I was brought illegally at the age of six, I married my husband a us citizen. He petitioned me, I-130 and I-601A. I was able to fix my status and now I am a legal permanent resident. I did have to leave the country but only for 11 days to attent my visa interview. I am now back in the states. That's how I was able to fix through my husband. And as far as that coming out when she applies for her father. I'm not sure. Depending on the laws, I heard from an attorney Lauren Scott that the bans/bars are no longer going to be in place after 2018. Hopefully we can have good news in the future regarding that.

No it won't affect her application at all. You do need to put there truth though, you never lie to immigration. I was able to fix through my husband and it didn't affect my case. And msmontader are you trying to get your permanent resident? Cause then that will be the option.

I am a Muslim like you and we both know that what you are telling is completely not true. You can meet you fiancée and you don?t have to date her or take her to a hotel to spend a quality time with her in order to satisfy USCIS.

I thought I would update people on my experience yesterday at Chicago O'Hare at 3:30pm and hope it helps other people. Before I start the story, just to say I got in.

We are still waiting for our NOA2 and I have come in for 6 weeks. I was made redundant and left my employer on 23 November, so have no job and only have a room in a flat as I have sold my flat in preparation for my eventual move to the US. Better to sell it a reasonable leisure than sell it in a hurry!

So. I brought a folder showing all my ties to the UK and our lawyer provided us with a letter saying that I was only coming for 6 weeks and then leaving again. Our lawyer has constantly told me 'do not come back to the US without the K1 Visa in your passport'. So it was good of him to provide the letter - I expected to only provide one saying that he was acting on our behalf.

I was nervous at passport control but controlled the nerves well.

All he asked me was:

What are you here for?

Answer: holiday

How long are you staying?

Answer: six weeks - I return on 12 January

And then it was the usual - 4 fingers - one thumb routine and I was through.

Collected my luggage and made my way to the customs guy with my completed form. This has always been quick - hand the form and through. However, this time he had questions. As I had bought my fiance's children a couple of London t-shirts and mugs, I declared them although it was under $100, which I know is the limit. I did this last time too. He saw the total on the front and then turned over the form and saw the items.

He asked:

Who are you here to visit?

I was thrown as I didn't expect him to be asking that question - I expected that from passport control.

I said 'pardon?' He didn't repeat the question - he just looked at me.

I said 'My fiance'

He asked 'When are you getting married?'

I said 'March or April, whenever the K1 Fiancee visa comes through.'

He asked 'What visa are you on now?'

I replied 'An ESTA'.

He said 'You know you're going to have to go home, don't you?'

I've said 'No!' and as my heart fell through the floor. My fiance is just yards away from me - waiting for me at the other side of the door I can see.

He said 'You can't stay until April'.

I said 'I don't want to. My return flight is on 12 January.'

He said 'OK. Have a nice day.' and waved me through! He didn't even ask to see my return ticket!

I think my mistake was putting anything on the customs form. Everyone else was being waved through. I only did it as I had left the tags on the presents to give to the boys. In hindsight, that wasn't really necessary as I'm not going to be able to return them as I'm in the US for 6 weeks! I should just have removed the tags and not declared anything.

There's also another possible explanation for the questions. If I did show up at passport control as having applied for a K1 visa, passport control might have tipped the wink to customs whilst I was getting my luggage to ask me more questions. The customs guy did look down at my luggage as if to assess how much was there - I was about 3kg under the 23kg allowed and had my carry on bag and laptop. However, I have a brand new passport, so no stamps in it - I would think their computer system will link my new passport to my old one but I don't know what detail it would show.

I walked out into the arrivals hall and into the arms of my fiance and just wanted to cry. He said 'You're shaking but you're here and that's all that matters'.



Chicago is always my POE, and I have only ever been asked the basic "who are you seeing, how long are you here for" questions - even when I offered further info!

You don't need updated pictures from your finance. They will only use the one you submitted with your application I129F or If you decided to add any in your I134. Also, dating it "manually" can make a difference but you should have taken pictures with digital timestamps on the picture if you were using a digital camera. Anyway, I don't think it's all that important as long as your other documentation, proof of evidence looks legit.

