Hello, Selamat Melam to you both. Congratulations on your success thus far, our prayers are with you. My fiancee, Indra and I are patiently awaiting our NOA2; I received the NOA1 Feb. 5th so it's nice to see another Indonesian K-1 applicant's timeline for real. Did you have to have his birth certificate translated and legalized(notarized)?

We have discussed our next steps once we get our NOA2, but it's still unclear to me if she needs her birth certificate translated for the K-1 interview, and if she will need this for the AOS in Minnesota.....

"b. Crimes committed against the person, family relationship, or sexual
morality which do not involve moral turpitude include:

(1) Assault (simple) (i.e., any assault, which does not require an evil
intent or depraved motive, although it may involve the use of a
weapon, which is neither dangerous nor deadly);"

Thanks for the input. I have read their interpretations on crimes of moral turpitude already and I feel like we should be fine. However, any conviction probably doesn't look good to them! This process makes me second guess EVERYTHING!

It makes me feel better to get a second opinion.

Meghan- I think it did happen in the Albaicin!! Two drunk Spaniards were trying to pick a fight with my fiance and his friend (both from Brazil)... they had been watching a soccer game at a bar (wearing their Brazil jerseys, of course) and the Spaniards followed them for awhile and finally started pushing them around-they were looking to fight! Anyways... the police ended up coming and breaking up the fight and only arrested my fiance and his friend...the foreigners. Of course. They stayed one night in jail and then were released. A YEAR later, they had a court date and they were ordered to leave the country, which they did.

Now I'm all freaked out that he will get denied at his interview! We have a copy of the court records, but it obviously makes it all sound like their fault.

Can anyone answer- Is this a serious enough of a crime for denial?

He was sentenced to a year and a half in jail, a $2,000 fine, OR deportation. He obviously opted for the deportation, but worked it out with the judge that he could leave on the ticket he had already purchased to return home.

I'm terrified they are going to reject him just because of this!

To make it more clear, the Judge SUBSTITUTED deportation instead of using a sentence of jail time or the fine.

Does the fight constitute a crime of moral turpitude?

There were no weapons used. There was no permanent injury, disability, or disfigurement.

No prison time was served, nor fines ordered to pay. (substituted for deportation)

That's what I thought, but it's always nice having someone confirm just to be safe. I figured the court documents would be enough and any other information they want they'll have to get from Spain directly, which might prove to be just as impossible for them as it is for us! Who knows!

Since the court records are in Spanish, I'm assuming they will have to be translated in to English or Portuguese since he will be doing his interview in Brazil. That fight in Spain is the only run in he's had with the police so I'm hoping it won't cause us any trouble/delays.

My fiance is from Brazil but lived in Spain for almost two years. He originally went to Spain on a 3 month tourist visa, but ended up finding a job and staying. His employer told him he was doing the paperwork that would allow him to stay on a work permit, but never actually did. This being so, my fiance was illegal in Spain for quite some time. Spain does not issue police records for illegal immigrants and although we have tried calling multiple embassies (brazil embassy in spain, spain embassy in brazil) they have told us that we won't be able to get a record. He had a minor incident with the police from a street fight, but only spent one night in jail. He had a court date, went, and they told him he had to leave the country since he was illegal, and he did. He has copies of all the court papers, but we are still unable to get the official police record.

Since police records are mandatory from each place the applicant has lived for over 6 months, what do we do?

We plan on being honest about the whole situation including his illegal stay in Spain and the fight. Will this cause problems? Will we still be eligible for the fiance visa?

Any advice or information would be greatly appreciated!

This whole process is so stressful!

Thanks for the reply. Salli had emailed them asking if all her documents were in order and how they would contact her. They responded a day or so later stating everything was ok and they would be processing it in the next couple of days. That was over a week and a half ago. I sent them an email politely and briefly describing our situation (so they didn't think we were just anxious and neurotic) and asking for some info. I was very clear that I wasn't asking for immediate action, just info on whether or not there was a complication. I have yet to receive a response. I really just want to give the park (where we plan to have the ceremony) and the venue for the reception a deposit, not to mention arranging her parent's and my extended family's travel. These places will not hold reservations on my wit and charm alone. But I can't bring myself to pay for anything until I know she will receive the visa, or else I have a wedding without a bride. We can always postpone the wedding, but it appears that her parents could not attend with in the timeframe allotted by the K1. It would absolutely break her heart if they couldn't be there. I'm in a bit of a pickle. A very stressful pickle.

My fiancee had her interview on 8/6 and was told that the visa should take about a week (it is now 8/20). We have emailed the embassy in Helsinki and received little to no response. Just want to see if anyone had any insight on what could be the cause of the delay. We are in a time crunch to arrange the wedding so her parents can attend and I am starting to worry that we will not be able to accommodate their schedules.

My I-129F was approved on 11/5 and sent to the NVC. The I-797 says it will be processed and sent to the embassy (in Romania) within 2-4 weeks. I've scoured every source i can find, but i really don't have a good feel for the timing between that 2-4 weeks and her appointment. Does anyone have any recent experience with this (especially if they have experience with the embassy in Romania).
It does seem that only good things were posted on the "embassy" area about the interview process.

Hi All,

This is my first time starting a topic, so please forgive me if I'm doing this wrong.

I am about ready to send off my documents to my fiance for his K-1 Visa interview at the London Embassy on 12/9! I'm including my last 3 years of tax transcripts that I requested from the IRS. Since I have these, do I need to include my W2s or copies of my actual tax returns?
Honestly, I'm having trouble finding my 2009 W2- it's gotta be floating around here somewhere, just can't find it at the moment! I can keep looking for it, but I'd rather not if it's not needed. (Obviously I will need to find it at some point...)

Sorry if this is a silly question. Thank you for your help!

Since the old site crashed there is issues with many links. A good trick is, when links from the old site fail to open, if you put your cursor over the link, right click and copy shortcut. You can then paste the link into a new browser window, add a 2 after the word 'forum' in the address bar and it will take you to the document you require. I have copied James Shortcuts from the old site. See below.

Reason's for denial vary from case to case and it seems what CO looks at your case. The reason we were deniedwas:
1) the lack of evidence I had before the Dam Hoi
2) I made only 1 trip
3)we had our Dam Hoi a few days into my first trip.
They requested a timeline and ask me to provide more evidence of communication
We were also introduced by her Aunt in the USA. To the consulate, it looked like an arranged engagement. I can't really blame them because I didn't do my homework before starting our relationship. I wasn't aware that I had to keep every bit of evidence down to the last detail. No matter how real the relationship is, if you don't have the evidence, it makes it difficult for a consular to grant a pink slip. Step back and look at your case from a CO's point of view.

Some reason's for blue slips have been:
request evidence that you paid for the plane tickects.
lack of pictures
not enough trips to Vietnam
No ceremony
request birth certificates of parents(Vietnamese family in USA)
request more evidence of communication
request a timeline
the spouse or fiancee answered a question wrong
request proof that the benefiaciary and petitioner can communicate with each other(no language barrier)

Congrats!! We had the same delay. They wrote on the upper corner of the pink slip "CLOK" hit. I guess the Dept of State had to clear the CLOK hit before the consulate could issue the visa. I am glad you got it taken care of!

I am sorry to hear your case was sent back. It is a very difficult time for you and your loved one but you must not give up. Our case was sent back in 2006 and my wife is here now. You have to continue building your case for when it comes time to appeal the consulates findings or submit a new petition. (I am not sure what Vermont does with returned petitions.) Thao is from Ben Tre about 45 miles south of HCMC. You had to take a fairy to get there but they just completed a new bridge so it is easier to get to.
