Removing Conditions on Residency General DiscussionI-751 January Filers, 2013
Hi!

We're cutting it close too! My husband's card expires 1/12/2013 and we just sent it! Finally! Today! So glad to get it sent it out finally.

Our daughter was born in June, and I initially planned to get this sent out 90 days exactly before it was expired. However, I didn't have the time I thought I would on maternity leave! Haha - I'm a new mom and learning quickly that everything takes longer these days!

Just wondering how everyone is doing. Michael & I are nearing our 6 month wedding anniversary in less than a month! We just filed for AOS, 5 months after he arrived approximately. We are hoping to get that moving, so that he can really settle in, start working, go home for a visit, etc.

We are just starting to plan our wedding reception & celebration - looking at February/March, and maybe about 200 guests. We had our wedding, and only about 20 guests, at the courthouse with a simple dinner at a nearby British (English, not Welsh...lol) Pub. I'm loving every minute of having him here and being married!

Well, they might just be kicking things up a notch, I just got an update today. Thanks the 2nd one. Might not mean a darn thing, but then again it just might. One can always hope!

Sorry, forgot to post my name.
Bryan

Yeah, I will never know how many days they 'touched' it before approving it - because I didn't check. Since I was over here on holiday with my fiance, I barely have gotten online to check it. We checked when I first got here - wanted to show him the site, etc...but really didn't think we'd be getting the NOA2 until April.

Hope it means you are getting yours soon!! No matter what, it at least means things are moving along! Good Luck!

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary 2010 K-1 Filers
WHOOOO HOOOOOOOOOOOO I am with my fiance in the UK on a week's holiday - and checked my e-mail today to find a huge SURPRISE - On February 25, our I-129F Petition was approved!! Wow, and I was totally expecting to wait until the end of April to get that message!!! Now, we get to finish doing all the paperwork so when Packet 3 gets to him, we're ready to submit right away! Wow, this means he could possibly get to the U.S. before the flights get ridiculously expensive for summer - and be here by June, not September!

Whooooooo Hoooooooo!!! What a great birthday gift for him - today is his birthday!!!

  :star: :star:

Congrats to everyone else who has received their NOA2 already, and good luck to everyone who is still waiting!

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary 2010 K-1 Filers
Wow, the last month has kinda slowly creeped by, and now it feels like it has just flown by. Yesterday, it was a month that I mailed the petition, today is a month that it was received...and tomorrow will be the one month anniversary of receiving our NOA1. My guess/goal from the beginning was to receive the NOA2 by the end of April and we are right on schedule with that.

Oh, and I will be flying to Heathrow next Thur/Fri to spend about 10 days with my fiance - so the next few weeks should pass rather quickly too, even though I wish they would slowly creep along!!

Can't wait to hear from the first January CSC K-1 filer to get their NOA2. Good Luck everyone on a speedy journey!

I received my NOA1 in the mail today. It definitely has made my day. It's kind of weird how just the receipt has made me smile so much. I knew they had received it, I had watched my checking account and had seen that the check was cashed. It's so great to finally have the process moving along. We've been talking about and preparing for the Visa for months, so it's nice to see it moving along!

Good luck to all the January 2010 filers!

We are now officially January 2010 Filers! SO very happy to join this group!! We've been working on the forms, collecting evidence, copies, letters of intent, etc. since December 6th. We've been reading about the Visa since September. So glad to get this moving and hope we all have a smooth, quick as possible journey so that we can be with our loved ones!

I mailed the packet yesterday afterwork at 4:10 p.m. via Express Mail from the USPS. The tracking information says it made it to Santa Ana, CA this morning at 6:08 a.m. :star:

K-1 Fiance(e) Visa Process & ProceduresNewbie question

The process can seem overwhelming at first, but let me assure you that while there are a lot of things to gather, the requirements are fairly straight forward. Just focus on gathering one thing at a time, and before you know it, you'll have the whole packet assembled! In fact while gathering both the I129f packet and the AOS packet the end sort of snuck up on me - one day I went down the checklist...and everything was there! Yay! The guides are very helpful for creating that checklist.

Good luck for a speedy visa journey!

Thanks to everyone who responded for their help! I sent in the I-129F packet on Monday and it was received today at the USCIS office - CSC.

