Your story is not uncommon.  Looks like very sloppy paperwork involved here!! Especially on your x-fiance's side.  Mistakes happens, good intentions sometimes have a negative effect and consequences.  That's why there is a consulate interview to determine these things.  Next time dont make the same mistakes and make sure everything is correct.  Anyway, good luck, doubt anything bad will happen to you.

To everyone looking to start a visa case, and especially for those in the middle of processing a case.

Please don't overlook the need to place a nice-looking signature and date on all the forms you turn in, and especially if the signature is not yours. Here's why.

We had a situation that the joint sponsor of our IR-1 case signed his Affadavit of Support form, but the first part of the signature looked overwritten (like maybe his pen ran out and he wrote over the first part to get to the rest of the signature.). The National Visa Center didn't say anything about it, but when the case got to the Embassy, they asked my husband to have the joint sponsor sign the form again (with a clearer signature). He signed the form but forgot to put the date there. We turned in the signature, and they didn't accept it because it didn't have the date. Uggh! So, we have been waiting for the new signature page to arrive in the mail (another two weeks of time lost...) to turn into the Embassy.

Remember the forms are legally binding in their area, and a good looking signature is important to the Embassy to avoid fraud issues. And don't forget to put the date!!

Final update on this topic.

Yesterday, we received the call that my husband can come and pick up his visa. We did submit a "garbage" policy as someone in the forum called it, and it looked like they may not accept it... The asked for an actual copy of the rules and regs of the policy, not just for a copy of the purchase info and ID cards that they sent. I was worried because in all the info they kept implying that the policy we needed should cover my husband's medical condition of Diabetes, which this policy is very clear that it does not cover pre-existing conditions. Yesterday, the call came in and we all jumped for joy!!

Now on to purchasing airfare and making travel arrangements, etc.

Further update:

We turned in the signature that we were missing, and were asked if we had gotten the health insurance. My husband said no and asked if they had gotten the email we had sent, and if they had an answer to the question of the requirement and type of insurance.

The lady gave him a document, with the top half in English and the bottom half in Spanish, basically explaining the issue. What is interesting is that in the English part, they say that "it is recommended that you provide proof of medical insurance in the U.S." In the Spanish half, it says "es necesario asegurarse", which translates to "it is necessary to insure yourself". Neither side says that it is a requirement, but the paper does mention the issue of public charge.

The document also assumes that the policy purchased would help to cover expenses incurred due to the medical condition. They say specifically "You can purchase a long-term medical insurance plan (at least for one year) that includes coverage for medical assistance in the U.S. to cover any expenses that you may incur due to your medical condition."

This would almost make me think that I should consider a couples policy that I would qualify for, and to see how long I would have to wait to add my husband to the policy. (Insurance companies vary in how long he would have to be physically present in the US to qualify for a policy. Some have said minimum one year, and other's just long enough to establish residency in the state, which could be within a month, or maybe maximum 3 months.)


I think we will be needing to continue to dialogue with the Embassy to really get this worked out.
Advice? We have also spoken with a lawyer in a free consultation, and this issue is new to him.

Update:

Ok. So I called the Embassy again (this is the 3rd or 4th call now) to ask about if the insurance cannot be travellers insurance, what would they classify travelers insurance. The explained that travellers insurance would cover one while travelling, but for most policies, the moment the person changes status to be a permanent resident, the travel ends and then the policy would become invalid, or revoked, etc. This gave me a new line of thought about what we really should be looking for. I then wanted to make some calls to see if there were any domestic policies that would work, but all of those companies said that he would need to be physically present in the US to make the application, and most were more strict to say that he needed to be in the us 12 months (for one company) and/or be a resident of the state to purchase a plan with them (the state HIPAA medical plan). That really left me wondering where I might find a plan that would really work. I don't know if Wisconsin has really tough laws about residency, or if the federal government has laws about residency?

I then came across a plan by Seven Corners called Inbound Immigrant, and I talked to an agent, and he seemed to think that the policy would work in our situation. But, in reading the actual plan summary and information, there is a line that makes me wonder.

It says:

Coverage Intent
Please be aware that this is not a general health insurance policy but an interim travel medical program intended for use while away from your Home Country or Country of
Residence.


So my husband would be away from his home country, but would be establishing a new country of residence. What do you think, forum members? I will probably be calling the insurance company tomorrow to clarify.

As an additional note, my dad has contacted the state representative for our district to see if they can find out any information on the basis of the requirement. I will keep you up to date on any information that they are able to find out.

