Caillen, I used the form the Bank gave us with the authorization from the bank teller on it. I believe u need 2 copies of all the DS-forms for the interview except the ds-156k u only need one copy, so he should use the DS-157 the bank gave him, and one DS 157 the embassy sent him.

Congrats!!! and Good Luck! Im happy for u all.

My Fiance got her visa on march 17th and so she is flying to Minneapolis on April 6th we had already done the CFO seminar and got her certificate prior to interview, so all she had to do was go back to have them stamp the visa/passport. Georgia is nice this time of year (rebelheart), but unfortunately for my fiance it is going to be freezing for her in minnesota this time of year.

Get an attorney only if you have a dark past. I paid an attorney and he has done nothing but slow the process. This site has great information, and I wish I would have found this site before I found an attorney.

US Embassy and Consulate DiscussionEarlier Interview
Hello all.
Now that I have hurdled the NOA2. I have a new problem to solve. I project Natalya's Interview to be at or around Thanksgiving. She will be 8 months pregers. Not the best time to fly. I anticipate the Consulate to recieve her packet at the end of this month. Can we ask for a Early October Interview date because of our pregers? What are the rules on this?

She has sent me all they documents already. So what about me do i need to take any proof of what i have in my bank??

Nope, but it never hurts to have to much. In our case all they even took from my fiance' at the interview was my W-2 and the I-134.
I guess they didnt want to look thru the mound of financial documents.

K-3 Spouse Visa Process & ProceduresQuestion about K3 I-130
I believe it says you need to file a seperate I-130 form for each eligibile relative. But I don't remember reading any exceptions to this. But I'm new to this myself. But I've been looking over the I-130 and I-129f a lot the last month.

QUOTE (Paul Ficca @ Sep 23 2007, 03:58 AM) <{POST_SNAPBACK}>
One more question...

along with My wife who i will be filing the I-130 for there is also our daughter (6 months) because she is my daughter do i need to file a separate I-130 or can i just include her on my wifes?

K-3 Spouse Visa Process & ProceduresName on visa vs. name on passport
What if I file for the petition with Paternal-Maternal-de-My last name will the government just conform it for her to my last name?

QUOTE (Erika @ Sep 25 2007, 12:46 PM) <{POST_SNAPBACK}>
My wife's passport says her full "Peruvian" name...."Erika-Rosa-Paternal-Maternal-de-My last name". My lawyer submitted the immigration paperwork as her "American" name...Erika-Rosa-My last name. Our interview is coming up. Does anyone know if I should have her change her passport? Or if the name differences will be a problem at all?

Thank you so much for all the responses. You have definately made me feel better because everyone else tells me no or I don't know. Though I hope pushbrk will stop beating dead horses. And thank you much Reba for answering my question.

Sorry I delayed to respond been a work-a-holic...

Yes most of my friends are K-1'ers and still don't believe I'm married. I asked my HR at work and they have no idea, they told me to talk to the IRS or an immigration lawyer. But yes I needed moral support that I was right. So muchos gracias! But I was only not clear how to make it known, registered in the US... So it's all good now thanks again.

K-3 Spouse Visa Process & ProceduresWhen is the marriage legal in the US
Thanks, yes I have it translated officially and have copies. But besides the petitions and visa for my wife. Do I need to do something else in the US to say hey I'm married I'm changing my status officially now? Because I would like to put her on my medical insurance because my medical insurance works in Peru as well currently I believe. Or should I just go for it and change all my license and tax info and everything now?

QUOTE (Neonred @ Sep 23 2007, 06:00 AM) <{POST_SNAPBACK}>
If you got married, even in Peru, then you are married everywhere. Do you have some documentation that shows you were married? Get it translated as you will need it later.

