The RFE has recently been referring also to the biometric appointment letter. Several of us have an RFE showing when we check online but only received the biometrics appointment.

If you have called them to say you haven't received the RFE and they said to wait 3 weeks, that is all you can do. If you haven't called to say you haven't received the RFE you should do so straight away.

If you are in China how are you going to keep the biometrics appointment anyway?

That is all they asked for in the instructions so why send them stuff they don't need but which they can find problems with.

You must have been married to the US citizen for 3 years and lived in the US for those three years. You must still be married to and living with that US citizen.


If so you may apply 90 days before you meet those requirements. Your husband doesn't need to attend the interview unless USCIS direct him to be there.

There is a date on your GC which says Resident From. It is 5 years from that date, but you can apply 90 days before the 5 years is completed.

Of course you must meet any other conditions also.

Just wondered where you saw that information? Sounds right but I couldn't find any info and put the last 5 years for both employment and addresss's.


The old USCIS web site before they put the new one up couple days ago. Was in the N-400 FAQs I think. Also seen others post here and on another board that if using the 3 year marriage qualification you read all 5 year questions as 3.

In my case only been in the US 33 months and my previous employer was from 1976 so it only mattered for trips outside the US. Hasn't been queried so far.

Unless of course there is an RFE and the NOA for the biometrics. If you then let the time for responding to the RFE run out the case gets closed, it is very difficult if not impossible to get it reopened. You then have to start again and are out $675.

Unfortunately there is a risk albeit a small one it just doing nothing. I would have been one of the unlucky ones if I hadn't followed it up.

Most people that got that e-mail all they received was the biometrics appointment letter.

In my case I discovered that as well as the biometrics appointment there was in fact an RFE I didn't receive. I discovered it because the alleged RFE and biometrics appointment letter had different dates so I followed it up. However even that seems not to be a good guide as some who only received a biometrics letter, that letter was dated differently from the alleged RFE.

I put a paperclip on my papers having put them in the order on the document checklist, with the application on top.

If sending USPS send to the PO Box address, the courier address is for FedEx, UPS, etc.

If you owe Federal, State or local taxes that are overdue you have to take to the interview a signed agreement from whoever you owe the tax to that you have filed a tax return and have arranged to pay and documentation from whoever you owe taxes to showing the current status of your repayment plan.

At the moment total fees are $675 and depending on your local office around 5 months, sometimes a few weeks more or a few weeks less.

Problem is they do background checks again but hopefully it will not involve a delay the 2nd time around.

Your assumption is almost certainly accurate.

Unfortunately I made that same assumption and there was an RFE that I hadn't received. Assumed the biometrics letter was it.

Got it sorted out in the end but it involved unnecessary hassle I could have done without and only just managed to do it before the time allowed to respond expired.

It is almost certainly down to them not wanting to spend time to copy stuff. That mounts up over a day and would reduce I guess the number of interviews they would conduct in a given time.

I am taking originals and photocopies. It has been known if you only take originals for them to keep those. They don't have to do photocopies.

If there are documents there you must have, birth, wedding certificates for example I certainly would copy those.

Not necessarily correct.

If you are applying on the 3 year marriage to a USC condition and provided you have been married for the full three years on the date you apply, you can indeed apply 90 days before the 3 year residency requirement is met.

So if on November 2, or today as we are past that date, the wife has been married to the same USC for 3 years she can apply now.

How are you applying for citizenship on the basis of 5 years residence in the US or 3 years residence and 3 years married to a USC. If the latter you cannot now apply as you have to be living together in a stable relationship, just being married isn't enough.

What information for your spouse don't you have. Just looked at my N-400 and for the wife it was name, address, date of birth and social security number. If you are applying on 5 years residence do you need anything else?

Did you send tax transcripts along with your N-400 when you submitted. If so take those. If you take the F1040 I believe you have to take other stuff as well such as W2s, but as I'm taking tax transcripts I haven't took closely at anything else.

Yes you can apply 90 days before the 3 years residency is completed. My citizenship application was 14 weeks start to finish. It does depend on the office I would suspect Florida offices might get more applications than others due to the large Hispanic community which might mean a slower time and a longer wait for an oath ceremony. But if you apply October 2010 he should be a citizen April/May 2011 at the very least, all things being normal.

He can apply 3 years from the date on his GC which says he has been a citizen since. If 90 days before the 3 years, he has been married to you for three years he can apply then. The 90 day early application only applies to the residency requirement not the marriage requirement.

In order to apply for and be granted citizenship based on marriage you have to be living together, so I would suggest you couldn't go to Brazil and leave him in the US in those circumstances.

There isn't an alternative way. The problem is some country specific requirements concerning visa and passport use do not cater for people with more than one nationality and there is no official solution to deal with it.

Yes the airlines are the only ones gathering the information. They are then required to send some of that information to Homeland Security. To be correct there are no immigration exit controls there are certainly immigration checks of the exit information.