Like the other person said, just find him a cheap insurance policy that you can drop or change in a year. The easiest way to get what YOU want is to give them what THEY want. No matter if it's difficult, expensive, annoying, not normally asked for or what have you. They want it to give your husband a visa. You want a visa. It's not unreasonable to ask. Just do it :) You'll both be happy and where you want to be.


Yes, that is what we will do, but that doesn't make it right. I think we will try to get to the bottom of things, if for nothing else to help others out. Yes, we do want the visa, and a "garbage" insurance policy will not stand in our way to get it. (Imagine waiting almost a year to have his case resolve with the visa, and at the end, they make this requirement with no base in the immigration law that we can tell.)

My mom needs to take medication to control her blood pressure and cholesterol level but they didn't ask for insurance coverage for her. I was actually looking for one so that she'll have coverage before she gets here. However, the ones that I like requires a social security number to apply so I'm still waiting for her card to arrive in the mail. In US Embassy in Manila, health insurance coverage isn't not required for immigrating parents. I think it's specific to your Embassy that they ask your husband for it.


Did she admit that she has issues at her medical review? Did the embassy people seem to indicate that she had a medical issue while in her visa interview? Did they mention insurance at all in the interview, or did you (she) mention it? What I don't get is that it can be a "requirement" at one embassy and not at another. Under what law do they make the requirement, or omit the requirement?

The staes of MARYLAND, VIRGINIA and the District of Columbia has laws that policies will not be written with pre-existing clause.

BCBS has 26 Plans, and many of these Plans do write policies without pre-existing clauses. Atena, and Kaiser also write without pre-existing clauses.


We won't be in any of those states. We will be in WI, and there, he would qualify to be in the high risk pool for insurance with pre-existing conditions, if we could wait for him to get to the US. What I don't like is that we have to purchase a policy for the year, at a cost of at least $1000, and he will probably not need to use it. He probably will need to see a doctor for something else, and I don't know if that will be covered in the policy purchased.

Oh, and let me clarify one other thing. The medical exam that the visa seeker will get is not an overall diagnostic for possible problems (like uncontrolled diabetes or other chronic diseases). The blood test is a test for just one or two things, not a general blood workup test. He was honest in his dialogue with the doctor about his taking pills for diabetes, and the doctor needed to include that in his medical report.

That is exactly my point. To find a policy for a pre-existing condition before he gets there is nearly impossible, so if that is the Embassy's idea to cover his Diabetes, then their idea won't work. If they just want him to have a general policy for whatever eventuality might happen in his first year in the US, then OK, I can see their point. But it should be something that is mentioned as a requirement to show proof of insurance, either through a job, or ???, or through a major medical policy, like the one I will probably buy.

AOS is adjusting his status for a GC within living in the US, your husband will be given a GC ability as soon as he enters the US.

There is a condition to quarantee that your husband will not become a public charge. The state of Mass. requires thaat all of its residence haave health Insurance.


By AOS here I meant the Affadavit of Support (the I-864 form and information), not Adjustment of Status. Sorry for the confusion.

Part of the that "last" step is to ensure that the immigrant will not likely become a public charge. A pre existing medical condition may also cause other related issues. If you weren't obviously going to cover him on your work plan as a spouse then how did you show that he was not likely to be a public charge ?


Well, that is what the AOS is for right? I have a joint sponsor for him in this case. I would assume the sponsor (me) and the joint sponsor should be the ones that support my husband in all things that he might need, right? To my knowledge, there is no requirement for health insurance in the case that the spouse doesn't have any (as I don't).
(Our family have been living in Costa Rica for the past 5 years...)

To me it all sounds very strange, there is no such requirement in order to get the visa. No one can force you to get an insurance, if you want to pay out of your own pocket that is all good. You need to talk to some more people about this, maybe actually talk to someone at uscis or something cause it sounds to me like the consular officer don't really know what he is talking about.


I wish USCIS had the answer, but I called there and they did not confirm that there is a requirement for health insurance. There is no requirement for the cases they handle directly, ie the adjusting status cases. I have yet to connect with anyone at the National Visa Center. They have such a long wait to speak to a person.

Yep.
This is only the second time I have heard of them requiring health insurance for a spousal case (the other case was a wife with severe asthma if I remember right), but it is quite common when petitioning elderly parents.

Travellers insurance does not usually cover people who immigrate, hence they would not accept it.



