Kyd, she will not be asked to show a copy of petition or documents, but it is a good idea to send a copy incase more documents are required (or lost ) by the embassy at some point in the process then she will already have them there in philippines, saving time of u sending them to her then her sending them to Manila. But u will be sending her the Originals of some documents at some point unless u yourself are attending the interview with her in Manila. Atleast make the copy of the petition and certain documents then keep for yourself and if u need send something they request or lose u have it.

hello Rick2000, I also had a problem like yours, with my filipina fiance's birth cert having an error i was also told it can take alot of time and expense to change this. It is true! u will need a lawyer and a court/ goverment appearance is necessary. But be careful about choosing a lawyer in the philippines for this, i suggest having your fiance get this fixed on her own and without telling the lawyer why the birth cert is needed or that she has a foreigner fiancee. If not u could be showing them $ signs. But before doing this i would call the embassy in Manila and ask what they think about your situation, telling them your passport, i.d., and such is all correct, just the birth cert is wrong. They might have an easier solution to your problem.

yes the brown envelope covered in plastic recieved from the medical is not to be opened ( x rays) then after your interview when your visa is delievered u will be given another large brown envelope this is also not to be opened ( for customs agents at POE ).

Yes u will be informed of your medical and interview date from your packet the embassy sends ( usually about 6 weeks before interview date). u can also check the embassy website in manila, or u can call either the USA or manila embassy about the date , but they wont know until about 8 weeks before interview or about 4 months after Manila has recieved from NVC.

One thing specific about the Philippines process is the long wait from the time the Embassy in Manila recieves your petition until u are assigned a interview date between 4 - 6 months. Philippines medical exams must be done at St. Luke medical center and its in Manila, so if your from the province travel can be an issue, since the medical exam is before the interview usually by 1 week, so its stay in manila hotel for a week or pay airfare or travel expenses to and from twice.

As far as their child is concerned your brother is allowed to petition for all of her children under 18 or maybe 21 even if not by him ( your brother ) it is as simple as an extra form with the childs info, but also they will need passport, birth cert., etc for the child also.

:unsure: A question for whom ever can help me with this minor problem. My 130 was just approved and I am doing my research about the next steps while I wait for a NVC case #. When I applied for my wife, I used my present address where I was doing my internship. However, I will be moving to a new address to start my residency in just a few weeks. So the problem is that when I fill out the 864, I will have to use the new address because that is where my new employer will be. While I was looking at the 864 today, I noticed something about having to report any change of address for the sponsor.

Now my question is that do I have to report the new address (my new house) or can I still leave the old address(my parents address) and attach an explanation? Also, If I do report the address change, then what will that do to my case at the NVC since the address change form is sent to VSC?

The insctruction pages on I-130 clearly state that only a money order on personal check is accepted. Also, each service center has their guidlines,on USCIS webiste, as what kind of payments they accept. Sending personal check is recommended cuz that way you can see reciept number on back of it when the check is cashed. Good luck.


I forgot about that... I used the personal check cashing as a sign, showing things were progressing.

I'm not an expert but, I sent a personal check. You could do the same. Send a new personal check tomorrow and bring the recipt for the Certified Check to Bank of America and get the Certified Check cancelled. You might have to pay a fee but you will get most of the money back. If the Certified Check has been cashed. Then... make a new post... because I dont know what do do for that.

After filing and expecting the NOA2 by the end of June, I was delighted to get another I-797C in the mail this morning....until I opened it. They have transfered my case to California, even though I live in Wisconsin and the official USCIS site STILL says I should send the I-129F to Nebraska....which is what I did. :angry:

This link shows there have been changes to where applications are supposed to be mailed

USCIS.GOV FORMS AND FEES

And it states

"NOTE: Effective 4/01/06, the filing addresses for Forms I-129, I-140, I-485, I-539, I-765, and I-907 will change. Address information will be available from each document’s Forms Entry Page, linked below. "

But when I follow the link to the I-129F form USCIS.GOV I-129F FORM....it states clearly on the form that if you live in Wisconsin it gets mailed to Nebraska!!!!!

So they've had the case since early April and they couldn't have sent this through a little faster??? I know they have a lot of cases and files to review but really!!! That's 2 months wasted time for the file to be sitting on someone's desk only to be transferred to another office.