K-3 Spouse Visa Process & ProceduresWhen is the marriage legal in the US
Hello,

This is a nice helpful site, a very good idea indeed. Glad I found it. Well my question is with the K3 visa at what point is it legal here to change my status to married? I've heard it both ways that the US government recognizes my marriage in Peru and also the opposite that I need to wait for the Visa to be approved so my wife can come here. And then when she is here we can marry again and then it is legal. I was hoping you experienced people wouldn't mind educating me.

We got married in Peru August 6th and I am back in the US until December. Just waiting on a few things then I can send out the initial I-130 petition, so still a lifetime away from the documents finishing. crying.gif But I'm sure surviving this wait makes the relationship so much stronger in the long run.

Thank you so much for taking the time to help.

K-3 Spouse Visa Process & ProceduresQuick Photo Questions for I-130 I-129f
So when you get your passport foto in the Us it's of course 2" x 2". Well my wife sent me her fotos and they are more like 1 3/4 x 2 1/4". I assume this is fine for the I-130 & I-129f because every other detail in the instructions is good with the fotos. And I assume they cut the fotos to there profile folder size anyways. But does anyone know if I will have a problem? She says that she doesn't know if she can get 2" x 2"

Also wondering if anyone has found out if it is ok to send both the I-130 & I-129f together now? Or was that just for August?

Muchos Gracias

K-3 Spouse Visa Process & ProceduresG-325A advice
hmm yes I was wondering if I would need to initial. Well as far as the name on her passport it's "name name de name" is super long and won't fit in any boxes. But I know other people from peru used only there family name and not all 3 last names and had no problems. But The g-325 says it has to be filled out by her. And if I would need to initial after crossing out it would not be her initials so I'll just go with no initials. ok thanks listening to me think outloud and for your help!

I have just recieved my wifes copy of the G-325A and there is a problem with the Family Name on the bottom in the heavy black square. on the 4 forms for the I-129f the family names says "my last name" and for the I-130 it says "Her family names de My family name" But for all 8 pages the family name on the top left first box is just my family name. I'm assuming I should break the news that she needs to resend the documents but I'm in a hurry to send them now. I was wondering if there is a way I can go around this. I read this in another post since I have her signature in the documents I could make a new document cut out her signature and make all 4 copies with original copies of her signature. But I thought I read somewhere that 1 of the 4 copies has to be signed with ink and the others an be copies. I also read that the signature isn't needed as long as everything else in the I-130 is filed correctly. But now I'm thinking the copy option is the best. Tell me what you think. Thanks for your time,

Nick

If one copy has to be signed then she may as well sign them all.
I wouldn't play with it. Just have her download everything again and sign everything and shoot it to you.
I was RFEd for submitting a copy that I thought was my original one.
Printers are to good now. Can hardly tell the difference. USCIS did tho!

Or just correct the information that's wrong. Line out the wrong and put in the corrected. Her name should be her current legal name. If yours as added, then the the only correction is to line it out. No need to add anything.

I've always wondered how much editing you can do on forms and still be accepted.
May depend on which form.
How about "white out" and corrections, Should the correction be initialed?
I've NEVER seen anything official on correcting documents.
I'd think notarized forms shouldn't be corrected unless the Notary initialed the correction.
Don't really about any of it tho.
I know DS 157s can have corrections. At least we did with no problems. Looked like a mess but it "flew".

Is there a thread here on VJ that gives info how much correcting you can do and not get an RFE?
Bottomline is to have everything "to the tits". May take a bit longer but RFEs extend the process also.

Thank you I'll do this and just cross out her family name so it's just my family name. Also she wrote the date as 07/07/07 and then rewrote 11 over the first 07. :s I'll just cross that off too and rewrite the date because I'm not sure how picky they will be at INS.

U.S. Citizenship and Immigration Services (USCIS) is revising the locations for filing Form I-130 that are currently listed in the form’s instructions posted on this website. Until new instructions are posted, the following information applies:
Effective December 3, 2007, all petitioners filing stand-alone Form I-130 are encouraged to submit their petitions to the Chicago Lockbox instead of a USCIS Service Center. I-130 petitions filed with the Chicago Lockbox will be routed to, and adjudicated at, the appropriate USCIS Service Center. This routing will be based on the petitioner’s place of residence in the United States.

