I wasn't being hostile I was pointing out a commonly held misconception about a document often called a licence when it isn't.

It isn't a driving licence it is a document which translates the official driving licence held by the person.

Present it to a police officer on its own and they will not accept it as it isn't a legal document issued by a licensing authority, they will ask you for your national driving licence. In the UK you buy a "International Driving Permit" from the AA. The 1st page has the details from your official licence numbered 1 - to whatever. The subsequent pages, each in different language, also having the same numbers alongside which is an explanation of what that information is.

So if I'm in say Mexico I give my official driving licence to a police officer and the permit and he can understand my UK licence and know if I'm permited to drive or not. It is often a requirement where your licence is printed in a different language then that used in the country you wish to drive in, that your official driving licence is only valid if you also carry an international permit.

The OP is from the UK and a UK licence is accepted in the US as is without the permit.

Your suggestion that the OP could meet his requirements with an international drivers licence was incorrect and I said so and explained why. If you choose to see that as being hostile so be it.

There is no such thing as an international drivers licence. I used to be a police officer for years and this myth has been perpetuated for just as long.

What these documents are the AA in the UK call it an International Drivers Permit is a translation of your drivers licence into another language. The permit contains a number of the more common languages and it helps an officer understand your proper licence. These permits are only valid if your proper licence is produced at the same time.

For UK nationals coming to live in the US they are worthless documents as the UK licence is printed in English and can be read over here. For someone coming from country whose driving licences are not printed in English then the international permit is worthwhile.

There is a box to check on the visa application form which asks for a SSN to be allocated once you enter the US. It takes about 2 - 3 weeks after you enter to receive the SS Card. The system isn't foolproof and sometimes the SSN doesn't get allocated. If you haven't received it after the 3 weeks go into a SS office to check.

Leave others you might something about Ohio DMV yo answer that part.

Your wife completes the I-130 and sends it to the US Embassy in London as you qualify to file there.

When that is approved you will file for a IR-1 visa which will mean you get your 10 year unconditional green card about 2 - 3 weeks after you enter the US on your visa.

As to your house have it valued by an estate agent and get it in writing. Get a mortgage statement from your building society and these two documents prove the equity in your house. You will not need these documents until you apply for your visa.

We were in a similar position last year. Sent the I-130 off in June that was approved September. Sent in the visa application and had that by November.

Providing there equity in your house is above the amount required no problems at all.

As I say we did it last year so only too pleased to answer and questions you might have.

The I-130 phase takes around 10 - 13 weeks. All depends on the time of year, might be quicker and shouldn't be much longer. When the I-130 is approved they send the visa application and instructions and you can expect that to take 2 - 3 months. It is a straight forward process unfortunately the waiting takes the toll as you normally don't know exactly how long the wait between each stage will be.

My timeline is tacked on the end of my posting and it is pretty typical so you will get an idea from that.

You say he is contracted to his current boss for 2 years. Does that mean he has to live in the UK during that time.

He can come over activate his visa and return to tie up the sale of the house etc, but if he wants to be in the UK for 2 years I believe he would have to apply for permission to be out that long. Sorry can't remember what it is called, advance parole or reentry permit.

Once you have a GC you really cannot stay outside the US for more than 12 months. Some say even 6 months could cause problems. The problem is if he comes back to the US and the CBP officer deems he has given up his permanent resident status he could be refused entry.

The fact you are married and yourself living in the US doesn't stop him using the VWP to come for visits, providing they are not long than 90 days and not too frequent. If he needs to be in the UK for 2 years that is an option and apply for his visa say 9 months or so before he is ready to move.

If you enter on the visa waiver program with the intent to get married and stay, that is illegal and misuse of the VWP.

If you are thinking of that it is daft to make it public. Have people done that of course they have. Have all been successful - no but just how many come unstuck no-one really knows.

If you enter the USA on the VWP and spontaneously decided to marry that is legal. Or entry to marry with the intention of returning home, which I did as my then wife was coming to the UK to live. But seek a one time consultation with an immigration lawyer in the US to have all your options properly explained.

Portland stamp the immigrant visa with a rubber stamp with the date and then either hand write CR1 or IR1 inside the stamp. I came in through Portland and just double checked my passport. Guess what they do is the same as every other POE

It will not be across the visa but just slightly overlapping one side of it.

It is not uncommon for people to refer to the whole visa process as the I-130. Not correct of course. But if you do DCF in London the I-130 is the first form filed out and sent to the Embassy and the rest follows on from there.

I assumed that the OP was referring to the whole process by the I-130 reference as they did say they now were in the US and has a GC.

If you lied on the I-130 and obtained a visa through that application, they will revoke the visa and subsequent GC and remove you from the USA.

If you get as far as getting citizenship before it is found out than that citizenship can be revoked.

The beneficiary has FBI checks.

