David...the I-129-f totally moves faster to approval than the I-130 (unless you go through Vermont Service Center, which seems to be pretty quick). Which one you go with depends on how you'd like to enter the country. One you have to adjust status once you enter (I-129) and the other you "adjust" through the NVC and already have an immigrant visa once you enter (I-130). Of course, if you go with the I-129, you'll be in the country much faster.

Jbeabout: Have you gone to the interview yet? I was just looking at your timeline and wondered if you had gone yet.

Thanks for all your replies. I have decided to submit an IMBRA waiver and hopefully start a new I129-F. I am in the process of finding a good lawyer who has experience with HCMC Consulate to help me through the process because Thao and I don't want to make the same mistakes over again.

Dave,
Was her visa denied or was she given the paper for section 221(g) stating that she could be approved pending she show more proof? She had her interview then, right?
I'm sorry and I hope you're able to make this right!

After her first interview Oct 6 2006 the consulate requested more proof of a relationship. My fiancee submitted to consulate a timeline on how we met,when I proposed, when and where the engagement ceromony took place and emails and phone records. All that on top of the evidence in my packet 3.They ignored all that evidence and sent the paperwork back to USCIS with the recommondation it be revoked. I am wondering how I can pull this petition and start over or do I wait and see what USCIS says?

October 2006 my fincee's visa was denied and sent back to the states to USCIS California. (arrived 2-06-07) The consular denied her because there were only 2 letters and 1 trip to Vietnam and said our relationship was a sham. After the denial, I have made another trip to Vietnam. The consular ignored all the emails,phone records and other evidence of communication I had in my document package. I don't know what to do next or what to expect.

I had my case sent back as well. I received an email from CSC stating they won't adjudicate it because it has expired and I may file a new one. I had no other option but to file a new petition. Now I read this article and it appears some consulates won't look at the new petition until CSC reviews the denied one. #######!

Hi guys,

I am just curious, can my husband go get his medical taken care of now? I received an email stating our case has been completed. Along with the email was a link for the Immigrant Visa Check list, so I clicked on the link. As I was reading the check list It states that the following:

A medical exam is valid for one year from date of completion if there are no health-related ineligibilities identified. A valid medical exam is required to enter the US on an immigrant visa.
Date of Medical Exam: ______ Expiration Date (one year later): _______

Then as I got done reading this link/Check list I noticed it is dated 12/8/2010, therefore it is not really current? I am asking since we are not sure where his vaccinations are at?? I assume that he will be ok. He has been to the US in the past so I am sure his shots will be a few maybe?

Anyone know if he can just go and get it handled now. The lady at the NVC call center said "I can not guarantee this" but I assume he will be scheduled for a DEC appointment>

Please advise....

It also shows that the fee for the visa is $355, not the $240. Why can't they send us updated information/links???

OK, so I just called the NVC to check the status of my case. The guy told me that the case is completed (already knew that). Then he placed me on hold for like 5 minutes. He came back to tell me that, once I have received the email from them with the appointment information, that is when my husband can schedule his medical appointment.

I said wait a minute, will my husband receive his packet in the mail with all his stuff for his medical appointment and his slip for the interview??? He said "NO,NO,NO miss, he will not receive anything in the mail. All he will received is an email, that he will print off with his information. WTH is going on???? I am really confused?? :help: :help: :help:

Well maybe each country is different?? However, I had to pay the DS-230 and the AOS (Affidavit of Support fee)on this end,then my husband needs to bring $240.00 to his interview plus his DHL fee.

I would double check if you need a fee at the embassy in Nigeria.

No. They do not schedule visa appointments. They are independent of the NVC


Independent or not, I got through in less than a 5 minute wait. Rep asked me the same questions, case number, Ben nname and DOB, petitinor name and DOB. I called visa ctr before and after and she read same script. We have no update and we dont schdule until the second week of each month. Mi nah know but mi sure happy :)

I appreciate all of your responses! I was feeling like such a weirdo! My husband's name is Guven and we have not seen each other since we were married in January. It didn't bother me until now. I guess because we are so close but the uncertainty is killing me. I have been trying to watch movies and kill time. However, I have a 2 week paid holiday when the college I work for closes down for Xmas and I was sooooooooo thinking his interview would be before then but... dang it :(I don't think so.... I have a question. How did you all do this?? I am married and I feel single. I don't cheat or anything like that but I envy everyone that is with their spouse and I feel insane for waiting it out. Almost a year without him and I am still alone :( I am just so confused at this point. I want him here, I love him, and talk to him weekly with daily phone calls and emails but I don't feel married