In Lao, the medical exam will provide you with the big brown envelope/Chest X-Ray, a document that you were vaccinated, with dates. Proceed to the interview where most likely they don't even care about that stuff! I would not be worried if the information was given verbally.

If you having issues with the Udon clinic I suggest the clinic in Laos. Also, when does it say you need to pass the medical before you even get an interview date? I recalled my wife had to go multiple times for vacinations and X-rays after getting her Interview date.  BTW, hire a consultant in Laos who knows the procedures to obtain the K1 Visa. It's dirt cheap and he/she would hold your fiance's hand the entire way! Dont know anyone? Ask the  Elders and you shall get in contact with one.

The UK embassy is the exception to the main rule. It's a I-134 you file with a K-1, not an I-864. You can have a co-sponsor at the London Embassy that is the primary sponsor and the beneficiary (UK citizen) has the option to self-sponsor. My fiance is self-sponsoring at London and my father is filing the I-134 sponsorship for him as I am a freelancer and can't show enough proof of income.



Actually, the London embassy is a sort-of-exception. They allow co-sposnors (someone not the petitioner) to be the sole sponsor and allow for the beneficiary to self-sponsor.



I was just about to make a new post asking a very similar question, but this is music to my ears! This is my first post to the boards, actually. I'm currently self-employed and can't show proof of income as well. My partner is in the UK. My parents have already agreed to sponsor him, so we'll have them, but he can also sponsor himself?! I've been worried about not being able to show my proof of income for a while and we're planning on starting the process soon. Is there a website that you can direct us to that shows this bit of information (about him being able to sponsor himself, or my parents being the sole sponsor?) Thanks!! =)

Hi everyone! 

I'm getting the last bits of our I-129f package together and I just grabbed the sharpie to write on the back of the photos... and I'm not sure exactly what to put. I was just going to write who is in the photo, where the photo was taken, and the date. Can I just put something like, "April 2013" or "August 2012" or should it be exact? I know this probably isn't a huge deal, but I don't want to do the wrong thing!

Here's our I-129f so far. (We haven't included a TON of evidence as he's from the UK and we've read adding a bunch of excess info is too much for the UK.)

OH! And I'll include the personal check for $340, too, haha. I haven't written that out yet!

 

 

Now that I typed it all out, I'm pretty sure that's just fine, haha. Thoughts? =)

Wish us luck as I'm hoping to get it in the mail this week! Speaking of which, what have you guys found is the best way to mail your initial packet? Delivery confirmation? Etc.

This is my first VJ post! I was looking for similar information about Police certificates and the K-1 Visa process, and I'm finding it really helpful so far.

 

Do you mean your fiancé lived in Plaistow in London, UK? If that's the case he will need a Police Certificate from the ACPO Criminal Records Office. The guidance and forms are all on this site:

It costs 45 GBP for the standard service (about 2 weeks to process) or 80 GBP expedited, plus it costs 48 GBP to courier to an non-UK address.

I agree you ought to send some evidence with the packet. Although photos of you together are considered 'secondary' evidence, you do need to provide evidence that you have met in person within the past two years - that's a basic requirement of the I-129F petition. You can include photos of you together in the UK, somewhere recognisable or at a dateable event is a good idea - you can provide a caption below the photos. The best evidence would be copies of your passport entry stamps and boarding passes from when you visited the UK or if he came to the US before. Also include receipts or bank statements that show you made purchases around the same time or in the same place - anything that can PROVE you were together in the same place at the same time. With regards to facebook, you cannot submit any evidence electronically, or on a disc/memory stick.

 

While it's a good idea to save some evidence relationship for the interview just in case, that is not a requirement for the UK consulate. Most of the reviews on VisaJourney report that the interviewing officer either did not ask or said they did not need to see their photos on the day. I understand that it's different in other countries.

Even expired is should be ok (however there is no clear distinction written by uscis that stipulates the passport need to be current) however, if you wanted to err n the safe side, nowadays it is super easy to order a copy of a birth certificate online from the state records... Took me $8 and 3 weeks...