You don't think the FBI just keep records which are just crime related do you. However the beneficiary is also checked to see if they have a criminal record in the US. People commit crimes when a visitor and just because someone says they have never been to the US doesn't mean they are telling the truth now does it.

Really? Thanks. Im just assuming (based on timelines posted by several applicants) that you will receive the NOA1 first before they cash your check (which happens a few days after the NOA1 was sent out).


My experience is that the check being cashed is the indication they have reached your file. Probably prepared the NOA the day they cashed the check, or day before.

I've always seen my checks cashed about a week before the NOA hit the mailbox.

You can enter on your visa and leave again to tie up loose ends in your home country. You wouldn't be the first to do that.

You would need your GC to get back in again but you can either wait for that to arrive (about 4 weeks) before you leave or have you husband send it to you by courier. Make sure you will be back in the USA within 6 months to avoid problems.

You could also travel on the VWP and ask the CBP officer to allow you to enter under that scheme and leave your visa unused but they may not agree to do that.

Provided you came in October and would be back again in Janaury 2010 using the visa is the best option. If gives you an earlier resident from date and hence earlier qualification for citizenship if you so choose.

Not sure from your post how your wife had an I-94 expiring May 1 2008 if she entered on March 3 2007. However the time for any ban would I guess start counting from when the I-94 expired. 180 days for a 3 year ban and 1 year for a 10 year ban.

However the words of the immigration judge would seem to show I'm wrong and while I know officials make mistakes I would always assume an immigration judge knows what they are talking about. Afraid it looks like you will have to wait for a definitive answer when your wife is interviewed.

I am confused.

The Lawyer said to file a CR-1, not an AOS... isn't the CR-1 the visa you have to file when you are not resident of the country? Which means he would need to go to his country to do the visa interview, which means that they are no intent to immigrate during the actual trip since he has to go back to do the interview anyway? Going to the US and get married is not against rules.

I know this was one of the possibility for a temp non-immigrant work visa as well. If you apply to a CR-1, you prove non-immigrant intent even if you have immigration proccessus underway since you HAVE to exit the USA to do the interview for the Visa. As long as they are no overstay in the interim which would cause a ban.

Correct me if I'm wrong B)

"I am going to the U.S. for work" is the only thing he needs to say, as that is the one concrete fact. "To see my girlfriend who lives here" would not even be necessary info.


It doesn't matter what he says you have posted in a public forum that he intends to come on the VWP, you will get married and then he will stay to adjust status. You have told us you have that intent. That is illegal under US immigration law.

Did the lawyer tell you that when he enters on the VWP he signs away his rights to appeal any decision made by a CBP or USCIS. If you do what you suggest and USCIS decided he came in with intent to adjust he gets deported and gets a ban on entering the US for a minimum of 3 years. Do people do it yes, do some come well unstuck yes they do, do you feel lucky. By the way when you apply to adjust status you have to prove he entered without the intent the marry and stay to adjust status, they do not have to prove he did.

Thank you all. We have the "ACRO Police Certificate for Immigration Purposes" with a cover letter explaining what the police certificate covers- I imagine the cover letter is standard.
On the police cert it has the Date, Offence, Court and Disposal. Disposal has the fines, costs, and the driving course completion.

Is there ANYTHING else the UK VJers can think of that I need to get to respond to the RFE? Do you think this was sent in error?

You don't get a ticket in the UK for drink drive, you get arrested and taken to court and it counts as a recordable offence and goes on your criminal record.

They are asking for the record from the Court your husband attended, showing the precise nature of the charge dealt with by the court, what the sentance was and if a fine was imposed that it has been paid.

You are clearly wrong. One of the conditions attached to the VWP is that you give up your right to appeal any decision made at the POE by the CBP officer. You do not get that right back if you file for AOS and are refused. Your VWP entry is revoked and you are returned from whence you came without the right of appeal. Another point to note is that a decision made in a Circuit Appeals Court is not binding on the Courts in other Circuits.

i am wondering if it is possible to make an appointment now, or in the next few weeks for the medical at knightsbridge doctors, i havnt heard anything from USCIS about our case as yet, but my husband and i are visiting london in january 2011 and i was thinking maybe get this out of the way before my interview then when i go for my interview it is one less thing to worry about (i remember the first medical and it was awful!)

do i need to have notification about my interview before i can make an appointment?

They have now changed the system in London. You have to have had your medical and the Embassy received the results from the doctors before they will schedule the interview.

If you are not a citizen you cannot be on a jury. Lots of people get called when not citizens as their names come up on the databases used. The DMV is one commonly used by lots of States. I was called twice when a LPR. Just get hubby to inform then you are not a US citizen.

As you say this was customs, don't you think this had nothing to do with your immigration application but more to do with arriving back from China and maybe them checking you were not carrying counterfeit items, large sums of money or other matters of interest to customs.
