I just looked it up on the i-864 instructions and the formula would be: needed assets = (required yearly income - actual yearly income) * 3. It says its multiplied by 3 if its your spouse.


Yep it is 3 if it is your spouse, that is what I said, but he said for the I-134 and that I thought was for a finance so not a spouse so would be 5 would it not?.

It is the use of the I-134 I'm not sure of having done DCF via London.

We used only assets when we came over.

To calculate the value of assets required it is the poverty level figure for your size family multiplied by 3. So if you have income which falls short of the poverty level it is the short fall multiplied by 3.

One proviso. The 3 multiplier I know is for those already married. I have a niggling doubt that for those coming over on a finance's visa it is 5 times. You need to check that to be sure.

Things really slow down in August as a lot of the Embassy staff come home for a vacation. It takes a while for them to catch up when they get back to work. When I was in England my work had me in almost daily contact with the Embassy and August was a nightmare to get things done.

Hi, I have a question that i'm hoping someone has the answer to....

I went for my K1 interview yesterday at the London Embassy (I was approved :D). When i was half way home i realised i had not been given back my original divorce decree... Will this be included in the envelope containing the visa or have they made a mistake not giving it back to me at my interview?

Your problem is going to be it will almost certainly be inside the MBE which you must not open. Original documents are normally returned, did you get the originals of other documents back?

Well worth a call to the help line to get the e-mail code for this week to e-mail the Embassy. Once you get your passport back with the visa in it and the MBE with all your case file documents in, the only way it could be retrieved would be to take the MBE back to the Embassy for them to open and reseal. You might luck out and it comes back with your passport and not in the MBE but I don't think I'd take that gamble.

You will receive back the originals of any personal documents you submitted as part of the process.

Copies of those documents plus all the official forms etc that you completed as part of the process will come back to you in a sealed envelope when the visa is delivered. That envelope must not be opened and is carried by you and given to the CBP officer when you enter the country. They keep that envelope and send the contents to the USCIS. You are not given any copies of what is in the envelope.

It you become a US citizen the biggest advantage is you can come and go as you please without having to worry about how long you can stay out of the US before you could lose LPR status. I think that out weighs the minor disadvantage of having to fill out a tax return if you are living outside the US.

I don't think it matters really if you have a conditional or unconditional green card. If you are out of the US for more than a year, and some say as little as 6 months, it could held you have given up your residence.

A few years out of the US would be very problematic.

Not everywhere has such an "affidavit". In Pennsylvania, you get asked if you want to register to vote on the screen as you're sitting down to have your DL photo taken, its really easy just to press "yes". Of course, I never would!


Very similar in Oregon, I got asked if I wanted to register to vote when I got my licence. Then again when we changed the registration on our vehicles from just my wife's name to joint names they asked me again if I wanted to vote. Don't know if they would have given me a form or not with something more on it, I just so no each time.

Registering to vote is a serious INS offence. The N-400 has a question on that, they will also ask you in the interview. They are trained to tell if you are lying as well, so you can't hide that. People have been denied their N-400's and deported for that.

So either forget about the N-400 or if you really do want it, you'll have to hire a good immigration attourney to help you out and help you get represented in the interview.

Regardless of if you knew or not it was illegal in INS standards, that won't matter. The fact you did register has now put a serious flag on your status...


Especially has he has already called them and confessed to the crime, time to spend serious money on an attorney.

Some local elections as a non citizen you are allowed to vote in it just depends on the rules for that election.

I cannot vote in my city elections as they adopted the rules the County have for their elections and they state you must be a citizen. Check the rules for the election you voted in first to make sure you should not have done so.

That is a very inaccurate piece of advice once you show you have given up permanent residence you almost certainly will lose your green card. Following your very bad suggestion is a sure way for that to happen.

If you move to Switzerland before you obtain US citizenship you will lose your permanent residence status. Once you cease to live permanently in the US if you haven't obtained citizenship you would need to go through the visa process again. The USCIS consider residing outside the US for somewhere between 6 months to a year as giving up your permanent residence status.

You can obtain citizenship after you have lived in the US for three years with your US spouse.

Draft it all out first before filling the form out. I think you might have a hard time convincing the consular officer you can't even remember which year you lived somewhere. Take the time to get the information you need. If the form isn't filled out to there satisfaction it will cause you more delay and problems in the long run.

There are a few PD that will take non US citizens. A poster on here from the UK had been in contact with several before he left the UK, as he was interested in taking that career path.

It is rather silly what you can and cannot do. I was a counter terrorist detective in the UK. Spent 10 years in such a role with SO12 at Heathrow airport part of which was spotting and exploiting flaws in the security system there to test its effectiveness. Assisted the FBI on numerous of their investigations but because I'm not a US citizen I cannot be employed by the TSA. Tell me that makes sense.

His problem as with all immigration at POE in any country is how the immigration officer dealing with his "request" to entry the country interprets the rules in the circumstances he is dealing with.

The problem has been compounded by him being out of the US in questionable circumstances once and being untruthful to the immigration officer about the purpose of that trip to get back in. If the immigration officer this time around examines his passport he will see stamps for two extended trips to the same country in a short period of time.

The best advice has already been given. Seek advice from an immigration lawyer who knows about abandonment of resident status.

The climate in this part of Oregon is very much like England. Bit hotter in summer and a bit colder in winter. Rains from October'ish to April/May and then normal get dry summers. That is in the Willamette Valley. If you go to eastern Oregon then it is much colder in winter and much hotter in summer.

When it does rain it more often then not isn't a heavy rain.