Nik & Heather - I noticed your timeline in another thread and was thinking - wow, that sure looks like what I hope my timeline will be except for 2010, not 2009. My fiance is from the UK, we're filing in January, and we're thinking of planning an October 2010 wedding. I am really scared to plan anything, though, in case the process takes longer than I anticipate...would hate to have to re-schedule everything (and inform our guests of the delays) as well as lose the deposits...but we will see :)

Thanks again!

K-1 Fiance(e) Visa Process & ProceduresNewbie question
Hi & Thanks to everyone that has posted on these message boards.

Background: I am a USC and my fiance is a UK (Wales) citizen. We are preparing our initial filing of our I-129F for our K-1 Visa.

I have been reading these message boards and have learned a lot, and wow so much to read. It is quite intimidating. I also have read through the USCIS.Gov website and I have a book that I bought that is a Guide to the Fiance Visa. I didn't fully realize before that we need letters of intent (duh!) so now I have to ask my fiance to write that up and mail it to me to complete our paperwork.

My question - as I read these forums, I see a lot of acronyms that I am not familiar with. I know some basics (AOS, USC, etc, but there are a lot that I can't figure out.) Is there an acronym cheat sheet anywhere?

Thanks again!

K-1 Fiance(e) Visa Process & ProceduresJanuary 2010 I129F filers

I checked the wait times for the California for I-129F, and it was last updated Nov. 30, 2009, which said 5 months... do you think that is accurate? I am submitting this week so I can't check online yet. I am trying to book a tahoe wedding so I need to be reserving asap!

Visa222 - I am new here too, just sent my packet to the CSC on 1/11/10. From what I understand that 5 months is an average for the CSC processing times (but most are getting through in about 90 days. I would not book anything that you can not change later, nor would I book anything you can't get your deposit back. Most people are taking right around 6-7 months from what I can tell (from the UK which is where my fiance will have his interview). You could easily see delays due to processing slowing down (or see a faster return due to processing speeding up). Then, there could be a slow down for scheduling the medical or interview (I've read cases where it can take a few months like right now in Montreal).

So, basically, I would think a July wedding is a possibility - but I think you are looking at a 50/50 chance of everything getting done in time. It's definitely not a "for sure" thing.

This is just my opinion from all the reading/researching I've done.

K-1 Fiance(e) Visa Process & ProceduresBeginning the Process
I am not an expert by any means - but I wasn't able to tell from your original post if you have read about the differences between a CR-1 (already married) and K-1 (Fiance - to be married within 90 days after entry on the K-1/Fiance Visa).

From what I understand - here are the pros/cons:

K1 - faster processing of the visa (just slightly faster, like 2 months-ish)

CR1 - Considerably cheaper
- Beneficiary can immediately start working once arrived on the CR1
- Beneficary can immediately travel outside the US because they immediately get their LPR status/green card upon arrival

Depending on where you want to get married & when, one or the other may be better. I didn't realize before filing all the benefits of the CR1, and if I did, we definitely would have considered it. Just wanted you to know there is another option.

K-1 Fiance(e) Visa Process & ProceduresI-129f's HARDSHIP of meeting in person request?
I don't have any knowledge of this subject but this post reminded me of a recent post (which in addition to a disability faced financial difficulty in order to meet in person).

Good luck on meeting in person or pursuing the waiver...either way, good luck to you.

K-1 Fiance(e) Visa Process & ProceduresTourism Visa Question

Thanks! Definitely an interesting read. After reading all thats been said in this thread and the link Amy And Michael just posted, I am left with this question. Is it EVER ok when asked "who are you here to visit?" to answer with "my girlfriend/boyfriend/fiance"? Or should people just say 'i am visiting a friend'? It almost sounds like if they hear any sign of a relationship, they slam the door closed. :( This makes me worry.