Sounds like im reading what I have felt. The next 4-6 Weeks feels longer than the past 9 months. I always tease my huzband and friends and say I feel like the lonely married single lady. we were blessed to have Skype, but about 6 months ago the service providers merge and the service sucks real bad. I was calling the NVC several times a day as well. I called the DOS on Nov, only to receive the nrws we receibed out interview date. I feel more nervous that we r at this point. Its all a long stressful process. Right now there is a person that holds our future in their hands. A person who doesn't know me, him or us. Right now that is the most stressful part of this who process.

Maybe you could try calling the DOS number? They seem to have a little bit more info than NVC,they are much much nicer and the hold time is way shorter. Just a thought. I called NVC 3 times in one day gor same answer, then someone suggested I try DOS so I did and I got an answer. Called NVC back and still they had nada..

OMG, best advice of the day call DOS for interview date. Guess what? I did call them and I got it, my date is set for Dec 3 @ 7:30 am in Kingston.....

I was not on hold long 3 min & 26 sec and the lady was very, very nice.... Funny called the NVC over lunch and they had nada, hummmmmmm...

Ok, Right now I am freaking out!!! I received my email to go on line and pay my $88.00 AOS fee. So I when to login and it says the following message:

 

This case is in the process of termination. Fee payments and online forms can no longer be accepted. If you believe you have received this message in error, or to resume processing of the case, please contact the NVC immediately.

 

So I called the NVC right awats and the rep wasn't very reassuring. She told me not to worry and that it is because they are in the process of making the bill avaliable. I do not buy into this. Has anyone ever received this type of message???

 

Please let me know so I can rest a little.

Thank-you. I know I should be happy I am this far and I am. As you know road blocks suck,.from your story I know you feel the same pain just in a different phase of the process. The system is so backwards. They have all the original proof they need. What difference do the full details really make. Its a done deal. The divorce and a new marriage very real and legit.

Jamaica requires an original copy of a divorce CERTIFICATE,.not a divorce decree. Guess they gey to make the rules as they go along. Smh another sleepless night..

what i had planned to do before i was put on AR .....I bought my ticket with open return(no extra cost) then i would have just called my agent and said give me a return date and 1 way ticket for my fiance same itinerary, now the downside to this is sometimes it can take 2 weeks to get a open date for return if season is busy. as in my case i had already extended my visa twice and was gonna expire again and we were put on AR, so i abandoned that plan and returned alone march 6th ...so of course she recieved her Visa 11 days later.

After being a short time in AR we recieved the text from DelBros saying they had the Visa and would be delivering it. It was only 2 days after the text before it was at the "door". We live in Angeles city, pampanga. Like the others said it is possible to send the visa to any address in phils, and even name 1 other person to recieved in your absence.

KTMguy, yes they embassy would have asked for further documents at the interview if required. U should ask your fiance' if she recieved a white paper with her pink paper to pay the Delbros Fee, the white paper would have a check mark in the "wait until u hear from us" box, or more boxes will be checked if u are on AR. I also payed the delivery fee and we werent asked for additional docs. but we did recieve that white paper and were on AR for only 3 weeks thank goodness, but yes i would call the embassy and inquire....my opinion is your on AR but its just a simple review shouldnt take much longer.

I have heard something about a semminar that is required for Filipinas prior to them being given their K-3 visa, is this true, please explain.

It is a seminar required but not for them to get their k visa, but after u get the visa it is a stamp added to the passport, allowing the filipino to go abroad, without it there can be problems leaving or so i have heard.
the Seminar is CFO seminar, and must be attended in manila and cebu i believe.

My fiance went to her CFO without any of that kind of info only birthcert, baptismal, passport.... no personal relationship type paperwork and she recieved her CFO certificate no problem. They did ask her alot of questions she said it was harder than the actual interview at the embassy.

Caillen, I used the form the Bank gave us with the authorization from the bank teller on it. I believe u need 2 copies of all the DS-forms for the interview except the ds-156k u only need one copy, so he should use the DS-157 the bank gave him, and one DS 157 the embassy sent him.