I just had to complain somewhere, because I know it won't help to contact them and complain. It may only get the file sent back to Nebraska to start all over again.....AGAIN!!!



It is a common mistake to read this link and information fast. Remember that there is a difference between the I-129 & I-129F in regards to what the forms are used to petition for.

You did mail yours correctly to the correct address.


I recieved one too. Notice Date of June 1st. IMBRA is an additional step In the process, I guess. I need to get Natasha to the US as soon as possible. We are expecting. So I called the 1-800 and asked someones opinion of when they think Natasha will be in the US. USCIS is thinking August.

I totally agree. What is interesting is the website is still saying the last action was on June 1st. When the paper work says June 6th. I feel pain thinking I am asking these people to help me be forever happy with my wife to be.

Anyone wonder where their cable bill is or a Credit Card bill is. You wonder when it is coming in the mail. You want to make sure you pay it so you don't have any late fees or finance charges. So you wait a week... Still no bill. You call and ask where it is... and the operator says "its coming." So you wait a little longer. As the sweat builds on your forehead, you go and do something ridiculous to find the bill. You might dig through the trash or ask neighbors if they have seen your bill. And then the next day its in your mailbox.

This immigration process seems similar. You wait and wonder. You call and get a robot. You flip out and do something rash. Congress and Senators are trash and you have to dig through them.

I hope this post is my ridiculous attempt at finding my NOA2 and my mailbox has good news tomorrow. Keep smiling everyone.

Hi Everyone,

I have officially lost all hope. I really, really, really, REEEAAALLLY, thought that I would be getting my NOA2 sometime this week. Tomorrow is Friday and I haven't received a thing. I've contacted both senators (filled out the authorization form when sending letter the first time) and haven't heard anything from them. I contacted my rep. in congress and haven't heard from her either. I've contacted UCSIC to get the same "call back in 30 days" bull.

I've seen people with NOA1s of April and May, but yet I who have an NOA1 of March 10 get nothing. I know, I know, I should get this depressed, but every night when I speak with my fianceé it just seems like she is farther and farther away. Our relationship has grown as have we and yet it seems we are prisoners to this process and our relationship cannot progress.

I am seriously on the verge of just simply giving up. Lord knows what I will do if I am denied. Most likely I will just give up. At one point or another we must admit that we are doing ourselves more harm than good by staying in this sort of relationship. Obviously every bone in my body tells me that breaking up is just simply not an option, but I don't know how long that can last. 2 years, 3 years, 4???

Maybe I will cheer up once the processing times change, but even then it will only mean that I have to wait until the processing date reaches 30 days after I got my NOA1. :crying: :(



Your frustration is noted. I'm stamped with receipt date of March 21st and I am waiting for NOA2. I watch these Vermont people getting fast approvals and others in California with all the luck. I am extremely happy for them, but very jealous.

Try to imagine getting a text message at 2:30am saying, ”I'm going to the hospital,” from your four month pregnant finance who is trapped in a country and cannot leave because USCIS is undergoing reconstruction.

Would you ignore the text message and give up? Remember, she is depending on you.

I have a fiance. We are expecting a child and this whole process is killing me.

It is likely that my child will not be born in America.

For July and August I have been trying to get the attention of my sentators and congressmen. They made inquiries and Requests for Expedition, but they were getting snowballed as well.

Yesterday, I would not stop calling them untill they found my file. The inital customer service rep was very professional, the second could not operate a computer, and the third was again very helpful. It had been misplaced (in transit) for several months. I recieved all my recipts for NOA1 and the MBRA RFE, but still they lost it. Now my divorce decree is missing. I think someone took it. This is my current nightmare.

Do you have any suggestions?

Dude, you are getting a 2nd RFE, this can actually expedite your case. Take it from me (look into my timeline), you get the RFE, turn it around quickly and Whammo, approval.

When you send the RFE evidence back, send it USPS express. On the front and back of the USPS provided document Envelope, write the following: ATTN:RFE in red marker. This is the information on the RFE envelope supplied by CSC. It will then move through CSC like a madman!!!

2 days after CSC acknowledged my RFE, approved. Try it. Plan for success!!!