Of the 7 trips we've made back & forth (I went to visit him 4 times: landing in Heathrow twice, Bristol once, and Cardiff once; and he visited me 3 times arriving in Chicago all 3 times), the only time we experienced "issues" was my very first trip there to meet him. Every time I have basically said "I'm here for a vacation and to visit my fiance/boyfriend" or "I'm here on vacation to visit my boyfriend and attend his nephew's wedding". The very first time I tried to enter, I entered in Cardiff, Wales and we both were extensivly questioned as to our intentions, financial questions, ties to the U.S. I stated that time that I was there to meet a friend and have a vacation. The questioning caught me totally off guard, as I had no knowledge of any of this stuff, and it only ended when a serious "tie" to the U.S. came up - my upcoming PAID FOR trip to Disney World. The officer questioned me, then found him and questioned him, and then questioned me more. I was seriously shaken up for it. The next three times I have carried proof of ties to the U.S., but never needed them and breezed through security each time.

Upon arriving to the U.S., he was never asked more than 3 questions, usually the "Why are you here" "How long" and "When was your last visit and how long was it for".

I have travelled with my passport many times before originally visiting him, but never to meet someone, and never travelling alone. I think they are just highly watching for "red flags" that people have intention or a reasonable chance of immigrating without the proper visa/paperwork/authorization. Of my entire flight, I was the only one who was not a UK citizen or a family travelling together. The realization that they can deny your entry and send you back without any right to an appeal really scared me, so now I always fly prepared - with a few copies of bills, mortgage docs, letter from my employer stating when I'm expected to return and the amount of vacation I have left (which the border agent asked upon my first trip over, and I was thinking "really - who would ever carry that with them"), etc.

My fiance never had these documents on him, but never needed them either. That's a good thing, because he didn't have many bills or rental agreements in his name as he lives with family.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresTourism Visa Question
A recent topic with a UK Citizen (Scottish) where they applied for a B2 Visa because they felt the VWP wouldn't allow for a long enough visit. Just thought you might enjoy read as it may help your understanding...

K-1 Fiance(e) Visa Process & ProceduresTips for not getting turned away for a visit?
Like PP's have said it sounds like you have done your research and are prepared. Everything I would suggest to bring is already covered.

I am the USC and when I went to visit my now husband the first time and landed in Cardiff, Wales we were both interviewed. The only thing that finally stopped the questioning was when it came up that I had an already paid for trip to Walt Disney World in approximately a month. I didn't have any evidence of strong ties on me. That was definitely before finding this website.

Every other trip, they didn't even ask. I made 4 trips to the UK, he made 3 trips to the US before we filed for the K1.

I just want to say I think you will be fine. You are fully prepared and put his fears to rest - it sounds like you have plenty of evidence of ties to home for if any questions do come up.

Have a great Christmas visit and hope your K1 gets approved quickly!
Amy and MichaelFemaleWales2010-11-05 08:00:00
K-1 Fiance(e) Visa Process & ProceduresK-1 Denied
I'm not sure if you should provide the evidence or start from scratch. It sounds like you should be able to prove, somehow, that you have met in the last two years. You just have to prove that you met...there's many ways to do that. Pictures are not primary evidence, but receipts and other things are.

1. If you applied for a marriage license - did you both have to be present? Are your signatures on the document with a date? That would be enough to prove you met.
2. Gas receipts at gas stations along the way, receipts for dinner, etc.

When I applied, I used the receipts I had - an ATM receipt showing I took out money in a city nearby where my fiance lives, an entry on my credit card statement for a shirt I bought for him when I was there, etc. etc. The boarding passes I had proved I was there - but for you that's obviously not necessary. Did you save movie stubs, receipts, etc? Do you use a credit card, debit card?

I'm not sure of the cost difference, but if it were me I wouldn't just drop the first attempt at filing the I-129F petition.
Amy and MichaelFemaleWales2010-12-30 17:55:00
K-1 Fiance(e) Visa Process & ProceduresK-1 petition denied

This is only the first set of form and documents you need to send to the USCIS. You better get your act together and make it happen; hopefully your fiance and future wife will be understanding in the future because you didn't take care of things as the man in the household should.

Really? Was this necessary? How come sometimes people can post great information, and other times posts simply tear the OP apart? I'm sure by page 3 he realizes he's made a few mistakes.

Guess I am a great "man in the household" (I am Amy, by the way) as I take care of many of "things as the man in the household should". I rarely post on this site, mostly read and learn, but this post just begged me to stand up for what is right - and this is just not right!

Geez!