It may be common in practice, but it is not mentioned in the law or in lists of requirements. That is where our sticking point is. We went to what should have been the "final interview" and they gave us this requirement there, and it was just like out of left field. They also didn't provide us with any good information about what type. They literally said on the form they gave us that it has to be for a minimum of one year and it cannot be traveller's insurance. That is all. No minimums or maximums, no requirements for what the policy should or should not cover, etc. We were shocked and dismayed and left in a feeling of disbelief. Can you imagine?

This was the problem 'He answered that he takes medicine sometimes for blood sugar issues", this is a chronic condition. Therefore the embassy wants to make sure your husband will not depend on government aid. This condition requires daily medication or doctors supervised visits.

They have opted to asked you'll to provided proof of Health Insurance rather than to straight out reject your husband petition on the fact that he could become an aid to government assistance.

Your choice......


I probably would agree, but isn't that what the sponsor and joint or co-sponsor are for, to help so the person doesn't go on government aid? And, this kind of insurance doesn't cover anything pre-existing, so it won't help with his diabetes needs. It will just help for emergency situations or accidents, etc. So it will hopefully be a good net, but it is a shame that they can't just ask us to find a plan to enroll him in once we set foot in the US.

At the required medical exam, the doctor will ask if you have any health issues or take any medication. He answered that he takes medicine sometimes for blood sugar issues. The doctor then put that information in the paperwork that he filled out for the Embassy's information. My husband didn't take a test to prove that he has diabetic issues or anything, and diabetes is not a disqualifier as far as immigrant visas are concerned. The consular officer didn't even say that the health insurance policy had to insure for issues with diabetes. Just asked for a general policy that would last for 1 year and not be "traveler's insurance". They implied that it is an optional requirement that they can place on an applicant. When I asked for more information, the consular officer would only say to look at the USCIS website (where there is no information). I had to call the Embassy later to try to pin down the real requirements, and still feel like I don't have all the information.

I am new to this forum and probably would not have encountered this wonderful forum if not for what happened to us at my IR1 husband's final visa interview. They required him to present a health insurance policy. Their details were only that it could not be a policy commonly called a "traveler's health insurance", and that it had to be for a period of one year. Does anyone know about this requirement? I, as the USC, live with my husband in Costa Rica, and so we will both be moving to the US once he gets his visa, and as of this moment, neither of us has a job or even job offer there. Help!!

Good Luck! We sent our packet on Thursday, the 8th of August, it was delivered on a Saturday (via tracking USPS), and we had our NOA1 on the 16th, so just over a week after mailing! Just waiting for our NOA2 now... =)

Hi friends!

I called the Department of State number (( (202)485-7600 )) and got through right away with no wait. I was surprised to hear that the NVC had electronically sent our case on the 6th of November to the London Embassy! Woohoo! She said they have yet to download our case at the embassy but once they do our hard copy gets sent to the Embassy at that point. Either way, its left the NVC and we're on our way! She also gave us our case number as well. Our NOA2 was on September 27th, and we were at CSC. 

 

So our timeline is:

 

Our Visa Journey: 

Sent our I-129f packet: August 8, 2013
Received NOA1: August 16, 2013
Received NOA2: September 27, 2013

NVC Received: ??

All of these NOA2 quick approvals have me checking the uscis website on our case status constantly now, haha! I even told myself I wouldn't be THAT person who checks all the time but I just can't help it with all of the good news from those who filed in August and have already heard back!

To be honest, we hadn't planned on it going that fast and actually didn't even consider that it may happen like that, haha. We've always been concerned with making plans too soon just in case it takes past 5 months... We definitely weren't expecting this! We haven't heard anything yet, so we're still waiting, but since others from CSC have heard back, we know it may be a possibility... So congrats to all of those who received their NOA2s already! In the meantime we will still be waiting patiently!

Our NOA2 was 27th October, and we got our case number for the London Embassy last week on Friday. My fiancée called the Department of State on (202)485-7600, and got through to a real person right away, no waiting. They gave her the case number and said it had been sent from the NVC on 6th November. Our petition was processed through CSC.

 

Hopefully yours isn't far away!

 

 

 

anyone here with an NOA2 on OCT.28 receive their case number???? if no can those who have received their case number tell us the date of your noa2 so I can keep track of about how much longer I have to wait for mine. Please and thank you biggrin.png

For the I-864 do I have to provide US tax returns or can I use my Canadian tax returns and include a letter from my employer and bank statements showing direct deposit?