Petitioners who reside in AK, AZ, CA, CO, Guam, HI, ID, IL, IN, IA, KS, MI, MN, MS, MT, Nebraska, NV, ND, OH, OR, SD, UT, WA, WI, or WY are encouraged to file their stand-alone Form I-130s with the Lockbox using the following address:

QUOTE (sydkym @ Feb 25 2008, 08:59 AM) <{POST_SNAPBACK}>
So basically, I just need to look at it every day to see if the date changes--although it hasn´t in almost a month! Is that unusual? We´ve also been waiting for our I-129 1st NOA. We sent the papers Feb. 7, they arrived Feb. 11, and now it´s almost the end of the month. I thought it was an average of 10 days for that paper.

You should fill out your timeline. But if you sent on the 7th I wouldn't worry. I filed both documents together to the chicago lockbox and when they got to CSC they did the I-130 first and waited a little while before they sent me the NOA1 for the I-129f. So I don't think you should worry too much.

Thats all I can tell you but feel free to chat with me I'm in the same Peruvian boat. smile.gif

K-3 Spouse Visa Process & ProceduresPeru K-3 Interview Q's
I was wondering if anyone knows exactly what documents will be needed for the interview for a K-3 in Peru? I have the I-186 and the DS-230 all filled out and hoping that is all. I know the K-1 has a lot more and trying to look at the Embassy info page on the site here and so wondering if need to do the DS-156 or what more documents to fill out will be included in the 3&4 package. On the Embassy's page they have a special online link on where to make filing out the DS-156 easier: https://evisaforms.s...s156.asp?lang=1

Our application is at NVC and I'm about to go back to Peru this week so wanted to get everything done now if possible so it is ready for my wife.

K-3 Spouse Visa Process & Procedures2 questions
1. My address just changed and the the interview date has just been given for July 3rd. Who do i need to notify of the new address? i tried changing on USCIS website but it said: U.S. Citizens who do not have an application or petition pending with USCIS are only legally required to notify USCIS of a change of address if they have previously submitted a Form I-864 on behalf of someone who has become a permanent resident. If you have previously submitted a Form I-864 for someone who immigrated to the U.S., you must complete a Form I-865 within ten days of the completion of your move.

Do I need to contact the Embassy, I will write NVC but my other question is about NVC too

2. NVC wrote me a letter that the CR1 was approved and to send the $70. But the K3 visa is already at the embassy in peru with the interview date. What do I do with that? We will only persue the K3 visa because we already bought the plane tickets for July 11th.

I was sort of expecting the packet 3 & 4 to tell us everything we need for the interview. But there was very little information saying only you need to do these things:

*Medical Exam
*DS-230 for my spouse
*AOS I-134

But I know she needs to go to the policia and get some forms and go to a bank to get a receipt or bank check for $131

Really this seems to easy so what more is there that is needed to gather before the interview? have a large sum of proof neatly organized with copies of everything, photos receipts. But is there any other paperwork I shoudl fill out just in case for a K3? I will not be able to attend the interview with my wife which I know will make it a little more difficult. So I'm trying to get everything just a little extra organized and neat and tidy and shiny for her.

as far as i know if your wife is a K3 applicant she needed of the following :

1. DS-157 ( where u said u going to pay 131 dollars ) 2 set - original
2. DS-156 u can print 2 copies for this form after u fill up online ( 2 set - original )
3. Affidavit of Support ( AOS ) I-134 - - notorized
4. ITR and W2 latest ( 2005,2006,2007 )
5. Birth Certificate , Marriage Contract , Divorce Decree w/ resolutions
6. Cert from employer
7. Statement from Bank
8. and other supporting papers

hope that will help..... goodluck to your wifey good.gif

K-3 Spouse Visa Process & Proceduressilly question
I'm sure the answer is no, but I need to ask anyways. So my wife is getting her police records and she asks me if it needs to be translated into english. Well it would save time if a lawyer could pick up the papers in Lima.

