what matters, is routing on the I-130, where it is currently, and where the I-129F will be adjudicated. 

 

So basically if you're I-129F gets sent to the NBC there will have been no point in sending it because it will just be matched up with the I-130 already sitting there? Have they normally been getting sent to the NBC? Do you know? Thanks

Why? Please note that the 'current routing' of stuff is some big problem, and filing an I-129F ( IMO ) actually does something else with the I-130.

 

 

What do you mean by the current routing of stuff? Are you saying the I-129F has the effect of sending the I-130 somewhere else and making it get processed faster? I thought they both are met up with each other at the NBC and then the I-129F eventually gets cancelled out.

IMO, currently, filing an I-129F SEEMS to get the I-130 yanked to another office altogether, 

and both are adjudicated at the same time. 

 

IMO, if it seems useful, this casefile pulling, then I say go for it.  Ya, I usually don't say this, but if yer gonna wait regardless, a casefile yank seems useful. 

 

 

 

 

 

What i have read from others is since you do have a I-130 on file the I-129F will be sent also to NBC (I had thought it was going to TSC with the other I-129F) but nope.They will marry up your two petitions so they can sit and marinate together. but hey like darnell said if you are waiting all this time why not. lets hear a successful story about a k3. It's been ages since we have. Go for it.
 

 

Would you guys think it's pointless to send in the I-129F until you've waited at least 6 months or so for the I-130? Kind of a watch and wait stance, if that makes sense.

No and no.  There's really not a problem with ALL the phone calls being initiated by one party.  Consular Officers have family and friends back home too.  They know how phone contact works best with the USA.

 

Hmm, alright. If that's the case I guess I'm confused why the OP was denied. I asked earlier because in the evidence my wife and I submitted with her I-130 there was a log of all of our skype calls and the majority of the time I initiated the calls with her, rather than the other way around. So when I read the OP's post I became a little concerned.

My husband and I have not filed taxes jointly yet, but I work for a CPA firm. Most of our clients use form 1040. However, 1040A can be used if you meet a number of requirements, such as the taxable income being less than $100,000, certain kinds of income to report only, etc.

 

There is also form 1040EZ, which yet has another number of requirements that have to be met.

 

I suggest you read the instructions for all three forms.

I can't use 1040EZ and don't need 1040A. I was more worried about form 1040NR etc.

Should scrap the petition and just raise the fees for actual visa application. You have a valid passport which your country issues you after a background check. then the petition does a check then you provide police clearance for the interview. You have to prove your relationship at the interview when it was presumably approved via petition. So redundant, a complete waste of time waiting for 6-8-10 to a year wait alone, depending on the case.

Seems ironic when looking into relevant articles for the i-130 and says for immediate family members there is no wait for a visa. Yet, the waiting just too have approval of relationship takes so long. *sigh*.

Yeah, it's the USCIS portion of the whole process that I really don't understand. The NVC and Interview have relationship verification of their own, so why do we need to wait for the USCIS to approve the relationship? It's the weakest link in the entire process and the reason we're all suffering I think. So sad.

I know that's not much comfort when it feels as though your family is being torn apart. My husband and I spent the first 15 months of our marriage apart because of similar backlogs in 2007 and it was horrible. 

 

Did you ever get the feeling that the separation would never end? My wife and I are almost five months into the process and are anticipating another year before she's here. It feels like it's never going to end and really makes me despair sometimes. Any coping advice? 

 

I suggest something else.

 

Take a copy of the I-130 receipt notice,

submit an Adjustment of status set, from Guide 2 in the Guides, minus the big I-130,

and he can stay until the green card is issued.

 

If only we all could do that....

then married filing seperately is the way to go.

 

 

 

When you first filed for the ITIN did you have your wife put your address in the main address section and then her's in the foreign address section? Or did you do her foreign address for both? Just curious. Last question. Thanks

   OP...firstly, listen to Darnell...that is correct.  My taxes are in the mail as we speak...filed married, joint...sent to Austin Tx with w7 (spent hours on the phone with IRS confirming this process).  Leave to ssn spot blank...IRS will fill it in once the number is assigned via the w7.  Then IRS will forward for tax return processing.  I was told 3 to 5 weeks for the w7 then another four to six to process the paper return....hope this helps...

 

 

Did they send your identification documents back to you within 3 to 5 week timeline? I'll be sending my wife's passport and would like it back as soon as possible. Just curious. Thanks

oops.  it won't get kicked back the IRS, as he's including the actual passport.