I am watching my fiance's visa like a hawk. I am having nothing but trouble getting her here. Any words of advice or encouragement would be helpful.

I contacted a Visa Attorney in January. Papers sent February. Never received an NOA1 because he never sent it. Received a RFE in July. Now I am being sent another RFE (August 14th) and I am waiting to see what the attorney forgot.

I have contacted all my senators and congressmen and they have sent it an Expedite for processing. The congressmen have not received a reply. He and his staff had no idea how bad USCIS had become, and too are powerless. I have been to my local office, and I am considering going to CSC and personally flying the information to VSC. This is getting beyond ridiculous when others are getting approved in 50 days. If I would have reapplied in May she would be here now.

By the way... she is due in January. And she is ordered to bed rest.

What can I do?

Perhaps I did not make myself clear. My fiance's son does not want to immigrate here with his mother. I do not want to involve him in the immigration process if I don't have to. My question is if I have to include him on the I-129f because he is still 20yo at the time of application, but does not want to immigrate, does he still have to attend the interview. I understand it as he does not. I will be in that same situation by hopefully early summer of next year. From my understanding he DOES have to be listed on the I-129F form. He is her son after all, But you do not have to list him on the I-134 and he doesn't need any physicals or anything. Listed on the I-129F at the beginning and that is all. I'm thinking everyone else has skimmed over your post and missed the point.

In the Uk, is it not true that you only need the fathers permission, if you were married?
As far as Im aware, if you were NOT married, the father does not automatically have parental responsibility and therefore has no say.
This is what I was advised by my lawyer.

I'm in a similar situation myself. My fiancee has a 14 year old daughter who will be named in the K-1 Visa app as my step-child to be, and she will be coming with my fiancee to live here. Her father and my fiancee were never married, my fiancee has primary custody, receives no restitution from the childs father, and furthermore he has not attempted to even make contact with his daughter in 5+ years now. :(

Is what chloe said above true? Just attempting to figure out what we will need, as I am sure that, despite absolutely no effort to contact his own daughter, it may become a bit tedious to find him and get his permission.

Any help would be appreciated!!


Im in the exact situation with my fiancee from England who has a 15 year old daughter. She met with some sort of government offical who told her the same thing. If you were never married to the father of your child he has no legal rights and the child can leave the country. That law was changed within the last five years, but only effects kids born after that date. Which is good news. Since he hasnt been seen for the last 6 years. Last she knew he had traveled to Australia.

That is an excellent question. All he needs is a notary seal.
Dont pay any attention to the rude people that troll these forums 24/7. If THEY would read the I-134 themselves more carefully they would see it written a little confusing.

I never had a touch after the first few days after my NOA1. Found out by Email! Good luck with that touch. PS Change your plans now while you have plenty of time. Dont rely on the USCIS. Thats just plain silly. Thats like trusting the government with your social security payments. They'll get you the money one day. If they can find it.

I'm struggling from this question too. It is such a huge additional expense and supposedly is not technically necessary, but it sounds like it could make a difference. I haven't really heard much from people who haven't gone, just people who have gone. Please let me know what you decide, or if you find any good info.

One more thing: An RFE is not the end of the world or anything and shouldn't delay things too much. Put it this way, if getting the original signature will delay sending your application for a week or more, you're not risking much by scanning it. If you do get an RFE just have your fiance send the document directly to the service center from abroad.

Because of the cost of both money and time, I decided to risk it and send scanned signatures from my fiancee Andrea. Considering all the warnings I told her to do a high quality print and scan. What she sent me was a small, faint signature, so I had her re-do it and sign bigger with a thick pen/thin marker. She sent me back a much better signature, we sent them in, and it was approved. It may not work everytime, but may be worth the risk if your fiance has access to a good printer and scanner. Remember to then do a high quality print yourself.

I used a visa agency in Californina to review my I-129F and supporting documents and instructed them to send it after making sure all was in order. Today I received the NOA1 and it came from the California service center instead of Nebraska (I live in Minnesota).

I'm more than a little upset - anyone know what sort of delays (if any) will this cause? Also, California is running 20-30 days behind Nebraska which could make it worse. I sent an email to the agency asking for an explanation, but no reply yet (not likely until after Christmas).