My wife spent the day running through hoops in Lima half the people lying just so they can get some extra money. Is it like that in most countries when you are doing the last couple weeks of running around to do the papers before the interview?

K-3 Spouse Visa Process & ProceduresNew Address Question
I asked the question before of what to do if I changed my address a few weeks before the visa interview and the advice was to tell the people at the interview. Well my wife had a rather quick interview which was great but she forgot to tell them about the new address. Though all the interview papers had the new address. Only the I-130 and I-129f have the old address. So my question is should we be concerned? My sister lives at the old address they have so anything they send she will get. About to apply for AOS with USCIS so they will have the new address...

Hello December filers! Long time lurker here! My check for our I-130 has cleared yesterday, 2/1/08. I'm still waiting for the check image to show online though but at least were past the first hurdle! The Chicago Lockbox received our application on 12/16/08 and was only stamped with USCIS CHICAGO LOCKBOX on the signature portion, no specific person signed for it. I'm sure your checks will also be cashed soon! biggrin.gif

Thank you guys for all of the great wishes smile.gif ...

I've called USCIS but they keep saying "give it more time and call us back in a couple days" ... This has been the response twice ... But they don't have any further answer because they don't see it in the system sad.gif

I figured that if they didn't want my 129F there, they could've sent it back to me and entered the 130 ... I mean give me break ...

I sent both my I-129f and I-130 together to the chicago lockbox and bot both my NOA1's. It's a painful wait I hope CSC gets faster soon.

US Embassy and Consulate DiscussionMedical Insurance, Philippines?
Thanks for the responses and best wishes! I'm not sure if I'm being nice or just looking out for my own self interest, but these aren't mutually exclusive.

Even though medical costs are much lower than in the US, a catastrophic event would still be quite a drain I imagine. I'll do some more investigation. I guess I'm a little surprised I'm the only one concerned about this, but maybe I think too much and need to relax more.

US Embassy and Consulate DiscussionMedical Insurance, Philippines?
I could be thinking too much while we're waiting (dum de dum)...

I am curious if anyone here has thought about health insurance for their fiancee and family in the Philippines. One of my concerns is that if anyone in her family becomes seriously ill (or if she does while we wait) it will likely be up to me to decide to help pay for the medical expenses since her family would not have the money.

Since I don't want to be in the position of making this decision (and I'm not sure I could afford it), I am thinking of buying insurance for her and her family. I think they have a minimal insurance policy (Philhealth) which doesn't seem to cover much from what I can tell. Does anyone have any experience with any other sorts of policies? Has anyone else thought about this? (I couldn't find a thread) Any ideas? or do I worry too much?

Thanks,

-- Jeff

US Embassy and Consulate DiscussionEarly medical originals required?
Congratulations and Good luck on interviews, also!

I'm trying to get things together to send to Mae for an early medical. She has not received the Packet 4. I'm confused if the originals are required of the NOA2 and the NVC letter. She would like to go along with another person from VJ (another Mae, David-Mae Forever) on the 16th, but I'm not sure I have enough time to send the originals, however I can scan and email them. Also is there enough time to have St. Lukes receive the Packet 4 from the embassy?

Thanks!

US Embassy and Consulate DiscussionSO Birth Certificate (Indonesia)
Hello, Selamat Melam to you both. Congratulations on your success thus far, our prayers are with you. My fiancee, Indra and I are patiently awaiting our NOA2; I received the NOA1 Feb. 5th so it's nice to see another Indonesian K-1 applicant's timeline for real. Did you have to have his birth certificate translated and legalized(notarized)?

We have discussed our next steps once we get our NOA2, but it's still unclear to me if she needs her birth certificate translated for the K-1 interview, and if she will need this for the AOS in Minnesota.....

God bless you both, terimakasih for any help that you may offer us.
