Americian attorney working in HCMC that could possibly help you with this.

I don't know what I need to do to convince them. I included all our evidence(I mean every last bit of evidence) in our new petition. My package was 3 inches thick. I also got statements from co-workers, family and friends saying that we are legit and we want to marry and start a family. I plan on being there for the next interview, probably in April, with more evidence. It will be my third trip there. They may deny us again for the very same reasons or find something else to delay us. That is why I hope Kevin and Tuyen can convince them now and not go thru what I had to do.