 

Perhaps the DOR reference confused you?  Some states have state income tax, and his is labelled as DOR - I am assuming Department of Revenue.    His approach on the paperwork is perfect, IMO.

 

 

 

Yes, you are exactly right Darnell. I am required to send copies of everything I send to the Feds for the ITIN to my state Department of Revenue, per their instructions. I'm not sending stuff for the DOR to the IRS.

 

Darnell, how long did it take you to get the ITIN and for the IRS to process your return? Jw.

Why exactly would my W-7 get kicked back? I'm sending in exactly what you mentioned: the W-7, the return, her passport and the letter that Darnell mentioned. I'm doing exactly what others  who have already got an ITIN are doing. Nothing has changed. 

 

I just mentioned my DOR for info purposes only. The state return is going to the state DOR, not the IRS. It's not like I'm sending my state return to the IRS. That would be pointless and stupid.

Dude,

 

No way in heck would I send in her passport!

 

She's already told me she won't be needing it for a while and her government doesn't do certified copies. The ITIN Section of the IRS says they will return all documents to you within 60 days and that you can give them a prepaid courier envelope so they can send it back to you. I'm not concerned about that. She can always get a new one and we won't be needing it for quite some time.

Since yer prepping the big packet including the W-7 application,

this is actually the ONE TIME where you leave it blank.

 

The ITIN Unit is really good , they know what to do,and during tax season, are rather fast .

 

Apologies if I seemed grumpy, I am a cranky curmudgeon mostly, and it bleeds out some days.

The first year I filed jointly, I left it blank, as I included the W-7 with the 1040 and a bunch of other stuff.  If'n your spouse is still over-seas, and you two want to file as mfj, well, there's more stuff to do.   This is not a trivial thing to prep.  When you can make time, please get IRS form W-7 and study it, and learn how to draft a coverletter requesting foreign spouse to be treated as a resident alien for tax purposes. 

 

IF you are seeking to file mfj you are missing some important instructions in IRS form W-7.   If yer not a reader, I suggest you hire a teenager for a few hours. 

 

The 2nd year, I put in her ITIN.

I already have the letter to the IRS and my state DOR stating that we'll be electing to treat her as a resident for tax purposes ready to go, as well as a signed W-7 and signed Income Tax Forms from her. Just wanted to know what to put in the SSN box. She also signed both letters. I'll be sending it all FedEx to the courier address in the W-7 instructions, as I have read them already and we'll be sending her passport as evidence of her foreign status. Photocopies of all of the Federal forms will be going to my state DOR.

by filing the W-7 with a tax return into the special ITIN address in Austin, TX.

 

This is not a trivial thing, study the W-7 instructions

 

What did you put in the SSN box for your spouse on your return? Something like "ITIN Requested"? Just curious, as I'll be married filing jointly for the first time and will be requesting and ITIN as soon as I get my W-2.

Hi all,

 

I've posted this question elsewhere but have not gotten many responses. Does anyone have any input for us?

 

Here's our situation: My wife got her visa and the sealed envelope yesterday. On the sealed envelope there is a paper stapled on top that gives a summary of all her biographical details and on this paper there appears to be two errors: 1. It lists her occupation as a registered nurse, when in fact she is a registered midwife. 2. It lists her alias as her first name plus my last name and the suffix "Jr" (I'm a Junior, obviously). I don't think this is correct, as the Jr only applies to me.

 

With that said, do we need to call the embassy to have these things fixed and send the sealed envelope back? Or are they inconsequential and not really related to the visa and POE? I really was hoping this would be the last step in the journey other than POE and am not in the mood to have my wife return the package and then hope to get it back with everything correct in time for our flight to the US on Sept 23rd. Any advice or input would be much appreciated. By the way, the visa itself is fine and everything on it is correct. It's just the sealed envelope that is not.

i usually fly from Brnik (LJU) or Trst (TRS)...I dont really care which airline is, I always take the cheapest, even though Lufthansa is far my favourite (you get your own TV and it makes time go by a little bit faster). Once i travelled with United and that was a pain. The flight took forever, because there were only a couple TV's in the airplane).


I usually fly out of Milan. Are there direct / in - direct flights from LJ and TS ? I' m not well informed about those.


As stated before, it doesn't matter if the ticket is one-way or round-trip. With a one way ticket, the airline may want to see a valid visa allowing long(er) term stay. (I'm thinking something other than a tourist visa.) When my husband came he had a one-way ticket and they asked to see his visa when he was checking in for his flight.
Basically, you buy the ticket that is best for you and your pocketbook. :)
